A meeting of the Plat Review Committee was held at 9:00 A.M. on
Thursday, December 23, 1982 in the Central Fire Station, Fayetteville,
Arkansas
UTILITY REPRESENTATIVES PRESENT: Ivan Faulkner, Floyd Hornaday,
Roy Hawkins, Connie Skinner, L.O. Ferguson
CITY REPRESENTATIVES PRESENT:
Clayton Powell, Sid Norbash, Bobbie Jones,
Suzanne Kennedy
The only item to consider
was a request from Gordon Wilkins
to vacate part of an easement on
East Oaks, Phase Two; a request for
the elimination of a street light in
that subdivision.

GORDON WILKINS
1) Bobbie Jones (City Planning Administrator): Bobbie Jones said she
had received two letters from Gordon Wilkins on East Oaks, Phase Two; one
letter included a request for a release and a request to vacate the east
4' feet of a utility easement which would narrow a 25 foot wide easement to
2011 feet by taking the east 411 feet off that easement. The second letter
requests the omission of a street light. She said Mr. Wilkins will be out of
town until after the first of the year so that if any Plat Review members wish
to talk with him, she would arrange to run the requests through Plat Review
again after the first of the year. She said his mother had indicated that the
reason for the request is because a potential buyer of Lot 1, Block 12 would
like to build a house which would necessitate a variance from the setback.
Bobbie Jones stated, as to street lights, she thinks the developer should have
registered his objections at the preliminary plat level and surely no later
than the time of final plat approval.
She said, on Bois De Arc Lane, the City received requests from people to
the west to keep the connection out because Winwood was already congested.
She said either the Planning Commission or the Board of Directors wanted the
right-of-way left in and required a sidewalk to be built so children could go
to school, with the condition that one lot length of Bois De Arc Lane would
not be constructed until after Township Road is opened up. She said the City
is presently looking at the right-of-way requirements for opening up Township
Road and at this time the opening of Township Road is fourth or fifth priority
on the list of street priorities.
2) Arkansas Western Gas A representative was not present but John Kehn,
Town Plant Manager, submitted a letter stating the Gas Company has no objections
to releasing the east 42 feet of the existing utility easement running parallel
and adjacent to the east property line of the following lots: Lot 1 in Block 12,
Lot 1 in Block 13, Lot 1 in Block 14 and Lot 1 in Block 15, all located in Phase
II of the East Oaks Subdivision.

3) Clayton Powell (City Street Superintendent): Powell noted Mr. Wilkins
also requested a final subdivision inspection and a release which Powell said
normally should be submitted by the developer or the engineer. Bobbie Jones
said Mr. Wilkins is considered to be the developer. She said Wilkins doesn't
think the streetlight is needed because he doesn't think the street connection
will ever be made at the intersection of Bois De Arc Lane and Twelve Oaks Drive.
Powell stated he was opposed to the deletion of the streetlight because it
is desirable to have a streetlight at all intersections. He feels the street
will go through eventually.
Powell stated we need 25 foot easements to avoid a conflict with subsequent
homeowners. He will check his file to determine the status of as -built
engineering plans and profile, certification of liens, etc. He stated requests
should have some justification or explanation.
4) L. 0. Ferguson (Warner Amex Cable Co.): Ferguson stated they have
cable buried in that easement but does not know exactly where. He said they
could not approve the release, unless the developer wants to pay for relocation
of their cable.
5) Ivan Faulkner (SWEPCO): Faulkner stated the easement has both primary
(7,200 volts) and secondary (120-240) within it. He said there is no way to
release any of the easement without going back and redoing it at the developer's
expense. He said SWEPCO's cable comes within one or two feet of the estimated
release which would not give them adequate room to maintain their lines. He said
SWEPCO is willing to install the streetlight when requested to do so, at the
standard price as of that date, and said they were told to leave it out previously
because the street was supposedly not going to be built.
Bobbie Jones said Wilkins' mother (Maxine Edwards) said they have a
potential buyer on a lot and the house had to have an eight foot setback from
the line in order to get it on the lot, and with the easement, there has to be
a 121 foot setback.
Faulkner said he cannot recommend the release since the easement contains
the primary loop for SWEPCO that feeds the major portion of the entire subdivision.
6) Roy Hawkins (Southwestern Bell Telephone Company): Hawkins stated the
easement is a main feeder route for the entire subdivision and feeds several
streets beyond that point. He said their cable is laying right beside SWEPCO's
and if the deletion of the easement is made it will not give them room to
maintain the cable without getting on private property. It would have to be
relocated at 100% cost to the developer. He said his boss recommends and would
support writing a letter to the Planning Commission that Mr. Wilkins go to the
City and ask for a variance on the setback. Hawkins said he would add to that,
if Wilkins can get his building on the lot without getting within six feet of
the easement, they would support a variance.
Bobbie Jones said Wilkins can get to the easement from his overhang now,
but no closer.
Hawkins said if Wilkins can put his building on the property and the over-
hang is within four feet of the easement it will put the main structure seven
feet away and the Phone Company needs at least that much to get in with a backhoe.
Bobbie Jones said, as it stands now, the overhang could be eight feet from
the property line were it not for the easement.

Hawkins said the only visible thing the phone company has in the easement
is a pedestal right in the middle of each block which goes north and south.
He said there is a sewer manhole in the easement, that the Gas Company is on
one side of the sewer line and SWEPCO, the Telephone Company and Cable Company
is on the side Wilkins is asking to have reduced. He is not sure where the
water lines are.
7) Sid Norbash (City Engineer): Norbash stated he is not sure whether
the City has water lines in the easement but they do have sewer lines
located in the easement.
8) David McWethy (Assistant City Manager): Although not present,
David McWethy submitted the following comments: He did not think the street
light in question was necessary, though he stated the developer might be
asked to sign a Bill of Assurances to install the streetlight if Bois De Arc
Lane should ever be 'put through, which McWethy thought was unlikely to happen
in the near future.
