A meeting of the Plat Review Committee was held at 9:00 A.M., Thursday,
July 8, 1982, in the Directors' Room, City Administration Building,
Fayetteville, Arkansas

The Committee reviewed the
Preliminary Plat, Phase 1 and also
Phases 2 and 3 for the Winchester
Square Subdivision located on
Highway 16 West outside the city
limits. James Cramer and C. Forbes
were present to represent C F, F Surveyors.

PRELIMINARY PLAT
HIGHWAY 16 W - OUTSIDE CITY LIMITS

1. Gen. Bruce Kendall (County Planning Board). The County is more
interested in the second phase, as far as the roads are concerned, and in reducing
the number of driveway entrances on Phase 1. In view of certain problems like
drainage,location and density, there is an agreement that the streets will be
curbed and guttered and hot -mix paved. On Phase 1, the developer has agreed to
pave Winchester Road as far as necessary to provide driveway entrances. The
County approves the plat as far as the streets are concerned.
Bobbie Jones said, in regard to the driveway cut on Phase 1 where the street
comes in between Lot 1, Block 2 and Lot 5, Block 1, she is not sure that it meets
City subdivision regulation safety zone requirements. The City requires that
driveways originate forty feet from the intersection of the streets.
Clayton Powell said that, if there is no view obstruction, the requirement
could possibly be waived, but he does not have the authority to waive it. He
explained that the City measures safety zones from the right-of-way lines rather
than from the edge of pavement.
Gen. Bruce Kendall pointed out that_the subdivision was a commercial one,
that it was outside the City Limits, and that he did not think the safety zone
requirement was a critical problem.
Clayton Powell explained that the meaning of the safety zone is to have room
to maneuver the ingress and egress coming out of a lot and traffic stacking up
at the intersection of Highway 16 and coming out of the commercial lot.
Mr. Cramer, representing C $ F Surveyors, said that they could move the
driveway cut back four feet.

2. Clayton Powell (Street Superintendent): He said that he appreciates
the County's efforts in negotiating with the developer to get curbed and
guttered and paved streets, and also thinks it's a good idea to have tandem
driveways into the lot as far as access to Highway 16. He pointed out that,
d° if the tandem driveways each measure 30 feet, this makes a 60 foot opening which
is normally wider than a city street and this will allow ample space and radii
for long trucks turning.
Gen. Bruce Kendall stated that, between the contiguous area and out to the
edge, density has a lot to do with what kind of street the County would require.
Bobbie Jones stated that the plat shows joint driveways between lots,
because the Planning Commission discouraged individual driveways for every lot;
and the owner will need to obtain permits from the State Highway Department to
install them. She said that, in effect we are looking at 60 foot driveways.
Mr. Cramer said that the State requires 27 foot per lot minimum.

3. John Durham (Fire Department): Since the subdivision is not incorporated
into City Limits, he pointed out that the owner would have to contract fire
protection if that is wanted. He urged the developer to supply a water source,
and if possible, obtain some hydrants, since water brought out on a fire truck
runs out very quickly. Since the City does not have Jurisdiction as far as fire
prevention and safety standards in the construction, the owner should be aware
there is an Arkansas State Fire Code which would be applicable to any construction,
whether within City Limits or out in the County. (It is not the City's policy to
allow fire hydrants on water mains outside the City.)
g 4. James Crownover (Ozarks Electric Cooperative): Because the lots are so
Ldeep, Ozarks Electric would normally want easements where driveways are shown on
co the plat. There was further discussion between representatives of all utility
6 companies as to the location for easement lines and also as to whether some of
those lines would be installed underground or above ground.

e9 5. Roy Hawkins (Southwestern Bell Telephone Co.): Mr. Cramer said that
Phase 2 would begin when all lots are sold on the highway, in answer to a
C3 question by Mr. Hawkins.
C' 6. Kenneth WagnerWestern Gas Company): gn (Arkansas p y): There are existing gas
lines in front of the Pentecostal Church. If there is any drainage anticipated,
it should be outside of any utility easements.
7) L. 0. Ferguson (Warner Cable): Mr. Ferguson said the only problem the
Cable Company has is - if cable is to be run underground, it must be put in
before the development begins. If the cable is run overhead, it can be installed
later.

*EASEMENTS were discussed at length by all utility representatives
and the following is a list.of easements agreed upon:
1. Along Highway 16, a 25 foot easement in back of the right -of way.
2. A 25 foot easement around the outside perimeter of the entire
development (East, West and South sides).
3. 25 foot easement outside the right-of-way on both the East and West
sides of Winchester Road.
4. 25 foot easement outside the right-of-way on the East side of Henry Road.
5. 25 foot easement along East

proposed in Phase 3 must be given in a recordable instrument when the
Final Plat of Phase 1 is recorded.
9. 25 foot easement off the North side of Lots 4 and 5, Block 2, Phase 3
and Lots 1 and 2, Block 3, Phase 3.
10. 25 foot easement on the lot line between Lots 1, 2 and 3, Block 1,
Phase 2 and Lots 6 and 7, Block 2, Phase 3. Also, between Lots 1 and
2, Block 2, Phase 2 and Lots 2 and 3, Block 3, Phase 3.

8. Wally Brt (Sanitation Superintendent): When and if the development
is annexed into the City, arrangements need to be made for a pad in Phase 1,
Block 1, and negotiations can then be made for spaces and placement of
proper containers at that time.
9. Sid Noorbakhsh (Assistant City Engineer): If the lots are ever going
to be served with City water, a problem would be posed with meter reading if the
water line is across the rear of the lots. There was some discussion as to
whether a 25 foot easement would be sufficient should a water line be included
along with the other underground utilities.
In regards to the question about possible future sewer development,
Bobbie Jones stated that the City Board has a policy against permitting
connections to sewer unless the property is annexed into the City. It was
clarified .that,;at this point, the developers are not seeking annexation.
Mr. Noorbakhsh said sewer is across the road but the grade is not good for
it.
10. Bobbie Jones (Planning Administrator): In answer to a question about
sidewalk requirements, she explained that there would be no requirement unless
the development were to become annexed to the City.
Bobbie Jones said that the plat represents the preliminary on all 3 phases.
The Planning Office will require the following:
- The plat must show the name of the street, Winchester Road,
on the first sheet.
- The Code calls for a topo. Mr. Cramer said it is almost flat,
and no topo lines would show on Phase 1.
- If covenants are proposed, they must be shown on the plat; if
there are to be no covenants, it should show "none".
- A letter is required from the State Health Department before the
Final Plat is approved.
- The name of the property owner to the south of the development
must be shown on the plat.
- The Code requires notification to the adjoining property owners and
it would be sufficient if those persons would sign a copy of the plat.
- The Code specifies a minimum jog between minor street intersections,
if they do not intersect at a 4 -way intersection of 150 feet.
If this is changed, there would not be the 11 acre lot size.
The alternatives are to 1) ask the Planning Commission to waive the
minimum jog distance to allow the 41.05 foot jog, or 2) ask the
Board of Directors to waive the minimum 1i acre lot size. There
must be a request in writing for the waiver.
- In regards to the Phase 1, Final Plat, the easement can either be
on those lots or it can be split but, if it is split, there must be
an off-site easement at that time in an easement instrument that can
be recorded at the Courthouse.
- Mylars that are too dark might be rejected, but those are not required
until the submission of the final plat.

Corrections should be made and ten copies submitted no later than July 19,
for the Subdivision Committee meeting of July 23 at 1:30 P.M. Planning
Commission meeting will be July 26th at 5:00 P.M. Once the preliminary plat
is approved, then specs, profiles of water, drainage and streets can be
prepared. After those are approved, installation can begin. Final Plat
cannot be approved until the plans and specifications for the streets,
drainage and water have been approvd. The Final Plat can be approved prior
to the installation of those items with a contract or a performance bond.
With no further business, the meeting adjourned at 10:00 A.M.
