HomeMy WebLinkAbout1980-07-31 MinutesMINUTES OF A PLAT REVIEW COMMITTEE MEETING A meeting was held of the Plat Review Committee at 9:00 A.M., Thursday, July 31, 1980, in the Board of Directors Room, City Administration Building, Fayetteville, Arkansas UTILITY REPRESENTATIVES PRESENT: CITY REPRESENTATIVES PRESENT: OTHERS PRESENT: Dick Shaw, Kenneth Wagner, Dennis Burrack. Cynthia Stewart, Bobbie Jones, Larry Poage, Don Bunn, Wally Brt, Al Rukgaber, Don Bunn. Harry Gray, Ross Fefercorn. The first item of business was the Final Plat of Phase I of Bronze Tree Village, a Planned Unit Development, located North of Township Road and East of Highway 71 North, Ralph Brophy - Owner, Ross Fefercorn and Thomas Prokasky - Developers. Ross Fefercorn was present to represent. 1. Dick Shaw (Ma Bell): Requested that the Certificate of Dedication be checked to see if "Public Utilities" includes the phone company and SWEPCO or should it just say "utilities". He feared because they are privately owned, they might be restricted from the easements. Requested that 40 ft. of 4" steel pipe be laid for phone lines across the drive entering the development from Township Road. Requested that 135 ft. of 4" steel pipe be laid for phone lines in the easement on the North side of Block 5A, the whole length of the easement. FINAL PLAT - PHASE I BRONZE TREE VILLAGE PLANNED UNIT DEVELOPMENT 2. Kenneth Wagner (Arkansas Western Gas Company) Stated there is a 2" line on the North side of Township Road, immediately behind the curb. He requested that the Gas Company be notified before any digging is done. He stated the existing easements shown on the plat would be sufficient. 3. Dennis Burrack (SWEPCO). Service will be underground. The existing pole at the corner of Brophy and Township will be used as the "dip" pole and service will dip underground at that point, back into the utility easement to the North. He stated he would need two 150 ft. steel pipes, 4" diameter, laid, by the Developer from the middle of the easement at the front of the Development to the middle of the easement at the back of Phase I. The pad and transformer will be placed in the Northeast corner of Phase I. Phase I will be served from a radius type feed. If future phases are developed, service will be from a loop type feed. Part of the contract that the Developer will enter into with SWEPCO will require that all easements will have to be cleared to final grade by the Developer before SWEPCO will install service. 4. Don Bunn (City Engineer): Sewer service will be from an existing 6" sewer line which is located in the building setback and utility easement along the North side of Township Road Plat Review Committee Meeting July 31, 1980 Page 2 Water service will come from an existing line on the West side of Brophy Circle. Bunn said that water service is available, and that he would work with the Developer in deciding how to run it. 5. Larry Poage (City Fire Department): Wondered how many accesses the Development would have. Mr. Fefercorn stated that when all phases are completed, the Development will have three entrance/exits. He asked if there was a hydrant within 1000 ft. and Mr. Fefercorn stated there was. 6. Al Rukgaber (City Street Department Representative).: Bobbie Jones stated that internal streets within the Development are required to be built to City Standards except for width and the omission of curbs and gutters. Mr. Fefercorn stated that all City Traffic Control Laws would be enforced within the Development. Al Rukgaber said that there had been some drainage problems in this area. Mainly, the drainage easement which constitutes the North line of Phase I. He stated that the Developer would have to be very careful about how water is diverted onto the abutting property. The City Street Department has had some past complaints on this. Al asked if Mr. Fefercorn was going to submit a drainage site plan to the Street Superintendent. Fefercorn asked if it would be alright to submit a drawing showing contours in lieu of a -profile. Mr. Rukgaber stated that a storm drainage system, approved by the City Street Superintendent is required by ordinance. He said there were two areas in which he was concerned, the North boundary line of Phase I, and the West property line, separating Brophy's Subdivision from private property. (No plans for street or drainage have been submitted to the Street Department for approval as yet.) 7. Wally Brt (City Sanitation Superintendent): Wally said he needed written permission to travel the private streets within the Development, and, also, stating that the Sanitation Department is not responsible for any damage their Sanitation Trucks might cause. Wally asked if the streets would be at an angle or crowned. Fefercorn said that the streets would be pretty flat with about a 5% grade, and no more than a 10% grade going up Brophy Circle. They would be crowned. Fefercorn stated that he would like to install his container on a temporary pad, so that when Phase II is completed, the container will be located to serve both phases. He asked if railroad ties would be alright. Wally said that was fine. Bobbie Jones asked Wally Brt to note that the entrance had been moved from its location on the preliminary plat. Wally noted the change and stated there was no problem. Fefercorn stated he had moved the entrance to a lower grade for better accessibility. 8. Bobbie Jones (City Planning Administrator): A. Designate in the title block of the plat that this is Phase I. • B. State in the title that this is a replat of part of Lot 1, Block 5, A Plat Review Committee Meeting • July 31, 1980 Page 3 • • Brophy's Subdivision. State that this is a replat in the legal description also The legal description must also have a full metes and bounds description called from the Quarter -Section corner. C. Under surveyor, change spelling to Kemp. D . Add to the note on variances, that Planning Commission. E . they have been approved by the Fayetteville Item 4, under variances, can be deleted as long as it is clearly designated on the plat. F. Correct spelling of "true" in the first line of the Certificate of Survey. G . Ms. Jones will check with the City Attorney as to the wording in the Certificate of Dedication, whether it should say "public utilities" or just "utilities". H . In addition to the graphic scale, a scale will be noted on the Plat that states 1" = 30'. I. One copy of the final plat, drawn to 1:100 scale will be provided, as the plat is not drawn to that scale. J . Existing Major streets will be designated on the Plat. (Township will be noted as an "Arterial Street on the Fayetteville Master Street Plan".) K . A bond will be posted, or a contract entered into with the City, to insure that streets are constructed to City Standards. If a Contract is entered into, the building on the lot to which the contract applies, cannot be occupied until that lot is released from the Contract. Mr. Fefercorn stated they preferred a Contract. L. Ordinance #2647, states that, based on 'rational nexus, development other than single family, requires streets adjacent to be brought up to City Standards; curbs, gutters, sidewalks, etc. This would require a sidewalk along Township Road unless waived. M. A point of beginning for each structure will be designated on the plat. N . Before the Final Plat of Bronze Tree Village will be submitted to the Planning Commission for approval, Clayton Powell, City Street Superintendent, must approve, in writing, the street and drainage profiles for the PUD. O . The easements designated as drainage and utility easements will be separated in some way, so that when the drainage is cleaned out, the utilities are not damaged. Plat Review Committee Meeting • July 31, 1980 Page 4 • • The last item for discussion was the Large Scale Development Plan submitted by Northwest Engineers, Inc. for John Maguire. Located at the Southwest corner of the intersection of Highway 265 and Highway 45. John Maguire - Owner, Northwest Engineers - Developers. Harry Gray was present to represent. LARGE SCALE DEVELOPMENT JOHN MAGUIRE CONVENIENCE STORE 1. Wally Brt - (City Sanitation Superintendent): Since the property abuts a State Highway, driveway permits will have to be obtained from the State Highway Department. Developer will dedicate additional right-of-way to bring the Highway up to an 80 ft. right-of-way. Dedication will have to be filed and recorded as a separate instrument. Harry Gray stated that the Highway Department right-of-way cuts into an existing high pressure gas line easement. Don Bunn stated that in that case the Highway Department would have to relocate the gas line, if they utilized that right-of-way because it was a prior easement. Harry Gray said there was no problem with the dedication of the additional right-of-way, other than it being subject to the existing gas line easement. Wally stated that the Developer would provide properdrainage, rather than dumping' it out the driveways on to the highways. Wally stated there was no problem with Sanitation Service, the site will be served off of Highway 265. 2. Larry Poage (City Fire Department): Asked what type of driveway Mr. Gray planned on installing. Gray replied that it would probably be blacktop. Larry Poage stated that underground gas tanks would be buried with 3 ft. of earth, 18 inches of well tamped earth and either 6 inches of reinforced concrete or 8 inches of asphalt Placement of the underground tanks must be designated on the plat. Larry Poage stated there must be no parking within 10 ft. of the entrance to the proposed store. 3. Don Bunn (City Engineer): Stated there was an existing water line on the East side of Highway 265, and also, on the North side of Highway 45. He asked Mr. Gray what size water lines he preferred. Mr. Gray replied 3/4". Bunn said either way the site is served, water will have to be run across the Highway. As far as sewer service, there is no gravity service available. He stated that service would have to be by pressure line. There is a pressure line East of Crossover Road. The Developer will have to install some type of pump station. They have not yet decided whether to have an individual grinder -pump, or a lift station to serve the whole area. Don Bunn stated he would work with the Developer and assign easements when the problem of the lift station is resolved, then advise Bobbie Jones, City Planning Administrator. Dick Shaw (Southwestern Bell Telephone Company): Stated that he would require a 25 ft. easement along the North property line, where the property abuts Highway 45. Also, a 15 ft easement along the West property line. Shaw stated there is an 8 ft. easement held by "Ma Bell"; in that easement four ft. South of the property line, there is an intercity toll cable. The Developer is to contact the Phone Company before digging in that area. Easements will be filed and recorded as separate instruments. Mr. Shaw requested the property owner's permission to place telephone cable in the easement presently owned by the Gas Company. S. Kenneth Wagner (Arkansas Western Gas Company): Stated the Gas Company would require a thirty foot easement West of the right-of-way of Highway 265. Wagner stated this should be in addition to the 40 ft easementtfor street purposes West of the Highway centerline.• Wagner stated that according to the drawing, the existing gas lines will be only 3 to 4 ft. from the underground gas tanks and island canopy. He stated that there must be at least a ten foot separation between the pump island and the gas lines. Mr. Gray stated there was no problem. There was some discussion over the high pressure gas line easement location. Mr. Gray felt that the easement was incorrectly drawn on the plat. He stated he would double check the location, and. Mr. Wagner stated he would also check the location. Mr. Wagner said there is a 10" line and an 8" line in the 30 ft. easement. They each have over 400 lbs. pressure on them. One should be centered in the easement and one near the West side of the easement. Wagner agreed with Dick Shaw's requests for easement on the North and West. 6. Dennis Burrack (SWEPCO): Stated there is an electric pole in the South corner of the property He said there was also service on the East side of the property, and also, a three-phase line on the North side of the property. He stated it would be the Developer's perogative which type of service he would prefer.(underground or overhead). Burrack asked the Developer to contact his office when he is ready to decide which type of service he desires. 7. Bobbie Jones (City Planning Administrator): A. 40 ft. of dedicated right-of-way is required from the existing centerline for street and utility purposes, unless waived by the Planning Commission and the Board of Directors. B. Separate building permits will be required for each structure, the pump island, each tank and the canopy. Harry Gray asked if he would need a building permit for the attendant building. Bobbie Jones said she would check on how her office handled a recent one for Dandy Oil Company on Township Road C. Check and confirm the location of the 30 ft. gas easement. D. State Board of Health, Sanitarian Department, approval is required for the food service plans and State Board of Health, Building Safety Department approval is required before a building permit will be issued. If the building cost exceeds $50,000.00, a paragraph will be required on each page of the plans in addition to an Arkansas Registered Engineer or Architect seal and signature. F. State Department of Energy _certification to be furnished on the plans. G . One parking space 12 ft. wide will be required for the handicapped. H . A ramp will be required for the handicapped. I. Sufficient parking is shown on the drawing for the immediate development, however, any future development will require more parking than is shown as future parking. J . Property owners to the West and to the South will have to be notified by the Developer before the LSD is submitted to the Subdivision Committee. K . Screening will be required on the West property line unless waived by the Planning Commission. L. Any landscaping on the corner of the intersection of the two highways can not exceed 30 inches in height. M. The sidewalk required on the East will extend to the South property line. Mr. Gray asked if this could be extended when the future building is built. Bobbie Jones said that if the Planning Commission approved it that way. The same applies to the sidewalk along Highway 45. N . An "as built" plot plan will be submitted to the Office of City Planning showing each individual utility connection to the building, parking lot paving and striping, this must be provided by the time the building is ready to be occupied. 0. Future development may have to go back through the review process. Additions to the LSD can be approved by the Planning Office if: 1. No more than 10 thousand square feet is added to the development. 2. No more than 25 additional parking spaces are required. 3. No new driveways or accesses are being installed. P. A sign permit will be required for any sign. All signs must be permanently affixed. The meeting adjourned at 12:05 P.M.
