A meeting of the Fayetteville Plat Review Committee vas held Thursday,
November 21, 1985 at 9:00 A.M. in Room 111 of the City Administration
Building, 113 West Mountain Street, Fayetteville, Arkansas.
UTILITY REPRESENTATIVES PRESENT: Kenneth Wagner and Tom Mcllroy
CITY REPRESENTATIVES PRESENT: Clayton Powell, Bobbie Jones and
Paula Brandeis
THE MEADOWS SUBDIVISION - PRELIMINARY PLAT
GROWTH AREA (NEST OF FAYETTEVILLE)
The only item of consideration today was the preliminary plat of The
Meadows Subdivision to be located on the north side of Howard Nickell
Road west of Fayetteville in the growth area. Plat submitted by Earle
Bullock and represented by Bullock and Frank Blew.
BUD ALLEN - COUNTY PLANNING
Allen was unable to attend this' meeting but commented via telephone
that the County requires 30' of right-of-way dedicated from the centerline
of Howard Nickell Road to the south boundary of The Meadows property.
JAMES CROWNOVER - OZARKS ELECTRIC
Crownover was also unable to attend but commented via telephone that
the utility easements as shown on the plat are adequate.
WALLY BRT - SANITATION SUPERINTENDENT
Brt was unable to attend today's meeting but notified the clerk he
had no problem with the plat if it met with the Street Superintendent's
satisfaction.
CLAYTON POWELL - STREET SUPERINTENDENT
Powell said that, because this subdivision is in the growth area but
not contiguous to the City limits, he was unsure as to which standards
prevail for public improvements such as streets. He added that both
City and County street specifications are in the process of revision.
He said he thought Allen's comments referred to Howard Nickell Road
and Meadow Wood Drive, but not to Lindy Lane. Powell requested that

Lindy Lane be fully dedicated within the limits of the property which
is being subdivided and to skew the cul-de-sac into Lot 5 even though
it may mean rearranging the lot lines of Lots 5, 6 and 12. He expressed
concern that the half street dedication as shown would remain, that
way with no means of maintenance. He noted that the alternative could
be to request a tandem lot private driveway to be maintained by the
property owner for access to Lot 5. Jones advised that the County
has shown a dislike for tandem lots. The Clerk clarified that Allen's
comment referred to only Howard Nickell Road. Powell said he felt
it best to avoid the 30' dedication on Lindy Lane.
Bullock stated that he owns the land to the west indicated on the
plat as a life trust and that when the trust is cleared, his intent
is to extend Lindy Lane cul into that area.
KENNETH WAGNER - ARKANSAS WESTERN GAS
Wagner said the easements as shown look good. He reminded Blew of
an easement to extend across the north side of Lot 5 or one between
Lots 5 & 6. Blew advised that the area to the north of Lot 5 will
be divided with a north/south street and the easement along Lindy
Lane extending northward. Wagner said there is gas available at the
southwest corner of Lot 4 as well as on the south side of Howard Nickell
Road back towards the east. He indicated that a contract can be obtained
if desired and he requested 90 days notice for installation. Bullock
said he definitely needed gas and he desired all utilities underground.
Wagner noted that there is possibly another subdivision with the a
similar name intended to this one. This was discussed, as well as
the similarity of names within this addition (there is already a "Linda",
several streets with "Meadow" and at least one with "Wood"). Jones
advised checking with the Water Meter Superintendent and the Fire
Chief, as they prefer to not duplicate names because it is confusing
in emergency situations.
CONNIE EDMONSTON - PARKS AND RECREATION
Edmonston passed along the following comments via the clerk: The
Greenspace Ordinance requires developers to contribute land or cash
in lieu of land in the amount of $105 per single family residence.
She said the Parks and Recreation Department will meet on December
9th at 5:00 P.M. to discuss and make a recommendation on this development.
Bullock stated that he preferred to make a cash contribution and Jones
added that the amount due for the twelve lots would be $1,260.00.
She said that a contract must be signed agreeing to make payments
as each lot is sold or at the end of five years, whichever occurs
first.

DON BUNN - CITY ENGINEER
Blew noted that the water line would be extended along the east side
of Meadow Wood Drive and along the south side of Lindy Lane. He said
he would set aside a 10-15' easement (within the 25' building setback)
for water only and that the remainder of the utilities will run along
the back sides of the lots. Bunn was unable to attend this meeting
but sent comments via the clerk on Friday, November 22 as follows:
There is a water line on Howard Nickell Road and the developer can
extend the water down Meadow Wood and Lindy Lane. He said a minimum
2" line is required.
TOM MCILROY - SOUTHWESTERN BELL TELEPHONE
Mcllroy said that the easements are fine and indicated that cable
is available on Howard Nickell Road. He said that Bell operates similarly
to the gas company in that the developer may pre pay and be re-imbursed
over a five year period or allow the individual builders to pay.
BOBBIE JONES - CODES TECHNICIAN
Jones asked if Bullock had considered extending Lindy Lane through
to an existing road to the west and Blew replied that it is set up
for either an extension or a cul-de-sac. Bullock noted that there
is a home blocking the way to that road. Blew added that it was more
desirable to not have through traffic.
Jones said that Planning Commission approval of the preliminary plat
authorizes the developer to have plans drawn for street construction,
drainage and water lines. She said that after these plans are approved
by the State Board of Health, construction may take place or a contract
may be signed for said improvements (constituting a lien on the property)
with lots being released individually.
Jones stated that property owners within 100' (including those in
Lewis Estates) must be notified by either a copy of the plat signed
by same or by certified mail, return receipt requested (which takes
about 10 days). Jones inquired as to the access for the Henry Shreve
property and the Albert Combs property and Blew replied that all property
owners surrounding this development have access to their parcels.
Jones said according to the ordinance, streets must conform to existing
City standards or to County standards, whichever is greater. She
added that the County requires at lease a double chip/seal surface.
Jones advised that 10 copies of revisions of this plat are due in
the Planning Office by December 2nd to present to the Subdivision
Committee on December 5th and the Planning Commission on Dec. 9th.

Jones commented on the difference in the perc test readings and Blew
replied that they have been inspected and approved by the County. Jones
requested a copy of the perc letter.
Jones expressed her concerns regarding the dedication of half a street
and tandem lots. She reiterated that the County disapproves of tandem
lots but that the ultimate decision will lie with the Planning Commission.
Bullock suggested he sign a Bill of Assurance stating that the remaining
30' of road for Lindy Lane will be dedicated when the land trust (to
the west) reverts to him. Jones advised that such a document would
become part of the legal description of the property and Bullock indicated
that he is the owner of the property and able to sign such a document.
There being no further discussion, the meeting adjourned at 10:00
A.M.
