HomeMy WebLinkAbout1980-08-28 MinutesMINUTES OF A PLAT REVIEW COMMITTEE MEETING A meeting was held of the Plat Review Committee at 9:00, A.M., Thursday, August 28, 1980, in the Board of Directors Room, City Administration Building, Fayetteville, AR. UTILITY REPRESENTATIVES PRESENT: CITY REPRESENTATIVES PRESENT: OTHERS PRESENT: Dick Shaw, Kenneth Wagner, Dennis Burrack, L. 0. Ferguson Jim Napier, Clint Hutchins, Don Bunn, Don Osburn, Clayton Powell, Cynthia Stewart, Bobbie Jones. Richard Mayes, Jim Stephens, Rick Cowdrey, Lamar Pettus, Larry Wood. The first item for consideration was the preliminary plat of Southern Heights, Phase I, a subdivision of property located off the end of Rodgers Drive, South of Lighton Trail and North of Huntsville Street. Jim Stephens - Owner, Engineers - Cowdrey $ Associates. Property zoned R-1, Single Family Residential.District. Jim Stephens and Rick Cowdrey were present to represent. 1. Wally Brt (City Sanitation Superintendent): Telephoned in his comments to the Office of City Planning. He wondered if, where Rodgers Drive terminates, if the Developers are planning on constructing a turn around. Rick Cowdrey stated they are planning on putting in a T -section of street which will incorporate the grades of the future streets. Bobbie Jones said that a turn around must be 100 ft. long by 30 ft. wide in order to facilitate Sanitation vehicles. PRELIMINARY PLAT SOUTHERN HEIGHTS PHASE I S $ J COMPANY 2. Larry Wood (North West Arkansas Regional Planning Commission): Stated that on the Master Street Plan Rock Street is designated as a collector street which requires 60 ft. of right-of-way. Mr. Cowdrey said hehas discussed Rock Street with Clayton Powell. Clayton stated that on the Master Street Plan Rock Street is designated as a Collector Street; but that on the map he has in his office it is designated as a Local Street. Mr. Wood said that he sees no reason to extend Lighton Trail beyond Lot 1, Block 1, of this subdivision, but that a cul-de-sac or turn around is badly needed, and that the Developer should dedicate half the amount of land needed to construct a turn around. 3. Clayton Powell (City Street Superintendent): Stated that if Rock Street is constructed it will create three lots with double street frontage. Clayton stated that the construction of Rock Street would be costly and difficult due to the terrain. Clayton said that the City Plat Book shows Lighton Trail as a 30 ft. right-of-way, with,22'ft. of dedication 2/3 of the way across the Subdivision on the North side (Western Methodist Assembly). Jim Stephens said that he had searched the abstract and could find no mention of dedication for the street off his property, but that they are showing the existing 22 ft. easement North of the Subdivision. Plat Review Committee Meeting August 28, 1980 Page 2 Clayton said that he is in agreement with Larry Wood in that dedication should be made for half a cul-de-sac where Lighton Trail ends West of Lot 1, Block 1. Clayton stated he is recommending no improvements to Lighton Trail at this time, but is requesting the dedication of a 50 ft. radius for the o eventuality of some kind of turn around. Clayton stated that Rodgers Drive had only 27 ft. of dedicated right-of-way West of this Development. As additional right-of-way can't be obtained on this side of the Development, the 27 ft. will be improved with 6" of SB -2, 20 ft. of asphalt cement 2" thick, with a Bar Ditch and Underdrain, to the West end of this Development. A standard street would then be constructed in this development. Clayton stated that both Lighton and Rodgers exceed the maximum dead-end street limit, and must be waived by the Planning Commission. Bobbie Jones asked if the Developers would need a waiver on grade. Clayton stated they are within the grade requirements in Phase I. David McWethy asked if the improvement of the 27 ft. right-of-way on the existing.portion of Rodgers Drive, would include sidewalks, curb and gutter. Clayton Powell said no, that by rational nexus, this developer should not have to bear the cost of building Rodgers Drive. McWethy felt there should be a sidewalk on Rodgers, and that Rodgers should be wider than 27 ft. Clayton said that he did not want the width of the street pavement reduced below 20 ft. He said that if sidewalks are installed, they will take up four ft. and that would leave only 3 ft. for a bar ditch, unless the City is willing to go through condemnation to acquire the additional right of -way.. McWethy asked according to the Master Sidewalk Plan, which side of Rodgers sidewalks are required on. The Master Sidewalk Plan had a heavy red line on Rodgers Drive indicating the preparer of that plan had shifted the Collector Street (Rock) up to Rodgers Drive. McWethy said the Master Sidewalk Plan needs to be amended on this. Larry Wood said that if a sidewalk is constructed on Rodgers, there will be no sidewalk to tie it to. The closest sidewalk will be at the corner of Spring Street and Fletcher Avenue. Bobbie Jones asked Clayton about the intersection where Southern Heights Place makes a Y with Rodgers Drive. Clayton said a local street is in keeping with the street design reducing speeds in a residential development. He stated he prefers this type of treatment to off -set intersections. He thought the design was esthetically pleasing. A tee turn around, which will be part of the proposed Rock Street, will be constructed at the Southern end of Rodgers Drive. On the future development phases they show a connection to 5th Street. The 5th Street stub is dedicated, but has never been constructed. It is currently being used as a driveway. I am in agreement with making that street connection in the future. 4. Don Bunn (City Engineer): Rick Cowdrey stated that he had asked Rick Mason, Community Development Director about the proposed sewer line that is to be built to the top of the hill, and perhaps contributing a share of the construction costs of the line, but.Rick Mason could give him no time table on the proposed line. Don Bunn stated that the Developers will be served water from the existing high pressure system. Sewer will be served off of Huntsville Street which will tie in at 5th Street. • Plat Review Committee Meeting August 28, 1980 Page 3 5. Dick Shaw (Southwestern Bell Telephone Company): Stated that the 25 ft. utility easement drawn around the perimeter of the subdivision is fine. He asked that the 25 ft. building setback be designated a 25 ft. setback and utility easement. He said he was requesting this because on lots this large, it is hard to tell where the house will be built on the lot, this way, he can be sure of getting service in. Shaw stated that easements used will be cleared to final grade of all trees, brush, etc. He said that where the building line is setback 50 ft. that 25 ft. of that designated utility easement will be sufficient. Jim Stephens stated that he would like to preserve as many trees as possible. Shaw said any easements that are not used after establishment of subdivision can be closed. L. 0. Ferguson stated that some of the trees could be saved if the developers would go to overhead service. Mr. Stephens stated he would prefer underground.service. Shaw stated that the Developer will be required to furnish conduit where the cable will be run under the street, but that can be worked out later. Shaw requested that the Developers contact the phone company at least 90 days prior to the time they wish to lay the cable, as that amount of lead time is needed in which to order.it. 6. Dennis Burrack (SWEPCO): Stated that due to the steepness of the terrain and the amount of rock involved in putting in ditch, the Developer will reimburse SWEPCO for any amount incurred over 40¢ per foot of ditch installed. If utilities are in the ditch jointly, they will also reimburse SWEPCO, but any difference will be charged to the Developer. Burrack asked when the Developers plan to start future phases. Jim Stephens stated that he has no plans at this time. Burrack stated there are two points from which service can be run, one coming down Lighton and one line coming down Rodgers, and, also, one coming off Huntsville and running up one side of Sherman. Burrack stated he would need the following additional easements: 1. 12 and 1/2 feet off each side of Lot 4 and 5, Block 2, for a total of 25 ft. of utility easement. 2. 25 ft. easement centered on lot lines between Lot 10 and Lot 11, Block 1; and between Lot 14 and Lots 10 $ 11, Block 1. Burrack said the subdivision would be served with loop type feed. 7. Kenneth Wagner (Arkansas Western Gas): Delete utility easement North of Block 1. 25 ft. utility easement on the West side of Lot 1, Block 1. Wagner stated the subdivision will probably be served from Rodgers Drive, but it would be difficult getting service in. He said the only other alternative would be coming off of 5th and Sherman, which would be costlier. Wagner stated that if he is in a ditch by himself with no other utilities, he can get by with a 10 ft. easement on either side of Rodgers Drive. Plat Review Committee Meeting • August 28, 1980 Page 4 8. L. 0. Ferguson (Warner Cable): Stated that he would require 2" pvc where the cable will be laid under the street. 9. Bobbie Jones (City Planning Administrator): A. Note on plat that Rock Street is a 60 ft. right-of-way, designated Collector Street on the Master Street Plan, unless the Master Street Plan is amended. B . Note on plat that the proposed use is Single-family residential. C. Note names of Owner and Developer on plat. D . Confirm that lots on the cul-de-sac, back of the street right-of-way have 70 ft. of frontage, at the 25 ft. setback line. E . Note on plat that off-site improvements are planned for Rodgers Drive. F. Furnish proof of notification of adjoining property owners. G . Planning Commission will have to waive the maximum length of a dead end street, and waive street light spacing in one instance. H. In order to go to the Planning Commission September 8, 1980, revisions must be submitted to the Office of City Planning no later than morning, September 2, 1980. I. Furnish 10 copies of revised drawings to the Office of City Planning for distribution to the Planning Commission members. Rick Cowdrey asked about the vacation of Lighton Trail Bobbie Jones stated that would have to be done by Jim Stephens, as well as the other property owners on the North side of Lighton Trail The next item for consideration FINAL PLAT was the final plat of Mayes Oakwood MAYES OAKWOOD SUBDIVISION Subdivision, submitted by Richard RICHARD MAYES Mayes. The property is located North of Highway 16 and Northwest of Highway 71 by-pass. Richard Mayes was present to represent. There was no comment from the following utility companies and representatives: James Crownover - Ozarks Electric Cooperative. Dick Shaw - Southwestern Bell Telephone Company. Kenneth Wagner - Arkansas Western Gas Company L. 0: Ferguson - Warner Cable. Larry Wood - North West Regional Planning. • • Plat Review Committee Meeting August 28, 1980 Page 5 1. Clayton Powell is outside the specifications. (City Street Superintendent): Stated that since this subdivision City's growth area, all streets will be as per county 2. Don Bunn (City Engineer): Asked if the water and sewer line profiles were compiled by an Engineer. Mr. Mayes replied they were drawn by Gary Carnahan. 3. Bobbie Jones (City Planning Administrator). A. When this plat was at the preliminary plat level, the Planning Commission required that hard surface road be constructed for two miles from the intersection of North/South and East/West Salem Road west to and including Mayes Oakwood Subdivision. An agreement was signed in which Mr. Mayes agreed to pay up to $20,000.00 for the application of double chip and oil seal on above mentioned road. Mr. Mayes stated that construction had not yet begun on his portion of street, but that paving had begun on Salem Road. He stated that the only thing holding up the paving of the road was the obtaining of right- of-way. Bobbie asked if any of the interior roads had been paved, and Mr. Mayes replied that all of the streets would be done at the same time. B. Bobbie stated she would check the legal description of the perimeter of • the development and see if the lots add up to the total perimeter. • C. Make final plat application and pay fee. The next item of business was the concurrent replat for property located Northeast of Huntsville Road, Northwest of Barton Avenue and South of Walker Street. Lamar Pettus was present to represent He stated that this piece of property is already platted as Northwood Subdivision. He said that the lots as they are now, are run diagonally and houses do not sit on any given lot. Dick Shaw asked that if anything is developed on this tract, if it will have to come back before plat review. Bobbie Jones stated they would not have to if the piece of property remains less than one acre. 1. Clayton Powell (City Street Superintendent): Stated that the Owner must dedicate 25 ft. from the centerline of Huntsville Road, 25 ft. for Walker Street and 25 ft. for Barton. Clayton stated that if duplexes are planned for the remaining property, the Developer should be required to improve Barton and Walker Streets. He said that if this replat is approved, control will be lost of requiring the Developer to do these improvements. Lamar stated he would be willing to covenant to the City that he will not build apartments or duplexes without constructing off-site improvements. CONCURRENT REPLAT WESTON ROGERS REPLAT OF PART OF NORWOOD 2ND Plat Review Committee Meeting August 28, 1980 Page 6 2. Larry Wood (North West Regional Planning Commission): Stated that another name should be found'for the Subdivision rather than Norwood II. He stated that the plat should show that this is a replat. 3. Dick Shaw (Southwestern Bell Telephone): Requested a 25 ft. utility easement behind the dedicated street right-of-way. He said it should be dedicated as utility easement and building setback and should be dedicated along all three streets. (Walker, Barton, Huntsville). 4. Kenneth Wagner (Arkansas Western Gas Company): Stated that should apartments or duplexes be built, the gas company will install line, meter loops, etc., for a set price. Requested a 25 ft. utility easement along the North property line. 5. Bobbie Jones (City Planning Administrator): Bobbie asked the utility and city representatives if there was any objection to the vacation of an irregularly shaped alley North of the house in the Southeast corner of the subdivision. There were no objections. A. Plat should be identified as a Preliminary and Concurrent Replat. B. Name should include "replat of Block 1, Norwood Addition. C. Plat will show lot numbers. D. Check legal description against total footage of lots. Ms. Jones doubted that the lots shown could add up to the total. E. House in Southeast corner does not meet setback requirements. F. Obtain a copy of the latest subdivision regulations and include all requirements for preliminary and concurrent plats. Art. 2, Section F. G. Waiver of topo requirements will have to be granted by the Planning Commission. H. Contact and notify adjoining property owners within 100 ft. of the subdivision. I. Plat will include the following: 1. Name and address of Owner, Developer, Engineer and Surveyor. 2. Subdivision Name. 3. Graphic Scale. 4. Date. 5. Acreage. 6. In order for this subdivision to go before the Planning Commission at its September 8, 1980 meeting, revisions will have to be submitted Plat Review Committee Meeting • August 28, 1980 Page 7 to the Office of City Planning the morning of September 2, 1980, as City offices will be closed September 1, 1980. 7. Show any existing street lights. 8. Reference sidewalks. 9. Bill of Assurance should be worded to cover any off-site improvements such as street widening, paving, curb and gutter, street lights, sidewalks or any other improvements that would normally be handled on a Large Scale Development. Shed on West property line does not meet required setbacks. K. Easement along Barton Avenue should be made subject to the legal encroachment of the existing house for the life of that house. • •
