HomeMy WebLinkAbout1982-06-17 Minutes� MINUTES OF A PLAT REVIEW COMMITTEE MEETING • T- OO • • 23 eni A meeting of the Plat Review Committee was held at 9:15 A.M., Thursday, June 17, 1982, in the Director's Room, City Administration Building, c5 Fayetteville, Arkansas. UTILITY REPRESENTATIVES PRESENT: Kenneth Wagner, Floyd Hornaday, Larry Winkler, L.O. Ferguson, Dick Shaw QCITY REPRESENTATIVES PRESENT: Clayton Powell, Wally Brt, Larry Poage, C+1, Bobbie Jones, Suzanne Kennedy OTHERS PRESENT: Mike Whitehead The Committee considered the Large LARGE SCALE DEVELOPMENT Scale Development plan for Barnes BARNES CATTLE TRUCKING CO. Cattle Trucking Company located at 600 Government Avenue. Mike Whitehead was present to represent Lichlyter Construction Company. 1. Clayton Powell (Street Superintendent): There have been insurmountable problems in this lot between Barnes Cattle Trucking Company and the City in the past due to drainage which is not the fault of the City or the Street Department. The lot is two feet lower than the street and has resulted in very heated discussions and frayed tempers in the past. Now is the time to correct drainage problems, raise the floor of the new building above flooding stage and grade the lot to drain to the east into the creek. Under the rational nexus provisions of the City Code, Mr. Barnes should improve Government Avenue with curb and gutter for the full width of the property, put in driveways to meet the safety zones contained in the street specifications and widen the street from the existing center line of the right-of-way 15.5 feet to the back of the curb. The street is currently asphalt paved 22' wide. From the center line, Q have 5' of widening including curb and gutter. Mr. Powell emphasized p that the previous drainage problems and accusations towards the City were the property owner's problems. There were no questions from Mr. Whitehead. 2. Wally Brt (Sanitation Supervisor): Wally Brt said that since C3 Mr. Whitehead says there will not be much trash, commercial cans would CS be alright and he sees no problems since their needs do not warrant a container. El 5 3. Larry Poage (City Fire Department): There is a requirement for fire O extinguishers in each one of these buildings if you anticipate gas or flammable liquid storage. Larry Poage told Mr. Whitehead there would be O• special requirements if there are buried tanks. The heating in these buildings should be eight feet in the air if there is a repair shop. The same goes for hot water tanks (or they should be enclosed). The exits out of the offices in the two buildings should go out west or north. Iso • Plat Review Committee Meeting June 17, 1982 Page 2 A fire plug is close so that is no problem. Subject to fire inspections in the future. 4. Kenneth Wagner (Arkansas Western Gas Co.): Mr. Wagner said that, if gas heating is needed, service is available although the Gas Company will have to bring it across the road They show three building setbacks. The existing office building is 20 feet from the right-of-way line; the other existing building is 8 feet from the right-of-way line; the new building will be set back 25 feet from there. We will work with the plumbers when they get ready to go in. No problem to bring gas across the road. Mr. Wagner asked for a utility easement in the setback between the buildings and the right-of-way. 5. Floyd Hornaday (SWEPCO): We've got electric service on Government Avenue. He said they have single phase service available where the new building is going to be, and they will work with the electricians and contractors when they get ready. There were no questions from Mike Whitehead. 6. Dick Shaw (Southwestern Bell Telephone Company): He said that he agreed that the 25 feet setback should be turned into a utility'easement. They will need a piece of conduit out of the building for phone service, preferably 2" PVC with a pull wire, a 4x4 3/4" plywood mounted on a wall inside the building with 110 volt duplex outlet, #6 gauge wire from panel tied to your neutral. Bobbie Jones asked if the easement you are asking for is to jog around the buildings. Mr. Wagner said since there are two buildings existing, this was his intention. On the existing office building, you show 20 feet; the old warehouse you show 8 feet; your new office building 25 feet. Show the building setbacks as utility easements. Mr. Shaw said the easement will have to be written and dedicated to all utilities as a separate instrument. 7. Bobbie Jones (Planning Administrator): Bobbie Jones said when she talked to Mr. Barnes about the zoning, she did not have a legal description to work with. She had measured off the centerline of the tracks. His legal only runs to the right-of-way line. She and Mr Barnes had thought the south 100 feet of the property was zoned residential, and it looks like the south 200 feet is. He needs to get it rezoned to develop it as drawn. The right-of-way extends 50 feet south of the centerline of the tracks. He can have a building on a railroad right-of-way with the railroad's approval. Also, on this legal description, the people he purchased the property from owned another fifty feet behind it that he did not get recorded on his deed. What happened to that fifty feet? At some point, there is a note here from the abstractor that there is a part that wasn't transferred. Clayton Powell reiterated that he needed the street paving widened 15.5 feet from the right-of-way centerline. It can be done with integral curb and gutter. The contractor must submit detailed plans for the street work to the Street Department for approval. This work must then /5/ Plat Review Committee Meeting June 17, 1982 Page 3 be inspected and approved by the Street Department. Prevent water from the street draining into his lot. The obvious way to channel drainage is to the creek to the east side. Bobbie Jones told Mr. Whitehead the City needs to know that the use of the buildings will be for parking requirements. She pointed out that the site plan doesn't show where driveways and parking are and that, if curbs and gutters are built, driveways will be needed and should be up to 40 feet wide; for more than one driveway, they must be at least 25 feet apart, and at least 121 feet in from side property line. Paved parking is needed. The City needs to know exactly what different buildings are used for to determine number of spaces. If he gets I-1 zoning extended to the south he will need to have a screening fence (the site plan shows a buffer fence) along the south line where it abuts residentially zoned property. With respect to the setback of this new building and zoning, to use this 25 feet building setback he is going to need to have no parking between that building and the street and have 100 of the area between the building and the street in landscaping. If he had industrial zoning on to the south of him he would have that setback. Otherwise, there is an exception in the Code for either 50 feet setback or it can be 25 feet if there is no parking and plantings. The other setbacks look okay. He will need to keep the parking five feet in from the residentially zoned property on the south and east. A sidewalk is not required on this side of the street; future developers on the other side of the street will have to install sidewalks. Again, there is 200 feet of this property in the R-2 zone. The rest is in the I-1 zone. He needs to see about getting it rezoned. Rezoning can be considered at a Planning Commission meeting on July 12. In order to make that meeting, a rezoning petition must be in by tomorrow and signed by the owner. If the Planning Commission approves this, it goes to the City Board on July 20th. If he wants to bring the Plan and the rezoning petition in together, he should call us tomorrow. Mr. Mike Whitehead then left the meeting. 8. L. 0. Ferguson (Warner Cable Co.):. No comments 9. Don Bunn (City Engineer): Although Mr. Don Bunn was not present, he submitted the following comments after the meeting: Water and sewer service are available just west of the property on the Government Avenue property. The other item for consideration REPLAT OF BRONZE TREE was the approval of a replat of Bronze BROPHY SUBDIVISION Tree, a Planned Unit Development, which OMNI -SHELTER, INC. is a part of Lot 1, Block 5, Brophy Subdivision, at Brophy Circle and Township Road. There was no one present to represent Onmi-Shelter, Inc. Bobbie Jones explained that only two buildings have been constructed, Units 9 and 10, and that the owner intends to sell those units. Units 1-8 have not been built. She said that the owner should have to, as he builds those units, stay within the boundaries as they are marked out on the plat. rsP Plat Review Committee Meeting June 17, 1982 Page 4 She pointed out that he does not have all of the private driveways and parking area constructed, and that a contract will be needed to be entered into with the City in regards to this. This is a planned unit development (PUD); this should be indicated on the plat. 1. Clayton Powell (Street Superintendent): There is quite a file on the history of Bronze Tree Village. They have not constructed any private drives as required by PUD specifications. They have cut an opening in the curb on Township Road and built access to the buildings 9 and 10. By making the curb opening they have added to the drainage problem to the properties on the east side of College Avenue to the north of Township. Their work so far has allowed drainage to increase in volume and velocity which is supposed to be controlled by the private streets specifications. He thinks the City Code requires that all improvements be completed prior to submitting a final plat. Based on the history and length of time already spent in construction and legal ramifications of contractors and developers going bankrupt, etc., he would recommend this final plat not be accepted without a cash bond for the private PUD, street construction and drainage control, or post a performance bond to complete the work at the call of the City without any of the legal ramifications of statute of limitations; or either constructed now before the plat is filed. They will have to go back and do something to correct problems they have created by adding to the drainage problems to properties on the east side of College Avenue. Bobbie Jones pointed out that one of the original conditions of approval was that drainage was subject to be approved by the Street Superintendent and she believes that that should still stand. 2. Dick Shaw (Southwestern Bell Telephone Company): asked if the drainage would be in the road. Clayton Powell said the Planning Commission approved a request after one of the revisions for use of asphalt curbing. They have cleared the natural vegetation and hauled in fill. The City is a party of the PUD covenants to be sure. It needs to be completed. Mr.Shaw said they were to provide conduit under all parking and driveway areas. Mr. Shaw asked if Mr. Powell wanted the drainage easement listed the way it is_on the plat. Mr. Powell said no, we still don't want to start accepting combined utility and drainage easements. Mr. Powell said they would have to compare it with the complete original site plat to see where the drainage is. He will check it on the overall plat but right now he doesn't know. Bobbie Jones brought out the original plat. Clayton Powell said we should show a specific drainage easement in ways which separate from the utilities. 3. Kenneth Wagner (Arkansas Western Gas Co.): He has a utility easement shown. Agrees with Clayton Powell about separate easements, would like to see the utility easements cleared and to grade before utilities go in. Will work with the developer on putting gas lines in with the regular main extension. He requested conduit under all parking and drive areas. We have an existing line along the north side of Township Road. Buildings 9 and 10 are served outside of excavation. Our line is three feet north of the existing curb on Township Road. /S3 • • • Plat Review Committee Meeting June 17, 1982 Page 5 Bobbie Jones said that he will make a seven foot cut where the parking is shown, just north of Township; the plat doesn't show that he is going to make any cuts. Mr. Wagner said he didn't look at the original plat but when he makes the cut for the driveway the Gas Company would like a line with 4" casing. 4. Floyd Hornaday (SWEPCO): Basically, we agree with the others regarding the separate easements. In addition, they discussed at prior times along the north property line we require 4" PVC conduit extending west the width of the lot to serve buildings 1-4. They have service to buildings on the front. Dick Shaw said that, referring to the original plats, he agreed to have conduit and also conduit across the driveway and parking lots not shown on this plat and those easements need to be cleared. Mr. Powell said on the west side there is going to be a considerable amount of fill. There is about a 15% grade he is going to have to fill on that west side. 5. L.O. Ferguson (Warner Cable Co.): On the original we requested 2" PVC under the driveway and along this north.side. Agrees with the other comments, we need to know how deep it is going to be. We have got a buried cable along this east side that is not in use. 6. Wally Brt (Sanitation Superintendent): He needs a letter that he has permission to travel on any and all private drives. 7. Bobbie Jones (Planning Administrator): said the parking area shown on the south property line needs to be kept five feet in from the south property line, the title block needs to say that it is a final plat and that is is a Planned Unit Development (PUD) and it needs a date on it. Building permits may have been issued subsequent to the adoption of the Master Sidewalk Plan. If they were, the sidewalks are required along Township. If permits were issued on Buildings 9 and 10 before the Master Sidewalk Plan, it will be required when the next building permit is obtained. The upper level decks cannot project onto the utility easements. The meeting adjourned at 10:15 A.M. 8. Don Bunn (City Engineer): Although Don Bunn was not present, the following comments were submitted by him following the meeting: There are existing water lines in Brophy Circle and Township and as he understands, it comes off Brophy Circle with the water. Doesn't know yet if private water lines or City -owned lines with individual meters off it. The sewer line is in the easement on the north side of the property and it is his understanding they come off that with private sewer lines, which is good, as far as he is concerned. The easements look sufficient to him. If they are going to put a water line in that easement on the west side of the property he wants it back as far on the west side as they can get it away from the buildings. There may be private sewer lines back there - those should be out of the public right-of-way. It looks like there is sufficient room to allow them to do that. 15y
