HomeMy WebLinkAbout1994-05-05 Minutes• • • MINUTES OF A PLAT REVIEW MEETING • A meeting of the Fayetteville Plat Review Committee was held on Thursday, May 5, 1994 in Room 111 of the City Administration Building, 113 West Mountain Street, Fayetteville, Arkansas. UTILITY REPRESENTATIVES: CITY REPRESENTATIVES: OTHERS PRESENT: Rick Evans, Jack Regal, Andy Calloway, Tim Johnson, Darrell Ritchey Don Bunn, Alett Little, Mandy Bunch, Randy Allen, Mickey Jackson, Lisa Cox, and Sharon Langley Mel Milholland, Mark Marquess, Len Edens, and Tom Hopper PRELIMINARY PLAT - HENDERSON SUBDIVISION BMP DEVELOPMENT - W OF OLD MISSOURI, S OF JOYCE The first item on the agenda was a preliminary plat for Henderson Subdivision presented by Mel Milholland on behalf of BMP Development for property located west of Old Missouri Road, south of Joyce Street. The property is zoned R-1, Low Density Residential, contains 32.72 acres with 57 proposed lots. Ms. Little advised the access to Old Missouri Road was good. She stated the 100 - year floodplain and flood way needed to be shown on the plat. Mr. Milholland advised the Margaret Henderson portion of the property was not a part of the subdivision. Mr. Conklin informed Mr. Milholland the Henderson property either needed to be a part of the subdivision or he needed to obtain a lot split. He pointed out the street was dividing Ms. Henderson's property, creating two parcels. Mr. Marquess of BMP advised Ms. Henderson's property was not part of the purchase of land and he would appreciate it not being a part of the project. He noted they had purchased the right-of-way easement through the property. Mr. Milholland stated that, if required, he would do a lot split of Ms. Henderson's property from the subdivision. Mr. Bunn explained they just needed to do a tract split on the plat. Ms. Little stated staff had discussed the need for access to Millsap Road (coming in behind the church). She suggested access between lots 31 and 32. Mr. Bunn stated there was street right-of-way going around the church which they needed to tie into. He advised he believed a connection needed to be made. Ms. Little stated the radius on the one-way street needed to be improved. Mr. Milholland stated there would be 30° radius and the street would be 18 feet wide. In response to a question from Mr. Bunn, Chief Jackson advised he believed that would be adequate for emergency vehicles but he was not positive. There was discussion regarding the utility easement and private access easement. 'Mr. Milholland explained that had occurred when platting Yorktowne Square. In response to a question from Ms. Little, Ms. Lisa Cox, Parks Department, advised this development had not been reviewed by the Parks & Recreation Advisory Board. • • Plat Review May 5, 1994 Page 2 Mr. Conklin asked if Mr. Milholland knew when, if ever, Phase II of Yorktowne Square was planned for development. Mr. Milholland stated he had met with the owners of that tract recently and found they were planning on developing the property. He reviewed the plans with the Plat Review Committee. Ms. Little advised there were a number of access issues which still needed to be resolved on this development. She further noted there would need to be off-site improvements and additional right-of-way from Old Missouri Road. Mr. Milholland pointed out his client did not own property adjacent to Old Missouri Road. Ms. Little stated vehicular traffic from the subdivision would empty out onto Old Missouri Road. Mr. Conklin also pointed out that, when the lot split of the Henderson property took place, additional road right-of-way could be required. Mr. Marquess stated that, if he had brought in the property without the access to Old Missouri Road and the, at the direction of city staff, obtain an easement for the access, he did not believe the city would require the improvements to Old Missouri Road. Ms. Little advised staff had been requested to fully assess all requirements for both on-site and off-site improvements. CHRIS VOTT - OZARE ELECTRIC Mr. Vott advised they had not received a plat so he was unable to review the development. Ms. Little advised the development would be reviewed at the next plat review meeting. • Plat Review May 5, 1994 Page 3 PRELIMINARY PLAT S & S DEVELOPMENT - MADISON AVENUE - S OF HWY 45, E OF STARR RD. The next plat to be reviewed behalf of S & S Development, Starr Road. The property is 10.18 acres with 23 proposed was Madison Avenue submitted by Mel Milholland on located on the south side of Highway 45, east of zoned R-1, Low Density Residential, and contains lots. Ms. Little asked if any consideration had been given to the potential for extension of the street into Phase II of Barrington. Mr. Milholland stated he had not believed that would be an issue since the City had not determined whether they planned a cemetery for the city owned property. Ms. Little advised that, with the plans as shown, access to that area would be cut off. She asked if there was flood plain on this tract... Mr. Milholland stated he did not believe there was flood plain on the property. Mr. Bunn advised he believed they needed to consider the access from Phase II of Barrington. He stated the key would be whether staff wanted a street to go through the city property. Ms. Little advised the city had been turned down for the cemetery. In response to a question from Ms. Little, Ms. Cox advised this development would be reviewed by the Parks and Recreation Board on May 16. Mr. Milholland advised the developer preferred to pay money in lieu of giving land. He further stated it was his understanding the City Attorney had determined the developer had the option to give money or land. Ms. Little advised that was true but the Planning Commission or Parks Board might ask for something different than offered by the developer. Mr. Conklin advised note B on the plat needed to be changed to southwest corner rather than southeast corner. He also reminded Mr. Milholland that the developer/owner was responsible for installing the sidewalks. Ms. Bunch pointed out the road on the western side of the property was entirely within the boundary of the subject property. There was discussion regarding the improvement of the roadway. Ms. Little reviewed the ordinance regarding developer improvement to substandard roads. She advised staff was talking about a total dedication of right-of-way of 25 feet from the existing centerline plus whatever happened to be on the other side of the road. Mr. Milholland pointed out if Sweetser developed his property to the west, he would improve the other side of the road. He stated he had always believed the road was the center of the right-of-way. Ms. Little agreed but stated normally the property line went to the edge of the right-of-way or to the centerline of the road. TIM JOHNSON - WARNER CABLE Mr. Johnson requested a 15 -foot easement between lots 19 and 20; a crossing between lots 9 and 10 to lots 3 and 4. • • Plat Review May 5, 1994 Page 4 RICK EVANS - ARKANSAS WESTERN GAS Mr. Evans advised he had an existing line down the east side of Starr Road and one on the south side of Highway 45. He also requested the easement along lots 17 and 18 be 25 feet wide. ANDY CALLOWAY - SOUTHWESTERN BELL TELEPHONE Mr. Calloway requested the easement on the east and north side of lot 7 be 25 feet wide. He stated they did have buried facilities along Starr Road and any relocation of those lines would be at the developer's cost. TIM JOHNSON - WARNER CABLE Mr. Johnson advised that, if the developer wanted cable to go in at the time of development, the owner would have to pay 90 cents a foot. CHRIS VOTT - OZARK ELECTRIC Mr. Vott requested the easement between lots 19 and 20 be increased to 20 PERRY FRANKLIN - TRAFFIC DEPARTMENT feet. Mr. Franklin advised a street light needed to be placed at the end of the cul de sac which would require a 10 -foot easement between lots 13 and 14 for the electric. He also requested that, when a street changed direction but the name was not going to change, the street name be placed on both. He further noted usually when a street changed directions, the name did change. RANDY ALLEN - STREET DEPARTMENT Mr. Allen noted there was a 15 -foot drainage easement on each side of lot 3. He asked why. Mr. Milholland advised they would be filling that lot and he did not have a storm sewer design at the present time. He stated they probably would have to run a pipe down one of the easements. LISA COB - PARKS DEPARTMENT Ms. Cox advised .the land dedication for this development would be .58 acres and money in lieu would be $5,175. She noted this item would be reviewed at the May 16 Parks and Recreation Board meeting. MICKEY JACKSON - FIRE DEPARTMENT Chief Jackson suggested moving the hydrant on lot 6 moving the hydrant at the cul-de-sac across the street. having the fire flow on the vicinity map. He further development he would support tapping into the already to the intersection and He stated he appreciated stated this was the last inadequate water main. Mr. Bunn requested Mr. Milholland run a flow test. He stated one of his comments was that they needed to look at the flows in the area. POSTAL SERVICE The postal service representative advised there would be rural boxes all of the • way around the subdivision. • • • Plat Review May 5, 1994 Page 5 DON BUNN - CITY ENGINEER Mr. Bunn stated the dead-end water line needed to be 8 inches. He reiterated staff's recommendation for the road was that the right-of-way be dedicated so the center of the existing roadway would be the new right-of-way and the developer was to dedicate 25 feet plus whatever was west of the road. He further stated staff would recommend that one-half of the street be improved from Highway 45 to the southwest corner of the subdivision. Ms. Little requested the sidewalks be shown on the plat. She noted sidewalks were required along Highway 45 but the developer could request a waiver. She also requested access to lots 15 and 16 be restricted to Hailey on the plat. In response to a question from Mr. Allen, Mr. Bunn advised staff was requiring actual improvements to Joe Fred Starr Road, not a Bill of Assurance. He further noted there was a requirement for the subdivision on the west side of Starr Drive (Gaddy Acres) to construct one-half of the roadway. He suggested the work be coordinated between the two subdivisions so the curb would line up. He further stated sewage treatment plant odors were a fact of life in the subject area and it needed to be noted on the plat. Mr. Allen asked why type of drainage improvements the developer planned to put in along Joe Fred Starr Road and Highway 45. Mr. Milholland advised he would just be putting in curb and gutter along Joe Fred Starr Road and he did not anticipate any along Highway 45. He stated they would be tying into the storm drainage. He noted he would be working with the State on the drainage along the highway at the northeast corner of the subdivision. In response to a question from Mr. Bunn, Mr. Milholland stated he was sure the garage would be taken down. Ms. Little pointed out the subdivision would be creating a nonconformity with the garage. She advised it would not be able to be rebuilt. Mr. Conklin advised he did need a tree preservation plan. Mr. Vott requested the city stop issuing permits until the water and sewer lines were in place. Ms. Little explained the procedure and advised staff would look at the procedure again, if necessary. • • • Plat Review May 5, 1994 Page 6 LARGE SCALE DEVELOPMENT - SHILOH PLAZA LEN EDENS - W OF SHILOH, S OF WEDINGTON The next item was a large scale development for Shiloh Plaza presented by Len Edens for property located on the south side of Wedington, west of Shiloh. The property is zoned C-2, Thoroughfare Commercial, and contains 1.55 acres. Ms. Little requested the plat be drawn in 1 inch = 50 scale. She also requested the vicinity map be included on the plat. She requested a chart showing the parking, explaining he would probably be asking for a waiver of 9 parking spaces. JACK REGAL - SWEPCO Mr. Regal advised he would probably come back to Mr. Edens with a separate utility easement between him and SWEPCO to be sure there was an easement on the existing line. Mr. Edens advised there was a filed utility easement and showed on the plat where the easement ran. He also pointed out he would be giving a 52 -foot wide easement to the building. In response to a question from Mr. Regal, Mr. Edens stated the building would be used for retail shops and two restaurants. He reviewed the amps that would be necessary. Mr. Regal advised the 20 -foot easement on the west property line and the 22 -foot shown further to the south would be adequate. He stated the building on the south side was a different matter, asking if it would be possible to dedicate any more than 17 feet on the south property line. He explained he believed all of the utilities would be in that easement and 17 feet would be too tight. He stated he would like a 20 -foot utility easement on the south side and the 4 -foot concrete service deck not placed on the 20 -foot easement. He also stated he needed load information. PERRY FRANKLIN - TRAFFIC DEPARTMENT Mr. Franklin asked if additional easements would be needed for street lights. Mr. Regal advised there were no lights on Shiloh and there was an existing pole on Wedington but he did not know if there was a light. He stated he was looking at constructing some type of overhead power line down Shiloh. He further stated he could come in entirely on the wrest side but he would need more easement and the cost would be greater to the developer because he would have to provide conduit and transformer pads. He further stated that, if they wanted underground service, he would have to have 25 feet along the west side. In response to a question from Mr. Edens, Mr. Regal stated he would need 29 feet from the building to the property line at the south side. Mr. Bunn asked if there were any off-site easements. • • • Plat Review May 5, 1994 Page 7 Mr. Edens stated he knew there were none on the west side but there might be on the south side since it adjoined the apartment complex. TIM JOHNSON - WARNER CABLE Mr. Johnson requested they pull one CTV wire on the back of both buildings so there would be a central location to tie into. RICK EVANS - ARKANSAS WESTERN GAS Mr. Evans stated he, too, needed a place to set the meters at the not a concrete area. Mr. Edens stated he could just pour a pad for the utilities. Evans stated that would be acceptable and the meters could go at the back building. Mr. the back that was ANDY CALLOWAY - SOUTHWESTERN BELL TELEPHONE of Mr. Calloway asked if the 30 -foot utility easement was a general easement. Mr. Bunn stated the easement was for water and sewer. Mr. Calloway requested a 15 -foot utility easement adjacent to and parallel to the 30 -foot water and sewer easement. He advised Mr. Edens would need to provide a schedule 40 PVC from the building to the easement. PERRY FRANKLIN - TRAFFIC DEPARTMENT Mr. Franklin reviewed the options for street lights. RANDY ALLEN - STREET DEPARTMENT In response to a question from Mr. Allen, Mr. Edens advised that leaving a 20 - foot area of green space should help the drainage. He further noted the underground culvert would take approximately half of the run-off. Mr. Allen stated he had talked with Mr. Edens regarding the drainage, which was currently draining onto Shiloh. He explained they could leave an open swale or grassy area on the south. After discussion, Mr. Edens stated he might have to make one of the buildings smaller since the utility representatives were requesting an additional 25 -foot easement. Mr. Regal advised that, if there was an off-site easement, the 25 -foot easement could be reduced in size. ALETT LITTLE - PLANNING DEPARTMENT Ms. Little advised they needed to have the legal description on the plat. She further noted an easement plat would need to be filed prior to the issuance of a building permit. DON BUNN - CITY ENGINEER Mr. Bunn noted Mr. Edens needed to file a grading plan and a tree preservation plan. • • • Plat Review May 5, 1994 Page 9 LARGE SCALE DEVELOPMENT - NATIONAL HOME CENTER NATIONAL HOME CENTER - N OF OLD FARMINGTON, E OF FUTRALL The last item was a large scale development for National Home Center submitted by Tom Hopper, Crafton & Tull, on behalf of National Home Center for property located north of Old Farmington Road, east of Futrall. The property is zoned C-2 and contains 28.24 acres. Ms. Little advised the subject plat looked much better than the one presented two weeks earlier. Mr. Hopper stated the parking area was left the same except for the access. He pointed out additional parking. Ms. Little stated she did not see access to the north. Mr. Hopper advised they had the information but believed they needed city staff input. JACK REGAL - SWEPCO Mr. Regal advised they needed to look at a pad mount transformer location, probably at the northeast corner of the main building complex or along the east line where the lawn and garden center met with the warehouse. Mr. Hopper suggested the north end of the parking area on the east side. Mr. Regal pointed out the easement shown was in and away from the property line by approximately 20 feet. He advised the easement needed to be extended to the east property line. He further noted there was an existing overhead line close to the northeast building corner to the existing south house. He further stated Ozark had a line to the existing north house. He reminded the committee there had been discussion regarding street lighting but advised he did not have any facilities on Futrell Drive. Mr. Hopper stated it was his understanding street lighting was required on Futrell. Mr. Regal stated he did have an existing power line where street lighting power was available at the corner of Old Farmington Road and Futrell. He stated they could extend from that point but it would be at the developer's expense. TIM JOHNSON - WARNER CABLE Mr. Johnson stated they would have to get a conduit from Old Farmington Road. RICK EVANS - ARKANSAS WESTERN GAS Mr. Evans advised they would probably provide service from the back the same way SWEPCO would be coming into the property. He advised they would have to get the load figures when available. ANDY CALLOWAY - SOUTHWESTERN BELL TELEPHONE CO. Mr. Calloway asked if the 25 -foot utility easement would come around to Old Farmington Road. Mr. Hopper advised they would not have a problem with that. He stated he had looked up the easement which was a public utility easement but dedicated to water • • • Plat Review May 5, 1994 Page 10 and sewer. Mr. Bunn advised it was a water and sewer easement but he did not see any problem in dedicating a general utility easement as long as the sewer line was protected. He further noted it appeared the easement needed to be larger and suggested the 50 -foot setback Mr. Hopper presented the traffic study and advised the synopsis was that a left turn lane off of Futrell into the entrance was needed and a left turn lane at Old Farmington Road and a traffic light at Old Farmington Road. Mr. Calloway advised they would probably serve the site from the southeast corner. He requested a copy of the electrical plans. CHRIS VOTT - OZARR ELECTRIC Mr. Vott asked if they planned on separate service for the warehouses. Mr. Hopper advised they planned on service all from one main complex. Mr. Vott stated it would not be necessary to find the territorial line in that case. He advised the line along the north would have to be adjusted. POSTAL SERVICE The postal representative asked that, when the developer was ready for service, he contact Rick Hutton with the Post Office. PERRY FRANKLIN - TRAFFIC DEPARTMENT Mr. Franklin requested a copy of the traffic study. RANDY ALLEN - STREET DEPARTMENT Mr. Allen advised it appeared most of the problems had been worked out. MICKEY JACKSON - FIRE DEPARTMENT Chief Jackson stated the sprinkler tap would probably be brought in from the back of the building and they would need an additional hydrant. TIM CONKLIN - PLANNING DEPARTMENT. Mr. Conklin advised they would need to submit a tree preservation plan and an easement plat. MANDY BUNCH - ENGINEERING Ms. Bunch advised they needed to have an alternate plan to tie into the water on the south side of Highway 62. Mr. Hopper stated their alternate plan was a 24 -inch line that, when moneys became available, the city would reimburse National. Mr. Bunn stated that was a good plan and he would respond in writing. In response to a question from Me. Bunch; Mr. Hopper advised screening was required on the north side of the property. He asked what type of screening was required, pointing out there were a number of trees already at that location. • • • Plat Review May 5, 1994 Page 11 Mr. Bunn agreed vegetation was allowed as screening. Ms. Little stated vegetation was preferable rather than a fence. Ms. Bunch advised she did not know if the existing trees would remain and, if they did not, new trees would have to be planted. She reviewed the types of trees that would be good at that location. The meeting adjourned at 11:05 a.m.
