HomeMy WebLinkAbout1994-06-23 Minutes• • MINUTES OF A PLAT REVIEW MEETING A meeting of the Fayetteville Plat Review Committee was held on Thursday, June 23, 1994 in Room 111 of the City Administration Building, 113 West Mountain Street, Fayetteville, Arkansas. UTILITY REPRESENTATIVES: Jack Regal, Andy Calloway, Tim Johnson and Rick Evans CITY REPRESENTATIVES: OTHERS PRESENT: Alett Little, Tim Conklin, Mandy Bunch, Perry Franklin, Cheryl Zotti, Randy Allen, Lisa Cox, Mickey Jackson and Sharon Langley Harry Gray, Mel Milholland, Bill Rudasill, and Tom Hopper PRELIMINARY PLAT - LATTA SUBDIVISION KEVIN LATTA - S OF HUNTSVILLE (HWY 16), E OF CURTIS The first item was a preliminary plat for Latta Subdivision, submitted by Bill Rudasill on behalf of Kevin Latta, for property located south of Huntsville Road (Highway 16), east of Curtis. The property is proposed for R-2, Medium Density Residential (R94-34), zoning and contains 6.04 acres with 16 proposed lots. Ms. Little asked if the developed planned on tying into Fairlane Drive. She explained there was another subdivision to the west which extended Fairlane to the subject property. She advised the staff would require the developer to construct all of Fairlane Drive. In response to a question from Ms. Little, Mr. Rudasill advised he planned to vacate Sherman Street and was, at the present time, obtaining adjoining property owners' signatures. Ms. Little recommended holding the plat until the street vacation had been approved. She explained that, should the street not be vacated, the plat would need to be redesigned. ANDY CALLOWAY - SOUTHWESTERN BELL TELEPHONE Mr. Calloway advised Sherman Street was a dedicated street and most of the utilities ran down the street. Mr. Rudasill stated he would grant an easement for the utilities. Mr. Calloway stated he would be opposed to the vacation of the right-of-way since the utility companies used the right-of-way. JACK REGAL - SWEPCO Mr. Regal asked that the highline poles along the east side of the public street be shown on the plat. He further advised he was concerned about the location of the water line since it was so close to the 161,000 volt transmission line. He pointed out the 100 -foot easement which contained the transmission line and stated he would prefer the water line be placed in the outer 20 feet of the easement. He explained the actual electrical service for this tract was Ozark. He also noted the legal description was incorrect. In response to a question from Ms. Little, Mr. Regal advised it was fairly common to locate streets within high voltage easements. He noted they had not, in the past, issued written permission. Plat Review Meeting June 23, 1994 Page 2 JIM CROWNOVER - OZARK ELECTRIC Mr. Johnson advised that, on Lots 1 through 5, they would have to serve from the street side due to the drainage ditch at the back. TIM JOHNSON - WARNER CABLE Mr. Johnson advised Warner Cable would also serve from the street side. MICKEY JACKSON - FIRE DEPARTMENT Chief Jackson requested the fire hydrant between lots 4 and 5 be moved to the corner and that the developer add an additional hydrant at the Huntsville intersection. He also noted engineering would want the waterline to be an 8 - inch line. ANDY CALLOWAY - SOUTHWESTERN BELL TELEPHONE In response to a question from Mr. Calloway, Mr. Rudasill advised the property would be zoned R-2 with lots 1 through 4 perhaps containing an apartment complex. Mr. Calloway advised that, on the apartment units, they would require conduit from the structure out to the easement. He also requested a 20 -foot easement parallel to Huntsville Street. He also stated he would need to know what size of units were on each lot. Mr. Rudasill stated it was his belief lots 5 through 16 would be duplex lots and 1 through 4 would be multi -family units with approximately 48 units. ALETT LITTLE - CITY PLANNER Ms. Little advised the developer would need to meet with the Parks & Recreation Board prior to bring the plat back to the plat review meeting. PERRY FRANKLIN - TRAFFIC DEPARTMENT Mr. Franklin advised the developer needed to check with the 9-1-1 Coordinator regarding street names. He also questioned the location of street lights. Mr. Regal advised they might be able to affix street lights to the existing poles. CHERYL ZOTTI - SOLID WASTE Ms. Zotti advised she would need to review the plans for solid waste prior to construction of the 48 units on lots 1 through 4. Mr. Rudasill advised lots 1 through 4 would be developed together and would require a large scale development. He pointed out they could review dumpster locations at that time. MANDY BUNCH - ENGINEERING DEPARTMENT Ms. Bunch advised there was a 6 -inch sewer located on the opposite of the water. She further noted the water line was an 8 -inch line rather than the 6 - inch shown. She stated the sewer had a crossing on Highway 16 approximately 300 feet east of Erica. Plat Review Meeting • June 23, 1994 Page 3 Mr. Rudasill stated the plans he had reviewed showed the sewer line to be on the south side of Highway 16. Ms. Bunch advised that all preliminary plats and large scale developments would not, in the future, be placed on the plat review agenda unless a preliminary drainage report be submitted with the plat. MICKEY JACKSON - FIRE DEPARTMENT Chief Jackson advised that, if lots 1 units, he would want the one shown on entrance and one where Sherman Street • • through 4 were to contain apartment the plat to remain plus one at the intersected. Plat Review Meeting • June 23, 1994 Page 4 • • FINAL PLAT - BOXWOOD ADDITION ATLAS CONSTRUCTION - S OF OLD WIRE, E OF AZALEA The next item was a final plat for Boxwood Addition submitted by Harry Gray on behalf of Atlas Construction, for property located on the south side of Old Wire Road, east of Azalea Terrace. The property is zoned R-1, Low Density Residential, and contains 20.25 acres with 53 proposed lots. Mr. Gray stated that, even though this was a final plat, there was still a question regarding the area south of Hamestring Creek. He explained that, at the time of preliminary plat, the Parks Department had requested a 15 -foot easement along the south side of the creek for a natural trail. He advised that the developer had just offered the entire tract south of the creek to the Parks Department as a park area in lieu of fees. He went on to say that, if the Parks Department did not want that area, the lot lines between lots 17 through 23 would be extended onto the south property line of the subdivision. Ms. Little land for a signing of JACK REGAL stated that, if the Parks and Recreation Board decided to take the park, dedication of the land would have to be made prior to the the final plat. - SWEPCO Mr. Regal advised he would need additional easements for the street lights. He stated he believed they could be within the setback areas. He reviewed the locations he would require. He also noted there was a street light shown in the middle of lot 49 and requested it be placed between lots 48 and 48; he also requested the light on lot 40 be placed between lots 40 and 41; the light on lot 17 be moved to between lots 16 and 17. TIM JOHNSON - WARNER CABLE Mr. Johnson advised the easements shown were fine. He reminded the developer that installation of cable at the time of development would cost 90 cents a foot. RICK EVANS - ARKANSAS WESTERN GAS Mr. Evans stated the easements shown were fine. He requested the conduit crossings be shown on the final plat. ANDY CALLOWAY - SOUTHWESTERN BELL TELEPHONE Mr. Calloway advised he needed an easement on the north side of lot 13 and some additional crossings. He further requested additional easements. MICKEY JACKSON - FIRE DEPARTMENT Chief Jackson advised he had no comments. RANDY ALLEN - STREET DEPARTMENT Mr. Allen advised he had not seen the drainage plans for this subdivision. Mr. Gray stated the plans were on file with the City. He further stated there was another plat on file (Ashbrook Subdivision) in which the drainage would tie in. He advised there was an extensive drainage plan for the entire area. Plat Review Meeting • June 23, 1994 Page 5 • • Me. Little advised the drainage easement was also the floodway and that did need to be noted on the plat. She also requested that, if cable would not be installed at the time of development, a notation to that affect needed to be placed on the plat. Mr. Calloway further advised he believed there was an off-site easement adjacent to lots 14 through 20. He requested that be shown on the plat also. PERRY FRANKLIN - TRAFFIC DEPARTMENT Mr. Franklin requested the cul-de-sac to the west of Ashbrook Drive also be labeled Ashbrook Drive so there would be no questions at a future date as to the name of the cul-de-sac. Ms. Little stated Jim Johnson, 9-1-1 Coordinator, requested "Ashbrook" be one word rather than two. Mr. Allen asked how Cedarwood drainage project would be affected by this project. Mr. Gray advised they would both drain to the same channel. Mr. Allen advised that he believed Cedarwood would drain across the southeast corner of this development. He stated they might need a drainage easement. He further stated he would do further research and contact Mr. Gray. LISA COX - PARKS DEPARTMENT Ms. Cox stated the land requirement for this tract would be 1.33 acres or money in lieu would be $11,925. She stated the Parks Board would review this matter on July 11. Mr. Gray advised that, should the Parks Board accept the land south of Hamestring Creek, the land in excess of the requirement would be "banked" toward future development in the same quadrant. TIM CONKLIN - PLANNING DEPARTMENT Mr. Conklin advised sidewalks would be required along Old Wire Road requested a note on the plat restricting access to Old Wire Road on and 36. He further noted there needed to be a notation on the plat in the flood plain would need an elevation certificate prior to the of building permits. Me. Little advised that, if all of the lots in the flood plain were filled above flood plain stage, Mr. Gray could request a letter removing those lots from the flood plain. There was also discussion regarding whether an easement was strictly a sewer easement or general utility easement. It was determined notation needed to be made on the plat, once it was determined whether it was strictly a sewer easement. Mr. Regal also requested a specific easement adjacent to the drainage easement. Mr. Gray pointed out that area was in the flood plain. He suggested serving those lots from the front. The utility representatives requested additional easements. Plat Review Meeting June 23, 1994 Page 7 FINAL PLAT - CRYSTAL SPRINGS, PHASE I JED DEVELOPMENT -E OF SALEM RD., N OF MT. COMFORT The next item was a final plat for Crystal Springs, Phase I, submitted by Mel Milholland on behalf of JED Development, for property located east of Salem Road, north of Mt. Comfort. The property is zoned R-1, Low Density Residential, and contains 38.23 acres with 112 proposed lots. JIM CROWNOVER - OZARK ELECTRIC Mr. Crownover requested additional easements and crossings. He also requested an off-site easement adjacent to lot 111. RICK EVANS - ARKANSAS WESTERN GAS Mr. Evans also requested additional easements and crossings. He explained that, since the subdivision was re -designed, they needed the additional easements. Mr. Milholland explained the re -design was caused by the construction of the new elementary school. PERRY FRANKLIN - TRAFFIC DEPARTMENT In response to a question from Me. Little, Mr. Franklin advised he believed they could use existing poles for street lights on Salem Road. TIM JOHNSON - WARNER CABLE Mr. Johnson advised he would require the same easements requested by the other utility representatives. He noted there was a charge of 90 cents a foot if the developer wanted cable installed at the time of development. Me. Little requested that, if the cable were not going to put the cable in, she wanted a notation made to that affect on the plat. RICK EVANS - ARKANSAS WESTERN GAS Mr. Evans stated the easements requested were fine. ANDY CALLOWAY - SOUTHWESTERN BELL TELEPHONE Mr. Calloway requested some of the easements be labeled more clearly. MICKEY JACKSON - FIRE DEPARTMENT Chief Jackson had no comments. RANDY ALLEN - STREET DEPARTMENT Mr. Allen advised he would like to look at the drainage plan for the entire subdivision and see how the drainage in Phase I related to the remainder of the tract. He asked for a copy of the drainage report. POSTAL SERVICE The postal representative advised the developer had contacted Little Rock regarding postal boxes. ALETT LITTLE - CITY PLANNER Ms. Little asked if lots 111 and 112 had been added to the plat since the preliminary plat. Mr. Milholland advised there had been a row of lots adjacent to the school. He explained the school had not wanted those houses adjacent to the school so they moved the street down and ended up with two additional lots. Ms. Little advised the sidewalk needed to continue along the south side of 27. She further noted sidewalks would be required along Salem Road and one-half of Salem Road had to be improved. Mr. Conklin asked that a notation be made on the plat that access was restricted to the interior streets. • Plat Review Meeting June 23, 1994 Page 9 PRELIMINARY PLAT - THE CLIFFS, PHASE I BILL UNDERWOOD - W OF CROSSOVER RD, N OF HUNTSVILLE RD. The next item was review of a revised preliminary plat for The Cliffs, Phase I (a P.U.D.) submitted by Tom Hopper on behalf of Bill Underwood for property located west of Crossover Road, north of Huntsville Road. The property is zoned R-1, Low Density Residential, and contains 25.5 acres with 204 units. Mr. Hopper explained this was the second time before the Plat Review committee for this plat. He advised they were making Cliffe Drive a divided boulevard extending from Highway 265 to the west side of the tract. He further noted there had been discussion regarding moving an easement which ran through the center of the property adjacent to Highway 265. He explained it was a 40 -foot easement adjacent to the proposed 100 -foot right-of-way adjacent to Highway 265. He stated the new plat showed a proposed right-of-way line 50 feet off the centerline of Highway 265 and an additional 40 foot easement in which the SWEPCO transmission line would be located (running north -south adjacent to the drive). He further stated the City would participate in the construction of the boulevard. Ms. Little advised she would be taking that matter before the City Council for confirmation. She also stated the condemnation was proceeding at this time. Mr. Hopper also units each, the pointed out that, while the buildings would still contain 12 buildings were larger. Mr. Evans also pointed out to the south of the boulevard where the gas transmission station was shown, there were two lines going north to Crossover. He advised that might make a difference on where the electrical poles were located. He stated the Highway Department would be requesting those lines be moved since they were getting additional right-of-way. Ms. Little asked that Mr. Hopper check further into that situation. She further noted it appeared, from the plat, that there would be sufficient room to move those lines. Mr. Hopper stated he could increase the 40 -foot easement to 50 feet in order to provide room for the gas service. • Plat Review Meeting June 23, 1994 Page 10 Mr. Regal advised the first request the Highway Department would make when widening the highway was that all utilities be moved to within 2 feet of the edge of the right-of-way. He stated that would put all of the utilities within the 40 -foot easement. Ms. Little stated the station and gas lines could be relocated outside the 40 - foot easement. Mr. Calloway, Southwestern Bell Telephone, stated the telephone company had no intention of serving the subject development from the existing facilities. He stated they would have to place new cable. In response to a question from Ms. Little, Mr. Regal advised they wanted to be as far as they could be located from the front of buildings 1 through 4. Both electrical representatives stated they did not know how much distance would be required between the two lines. Ms. Little asked if the Ozark line could be located on the east side of Highway 265. Mr. Crownover stated he did not know but it was a possibility. • Mr. Regal stated he would have to get with his supervisor and Mr. Crownover to determine how much room it would take for both lines. • ANDY CALLOWAY - SOUTHWESTERN BELL TELEPHONE Mr. Calloway asked if they could not make the entire 40 -foot (now 50 -foot) a general utility easement. Mr. Crownover suggested all of the utility representatives sit down with the engineer on the project and work out easement locations. Mr. Calloway stated he was supposed to have a 20 -foot easement within the 50 - foot easement. He pointed out if Ozark had to be 15 feet inside the easement, it would put them over into his easement and he would have to try to stay away from a 161,000 volt pole. He stated he would try to stay away from the power lines. He further noted that, with two parallel power lines with the amount of voltage these lines would carry, he was concerned about the effect it would have on the telephone service. He also asked the type of slope and access from the buildings to the iron fence. Mr. Hopper advised it was approximately a 3/1 slope. Mr. Crownover expressed concern regarding the iron fence adjacent to a distribution line. Mr. Calloway advised he had to have an easement parallel south and east boundary of the development. There was discussion regarding various locations for the to the entire north - telephone easement. • Plat Review Meeting June 23, 1994 Page 11 • • Ms. Little noted there were four issues which needed to be discussed. She suggested they first determine whether the ornamental iron fence could be placed under the power line. Mr. Regal suggested that, if the fence remained, it should be grounded. Mr. Crownover stated he believed the fence would create a serious hazard. Mr. Hopper stated he would work out another type of fence out of something other than iron. Mr. Regal stated the only major issue he saw was to physically find a location where Ozark Electric could place the distribution line and SWEPCO could place their transmission and distribution line. He further stated they would have to take a closer look at it. Ms. Little recommended they resolve that problem and come back to plat review in two weeks. Mr. Calloway requested a 20 -foot easement on the north property line. He also requested various crossings. He advised the telephone company would not be responsible for clearing any of the telephone easements. He also requested a concept plat of the entire development. TIM JOHNSON - WARNER CABLE Mr. Johnson requested the same easements and crossings asked for by the telephone company. He further stated the cable company had a line running with Ozark on Highway 265 which would also have to be moved. MICKEY JACKSON - FIRE DEPARTMENT Chief Jackson advised the fire hydrant locations were good. CHERYL ZOTTI - SOLID WASTE DIVISION Ms. Zotti reviewed dumpster locations and requested three of the dumpsters be moved or a turn -around provided. She requested the radius be changed at one dumpster site. She also asked if they wanted trash service around the pool area. Mr. Hopper stated the trash could be carried to a dumpster. RANDY ALLEN - STREET DEPARTMENT Mr. Allen had no comment. PERRY FRANKLIN - TRAFFIC DEPARTMENT Mr. Franklin requested a PVC under the intersection of the boulevard and Highway 265 for future street light installation. He also advised it was the responsibility of the developer for the street signs on the private drives. Ms. Little also advised the street names would need to be worked out. In response to a question from Mr. Franklin, a representative of Crafton & Tull advised street lights were planned for the east end of each island. Plat Review Meeting June 23, 1994 Page 12 LISA COR — PARKS DEPARTMENT In response to a question from Ms. Cox, Mr. Hopper advised there were 204 units in Phase I. Ms. Cox advised it would be $180.00 per unit. ALRTT LITTLE - CITY PLANNER Ms. Little noted sidewalks were not shown on Crossover Road. Mr. Hopper requested a Bill of Assurance since the road would be widened. Me. Little asked if they were still at 29% open space. Mr. Hopper stated they were. Ms. Little requested a notation be made on the plat regarding the open space. MANDY BUNCH - ENGINEERING DEPARTMENT Ms. Bunch stated Mr. Hopper had sent her a number of plans the previous week, including the water and sewer plan. She advised she would be reviewing those plans within the next week. She also reviewed items she wanted information on in relation to drainage. She suggested extending the flumes past the sewer lines or providing rip rap. Ms. Little reviewed the events which were to occur prior to submittal of another plat for the plat review meeting in two weeks. • Plat Review Meeting June 23, 1994 Page 13 • • PRELIMINARY PLAT - WILLINGTON PLACE DON GINGER - N OF MISSION, E OF CROSSOVER The last item was a preliminary plat for Willington Place submitted by Harry Gray on behalf of Don Ginger for property located north of Mission, east of Crossover Road. The property is zoned R-1, Low Density Residential, and contains 38.88 acres with 28 proposed lots. Ms. Little stated she had met with the engineer and had discussed an extension of Starr Road. She noted the extension was not shown on the plat. Mr. Gray stated that, due to the terrain, a major transmission line with a 100 -foot easement, a major drainage channel and floodplain going through the middle of the tract and a sewer easement in the southern one-third of the property, they were concerned if Starr Road were extended it would become a collector street. He further stated the developer wanted an up -scale single- family development which would not function with a collector street through the property. He pointed out they had made provisions for the extension of Township Road across the north property line. Mr. Conklin asked if the developer was planning on building one-half of Township Road or just dedicate the right-of-way. Mr. Gray stated it would be up to the City but they were showing a 40 -foot right-of-way dedication. He advised if the total right-of-way was only 60, they would like to reduce the right-of-way dedication to 30 feet. He further pointed out the street proposed in the subdivision would connect Highway 45 and Township but it had been laid out in such a way to discourage thru traffic. Ms. Little advised Township was a standard 50 -foot right-of-way so they would want 25 feet from this development. She further stated she believed they would require improvement of half of Township Road. She stated the decision would be made the following week. She further stated staff believed it was critical to extend Starr Drive. She asked Mr. Franklin to review areas for roads to access Highway 45. Mr. Franklin stated the developer needed to be sure access roads to Highway 45 met the sight distance requirements. Mr. Gray advised they were also making application for rezoning of lot 11 for future townhouses. He stated they would process the townhouses through large scale development if the rezoning was approved. He stated they were looking at possibly 22 patio homes on that tract. JACK REGAL - SWEPCO Mr. Regal asked that Mr. Gray show the location of the power poles in relation to the easement and in relation to Willington Court. He further noted that, if there were any poles which needed to be relocated, it would be at the owner's expense. He advised his only concern was the transmission line. He explained Ozark had the distribution for the subdivision. TIM JOHNSON - WARNER CABLE In response to a question from Mr. Johnson, Mr. Gray stated he assumed they would need a 20 -foot perimeter easement. He further stated there was a possibility of a 40 -foot setback requirement in the covenants. He also requested various crossings. • Plat Review Meeting June 23, 1994 Page 14 • • RICK EVANS - ARKANSAS WESTERN GAS Mr. Evans pointed out there might be with the 30 -foot sewer easement. He sewer. He also requested additional a problem between lot 18 over to lot 14 asked if that easement was strictly for easements and crossings. In response to a question from Mr. Evans, Mr. Gray advised he believed he would have to make a drainage easement along the creek and then would dedicate a utility easement on one side or both sides of the drainage easement. Mr. Evans stated the easements would need to be cleared. ANDY CALLOWAY - SOUTHWESTERN BELL TELEPHONE Mr. Calloway requested additional crossings. MICKEY JACKSON - HIRE DEPARTMENT Chief Jackson requested an additional hydrant located between lots 3 and 4. RANDY ALLEN - STREET DEPARTMENT In response to a question from Mr. Allen, Mr. Gray advised they would probably dedicate drainage easements. Mr. Allen asked if any of the creek channel would be moved. Mr. Gray probably drainage into the stated he believed it was a dedicated flood plain so they would have to follow the creek. He advised he would be submitting a plan in the near future. He pointed out all of the drainage would go channel. Ms. Little asked about a 25 -foot access easement shown on the plat. Mr. Gray explained they planned on paving the easement which would give access to the lift station and to the park. JIM CROWNOVER - OZARK ELECTRIC Mr. Crownover requested various crossings and easements. He also requested the lot lines on the development to the east be shown. POSTAL SERVICE The postal representative advised this subdivision would receive rural delivery. ALETT LITTLE - CITY PLANNER In response to a question from Ms. Little, Mr. Gray advised they would place sidewalks on whichever side requested by city staff. He further noted they would like to place the sidewalks at the right-of-way. Me. Little explained that, unless there was a terrain problem, the requirement was for the sidewalks to be set back 4 feet. • • Plat Review Meeting June 23, 1994 Page 15 LISA COR - PARRS DEPARTMENT Ms. Cox advised this plat had been reviewed by the Parks Board and they were accepting money in lieu of land. In response to a question from Mr. Gray, Ms. Little explained the parks fees was paid "up front". She further explained one-third of the fees could be paid when the final plat was filed with the County Clerk with the balance to be paid within one year. She stated no more than one-third of the building permits could be issued until two-thirds of the fee was paid, etc. Mr. Gray also asked about the sidewalk ordinance. Me. Little stated the sidewalks were to be put in as a part of the public improvements, as a developer responsibility. She further stated the sidewalk was required to be installed by the time 50% of the lots were built out. Ms. Little asked if the proposed lift station had been coordinated with the school. Mr. Gray stated he had discussed the matter with the architects for the school and found the school was above the sewer. He further noted the lift station would be deeded to the City with a reversionary clause. MANDY BUNCH - ENGINEERING DEPARTMENT Ms. Bunch stated there was a 20 -inch force main running parallel to the 24 - inch sewer. She further noted the water line on Mission was 8 -inch in size. She asked about the 2 -inch line shown at the end of the cul-de-sac. She advised she did not believe the Fire Chief would want a 2 -inch line at that location. She also advised a flood plain certificate would be required for each lot in the flood plain. She further stated a preliminary drainage report would need to be submitted prior to the plat going to Subdivision Committee meeting.
