adjacent to 515 Park Avenue. There were no comments.

Regarding the petition
to vacate an unimproved right-
of-way located on Eighth Street
near the Naval Reserve facility,
Bobbie Jones stated the Naval Reserve facility has written a letter stating
their objections which was sent to all utility companies and should be
received within the next day.

FINAL PLAT
SEQUOYAH SOUTH PHASE I
SEQUOYAH LAND COMPANY
1) Kenneth Wagner (Arkansas Western Gas Company):
In regard to the drainage and utility easement on the north side of Phase I,
Wagner noted the ditch washes out the area and he said he would prefer the
utilities to be outside the drainage easement, although he would not require
that, as he understands gas will not be needed at this time.
Cowdrey stated they had to slope the bank for a drainage swale behind the
units and another swale on top of the bank. He said the utilities will
probably go on the north side of bank, and stated it would be a grass swale.
Cowdrey said he did not feel they could make a change because of the steepness.
Wagner asked for a road crossing to be put in before they begin sub -basing
the road He asked to be given one week to ten days notice.

2) Ivan Faulkner (SWEPCO):
Faulkner stated he had talked with the developer and confirmed the need
for 4" conduit (with 36" of cover) from somewhere between Lot 17 and Lot 18
to the vicinity of the northwest edge of the private street.
Cowdrey said they don't know right now which units will be built first,
but would go ahead and install conduit under the road.
Faulkner requested 2" conduit crossing the private street for streetlights
with less than 36" of cover being required. He said that the 4" and 2" conduit
can be placed side-by-side in the same ditch.
On the east side of Common Area No. 28 he requested 2" conduit to cross
over to Lot 27 to get to the streetlight.
Faulkner noted conduit would not be needed for the streetlight at the
intersection of Sequoyah Court and Overland Trail.
3) Dick Shaw (Southwestern Bell Telephone Company):
The phone company requires, across the junction of Sequoyah Court and
Overland Trail, two 4" conduits, 60 feet long, to cross Sequoyah Court,
minimum 24" deep with either steel or PVC casing of cement.
They require, across Sequoyah Court, north and south, in the utility
easement, one 2" conduit, 95 feet long.
Cowdrey said they would probably build the southernmost units first,
but that he should know definitely within two weeks.
Shaw said, regardless of where they build, next to Unit 1 they need to
get down to grade so he can set a cross -box in, which will have a four foot
redwood fence around it, about four feet off the edge of the building. He
said they must be sure where the east property line of Unit 1 is so he can
set the box four feet off the edge of the property line.
Shaw said if the existing 15 foot utility easement on the north is a
City sewer easement, it should be redesignated because, when the second phase :.
is begun, the phone company will be requiring ten additional feet onto that
easement. Cowdrey agreed to check on that. Cowdrey said if the easement is
a City water and sewer easement, he may have to rewrite the easement form they
had made out.
Shaw said if the phone company is the only utility in that easement, a 20
foot easement would be sufficient, but if there are any other utilities, it
would have to be 25 feet.
4) Jim Napier (City Street Department):
Street Department does not like the drainage and utility easement
together but, since it is to be privately maintained drainage, they will not
be concerned.
Napier said Overland Trail seems to be an extension of Fifth Street and
asked if the name might be changed either to Fifth or Rogers, since it will
eventually tie to Rogers.
Bobbie Jones agreed the name might need to be changed and said this
question had come up previously,

After some discussion, it was decided it would be best to change the
short portion of Fifth Street (west of Sherman) to Overland Trail, so it can
be continuous from Sherman to Rogers.
Napier also stated Clayton Powell asks that some of the dirt at the
intersection of Sherman and Huntsville Road be cleaned up better.
5) L. 0. Ferguson (Warner Amex Cable):
The Cable Company requires 2" PVC in the same location as for the Phone
Company and one across the intersection of Overland Trail and Sequoyah Court,
east to west. Ferguson also requires a crossing from north to south on
Sequoyah Court in the 25 foot utility easement. He asked for 2" PVC from
north to south across Overland Trail if they are going to blacktop at a
normal depth.
Ferguson said if the developer cannot furnish the trench for the
utilities, their cable can go in with that of the Phone Company if the work
can be coordinated at the same time.
6) Bobbie Jones (City Planning Administrator):
a. Recording information for off-site easements must be added on the plat
(Book and Page numbers).
b. Reference to the covenants should be made on the plat.
c. The way the sidewalks are shown, it is difficult to tell to whom to assess
sidewalk responsibilities.
Cowdrey stated the developer will install sidewalks as the
buildings are finished.
Jones 'asked when sidewalks for common areas would be installed.
Cowdrey stated these would be installed before the first units
are sold, as this is also an FHA requirement.
d. Neighbor, Mr. McInnis, contacted Bobbie Jones about a driveway
problem, but she said she had been unable to reach him by phone.
Also, a neighbor, Lela Harris, is concerned about the development
going in and should be contacted by the developer at 521-3334.
e. It must be checked with the Board of Directors on the name change
of Fifth Street to Overland Trail from the east line to Sherman Avenue.
7) David McWethy (Assistant City Manager):
He was not present, but the following comments were submitted:
The City does not pay for streetlights on private streets - how are the
two lights on Sequoyah Court going to be handled, as far as monthly billing?
Bobbie Jones asked if the Property Owners Association would pay for
this expense.
Cowdrey stated, if the City won't pay for, he "guesses the POA will have to".

8) Wally Brt (City Sanitation Superintendent):
Brt requires a letter from the owner giving the Sanitation Department
permission to travel on Sequoyah Court.
Cowdrey checked in the covenants and stated there was a provision which
allows this in..the covenants.
Brt stated no objections to carrying cans from the curb, but he
recommended the use of a container for the area; he said with 26 units, if
cans are to be enclosed, people often throw their trash into the enclosure,
not into the cans, and it looks terrible and attracts rats. He also pointed
out that dogs will knock over individual cans and he recommended a container
to keep the area at its cleanest.
Cowdrey said they are trying to avoid an "apartment look" but, if they
have a problem, they will get containers rather than cans.
Brt priced some containers and also said the monthly sanitation charge
would remain the same but that, with the containers, they will do a pickup
more than twice :week• if necessary.
9) Don Bunn (City Engineer):
Bunn was not present but submitted the following comments after the
meeting:
He has plans and specifications on the water and sewer construction.
No comments regarding easements. Off-site easements have been recorded.
