MINUTES OF A PLAT REVIEW MEETING
A meeting-of'the Fayetteville Plat Review Committee was held on
Thursday�;•January 6,, 1994 in Room 111 of the City Administration
Building, 113 West Mountain Street, Fayetteville, Arkansas.

The first item -on the 'agenda was a large scale development for
Spring CreekCentre'Lots'5 & 6 presented by Robert Brown,
Development -Consultants, on behalf of Clary Development
Corporatioin''fbr property located at 637 E. Joyce Boulevard. The
property is.:.zoned;C-2, Thoroughfare Commercial, and contains 3.66
acres.
JOHN :HILL - `SWEPCO:•.
Mr. Hill advised the easements were fine. He requested 4 inch
conduit to service future' traffic signals - adding two sleeves
north of the sidewalk would be sufficient.
ANDY CALLOWAY - SOUTHWESTERN BELL

Mr. Evans requested the developer contact him prior to any

L.O. FERGUSON - WARNER CABLE
Mr. Ferguson requested Schedule 43 and 40 PVC conduit under all
paved areas within a utility easement and 90 degree steel sweep
elbows at all service areas. He stated he would service the
majority of the site from an existing backside overhead. line.
DAVY TACKETT - U.S. POSTAL SERVICE
Mr. Tackett advised he had contracts already with the ,developer
for mail service.
PERRY FRANKLIN - TRAFFIC DIVISION
Superintendent Franklin advised street lights were required at
every intersection and at 300 foot intervals. He also requested a
3 inch conduit across each street for future traffic signals.
RANDY ALLEN - STREET DIVISION
Superintendent Allen had no comment.
TIM CONKLIN - PLANNING OFFICE
Mr. Conklin advised parking spaces were required to be 9 feet by
19 feet with 24 foot minimum aisle width - adding the plat noted
parking spaces 18 feet in depth.
Mr. Brown remarked landscape space would be lost.
Mr. Franklin suggested the developer asked for a waiver from the
19 foot depth requirement
Ms. Little stated the staff would support either a waiver on
parking stall depth or aisle width to preserve landscape -
requesting the subject be brought to the attention of the
Subdivision Committee. She suggested Mr. Brown notify the
Planning Office formally of his intent to appeal for a waiver.
Mr. Brown provided Mr. Conklin with several documents"pertaining
to the abandonment of a utility easement.
DON BUNN - ENGINEERING DIVISION
Mr. Bunn requested Mr. Brown determine if the building would be
sprinkled.

FINAL PLAT - REMINGTON PLACE
MIKE PARKER - N. SIDE OF STEARNS. E. OF FRONTAGE
The next item on the agenda was a final plat for Remington Place
presented by Kurt Jones, Northwest Engineers, for property
located on the north side of Stearns. east of Frontage Road. The
property is zoned C-2, Thoroughfare Commercial, and contains 8.17
acres with 14 lots.
JOHN HILL - SWEPCO-
Mr. Hill advised he had an existing overhead service along the
north side of Stearns - adding he would serve lots 1,2 and 14 and
could do so with either overhead or underground service. He
stated the easements were fine. Mr. Hill remarked SWEPCO would
service one of the street lights and Ozarks Electric would
service the other two.
FLOYD CANTRELL - OZARKS
Mr. Cantrell advised he had an existing service pole to the west
and east sides of the development and a three phase underground
to the rear - adding he had no additional comments.
ANDY CALLOWAY - SOUTHWESTERN BELL
Mr. Calloway requested the 20 foot building setback on the south
property line be designated a utility easement and a 4 inch
conduit be placed beneath the drive. He stated the existing
building in lot 1 encroached severely into the west 20 foot
easement - noting Southwestern Bell had access to only about 8
feet of the easement.
Mr. Jones remarked some portion of the building had been removed.
Mr.'BUnn stated the easement issue had to be resolved or the
building removed.
Ms. Little stated the issue would be resolved prior to
Subdivision Committee or the plat would not be advanced to the
Planning Commission.
Mr. Jones confirmed that both Southwestern Bell and Arkansas
Western Gas would utilize the subject easement.
In response to a question from Mr. Jones, Mr. Calloway remarked
the issue could be resolved if he were assured there would be.a
conduit placed beneath the pavement from the southwest corner up
to the building in addition to conduit up to the property line.

He confirmed there were no existing utility lines currently in
the subject easement, and remarked an off-site easement was
probably not feasible.
Ms. Little stated the 50 foot building setback, which had been
revised from a 20 foot building setback, would need to noted on
the plat as containing a 20 foot utility easement.
RICK EVANS - ARKANSAS WESTERN GAS
Mr. Evans advised all easements excepting the subject easement
were fine.
L.O. FERGUSON - WARNER CABLE
Mr. Ferguson stated there was an existing underground line at the
west side of the building in the easement - adding he was not
sure there was a dedicated easement there.
Mr. Calloway stated he also had a line at the west side of the
building - explaining the line might have been installed without=
requiring the dedication of an easement. He requested Schedule
40 PVC from the southwest corner to the northwest corner of the
development under all paved areas - adding he would also need
conduit to the building if the developer intended to serve it.
DAVY TACKETT - U.S. POSTAL SERVICE
Mr. Tackett advised he would serve the development with curbside
delivery.
Mr. Bunn confirmed that all development on the site would be
commercial.
RANDY ALLEN - STREET DIVISION
Superintendent Allen asked why Stearns Road was not shown on the
plat as continuing to the property line.
Mr. Bunn explained the developer would construct both sides of
the street up to the point shown, half the distance, in lieu of
constructing only half the street to the property line.
In response to question from Superintendent Allen pertaining to
who would be responsible for completing the north portion of the
street, Ms. Little remarked she felt the minutes would reflect
that the developer of Remington Place was constructing an entire
portion of the street for half the distance and the next
developer would therefore be responsible for both sides of the
street, not just one side, for the remaining portion.

In response to a question from Superintendent Allen, Mr. Jones
explained drainage from Stearns Road would go to the west and
eventually to the south.
PERRY FRANKLIN - TRAFFIC DIVISION
Superintendent Franklin requested the street lights be noted
larger on the plat.
TIM CONKLIN - PLANNING OFFICE
Mr. Conklin stated impact fees for improvements to Joyce
Boulevard were $3,281 and would be placed in an Escrow account.
He advised the 10 feet of dedicated right-of-way on Stearns
needed to be noted on the plat - also stating a grading plan was
required.
Ms. Little advised the plat would not be forwarded to the
Planning Commission without the submission of a grading plan - in
addition requesting that the Planning Office be given the,AutoCAD
file for the subdivision after the revisions were made.
Mr. Jones explained his client wanted to amend the length of lot
1 from 200 feet to 205 feet - taking five feet from the north
lotline. He stated a 10 foot utility easement would be provided
within the 50 foot building setback along Remington Drive and the
waterline would be located with the easement. Mr. Jones
confirmed the sidewalk would need to be setback 4 feet - also
confirming the staff requested the sidewalk constructed along
Stearns be jogged out 4 feet from the curb.
Mr. Calloway stated he would not provide service until he had
been provided with a final plat noting the revised lotlines.
Ms. Little stated the plat would not be forwarded to the Planning
Commission unless revised plats were provided to the staff and
utility companies prior to Subdivision Committee and the utility
easements were resolved.
Mr. Jones explained the purpose of changing the dimensions of lot
1 was because there was a buyer interested in lots 2 and 3 and
developing them as one.
Mr. Hill remarked if that were the case he would then be
responsible for serving lot 3 as well as 3.
Ms. Little stated current policy stipulated that plats with
modifications to building locations or lotsizes returned to the
Plat Review Committee - remarking that this plat would not have
to return to Plat Review if the utility companies were provided

with revised plats and she heard from Mr. Calloway, Southwestern
Bell, regarding the easement issue prior to Subdivision
Committee.
Mr. Bunn advised the drainage issue would require a meeting with
the subject developers as well as the developer to the south.
Mr. Cantrell requested a 10 foot utility easement going west
along the south side of lot 4 to serve the street light at the
northeast corner of lot 3.

PRELIMINARY PLAT - BARRINGTON HILLS
CASTON CONSTRUCTION - S. OF MISSION. W OF FOX HUNTER
The next item on the agenda was a preliminary plat for Barrington
Hills presented by Ron Petrie, Milholland Company, on behalf of
Caston Construction Company for property located outside the city
south of Mission Boulevard, west of Fox Hunter Road. The
proposed zoning for the property is R-1, Low Density Residential,
and contains 77.2 acres with 132 lots.
ANDY CALLOWAY - SOUTHWESTERN BELL
Mr. Calloway advised the original property owner' of the
subdivision had been informed that improvements to Fox Hunter
Road and Mission Boulevard would require the relocation of
utility poles at the developer's expense. He requested an
easement running parallel to County Road # 75 to serve lots 51,
52 and 53 of phase two, as well as a 20 foot easement and a
crossing between either lots 53 and 54 or 52 and 53 to service
the island section - adding if the subdivision was developed in -
phases the subject easement would need to be off-site. He also
requested a Schedule 40 PVC crossing between lot 1 and the
easement between lots 56 and 93, a 20 foot easement and crossing
between lots 57 and 58 extending to lots 4 and 5, and a 20 foot
easement between lots 4 and 5. Mr. Calloway explained lots 14
through 30 would be serviced from the front in order to preserve
trees - adding the developer would be responsible for tree
clearance in both easements and right-of-way. He requested a 4
inch crossing across Carie Lane. Mr. Calloway remarked any lots
requiring front lot service would need a 15, not a 10, foot
utility easement.
FLOYD CANTRELL - OZARKS ELECTRIC
Mr. Cantrell requested the same easements and crossings as Mr.
Calloway and stated he had an existing line along Fox Hunter
Road.
RICK EVANS - ARKANSAS WESTERN GAS
Mr. Evans the following 4 inch crossings: from lot 1 to 56 and
93, from lot 53 and 54 to 94 and 132, from lot 74 and 75 to 23
and 24. He also requested an 15 foot easement between lots 23
and 24, as well as between lots 112 and 113 to lots 27 and 28.
Mr. Evans requested the private easement between lots 2 and 3 be
designated a 15 foot utility easement.

Mr. Ferguson requested the same crossings and easements.
DAVY TACKETT - U.S. POSTAL SERVICE
Mr. Tackett advised he would utilize curbside delivery to service
the development.
PERRY FRANKLIN - TRAFFIC DIVISION
In response to a question from Superintendent Franklin, Ms.
Little remarked the staff recommended an additional access be
provided between lots 13 and 14 to the east. Ms. Little confirmed
the dotted line through the subdivision was a sewer easement
containing two lines, and suggested an additional access also be
provided to the west through the development from County Road #
75. Ms. Little remarked annexation had been filed at the County:
Office and explained one half of Fox Hunter Road would be left
within the county were the site to be annexed. She stated that
due to additional issues the plat should be tabled until
annexation or County approval.
Superintendent Franklin discouraged the use of surnames for
street names, explaining that resulting in frequent theft of the
street signs.
JACK REGAL - SWEPCO
Mr. Regal advised there was an existing line along the south side
of the development which might require a 50 foot easement rather
than the platted 20 foot easement.
ALETT LITTLE - PLANNING OFFICE
Ms. Little stated all lots were required to access interior
streets and noted lot 3 did not have frontage on an interior
street. She remarked the revised sidewalk ordinance stipulated
that the developer, not the individual lot owner, was responsible
for sidewalk installation. Ms. Little advised a wetlands
determination was required for lots 40 through 44. She
recommended provisions for neighborhood amenities to serve
approximately four hundred residents, and requested assurances
from the Stanberries be provided to the Planning Office that they
did not want access from their properties. Ms. Little requested
a plat drawn to scale 1 inch = 100 feet, as well as a tree
preservation plan once the site was annexed.

LISA COX - PARKS AND RECREATION
Ms. Cox advised land dedication was 3.3 acres or money in lieu
was $29,700.
Ms. Little advised the Parks Department would need to be notified
if any lots were eliminated.
Mr. Bunn advised the subdivision could be constructed in the
county if the annexation failed.
MICKEY JACKSON - FIRE DEPARTMENT
Chief Jackson advised the hydrant shown in the center of lot 94
be relocated closer to the intersection in the northeast corner
of the subject lot. Chief Jackson stated additional accesses
were required.
Mr. Bunn confirmed the 15 foot private easement was intended to
access the sewer line, and was not for access.
DON BUNN - ENGINEERING DIVISION
Mr. Bunn explained the

replat was approved by the Planning Commission. He remarked an

PRELIMINARY PLAT JACKSON HEIGHTS
JACKSON & PARTNERS - N. SIDE OF MISSION, E. SIDE OF OLD WIRE
The next item on the agenda was a preliminary plat for Jackson
Heights presented by Ron Petrie, Milholland Company, on behalf of
Harry Jackson & Partners for property located on the north side
of Mission Boulevard, and the east side of Old Wire Road. The
property is zoned R-1, Low Density Residential, and contains
24.74 acres with 68 lots.
ALETT LITTLE - PLANNING OFFICE
Ms. Little explained there was a platted access to the north of
the development from Regency Estates and advised Jordan Drive
line up with the subject access and connect at the appropriate
location. She explained Ramsey Street to the east of the site
deadended at lot 8 of Ramsey Addition and advised an access be
provided to the east across lot 33 - remarking Jordan Drive would
need to be shifted to the south to provide a better intersection.
Ms. Little remarked that lots 56, 57, 58, 59, 60, 63, 35, 36, and
64 were substantially in the floodplain and, Jordan Drive being
relocated to the south, an openspace dedication at the location
was recommended.
Mr. Hill and Mr. Cantrell remarked they would not place lines
within the floodplain.
Ms. Little remarked Leah Lane intersected south of Broadview -
remarking it needed to form a four way intersection with
Broadview. She advised the property had been identified as a
proposed fire station site - stating the developer needed to meet
with the Fire Chief on the subject. Ms. Little remarked lots 22
and 23 had been identified for station placement but if Leah Lane
were relocated that was subject to negotiation.
ANDY CALLOWAY - SOUTHWESTERN BELL
Mr. Calloway stated there was an existing 16 and 1/2
Southwestern Bell easement across the south property
of Mission Boulevard - adding there was a major line
easement.

Mr. Evans advised the platted 50 foot utility easement was a
gasline easement.
Ms. Little stated the plat would not advance to Subdivision
Committee but would return to the next Plat Review meeting for
utility company comments.

FINAL PLAT - SAVANNA ESTATES PHASE III
FOSTER & PEOPLES - S. SIDE OF SKILLERN, W. OF OAKLAND -ZION
The next item on the agenda was a final plat for Savanna Estates
Phase III presented by David Jorgensen, Jorgensen & Associates,
on behalf of Mark Foster & Buddy Peoples for property located on
the south side of Skillern, west of Oakland -Zion Road. The
property is zoned R-1, Low Density Residential, and contains
18.08 acres with 35 lots.
ANDY CALLOWAY - SOUTHWESTERN BELL
Mr. Calloway advised the easements shown were fine and requested
a 4 inch crossing between lots 20 and 21, as well as a plat
depicted the additional abutting phases. He stated the developer
was responsible for tree clearance in easements and right-of-way.
Mr. Calloway remarked the concrete fence along Skillern for phase
I had caused Southwestern Bell difficulties because it was
constructed within as easement.
FLOYD CANTRELL - OZARKS ELECTRIC
Mr. Cantrell requested lotpins be set.
RICK EVANS - ARKANSAS WESTERN GAS
Mr. Evans stated the easements were fine and requested the
following crossings: from lot 34 to 1, a 2 inch from lot 1 to
lots 7 and 8, a 2 inch from lots 9 and 10 to lots 15 and 16, a 4
inch from lots 30 and 31 to lot 9, a 4 inch crossing from lots 26
to 25, a 2 inch from lots 24 and 25 to lots 17 and 18, and a 2
inch from lots 19 and 20 over to lot 22. He confirmed he would
provide frontside service to the development.

Mr. Ferguson stated the easements were fine.
DAVY TACKETT - U.S. POSTAL SERVICE
Mr. Tackett advised service would be curbside.

Superintendent Franklin had no comment.

Ms. Cox advised she would contact the developer.

RANDY ALLEN - STREET DIVISION
Superintendent Allen requested the 10 foot drainage easement be
designated a 20 foot drainage easement - adding he would also
need to see the drainage plan.
In response to a question from Superintendent Allen, Mr.
Jorgensen stated he would determine whether or not drainage
between lots 34 and 33 would be adequate.
TIM CONKLIN - PLANNING OFFICE
Mr. Conklin advised sidewalks were required along both sides of
the streets.
Mr. Jorgensen confirmed that the developer was not required to
install the sidewalks because Savanna Estates had been approved
prior to the revision of the sidewalk ordinance.

Mr. Conklin stated he was concern that homeowners abutting
Skillern Road would not be informed that they were required to
install a sidewalk along Skillern.
Mr. Jorgensen remarked there had been a discussion about the •
practicality of installing a sidewalk along Skillern Road due to
the terrain on the south side.
Mr. Conklin suggested Mr. Jorgensen determine whether a similar
wall would be placed within the easement along Skillern Road for
phase III and notify the appropriate utility companies, and
inform homeowners about the sidewalk requirement.
MICKEY JACKSON - FIRE DEPARTMENT
Chief Jackson had no comment.
RANDY ALLEN - STREET DIVISION'
Superintendent Allen advised the creek did not fall within the
platted drainage easement.
Mr. Jorgensen remarked there was a previous drainage easement
adding he would make the necessary correction.
DON BUNN - ENGINEERING DIVISION
Mr. Bunn requested the AutoCAD file for the subject plat and
requested plans for the wall along Skillern Road.
Mr. Jorgensen stated waterlines and hydrants had been installed.

FINAL PLAT - DEERPATH ESTATES PHASE I
K J ENTERPRISES - W. SIDE OF CROSSOVER N. OF WYMAN
The final item on the agenda was a final plat for Deerpath
Estates Phase I presented by David Jorgensen, Jorgensen &
Associates, on behalf of K J Enterprises for property located on
the west side of Crossover Road, north of Wyman. The property is
zoned R-1, Low Density Residential, and contains 5.89 acres with
9 lots.
ANDY CALLOWAY - SOUTHWESTERN BELL
Mr. Calloway stated the 20 foot utility easement along the south
property line of lot 1 needed to be labelled. He stated the
owner had agreed to provide a 4 inch Schedule 40 PVC along the
south entrance road from the highway right-of-way up to lot 2, as
well as a 4 inch Schedule 40 crossing from lot 2 to lot 1. Mr.
Calloway requested 10 foot utility easement along the east side
of lots 6, 7, 8, and 9 in the back.
FLOYD CANTRELL - OZARKS ELECTRIC
Mr. Cantrell had no comment.
RICK EVANS - ARKANSAS WESTERN GAS
Mr. Evans advised the easements shown were fine and stated he
would service the development from the front.
L.O. FERGUSON - WARNER CABLE
Mr. Ferguson remarked he currently had no plan to serve the
subdivision. He confirmed there was a crossing from lot 1 to lot
2.
PERRY FRANKLIN - TRAFFIC DIVISION
Superintendent Franklin requested the street names.
LISA COX - PARKS AND RECREATION
Ms. Cox advised parks fees totalled $2,025.
RANDY ALLEN - STREET DIVISION
Superintendent Allen confirmed sidewalk crossings were handicap
access.
Mr. Jorgensen stated the drainage plan had been submitted and

reviewed.
MICKEY JACKSON - FIRE DEPARTMENT
In response to a question from Chief Jackson, Mr. Bunn remarked
static pressure was adequate to serve the development.
TIM CONKLIN - PLANNING OFFICE
Mr. Conklin requested Mr. Jorgensen determine who would be
responsible for the sidewalk extending south to Crossover Road by
Subdivision Committee.
The meeting adjourned at 11:10 a.m.
