MINUTES OF A PLAT REVIEW COMMITTEE MEETING
A meeting of the Plat Review Committee was held June 12, 1980, in the Board of
Directors Room, City Administration Building, Fayetteville, Arkansas.
CITY REPRESENTATIVES PRESENT: Bobbie Jones,Cynthia Stewart, Clayton Powell,
Clint Hutchins, Larry Poage, Don Bunn.
UTILITY REPRESENTATIVES PRESENT: Dennis Burrack, Floyd Hornaday, Kenneth Wagner.
OTHERS PRESENT: A. D. Woodward, Glenn Woodward, Buel Curtis, Melvin Milholland,
George Faucette Jr., John Faucette.
The first item for consideration was the LARGE SCALE DEVELOPMENT
Large Scale Development submitted by A. D. WOODWARD
A. D. Woodward, for a retail parts store 1513 WEST SIXTH STREET
at Hwy. 62 West and Arbuckle Lane. A. D. Woodward
and Glenn Woodward were present to represent.
1. Clayton Powell (City Street Superintendent): Stated that Arbuckle Lane has an
existing, dedicated 35 ft. right-of-way which needs to be increased to a 50 ft.
,.right-of-way. The City will request an additional 7.5 ft. of right-of-way off
the West side of this property. Mr. Powell recommended that Arbuckle Lane be
improved from its existing gravel: He felt that the developers of The Parts Store
should participate in bringing Arbuckle up to City Standards; including curb,
gutter and sidewalk, and that a bill of assurance or a cash bond should be posted.
Clayton also recommended that The Parts Store put in a sidewalk along Hwy. 62.
2. Clint Hutchins (City Police Department): No comment.
3. Larry Poage (City Fire Department): Stated that there should be no parking within
10 ft. of the building entrance or exit. Also, according to the square footage
of the building, there should be 2 fire extinguishers.
4. Don Bunn (City Water and Sewer Superintendent): Asked if Mr. Woodward had been
approached about an easement for the relocation of the City Water Line. Mr.
Woodward had not. Don Bunn stated that he would check and see how large of an
easement would be required for water and sewer. He stated that water was
available off of Hwy. 62 and sewer was available at the Southwest corner of the
lot. The sewer comes from the West and dead -ends there.
Bunn asked Woodward what he planned to do with the East side of the property.
Mr. Woodward said that nothing would be done with the property at this time, but that
it may be used for storage in the future. Don Bunn stated that there would be
main extension fees based on the square footage of the property. He said that
the main extension fee plus the tap would be $550.00 for water, and that the main
extension fee plus the tap would be $770.00 for sewer. He said that if a new
business other than The Parts Store was opened on the East side of the property, that
there would be a separate main extension fee. But if The Parts Store was expanded,
there would not be another main extension fee.
5. Kenneth Wagner (Arkansas Western Gas Co.): Stated that the Gas Company was in the
process of moving all gas lines and that the Gas Company would request a 25 ft.
easement along the South side of Hwy. 62 right-of-way. Gas service is available

on the West side of the property. Wagner asked if the parking area would be
blacktop. Woodward replied that it probably would be. He said that if The
Parts Store planned on having the gas meter at the building, he would
strongly recommend running the gas service line through a PVC casing. Then,
if a leak developed, it could be repaired without tearing up the whole gas
line.
Don Bunn stated that the water and sewer may have to be in the
same easement as the Gas Company.
6. Floyd Hornaday (SWEPCO): Stated that SWEPCO has existing electrical service
on the West side of Arbuckle Lane. He asked if Mr. Woodward had given any
thought to what kind of service he desired (underground or overhead). Mr.
Woodward said that he would prefer underground service. Hornaday stated that
in that case, Mr. Woodward would be required to furnish service cable from the
building (meter) out to SWEPCO's power line. Mr. Hornaday stated that the pole
would most likely be set on the East side of Arbuckle Lane. Mr. Hornaday
asked if Mr. Woodward required 200 amp single phase service, Mr. Woodward
said that would be sufficient: Mr. Woodward asked if he could put the meter
on SWEPCO's pole. Mr. Hornaday replied that he could not. Mr. Hornaday
said the meter could be mounted near the pole on angle iron. Mr. Woodward
said if the meter had to be on the building that he could not see running it
underground. Mr. Woodward told Mr. Hornaday that he would need the service
on the East side of the building. Mr. Hornaday said that the service could not
come over the building, therefore, he would have to set another pole to put the
meter on the East side of the building. Mr. Woodward said he may have to
change his wiring set up.
7. Bobbie Jones (City Planning Administrator): Asked what the existing concrete
building was going to be used for. Mr. Woodward said that at this time the
building did not have a roof, only joists, but that if it was used, it would
be for storage. Ms. Jones said that if someone used the building in the
future, or if Mr. Woodward decided to lease the building to someone else, that
the use of the building would have to be cleared through City Planning, and
parking would have to be provided.
a. The 50 ft. setback must be from the roof overhang.
b. The Planning Commission may require sidewalks along Highway 62. Mr.
Woodward said that it was his understanding that the State would be
putting in sidewalks along Highway 62.
c. The Planning Commission may require some improvements to Arbuckle Lane
based on benefit derived or improvements required due to development
of the property abutting it.(Rational Nexus). She said that if the
Planning Commission did not require improvement of Arbuckle Lane
immediately, that a cash bond for the estimated cost of Mr. Woodward's
share of the improvements would have to be deposited with the City to be
deposited in an interest-bearing, escrow account. At the end of five
(S) years, if the work has not been performed, the Planning Commission has
to hold a public hearing to determine whether to return the money with
interest to Mr. Woodward; to use it for some other purpose that would

benefit the area around the site, or hold it a little longer to see if
improvements are still needed. When hardship is shown, the Planning
Commission can also waive any requirements.
d. Mr. Woodward is required to notify the property owner to the East because
they have a common boundary with the Woodward property, and a different
zoning district.
e. Upon completion of the project, Mr. Woodward is required to furnish the
Office of City Planning an "as built plot plan". The as built plot plan
will show any changes made to the drawing submitted to the Plat Review,
paved parking areas, where utility services enter into the building, any
signs, and utility easements, and any utility lines that cross the property.
f. 20 parking spaces are required. On the drawing there is a parking space
within the 10 ft. setback required from a street intersection, which
would have to be either backed up or moved. Any shrubbery within this
10 ft. area must not exceed 30 inches in height.
g.
The parking area must be sealed with at least a double chip and oil seal,
or paving. Each parking space will be marked off, and curbing or wheel
stops will be placed around the parking area so that parked cars do not
get outside the parking area.
h. Asked what kind of trash service Mr. Woodward perferred. Mr. Woodward
said that he was using cans and that he would like to continue to do so.
i. Ms. Jones would need to check Planning Office records to see if the lot
split was processed.
8. Dick Shaw (Southwestern Bell Telephone Company): Gave his comments by phone.
a. 25 ft. utility easement along Highway 62 West.
b. 15 ft. utility easement along West boundary of property.
Utility easements will have to be filed and recorded at the Court House as
separate instruments, with a copy furnished to the Phone Company
c. Furnish conduit (2" PVC) for running phone lines. Contact Phone Company
when service is desired.
Bobbie Jones added that unless the Planning Commission and the Board of Directors
waive the 7.5 easement along Hwy. 62, it will also have to be filed and recorded as a
separate instrument at the Court House.
Bobbie Jones stated that all revisions and easements would have to be added to the
drawings for the Large Scale Development and turned into the Office of City
Planning by Monday, June 16, 1980, in order to come before the Subdivision Committee and
the Planning Commission at their next meetings on June 23, 1980.
Ms. Jones told Mr. Woodward that the address of The Parts Store would be 1513
West Sixth Street.

The next item for eonsideration was the
Large Scale Development Plan for the
First Pentecostal Church of Christ, to be located
on Morningside Drive, North of Hwy. 16 East and
South of Huntsville Road. Submitted by Buel Curtis.
Melvin Milholland and Buel Curtis were present to represent.

LARGE SCALE DEVELOPMENT
MORNINGSIDE DRIVE
1. Clayton Powell (City Street Superintendent): Stated that Morningside Drive
requires 60 ft. of right-of-way, or 30 ft. from the centerline West. He said
the property owners to the North on Morningside Drive have participated with the
City in getting the street upgraded on the left side with monolithic curb, gutter
and sidewalk. He said the borrow ditch should be storm drained, with curb and
gutter and monolithic sidewalk built across the front of this property. He said
the monolithic curb, gutter and sidewalk should be off set to line up with the
existing monolithic curb, gutter and sidewalk, to the North. The City of
Fayetteville will participate in this improvement if it is imposed, and would
pave between the existing pavement and the new curb and gutter line. He said
there should be a drop inlet contained on the property to collect drainage,
rather than emptying it out the driveways onto the street surface.
Powell said the driveway should be 12-1/2 ft. from the adjoining property
line, and that it could be 40 ft. wide.
Melvin Milholland stated that it was his understanding that 40 ft. had
already been dedicated on the other side of Morningside Drive and wondered if the
30 ft. dedication was necessary in this case. Mr. Powell stated that he would
rather have a survey to determine the centerline and how much of the 60 ft.
right-of-way would come off of the Church's property. Clayton said that he
wanted a consistent right-of-way with no jogs.
2. Dick Shaw (Southwestern Bell Telephone): The 25 ft building setback along
Morningside Drive should be retained as a utility easement. The Telephone
Company requires a 15 ft. easement all along the North property line for
utility easement. Both utility easements must be filed and recorded at the
County Court House as separate instruments with a copy furnished to the
Telephone Company. Contractor to furnish Telephone Company with conduit (2" PVC)
for running their lines. The Church shall contact the Phone Company when they
are ready for service, and the Phone Company will work with the Church.
3. Clint Hutchins (Fayetteville Police Department): No comment.
4. Larry Poage (City Fire Department): Stated that there should not be any parking
within 10 ft. of an entrance or exit. Three 10-1b. ABC fire extinguishers will
be required.
5. Don Bunn (City Water and Sewer Superintendent): Asked if there were any plans
for the back part of the property. Mr. Curtis said that there were no plans for
the property.
Bunn stated that the only sewer available was an existing Community
Development sewer, and that a service line could be run from it. He said that if
Mr. Curtis had any plans for selling off the back part of the tract, that he would
have to provide sewer to all of the property, either by an easement, or by
running a main near it.
He said there was an existing 24" water main across Morningside Drive. He

said there would be main extension fees of $200.00 for water and $300.00 for
sewer, plus a $50.00 tap for sewer and a $95.00 tap for water. He stated that
the main extension and tapping fees would be going up, probably within the
year.
George Faucette, Jr., stated that a Community Development Sewer had just
been installed to the West and that it was a 6" line.
6. Kenneth Wagner (Arkansas Western Gas Company): Stated that there was not an
existing gas line in the immediate area. He said the gas line ended at a rock
house approximately 200 ft. North of the proposed site. Wagner stated that he
would withhold comment (cost, etc.) until it could be determined how far the
line would have to be run. He stated that he would also like to have the same
easement requested by Dick Shaw of the Phone Company to be retained as
utility easement.
Mr. Wagner stated that if the Church preferred the meter attached to the
building, that he would request the gas line to be put in a 2" PVC casing.
George Faucette, Jr. asked how much time would be required to get gas
service to the site. Mr. Wagner replied that it would run about 60 days, but
that he would have to talk to Frank Kelly about running the line across his
property from where the gas line ends at the house
7. Floyd Hornaday (SWEPCO): Stated that there was existing electrical service
on the West side of Morningside Drive. He stated that he would like a utility
easement as mentioned by Dick Shaw along the North boundary. He stated that
underground or overhead service could be provided depending on which type the
Church desired.
Mr. Milholland inquired about putting a transformer pad near the
telephone line. Mr. Hornaday said that would depend on the load requirements
of the Church as there is a minimum size transformer. He said they could run
the line overhead over the road, then underground to the transformer, or the
line could be run underground from the road. He said that if the line is run
underground the Church will have to furnish SWEPCO the 2" PVC. He stated that
if a transformer pad is desired the Church would have to furnish that also.
Milholland asked if the electric line could be run in the same easement (ditch)
with the phone line. Mr. Hornaday stated that the electric line could be run
in the ditch with the phone line, but he would not want to be in the ditch with
the gas line.
Bobbie Jones said that water and sewer must be 10 ft. from each other,
and that gas lines and sewer must be separated by 10 ft.
8. Bobbie Jones (Planning Administrator): Told Mr. Curtis that as far as additional
right-of-way concerning Morningside Drive, he should check with Mr. Ed Connell
of the City Water and Sewer Department. She thought a water line had been run
along Morningside Drive, and it could be that additional right-of-way had
already been dedicated at that time.
a. Three of the waivers requested would have to be waived by the Planning
Commission (side setback requirement, driveway setback requirement,
and screening requirement).
b. A permit will be required for curb, gutter sidewalk and driveway, which
may be obtained in the City Engineer's Office.

c. A Conditional Use will have to be approved by the Planning Commission in
order to have the Church in this R-2 zone. The Large Scale Development
Plan must be approved by the Subdivision Committee. The next Subdivision
Committee and Planning Commission Meeting will be held June 23, 1980.
d. The waiver for reduction of the number of parking spaces will have to come
before the Board of Adjustment.
Ms. Jones suggested waiting for the feeling of the Planning Commission
before coming before the Board of Adjustment.
e. The parking area is required to be surfaced with at least a double chip and
oil seal. If this cannot be done by the time the building is to be occupied,
there is an agreement form available in the Office of City Planning,
which makes it possible to extend the period of time in which the parking
(or other similar improvements) are to be completed. Ms. Jones stated that
she normally does not extend such improvements
over one year. She said that if a longer extension was desired, the
Church would have to go before the Board of Adjustment.
According to the square footage of the proposed Church, 74 parking
spaces are required.
f. It was Ms. Jones' understanding that as of July 1, 1980, all plumbing and
gas riser plans will have to go before the State Board of Health, Building
Safety Division, regardless of cost factor, for approval.
Any kitchen facilities will have to go before the State Board of Health,
Sanitary Services, for approval before a Building Permit is issued.
h. If the cost of the proposed Church is $50,000.00 or more, each page of the
plans will have to have a paragraph, and an Arkansas Registered Architect's
or Engineer's stamp and signature on it.
g.
i. There are new State Energy Regulations. Freeman Wood,
Inspector, should be contacted regarding these.
City Building
J. John Dietzen, City Sign Inspector, should be contacted regarding any sign
the Church may put up.
k. Two spaces, 12 ft. wide will be required for the physically handicapped,
or three if 74 spaces are required, each identified with an above grade
sign, and appropriate ramp.
1. Curbs or wheel stops will be required around the parking area to prevent
any vehicles from getting outside the parking area.

Each parking space must be marked off.
An "As Built Plot Plan" will be required to be filed in the
Planning before a Certificate of Occupancy will be issued.

individual utility lines, parking areas, all improvements and revisions,
etc.
o. Revised drawings must be turned in to the Office of City Planning by
Monday, June 16, 1980, in order to get on the Agenda for the June 23,
1980 Subdivision and Planning Commission Meetings.
Lot Split has already been approved. No further division is to be
made of this property without approval. There could be a problem
trying to divide it further unless a subdivision plat is approved and
filed.
