HomeMy WebLinkAbout1982-10-14 MinutesMINUTES OF A PLAT REVIEW COMMITTEE MEETING A meeting of the Plat Review Committee was held at 9:00 A.M. on Thursday, October 14, 1982 in the Chamber of Commerce Board Room, Fayetteville, Arkansas. UTILITY REPRESENTATIVES PRESENT: Kenneth Wagner, Ivan Faulkner, Dick Shaw, Larry Winkler, L. 0. Ferguson CITY REPRESENTATIVES PRESENT: Larry Poage, Don Bunn, Wally art, Clayton Powell, Bobbie Jones, Suzanne Kennedy OTHERS PRESENT: Dr. G. A. Sexton, Arthur Miller, Ervan Wimberly, Al Harris, Gary Carnahan, Tom Hopper Bobbie Jones said the Planning FINAL PLAT -PHASE ONE Commission approved the Concept Plat NORTHVIEW HEIGHTS ADDITION on Northview Heights Addition in J. B. HAYS April of 1981, with the conditions that streets will be built to City standards including 30' of pavement and encouraging the developers to look at the safest possible options on the slopes. She said the Preliminary Plat was approved by the Planning Commission on August 10, 1981 with the following conditions: (1) Include proposed detention pond and drainage system in the first phase of development; (2) Comply with Plat Review comments and requests; and (3) waive the 100' requirement for 4% grade in hilly terrain at the intersection of Highway 71 and the proposed access street. Grades must meet with the approval of Clayton Powell. She stated that Don Osburn, Meter Foreman, informs her that there is already a street named Northview so that street will have to be renamed. (1) Clayton Powell (Street Superintendent): There have been two or three preliminary "final" inspections but never a formal final inspection by the Street Superintendent. Public improvements for maintenance responsibilities are not accepted until after the formal final inspection. This should be requested by the Consulting Engineer and not by the individual contractors. He needs to know who the Property Owners Association is and the fact that the common areas and detention pond are for property owners association maintenance, not public. On a public dedicated drainage easement, utilities are not combined anymore, and in the future there will be problems trying to maintain drainage and utilities after a big rain in the middle of the drainage ditch. The intersection should have altered radii annotated for each side. (2) Larry Poage (City Fire Inspector): He stated the fire lane had not yet been inspected. Bobbie Jones asked that he make an inspection and report back to her. (3) Don Bunn (City Engineer): No comments. (4) Ivan Faulkner (SWEPCO): He stated the property line at the intersection of Highway 71 and Northview Drive comes out into the street and the utility easement running along the street is on top of the sidewalk and out to the center line of the street and in an adjacent property not owned by J.B.Hays. /77 • • • Plat Review Committee October 14, 1982 Page Two Ervan Wimberly stated there is an additional 25' easement there dedicated to the City of Fayetteville. Mr. Faulkner stated he will require an established record of there being a utility easement outside the subdivision on the edge of Northview Drive. He said the pie -shaped area at the top of Tract 4 has no actual connection between the utility easement and the common area, and he needs access across this area. Mr. Wimberly said he would make the wedge a part of the common area. He said what appears to be the north edge of the utility easement there is actually a ' section line and this will be clarified on the drawing. Mr. Wimberly stated he would be needing three-phase equipment for the restaurant (Building A on Tract 1). Mr. Faulkner stated to serve any future development, he would require a 25' easement on the north side of Tract 3. He said not to use street right of way for easements. (5) Dick Shaw (Southwestern Bell Telephone Company): He asked for a 25' easement along the west, south and north property lines (including just the curved part of the southwest portion along the right of way of Tract 2. On Tract 3 he asked for a 25' wide easement on the west side back of the road, with the possibility of cutting that back to 20' at some future date He asked for an easement on the east side of Tract 4 along the road right of way. Mr. Wimberly asked that the record show, if trees are to be cut, it will be at the request of the utility companies. He confirmed that drain tile had been put in the drainage ditch. Mr. Shaw asked for 15' outside the drainage ditch on Tract 2. Wimberly said the 4' concrete ditch is drawn more than 4' wide because on this scale 4' won't even show up. As actually constructed, the east edge of the concrete ditch is right along the east property line of the entire tract of land. There is 10' from the concrete ditch to the east line of Tract 2. (6) Kenneth Wagner (Arkansas Western Gas Co.): He echoed the sentiments stated earlier on the drainage ditch in the easement. He stated that if all utilities are underground on the east side of Tract 2, they will be crowded. He asked for a 25' easement on the north and west sides of Tract 2 and around the curve. He stated the common area and utility easement along Tract 1 look okay. Mr. Wimberly confirmed that the drainage ditch was V-shaped and about 1 foot deep. Wimberly asked if he could have a 20' easement rather than 25' on Tract 2. After some discussion, it was confirmed that Tract 2 would have to come back before Planning Commission as a Large Scale Development, as well as Tracts 3 and 4, and it was decided to wait until that point to decide on easements for those Tracts, except that Mr. Faulkner does want the 25' easement off the north side of Tract 3 shown on the plat. Mr. Wagner stated if the Gas Company must come from the highway to Tract 5, the owner must bear the expense to Tract 5, since there will need to be a new line. (7) L. 0. Ferguson (Warner Cable Co.): Regarding the concrete drainage and utility easement, he had planned to come in underground from the east side, and understands they may dig anywhere on the north side. ,73 • Plat Review Committee October 14, 1982 Page Three Mr. Wimberly confirmed that the 15' easement shown on Tract 5 is an existing easement, 71/2' either side of the sewer line. Wally Brt (Sanitation Superintendent): Bobbie mentioned here that Mr. Brt needed covenants to authorize the Sanitation and Fire Departments to have access into the Addition. Bobbie Jones (Planning Administrator): a. She asks that the recording information on the dedicated easement for the south part of the street be shown on the plat. b. AddThoroughfare Commercial after C-2, at the top of the plat. c. Add engineer's name and address next to owner's on the plat. d. Add a building setback line from Northview Drive for Tracts 1, 2, 3 and 4. It should be 50' unless there is landscaping with no parking between the building and the street. e. The name "Northview Drive" needs to be changed and the address reas- signed for Tract 5 to be off of the new street. It currently has a N. College address. • f. Submit a copy of the Covenants and the City must be made a third party to insure maintenance of the common areas. • g. Submit a copy of the Property Owners Association. h. The ratio of parking to proposed floor space must be shown on the plat. Mr. Wimberly stated here that he figured 2,500 square feet per unit, except for Unit A, which will have 1 space per 200 square feet. All the rest will have 1 space per 300 square feet. He told Bobbie street lights were not in, gas and telephone were not in. He said streets, drainage, water and sewer were complete and sidewalks were built. i. Planning Commission must be asked to waive the required 5' sidewalk width, as the sidewalks that are in are only 4' wide. Mr. Wimberly stated here the City Board of Directors had approved the 4' width. Bobbie asked him for a copy of these Minutes or a date when this waiver was granted. (Al Harris called 10-15-82 and said the sidewalks are 5' wide in addition to the curb.) J The owner must execute a performance bond or contract until the street lights are in, as builts, engineering certification, cost figures and lien waivers are received. k. Bobbie said, on the east property line, Building H, in the PUD code, it states that setbacks will be the same as for the district in which it is located. When it abuts an R-1 development any building containing more than two units and which exceeds one story should be set back an /79 • • • Plat Review Committee October 14, 1982 Page Four additional one foot for each one foot of height above ten feet in an R-1 district. Bobbie asked how many stories there would be 6n the east side. Mr. Wimberly said the south half of each building is single level; midway between two levels is the north edge of each building. Bobbie said the Planning Commission has the authority to grant a waiver to allow Building H to be a maximum of two stories high. Mr. Wimberly said all these issues had been discussed at the preliminary plat level. 1. Bobbie stated she needed ten copies of all revisions no later than Wednesday in order to go before the Planning Commission on October 25. m. Mr. Wimberly agreed that he would add a note that prior to the development of Tracts 3 and 4 the street must be extended, side- walk installed, water and sewer improvements extended to serve the property and additional street lights installed. n. There was some discussion about the location of street lights. It was decided that there needed to be an additional light, making a total of four. Mr. Wimberly said he would plan on two on an overhead pole and two on a free standing pole. Bobbie asked him to get back to her on the final location of lights. Bobbie explained the original plat of the Miller Addition which was filed in 1978 showed Lot 8 as 3.75 acres and Lot 9 as 2.63 acres. State regulations require state approval for subdivisions with any lot having less than three acres. The purpose of this replat i§ to make both of these lots be a minimum of three acres, because they have had a problem with putting septic tanks on Lot 16, and if they can get all of them a minimum of three acres, the County Health Dept. can work with each lot individually. The replat still doesn't solve the problem on Lot 16 but gives the Sanitarian more leeway. This is a request to relocate the line between Lots 8 and 9, as recommended by the County Health Department. She stated there will be a masonry garbage can holder required for Lot 8 when it develops. There will be eight tandem lots and eight street side lots. (1) Dick Shaw (Southwestern Bell Telephone Co.): He said there may be a problem on the east easement for Lot 9.which .shows a-25'!utility easement and no setback. Lot 8 shows a 20' setback. He thinks they both should read the same. Otherwise, he sees no problems. Bobbie Jones suggested they might change that to a building setback and utility easement, but that she would not allow building on an easement. CONCURRENT PLAT. (3) Kenneth Wagner (Arkansas Western Gas Co.): Looks fine 180 A • • • Plat Review Committee October 14, 1982 Page Five (4) Wally Brt (Sanitation Superintendent): It was confirmed for Mr. Brt that rock masonry garbage containers were already installed. There were no other comments from anyone else present. Bobbie said this replat would go before the Subdivision Committee on October 22 and before Planning Commission on October 25. Tom Hopper was present to represent BOUNDARY SURVEY Crafton, Tull P, Associates, Inc., Engineers A.W. REALTY for A. W. Realty. Mr. Hopper explained that the A.W. Realty dedicated two streets to the City, Sain Street and Joyce Street, and since then, he was hired to do an outside boundary survey of 250 acres. A.W. Realty, along with City contributions, built 1200 feet of Joyce Street. His firm has replatted a portion of the street that lies along Front Street. They need to close a portion of Sain Street that was previously dedicated to the City and to correct the legal description of Joyce Street that was dedicated to the City, based upon the boundary that was found and the fact that the original dedication dedicated a portion of Joyce Street in the Butterfield Trail Retirement Village area that they do not actually own. They need to straighten out the east end. This is not intended to be a preliminary plat. He said the new description of Joyce will more nearly center the street within the right of way. (1) Don Bunn (City Engineer): Mr. Hopper clarified that there were sewer lines coming from Mud Creek on the northeast. (2) Ivan Faulkner (SWEPCO): No comments (3) L 0. Ferguson (Warner Cable Company): He asked if there were easements along Joyce Street on either side. Mr. Hopper said yes, in addition to the right of way, there will be 25' utility easements on the north and south. (4) Ozarks Electric Cooperative: In the absence of Mr. Crownover, Bobbie stated that Ozarks Electric could not find a Mud Creek Addition preliminary and Mr. Crownover said there would be some utility easements needed. He said he would come by the Planning Office and look at the plat. Bobbie stated Mr. Hopper wishes to take the realignment of Joyce and the vacation of part of Sain Street on to the City Board of Directors and give a correction deed on the right of way for Joyce. (5) Clayton Powell (Street Superintendent): Has no objection to removal of the dedication of Sain Street wherever the owner wants to terminate the street. He asked how much the Joyce Street right of way varies from what was originally planned. He said the City Plat Book shows a dedicated Joyce Street right of way coming west off Old Missouri Road to the point N88 degrees 57' 05"E. Is that still aligned? Mr. Hopper said the change in the street is 5 to 10 feet at the most on the west portion. On the east portion the deed that the City accepted III • • • Plat Review Committee October 14, 1982 Page Six for property from A.W. Realty had an 80' wide right of way. A.W. Realty did not have any right to deed part of that to the City. The new deed will include the north forty feet they do own across from Butterfield Trail Retirement Village. Bobbie Jones said Butterfield Trail has been told they will have to do some street construction. Mr. Powell asked how much problem would it be to show the existing construction of Joyce Street (1,250') to the present terminal point and where the old right of way fell and how it really connects to this existing 50' road right of way coming west off of Old Missouri Road. Mr. Hopper said they would do that. He stated it was strictly the east end that needs to be clarified across the A. W. Realty portion. The deed to the City does not dedicate the road all the way to Old Missouri, just to the end of the property. Mr. Powell asked how far from that point it is to Old Missouri Road. Mr. Hopper stated about 300'. Bobbie Jones asked Hopper if he was giving 40' from the center line of the existing roadbed or off A.W. Realty property. He stated it would be 40' off A. W. Realty property. On the street dedications, Powell asked that the monuments be set in the dedicated street right of way so they have a permanent reference point. The last item to be considered by Plat Review Committee was a Large Scale Development Plan for Lot 1, Block 1, Colt Square, just named "Township Plaza"; owners Jim Lindsey and G. A. Sexton. Dr. Sexton was present as was Gary engineers. (3) LARGE SCALE DEVELOPMENT PLAN TOWNSHIP PLAZA LOT 1, BLOCK 1, COLT SQUARE LINDSEY $ SEXTON Carnahan to represent the Wally Brt (City Sanitation Superintendent): Mr. Brt agreed he could probably back up his trucks to go around the driveway and come out the east driveway. Larry Poage (City Fire Inspector): Mr. Poage asked where the fire hydrants were located. Mr. Carnahan said he thought there were some but did not know the location. Mr. Poage noted that parking was shown up against the building and asked if the exit door opened onto car bumpers. Mr. Carnahan explained that there is actually 8 feet of overhang covering the sidewalk between the building and the cars. Don Bunn (City Engineer):- He stated there was a sewer line on the south end and water comes off Township. He will contact Carnahan later regarding the main extension fee. Dr. Sexton indicated they wanted individual meters, as each module is set up to be about 1,000 square feet, 25' x 40'. Bunn asked that a line be run along the south and west, and stated he probably did not need more than a 2" line. 182 • • • Plat Review Committee October 14, 1982 Page Seven (4) Clayton Powell (City Street Superintendent): Powell said the Plaza is somewhat isolated from Colt Square by the creek, all access is off Township Road, which driveway access points will have to be approved by the State Highway Department. He requested that no on-site drainage be emptied out of driveways onto the highway since it has no storm drainage facilities - the creek to the west side can take all the on- site parking lot drainage. The only off-site improvement required by the Planning Commission on property abutting the state highways is sidewalks and 5' wide is required in a commercial zone. Carnahan stated he would be asking the Highway Department to allow him to put sidewalks on their right of way. Powell said sidewalks and driveways can be put on one permit appli- cation. (5) Ivan Faulkner (SWEPCO): Carnahan said they will use a 2 -ton air con- ditioner for each 1,000 square foot unit being served (about 15 units). Mr. Faulkner said he does not have an entry way except from Township. Overhead facilities will be needed at least to the corner of the property and from that point he will discuss underground service. He noted a 25' utility easement along the parking places on the east side. Mr. Carnahan said that was a dedicated easement. Bobbie Jones pointed out there was also a 25' easement on the north. Carnahan asked whether he could locate a transformer behind the 20' x 20' building, coming off SWEPCO's overhead on Township and go underground along the 25' driveway and in behind the building. Faulkner said he would have to furnish a conduit to specs from that point. Everything but the conduit would then be maintained by SWEPCO. Carnahan said they would like to have the utility entrances on the rear of the building inside the "L". Faulkner would want to dedicate an easement from Township Road to the transformer. He noted that this site had been under water in the past. Carnahan said he planned on doing some fill on the lot, and almost all the lot is outside the flood plain. Faulkner does not want the transformer inside the flood line and the pad for it needs to be stable because if it is placed on fill, there can be some settling. He wants the transformer contained. They can use one transformer for the entire structure which would be 75' x 100'kva, pad mount, single phase, size about 3 feet square. Carnahan said they will build in two stages. He asked if they could use two transformers. Faulkner said he could, if he separated with a roof line fire wall. He said it might be to both their advantages, and might save Carnahan some money. He said primary conducter cannot be run inside the building walls, but service conductors can be bussed. He suggested carrying from the transformer to a central location in the building, metering at that point, and thencarrying conduit from that point. Carnahan said he will probably have two transformers and two different gang meter base locations. Faulkner said there is no problem with the easement being over the parking spaces, since Carnahan will furnish the conduit. Plat Review Committee October 14, 1982 Page Eight Carnahan said there is about a 20' x 20' triangle next to the 20' x 20' building. Winkler asked that there not be too much of a bend in the conduit in this area. Faulkner asked for 2" scheduled 40 PVC to the transformer from the overhead pole on the east side of the entryway. It is not permissible to run conduit under the building. Carnahan was asked to keep the conduit out of the flood plain if possible. Since they may be going under so many driveways, it was suggested they might have an additional conduit from the pole to the first transformer, in case it ever went bad or burned up. (6) Dick Shaw (Southwestern Bell Telephone Co.): Telephone Company service is to the south, in the rear, and there will be no problem bringing service in. As of January, 1983, the FCC asks S.W. Bell to provide for an independent phone company, even if the company is a branch of Southwestern Bell. In the future, builders will have to provide much more conduit than before. S. W. Bell will only provide dial tone to a demarcation point within 25' of an independent phone company. He is in agreement with putting in two units. He stated each unit ought to be in some type of closet in which a conduit and a small connecting block can be installed, with a 2 x 2 piece of plywood. Carnahan said they will be leasing spaces which will only consist of four walls, a bathroom and a furnace, so the tenant will be expected to furnish the phone closet. Shaw said, depending on how many systems are ordered, the plywood may have to be larger in order to hang all the needed equipment. Shaw said, from the south, he is not sure which of the two easements the phone company is in, but he will check. (7) Kenneth Wagner (Arkansas Western Gas Company): Carnahan stated if the Gas Company needed an easement, he will be happy to provide one. Mr. Wagner asked where Phase 1 of the building will take place. Carnahan said facing Township and turning the corner some. Wagner asked if the 13 spaces behind the building would be surfaced. Carnahan said they might just gravel it initially. Wagner said the meter will have to be on the building, would it not be feasible to grant an easement along the parking area. He said a 15' easement along the back of the building on the west and south side would be satisfactory. Carnahan asked how far can you run to an individual from a group of meters. Wagner suggested two meters every 50'. Four in the center would also be okay. Wagner said it will be just as far to come from the south as from the east. He prefers coming from the south because from the east they have to come down the east easement, the south easement and back up the west and he does not want to wrap the building in gas. He said they can get in the 15' easement along the west and south side. Gas will be on regular contract agreement. Carnahan said he would get back with him to discuss the easement being located close to the building, as it occurs to them this would create a problem if in the future a tenant wished to expand in that direction. Wagner said if they charged him for 800' he would get credit back for all of it... • • • Plat Review Committee October 14, 1982 Page Nine (8) (9) Carnahan asked where the existing gas line is. Wagner said at the southeast corner of Block 2 of Colt Square, on the west side of Green Acres Road. He said they would come up through the sewer line easement. Their crossing is on the north side of East Colt Drive to the west side of Green Acres Road. They currently charge $1.75 per foot and $125.00 will be refunded on the meter. He said if someone else builds on Lot 22A Carnahan gets credit for that or for anything along that line. Wagner said he needs a utility easement on the west and south side of the proposed building. Bobbie Jones asked Wagner to make a note on the as -built that he and Carnahan will be responsible for that easement. Bobbie said she would need a description of the easement, in metes and bounds. L. 0. Ferguson (Warner Cable Co.): Ele asked for 2" PVC with sweep elbows from the pole to the SWEPCO transformer and another 2" PVC from the transformer to the utility closet in each section. Carnahan said they may or may not have two closets. Faulkner suggested from that same pad the Cable Company might run down to the other conduit which will give them an entrance around the service lines. Mr. Ferguson asked for a conduit at the first pad to the second location as well into the building. If there will be an equipment room in each section, he would like one into the equipment room, if not, they will work something out. Bobbie Jones (City Planning Administrator): Carnahan said the shaded area on the map represents the roof line, not the floor area. He said there is an 8' overhang along the front of the building, a six foot sidewalk and two feet of landscaping. a. Bobbie said there needs to be a 50' setback from the right of way line and the map shows only 44'. 20' is the minimum for the back. Carnahan said he would probably just change the 25' he has in the back to 20' and move his building back. He could also take 1 foot off the overhang and meet the setback requirements. Bobbie said in case this puts him into the Gas Company's easement, he needs to work something out with them. b. The sidewalk along Township Road must be five feet wide, exclusive of the curb. The City no longer enters into an agreement on this improvement. The sidewalk either must be in when you occupy the building, or there must be a cash bond put up, giving you three months in which to have the sidewalk completed. c. He must clear the flood plain with the Building Inspector or the floor must be two feet above. d. You must have a permit for any filling done for paving in the flood plain area. e. The drainage easement which is shown as 15' on the lot to the south should be shown as 121' each side of the south property line. f. Parking cannot encroach into the right of way. 185 • • • Plat Review Committee October 14, 1982 Page Ten g. An as built plot plan must be submitted. If you do the building in stages, submit one for each stage or you must have a permit for each portion. h. The sign setback must be 40'. Check with John Dietzen. i. She asked for 10 copies of revisions to be submitted by Monday for the October 2Sth Planning Commission meeting and the October 22nd Subdivision meeting. 7• If he is not permitted to put the sidewalk on the right of way, there must be an easement. /$6
