HomeMy WebLinkAbout1982-04-08 MinutesMINUTES OF A PLAT REVIEW COMMITTEE MEETING A meeting of the Plat Review Committee was held at 9:00 A.M., Thursday, April 8, 1982, in the Board of Director's Room, City Administration Building, Fayetteville, Arkansas. UTILITY REPRESENTATIVES PRESENT: Dick Shaw, L. 0. Ferguson, Kenneth Wagner, John Kehn, Avery Auten, David Tucker, Jim Crownover, James L. Walker.. CITY REPRESENTATIVES PRESENT: Clayton Powell, Don Bunn, Cynthia Stewart, Bobbie Jones, Don Grimes. OTHERS PRESENT: Harry Vandergriff. The first item of business was the consideration of the Large Scale Development Plan for Fayetteville. High School located at 1001 Stone Street. Property is zoned P-1, Institutional District. Harry Vandergriff was present to represent. 1. Ivan Faulkner (SWEPCO): Stated he has been working with the engineers on this project and that he has no problems with the project. 2. Wally Brt (City Sanitation Superintendent): Location of waste disposal system as proposed is fine. LARGE SCALE DEVELOPMENT FAYETTEVILLE HIGH SCHOOL 1001 STONE STREET 3. Clayton Powell (City Street Superintendent): Stated that with the dedication of the 5 ft. required for Stone Street right-of-way, his requirements are met. 4. Don Bunn (City Engineer): No comment, this does not get into any water or sewer lines. 5. Ken Wagner (Arkansas Western Gas Company): Stated that Arkansas Western Gas Company personnel have been working on the site and some gas lines have been relocated. He stated everything looks fine. 6. Dick Shaw (MA BELL): Asked if phone service would be desired in the new addition. Mr. Vandergriff replied it would be. Shaw requested conduit be installed from the addition where the phone service is desired to the existing terminal in the existing building. Vandergriff said that the present phone system is obsolete and that new phone and electrical facilities will be installed, he said at that time the conduit for the phone service to the addition will be installed. 7. Bobbie Jones (City Planning Administrator): Stated her concerns were the setbacks of the structure and the parking requirements. She stated from the plan, both appear to be adequate. • Plat Review Committee Meeting April 8, 1982 Page 2 L. 0. Ferguson (Warner Cable Company): Stated that if cable television service is desired to the addition, conduit should be laid in an area accessible for service to be installed. The next item of business was the review of a proposed ordinance to amend Chapter 18 of the Fayetteville Code of Ordinances to regulate the installation of utilities in street rights-of-way. PROPOSED AMENDMENT TO THE CODE REGULATING THE INSTALLATION OF UTILITIES IN STREET RIGHTS-OF-WAY Don Grimes, City Manager, addressed those present. He stated the proposed ordinance is meant to regulate the burying of utilities to alleviate the problem of damaging utilities that are buried too shallow, when the City is trying to repair or build streets. Grimes said he would like to take the three sections of the proposed ordinance one section at a time and entertain comments. Regarding the first section; he asked if the utility companies had any problem with that portion of the proposed ordinance, there was no response. Moving on to the second section of the proposed ordinance regarding the closure of streets for a period of more than 24 hours, and theimposition of reasonable measures to minimize inconvenience or danger to the public, Mr. Grimes asked for comments. David Tucker, Southwestern Bell Telephone Company representative addressed those present, he stated he is not opposed to this section of the ordinance. a He recommended along with notification of the proper.:persons as to the closure cp of a street for utility maintenance or installation purposes that the barricading, d safety control and warning devices conform to the Uniform Traffic Control 0 Manual. Grimes stated that could be added to the end of the paragraph in Section a 2. eaGrimes said it was not the intent of the City to require the utility companies to go through a lot of red tape if all they are doing is a service CI connection. This section is for work that will require the closure of a street for a long period of time. It is necessary to notify services such as ambulance, fire and police when a particular portion of street is closed so 03 U they may plan around it. Jim Crownover, Ozarks Electric Cooperative representative, stated he has a problem with the last sentence of the Section. He stated that the City Street Department should have to comply with this ordinance also. Grimes agreed and suggested the phrase should read "This section shall not apply to emergency repairs." and delete the rest of the sentence. However, if a utility is out in the middle of the night on an emergency repair, the fire, police and ambulance services should be notified. Bobbie Jones suggested running a radio ad if time permits. Grimes asked if there would be any objection to section 2 if it were amended as follows: Add to the paragraph that barricades, safety control and warning devices will conform to the Uniform Traffic Control Manual. Delete from the end of the paragraph "or to excavations by the City Street Department for street maintenance or repair" There was no opposition. gab Plat Review Committee Meeting April 8, 1982 • Page 3 • The Committee considered Section 3 of the proposed ordinance. Clayton Powell stated this section of the ordinance was drafted due to the installation of utilities in places where a great inconvenience is created. For example; manholes have been placed in the center of drainage ditches resulting in the ditch having to be relocated around the manhole. Other problems consist of placing utilities too close to the curb resulting in the curb breaking down or turning up. The same thing basically occurs when utilities are placed on the shoulder in certain cases. He said he would rather have utilities placed in the street rather than have these things occur. Grimes said there are other problems with the location of utilities outside the street. He stated that in some cases streets are earmarked to be widened. If the utilities are located in the shoulder or outside the pavement and not buried deep enough it creates problems. David Tucker agreed that these problems are a nuisance, however, he stated that as worded, the ordinance could result in utility companies locating their utilities at a depth of 8 ft. or more. He felt the ordinance as written could cause great expense.in some cases where it wasn't necessary. Tucker felt this portion of the oridnance should be handled in a different way. He felt there were a lot of cases where utilities do not need to be buried as deep as the proposed ordinance requires. He said the ordinance needed to be more flexible so that where utilities needed to be buried deep that could be required by the City, and if it was not necessary to go that deep they would have that option. He said these situations should be looked at on a case by case basis when the permit is applied for and when circumstances warrant it, require the utilities to be buried as requirdd by the City. Jim Crownover agreed, he felt this portion of the ordinance, as written, was too restrictive. Dick Shaw suggested a meeting of City officials and the utility companies when projects are planned and discuss the relocation of utilities and the placement of services. Grimes said that used to be the procedure, but it has been phased out over the years. He felt some type of plat review committee meeting in these types of cases would be a good idea, that way City projects and utility projects could be coordinated. Jim Walker stated the City deals with 6 different utilities as well as City utilities and each one has different problems. He felt they needed to be handled on an individual basis. He felt that on projects that warrant it a drawing should be submitted with a permit application, the City would know what is planned, on the other hand, the City should let the utility companies know what's lined up down the road also. This way everyone would know everyone else's plans and it would help to alleviate break downs in communication. Clayton Powell stated this would be great with him. Tucker stated an ordinance tied to the permit on a case by case basis would not be objectionable to him. Grimes suggested the adoption of the first two sectionsof the proposed ordinance with the corrections and deletions discussed today. The utility companies and the City utilities should work together to draft some general guide lines or procedural guide lines to use. He agreed that Section 3 of the ordinance, as written, is a little restrictive. He said he would rather have some general guide lines that everyone agrees upon. 127 • • • Plat Review Committee Meeting April 8, 1982 Page 4 Grimes said that budgets have been approved for the City Street Department and for Community Development projects. He stated he would get the information available on these projects to the utility companies. There being no further business, the meeting adjourned at 10:55 A.M.
