MINUTES OF A MEETING OF THE PLAT REVIEW COMMITTEE
A meeting of the Plat Review Committee was held at 9:00 A.M. on Thursday,
September 30, 1982 in the Directors Room, City Administration Building,
Fayetteville, Arkansas.

The committee considered REQUEST TO RELEASE EASEMENT
a request from Dr. Miller Williams 1111 VALLEY VIEW DRIVE
to have released the north twenty DR. MILLER WILLIAMS
feet of the forty foot utility easement
retained when a portion of the platted
right of way for North Street west of Sunset Avenue was vacated by
Ordinance 2493. Dr. Williams was not present.
Bobbie Jones explained that Dr. Williams wished to build an unmortared
rock wall with landscaping on the north side of the creek on Lot 3, Block 5
inside the north 20 feet of easement which borders his property on the south.
She said also that Mr. and Mrs. Warren Banks, who were present, lived on Lot 10,
Block 3, along the same section of easement. They wish to put up a fence as
they have had some problem with pedestrians and even some vehicular traffic.
She said the easement does not prohibit the putting up of a fence.
Mr. Banks stated he wished to know what type of fence might be least
objectionable to the utility companies. He said he just needs to funnel the
pedestrians closer to the lot line and thinks setting up a chain link fence
would be feasible. He said there is a fence at the west end which has been
pushed down, and he wants to get some grass to grow in the place where the
pedestrianshave been cutting through. He said there is an access gate which
he is willing to keep, but wants to divert the traffic more to the south. He
said all the utilities are located on his neighbor's lot, but there are meters
on his lot. Mr. Banks said he had talked to the phone company and they said
they would go under any fence and have no objections and they have access
through Sunset. He said he had spoken to Rip Lindsey at Warner Cable who told
him they didn't care, but suggested it would be better to put in a gate. He
said SWEPCO told him a gate is preferable but not mandatory. He said the Street
Department told him they had no plans for the easement and it was okay with them,
and the Water and Sewer Department said they would get back to him. Mr. Banks
stated he recognizes that any utility company would be entitled to take down a
fence if they need to have access.
(1) SWEPCO: Norepresentative was present from SWEPCO, but Bobbie Jones
stated she had received a letter from SWEPCO in which they said they have no
objections to vacating the north 20 feet of the easement but want to retain
the south twenty feet of the original right of way with full tree trimming and
right of way privileges to their facilities in the area.

(2) Kenneth Wagner (Arkansas Western Gas Company): Mr. Wagner stated
he was in agreement with releasing the north 20 feet of easement as a public
easement, but retaining it as a private gas line easement. He said the gas
company does have an existing line which he has traced in that easement, but
he is not sure exactly where the lot line is located. He asked that when
Mr. Banks is ready to put up his fence, he call the Gas Company so they can
locate their lines.
(3) L. 0. Ferguson (Warner Amex Cable Company): Mr. Ferguson said the
Cable Company has an overhead line which is on SWEPCO's pole on the south side
of North Street. He said he would like to look at both locations before making
a definite statement. He said he would try to get back to Mr. Banks today and
told him if he did not hear anything back from him, he may assume it is okay.
Bobbie asked Mr. Ferguson to get back to her with his comments for the
record.
(4) Roy Hawkins (Southwestern Bell Telephone Company): Mr. Hawkins was
not present but submitted comments after the meeting. He stated he did not
recommend the release of the easement due to the terrain and the type of
facility the phone company has existing in those easements and because of the
drainage ditch. He said everything from that point west is served through this
easement. He does not object to.a fence as long as it is understood that the
telephone company retains the right of access.
(S) Clayton Powell (City Street Superintendent): He was not present but
Bobbie Jones stated he was opposed to releasing the north twenty feet of the
easement because of a chronic drainage problem. He stated that only twenty
feet would not be enough room to get equipment in to maintain the present
drainage area. Bobbie Jones stated she had suggested to Dr. Williams that he
contact Clayton Powell to see if he could work with Mr. Powell on this.
(6) Don Bunn (City Engineer): Don Bunn was not present but submitted
comments after the meeting. He stated there is an existing water line in the
north 20 feet so that the release of the easement is not recommended He has
no objections to a fence being built.
The Committee considered the final FINAL PLAT
plat of Hamestring South Addition located HAMESTRING SOUTH ADDITION
on Highway 16 West and west of County Road HIGHWAY 16 WEST
877, outside the City Limits. Frank Blew
was present to represent Blew & Associates,
Surveyors.
Bobbie Jones stated that Don Bunn, City Engineer, had pointed out this
morning that the south 660' of this Addition is on the November ballot for
possible annexation into the City. She reported that Clayton Powell stated
he had no comments on this plat as it is outside the City limits.
(1) Kenneth Wagner (Arkansas Western Gas Company): Mr. Wagner said the
gas company does have a high power gas line on the north side of Highway 16
which is shown on the plat. If the Addition desires gas service, they will

put it on their regular extension contract. He said Lots 10, 11 and 12 already
have gas but the gas company will give them credit for future gas connections
on Lots 1-9. They will put a setting on top of the high pressure gas line and
extend intermediate gas on north of Lot 1.
Frank Blew stated the meter actually sets in the right of way and there is
a private gas service line in County Road 877 which is an exposed line and needs
to be eliminated and service needs to be off a new line.
Mr. Wagner stated he can extend service across the road somewhere close to
the house and they will need to eliminate the line and pipe from the house out
to the new meter. The developer will not get credit for the house. He asked
Mr. Blew if he needed a letter as to cost.
Mr. Blew stated he needed some figures on cost to give to the developer.
Mr. Wagner stated he would have that information for him in the next few
days.
Mr. Wagner stated there is an extremely high powered ArkLa gas transmission
line running along the west side of the Addition and Arkansas Western Gas will
not locate gas for anyone building close to that line.
Frank Blew said he thinks it is a 50' wide easement; 25' on each side of the
line and he was only able to locate it by their valves.
Bobbie Jones stated we need to narrow down that location. Mr. Crownover
(Ozarks Electric Cooperative) stated he would send her an address for ArkLa
which he has available. Bobbie stated that, with a blanket easement, we need
to see.if ArkLa will release it for a specific easement.
Mr. Wagner said on the north side of Highway 16 a 25' easement and a.'50'
building setback are shown. He feels reasonably sure the Gas Co. does have
a private easement 25' wide north of the gas line.
Mr. Blew stated the 25' utility easement is measured from the right of way
of Highway 16 and the gas and water are both within that 25 feet. He said the
50' building setback is measured from the right of way. He said the water and
gas lines are about four or five feet apart and one of them is about five feet
north of the right of way, and the other is about four or five feet north of that.
Bobbie Jones questioned if the 25' easement should be measured from the
right of way line or should it be measured from the gas line.
Frank Blew stated the right of way.
Kenneth Wagner said he would check the gas company's easement and he would
let Bobbie know if it needs to be changed.
(2) James Crownover (Ozarks Electric Cooperative): He said he thought on
the original preliminary plat Ozarks Electric had requested easements on some
property lines.
Frank Blew said perhaps he had overlooked something in the minutes when
drawing up the new plat.
Mr. Crownover asked if Lots 10 and 12 would be commercial.
Frank Blew said he didn't know, but the Covenants say Lots 1-9 will be used
for single family residential or multi -family duplex dwellings, except that
lots 10, 11 and 12 may be used for commercial purposes.
Bobbie Jones said if part of the subdivision is annexed it will be in the
A-1, Agricultural District. Some lots would be large enough for a single family
dwelling in the agricultural district (2 acres - 200' wide lot) but not large
enough for duplex dwellings in the agricultural district because the requirement
is four acres for a duplex in that district. Anything under construction prior
to November 2 (the date of the election regarding annexation) will still be
allowed.

(.3) Gen. Bruce Kendall (Washington County): In answer to a question
ca from Gen. Kendall, Bobbie Jones said the original preliminary plat approval
was dated sometime in 1980, and that an extension for final plat submission
was approved on July 23, 1982 from the Planning Commission.
Gen. Kendall said originally the road was approved on the basis of giving
most of the right of way over on the developers' land, which is shown very
clearly. Originally, lots 1 and 2 were not taken care of as to the narrow
road, and now he notes there is an additional easement. He said when the
extension was submitted, the old plat still showed a narrow road at the north
end and he noted the plat now shows they have arranged to take care of lot 1
and 2 with the proper 60' easements.
Frank Blew said the original plat was an additional half a quarter to the
north and this was where the problem was, so they have simply done away with
the original lot 1 and 2 and renumbered the lots because, if they built a 60'
road to the north edge, it would have narrowed down to a 12' wide gap:
It was clarified by Gen. Kendall that lots 1 and 2 on the final plat are
not the same lots 1 and 2 which were shown on the preliminary plat and that
after submission of the preliminary plat, the developer was given the choice
of either eliminating lots 1 and 2 or obtaining additional right of way.
• Gen. Kendall noted that lots 1 and 2 on the final plat have been started at
the point where the road is the proper width. Gen. Kendall stated the letter
he has on how to build the road is different than the one the developer signs
now. He wishes to give them a new one which gives instructions, and he stated
this new letter must be signed and sent in to the County.
Mr. Blew stated the road is still gravel.
Gen. Kendall stated that, if this were the original plat coming in now,
the road would have to be hard -surfaced, since the property is in the Growth
Area. Since the plat was originally approved under old regulations, it may
continue with SB -2 gravel and is satisfactory as originally planned.
Bobbie Jones confirmed this to be true and said the Planning Commission
was advised of this when they extended the preliminary plat approval.
Frank Blew stated since the owners have land further to the north they
plan to gradually take the road further in that direction.

James Crownover specified ten feet easements on each lot inside of the
center line between lots 1 and 2, 3 and 4, 5 and 6, 7 and 8 and between lot 9
and lots 10, 11 and 12.

(4) L. 0. Ferguson (Warner Amex Cable Company): He stated the Cable
Company has a cable in the middle of that gravel road and asked Frank Blew
how soon they intend to start work.

Mr. Ferguson said they would begin work on getting their cable out as soon

Oo as possible, but was concerned about whether the work would actually take place,
OO, since it had been postponed before.
0' Frank Blew stated when his client accepts a bid and obligates himself
financially, he expects the work to begin, unless bids coming in are in excess
of what is expected, or if the annexation creates some problem.

before the meeting. He stated there is water service already available for
Lots 10, 11 and 12. He said there is a proposed extension from Highway 16
north of county road 877 which will serve the rest of the lots. He is expecting
to be getting plans on the water line. He noted the utility easements all along
the east side which would be nice for the water line, but they still allow them
to be in the road easement if it is wide enough.
(7) Roy Hawkins (Southwestern Bell Telephone Company): He was not present
but submitted comments after the meeting. He stated that everything for the
telephone company had been worked out on the preliminary plat and is okay.
(8) Bobbie Jones (Planning Administrator):
a. The final plat must show the additional easements requested.
b. She will look further into the ArkLa gas easement.
c. The State Board of Health letter must be shown on the plat as
on a certain date because this is a subdivision with a septic
