MINUTES OF A PLAT REVIEW COMMITTEE MEETING
A meeting of the Plat Review Committee was held at 9:00 A.M., Thursday,
January 7, 1982 in the Board of Directors Room, City Administration Building,
Fayetteville, Arkansas.
UTILITY REPRESENTATIVES PRESENT:

The Plat Review Committee considered
the Preliminary Plat for Harb-Co Place
a subdivision located at the Southwest
corner of the intersection of Zion Place
and Highway 265. Property zoned
R-2, R-0 and C-1. Jim Lindsey - Owner and Developer.
Jim Lindsey and Tom Hopper were present to represent.
1 David McWethy (Assistant City Manager): Stated he would like to see both
sidewalks and street lights installed on the West side of Highway 265
adjacent to this property
2. Clayton Powell (City Street Superintendent): Stated the New Zion Road is
in place, it has been inspected and accepted by the City.
The new Zion Road has been named "Zion Road" the old Zion Road has
been renamed "Zion Place". Zion Place has a Collector designation on the
Master Street Plan. In Powell's opinion, Zion Place should be redesignated
a local street, and Zion Road should be designated a Collector Street.
Powell stated with the localstreet designation on Zion Road, sidewalks
can only be required on one side of the street.
Powell recommended sidewalks and street lights be installed by this
developer on Highway 265 for the full length of his property. Per
State..Highway Department guidelines, the sidewalks along 265 should be located
on the developer's property. A sidewalk easement will have to be dedicated
for the sidewalk. The developer will have to obtain a permit from the State
Highway Department District Engineer in Ft. Smith for the required
construction of the sidewalk.
If Zion Place retains its Collector designation, a sidewalk will
be required on the South side._i
Powell asked if the 50 ft. easement shown on the plat running across
Tract 3 and between Tracts 5 and 6 will be used for access. Hopper stated
that easement is shown for informational purposes, it is existing.
Powell stated the Planning Commission needs to address the matter
of whether or not sidewalks will be required where Zion Place makes the
90 degree turn North and then East.

3. Don Bunn (City Engineer): Asked if crossings had been installed. Lindsey
stated several water and sewer crossings are in place. Bunn stated sewer
is available on Zion Place and water is available off of Highway 265
and Zion Road.
A minimum 15 ft. easement will be required for sewer or water if they
are located in the easement alone, if other utilities are located in
es the easements, a larger easement will be required.
4. Jim Crownover (Ozarks Electric Cooperative): Asked if three phase service
will be required for the Hospital. Lindsey stated that is correct.
Crownover stated that ordinarily hospitals require service from two
sources in case one should fail. He asked that Lindsey have the hospital
get in touch with him to clarify this.
Crownover stated the nearest three phase service is located a half
mile away.
Crownover stated service cannot be located in a roadway easement.
Power will probably be brought in from the West. If Ozarks Electric
has to come from the West and use the transmission easement (50 ft.
easement across Tracts 3, 5 & 6), an additional 10 ft. of easement will be
needed on the North side of the 50 ft. transmission easement (South side of
Tract 5).
Crownover stated he would need to locate on Zion Place, he said he
• would coordinate his easement requirements with those of the other
utilities.
5. Kenneth Wagner (Arkansas Western Gas Company): Stated there is an existing
high pressure gas line on Zion Place and an intermediate gas line along
the West side of Highway 265 to the Social Services building.
Wagner stated he would also need to locate along Zion Road, he
said he would prefer to be located on the South side. He asked how
wide the road easement is. Powell stated it is paved for 31 ft. back of
curb to back of curb. Bobbie Jones stated the actual right of way easement
is 60 ft. Powell stated Zion Road is still designated as a local street
on the Master Street Plan and that he believes there is only 50 ft. of
actual designation. He felt this matter should be resolved by the Planning
Commission. Powell stated that if there are any major utilities located
North or South of ZionrRoad that he would appreciate having no cuts across
it. There are two existing drainage structures in Zion Road. He stated
that if utilities need to cross the Road, they should do so at the drainage
structures.
0 Crownover stated his service along Zion Road would probably be overhead.
Wagner stated the requested easement along the South side of Zion
Road should be 25 ft. wide.

6. L. 0 Ferguson (Warner Cable): Stated there is no cable service to this

development. He stated that hopefully, cable service will be extended to
Cg this area. He said that cable service can be located where easements are
• g' requested by the other utility companies.

7. Avery Auten (MA BELL): Stated there is cable overhead to where Zion
Road begins. Zion Road will eventually be a major feeder. He concurred
with the requested 25 ft. utility easement South of Zion Road. Auten
requested a 25 ft. utility easement North of Zion Road.
Auten asked if the 20 ft. easement between Tract 3 and Tracts 4&5
will be used for drainage. Lindsey stated the drainage will cross it only.
Lindsey stated where the drainage crosses the utility easement, he will
increase the width of the utility easement so that it can be gone around.
Auten requested a 10 ft. utility easement along the South, West
and North (South of Zion Place) boundaries of the subdivision.
Auten stated that if lots are split and the phone company does not
have access for service, he will need 15 ft. of easement which may be
split between lots.
Increase the 25 ft. utility easement West of Highway 265 to 30 ft.
8. Wally Brt (City Sanitation Superintendent): Stated that each tract will
be considered when it comes through on the Large Scale Development process.
He stated he would comment on each lot at thatetime.
9. Connie Edmonston (City Parks and Recreation Representative): Bobbie Jones
stated the only tracts that could be considered for parks contributions
would be the tracts zoned R-2 and R-0. Any tract over an acre will be
reviewed under the Large Scale Development process and parks contributions
can be discussed at that time.
Ms. Jones asked if a parks site has been considered for this area. Ms.
Edmonston stated the parks board has not decided yet.
Jones stated the exaction will probably be monetary. The fee will be
based on the maximum density of the zoning district. In an R-2 zone,
the maximum density is 24 families per acre.at $85.00 per family.
In order to develop an R-0 tract residentially, there must be an appeal
process through the Planning Commission, R-0 tracts can be considered
for parks fees at that time.
Ms. Jones stated the developer may enter into a contract with the City
whereby the parks fee will be charged at the time the tract is sold, or
at the end of 5 years. At this time, the only lots in this subdivision
that will be considered for parks fees will be tracts 2 & 3.
10. Bobbie Jones (City Planning Administrator):
A. Stated she had discussed the possibility of running this plat through
as a Preliminary and Final Plat. McCord stated it could be done if the
Planning Commission agrees.
B. Show the full right of way width for both Zion Place and Highway 265.
C. Note the acreage,
D. Add a graphic scale to the plat.
E. If there are to be no covenants, note it on the plat.
F. Notify adjoining property owners within 100 ft. and submit proof of

notification by either certified mail, return receipt requested,
or the respective property owner's signatures, before the Planning
Commission Meeting at which the plat is to be reviewed.
G. Add monuments and pins to legend.
H. The Master Sidewalk Plan calls for sidewalks along :.r.,. each side of
Zion Road, along Highway 265, and along the South side of Zion Place.
I. The Planning "Commission will have to decide if off-site improvements
are to be installed by this developer to bring Zion Place up to
City standards.
Powell interjected that he would reiterate his previous comments.
He did not feel that since'.Mr....Lindsey had constructed New Zion Road
that he should be required to do any improvement to Zion Place unless
there are further lot splits that would use Zion Place for access.
Powell felt that Zion Road, should be ,eclassified to be a Collector
Street and Zion Place should be reclassified to be a local street.
J. Street light spacing does not scale out on Zion Road. A waiver of
street light spacing will have to be sought from the Planning Commission.
There are no street lights shown on Zion Place or on Highway 265.
A waiver of the requirement that street lights be installed on these
streets will have to be obtained from the Board of Directors.
K. Reflect on the Plat that the Subdivision goes West to the 90 degree
turn of Zion Place.
L. If the Planning Commission agrees to consider this a Preliminary and
Final Plat, all certificates will have to be on the plat.
M. The next Planning Commission meeting will be held January 25, 1982.
Revisions will have to be submitted to the Office of City Planning
no later than January 18, 1982 in order to be reviewed at that time.
The meeting adjourned at 10:27 A.M.
