CITY REPRESENTATIVES PRE view Committee met at 9:00 A.M., Thursday, rectors Room, City Administration Building, SENT: Clayton Powell, Wally Brt, Don Osborn, Bobbie Jones. Larry Poage, UTILITY REPRESENTATIVES PRESENT: L. 0. Ferguson, Kenneth Wagner, Shaw, John Parker. COUNTY REPRESENTATIVES PRESENT: Bud Allen. Dick DEVELOPERS AND/OR THEIR REPRESENTATIVES PRESENT: Frank Blew, Ray Mitchell, Wayne Jones, Gordon Houston, Neal Albright. The first item discussed was the Preliminary Plat of Hamestring South Addition to be located on the North side of Highway 16 West and West of County Road 877, approximately one -mile West of Fayetteville: City Limits. Frank Blew, Surveyor, was present to represent the developers who are Lester Longwith and Ben Hunt, Jr. Comments and requirements were as follows: HAMESTRING SOUTH ADDITION Preliminary Plat Outside City - County Road 877 1. Don Bunn (City Engineer): prior to the meeting: "There is an 8 -inch water The new water line should Not present, but submitted the following comments line available on the North side of Highway 16. be sized to serve the subdivision. Check with the City Engineer on possible oversizing that may need to be done. There is a sewer line in Hamestring Creek, but it is not available to serve this development because of the restriction on sewer service outside the City Limits.' 2. Bud Allen (County Planning Administrator): Asked about the existing right-of- way width of County Road 877. Frank Blew said there is an existing 30 ft. between fences on opposite sides of the road. The property line is the center of the existing road, with the exception of other recent developments and such where people have already dedicated the required 30 ft. from the centerline. An example of this is the Pond Addition. This developer is dedicating 30 ft. from the centerline on his side of the road. Bobbie Jones advised that the City has recently passed Ordinance 2576, an amendment to its subdivision ordinance, that does require developers to make off-site improvements. She said outside the City, the County is to determine the amount of the total cost of the off-site improvements to be borne by this developer. Bud Allen said that the County does not yet have an ordinance requiring off-site improvements; and if there are any the City's ordinance will take precedence. Street Superintendent Clayton Powell commented that he thought the off-site improvements should be stipulated to whatever the County wants for County road or street standards. He said that he was concerned that as these areas are developed, even though they are dedicating the additional right-of-way, there would still be fences only 30 feet apart. He recommended that this developer move the fences back now. Frank Blew said that this developer proposed to remove the fences on his side of the road, cut the bank down, and widen the road bed on his side. • • • Plat Review Committee April 3, 1980 - Page 2 He added that the developer has talked about working with other property owners down the road and graveling the road. Mr. Blew said he thought there was a willingness to cooperate on the part of some of the other persons using the road. He said Fayette Tree and Trench is located down this road and the owner of that business presently spends around $3,000.00 a year maintaining the road. He has indicated he will assist these developers, but there is nothing definite on it yet. Bobbie Jones read from Ordinance 2576 how "delayed improvements" are to be handled by putting money in escrow. Bud Allen said that the County is requiring developers to hard surface roads in the Growth Area now; however, in this case they would have only half the right-of-way to work with He stated he thought the money in escrow would be an advantage to the County as a leverage to get the rest of the additional right-of-way. Frank Blew asked that his developers be permitted to go on and use the money now to develop the roadbed, the road right-of-way, borrow ditches, and such for the full 1 mile of this property, as his sign of good faith and as his investment. Mr. Blew said he thought this was preferable to having the money put in escrow and nothing being done with the existing road. Bud Allen said this was a decision to be made by the County Planning Board when it reviewed this proposal on April 7. 2. Larry Poage (Fire Inspector): No comments as this is outside the City Limits. Any runs made to fight fires outside the City have a fee charged on them. 3. Don Osborn (Water Meter Foreman): Asked if all these lots would have only single family dwellings on them and was advised that that is what the covenants stipulate. 4. L. 0. Ferguson (Warner Cable): We have a cable buried down the West side of the County Road. We can serve this from that. Mr. Blew said that he thought both the TV cable and the telephone companies are in the bottom of the existing ditch. He indicated that these cables might have to be relocated if the road has to be widened. Mr. Ferguson said he thought their cable crossed the road somewhere near the existing house. He said they would move their cable where - ever they have to do so. Mr. Blew pointed out that this plat not only dedicates 30 ft. of right-of-way for the road (measured from the centerline) but also has a 25 ft. building setback and utility easement back of that road easement. Notify Warner Cable anytime you are going to be grading or digging along the existing roadway ditch. 5. Kenneth Wagner (Arkansas Western Gas Company): We have a 2 -inch high pressure gas line on the North side of Highway 16. Be sure to call us before doing any excavation in there. The easement shown on the plat is sufficient. The responsibility for putting in the new gas line will be up to the developer. We will put it in on a contract to the developer. Mr. Hunt asked me about the line on the East side of that road. It is a private line that belongs to the house up the road and does not belong to the Gas Company. 6. Dick Shaw (Southwestern Bell Telephone Company): The easements look sufficient. my only concern is that there is no zoning in the County to restrict it to R-1 uses Someone could purchase a lot and put 3 or 4 houses on it. This gives our utility service a problem. Mr. Powell commented that the City's Subdivision Regulations require 11 acres for a single family dwelling on a septic tank. Mr. Blew pointed out that the covenants will also restrict this to single family dwellings. • • • -11 Plat Review Committee April 3, 1980 - Page 3 Mr. Blew said the developers do plan to put in a water line down this road. It will probably be oversized. If it is not oversized, it will be a 3 -inch main. If it is oversized it will probably be a 6 -inch main. He said they do not plan to install any fire hydrants. 7. Bobbie Jones (Planning Administrator): The final plat mylars must be 18" by 23". The scale on the mylars may be other than 1" to 100' if a print or photo conversion at 1" to 100' is submitted with the mylars. There are to be pins set along the road where the alignment of the lot changes in the middle of the lot. The ordinance requires a topo at 5 ft. intervals. This plat shows 20 ft. intervals. The ordinance does allow a different interval "if it better suits the land." I'll defer that decision to those who must work with the elevations. Are there any existing easements on the property which are not shown on the plat? Mr. Blew said there appears to be an ArkLa line parallel with and adjacent to the West property line, apparently 20 to 25 ft. wide. However, he had not been able to find any record of a recorded easement. Does the County Road have a name as well as the number, if so it should be shown on the plat also. Mr. Blew said he only knew of it as County Road 877. The developers must notify the adjoining property owners and furnish proof of that notification to the Planning Office prior to the Planning Commission meeting. Dimension the right-of-way for Highway 16. Show the proposed use (single family dwellings) on the plat. Are you submitting the perc data to the State Board of Health for approval? Mr. Blew said this would be done at the same time the plans for the proposed water line are submitted. Identify the road easement lines. Plans for the improvements must be approved prior to final plat approval. No lots are to be sold until final plat is recorded. Some lot dimensions were not legible on my copy. This should be corrected. I could not check to see if the Western boundary adds up since I could not read those dimensions. Along the road the call given as "N 02°09' W 432.90 feet" did not add up. The last date to submit the revisions for the April 14 Planning Commission Meeting is April 7. We need 6 revised copies. The next Planning Commission date after that is May 12. 8. Clayton Powell (Street Superintendent): One of the biggest problems we have now in the growth area and fringe areas of the City is large scale developments where off-site improvements are not required. It appears to me that 3 or 4 underdrains are needed on that road from the topo which exists on this plat. When these things are subdivided and people buy a lot and start building a house nobody wants a drainage ditch running right through the middle of their lot, so they will fill it. In a 1 -mile to 3/4 mile of road if you have an underdrain there and they block the ditch to where it can't get away then it builds up and overflows the road. I do feel that we need contour intervals closer than 20 ft. and also an engineering plan, no matter how informal, showing what is proposed to be done to the road, or whatever the Planning Commission may require. Show the underdrains and also if some of these underdrains have to flow off and away from the borrow ditches across lots this be rechanneled to lot lines. Mr. Blew said this was the reason the developers wanted to go ahead and invest the developers cost at this time rather than wait for the rest of the right-of- way. If that is done, there will be tiles and culverts put in where they are needed to be and some things of that nature. • Plat Review Committee April 3, 1980 - Page 4 Mr. Blew said that without directives, the developers could not afford to have the engineering done if it was not going to be utilized. Mr. Powell said if the City continues to "just let things happen" it creates things that can never be corrected. He asked that someone check to see if any off-site improvements were required of the Pond Addition. He said that personally, based on experience of areas annexed into the City, a double chip seal will not suffice. He said he would rather have just native dirt out there to maintain than to have a double chip seal on anything other than SB -2 base. When a chip seal without adequate base breaks down, you can't pave over it; but you must just rip it up and start over again. Mrs. Jones advised Mr. Blew that the County should advise her what action they take on this on April 7. The next item for discussion was the large scale MITCHELL OIL COMPANY development plan for Mitchell Oil Company to SOUTH SCHOOL & 19th STREET construct a 12,000 sq. ft. building on the Large Scale Development Northeast corner of 19th Street and South School Avenue. Wayne Jones, with McClelland Engineers, and Ray Mitchell were present to represent. Comments were as follows: 1. Don Bunn (City Engineer): Not present, but submitted the following comments prior to the meeting: "Water is available on the East side of Highway 71. Sewer is on_the West side of. Highway 71 and North of the Railroad tracks. Arrangements must be made for any sewer extension or tap across Highway 71 or from North of the Railroad. Contact the City Engineer for information. 2. Clayton Powell (Street Superintendent): Since Highway 71 widening is under construction, I assume that the additional right-of-way needed has already been negotiated. I understand that Mr. Mitchell isalso moving his operations to this location because of the widening of Highway 62. We need to determine that the right-of-way for Highway 71 has been negotiated. The plan notes additional right-of-way for 19th Street will be dedicated. A driveway permit will have to be obtained from the State Highway Department District Engineer. Their standards are the same as the City's. A driveway can be 40 ft. wide, measured at right angles. It appears there may be a considerable amount of paving. The on-site drainage should be controlled. There is going to be storm drainage all along Highway 71 there. One thing that does create a winter hazard here is drainage running out driveways or off on-site parking lots into the street. Where there is opportunity to put it in a storm drainage system, we require it. Mr. Powell questioned if there was proposed to be any access off 19th Street to the proposed building to be built on the East side of the property. Mr. Powell suggested it is time for the Planning Commission to start considering off-site improvements to 19th Street. It is just a dirt street. Further East there are several residences and a self -storage warehouse already existing. He said 19th Street appears to be in a "build-up" cycle. Wayne Jones said that as drawn there is no proposal for access to 19th Street --only to Highway 71. Mr. Powell asked if Mr. Mitchell would be willing to covenant himself to no access to 19th Street. He suggested that if Mr. Mitchell contemplated any additional driveways to Highway 71 or 19th Street in the future (other than those on the plan) he should show them on the plan at this time to avoid having to go back through the Planning Commission in the future. They discussed the location of possible other driveways that would meet the safety zone requirements. • • • Plat Review Committee April 3, 1980 - Page 5 Mr. Mitchell said he wouldn't mind having a driveway onto 19th Street if it was the opinion of the City that it would be better to have one. Bobbie Jones advised that if he wanted additional driveways in the future which were not shown on the plan approved, he would have to go back to the Planning Commission. Wayne Jones asked if Mr. Mitchell decided he did not want a drive- way to 19th Street could he put a note to that effect on the plan. Mr. Powell commented that when we do those things all we do is create reasons to goback for variances in the future. He said he would rather suggest that consideration be given to the off-site improvements of 19th Street because it is pathetic to see a street there and have someone say they never intended to use that street, but come back a year later saying they have changed their minds He said the street is there and it should be used. Wayne Jones asked how much improvement this developer should have to bear. Mr. Powell said he thought it would be fair that Mr. Mitchell be responsible for his half of the street abutting his property. The people who own the undeveloped property across the street could then be responsible for the other half. He also suggested that the funds be deposited into an interest-bearing escrow account rather than try to construct half a street. 3. Wally Brt (Sanitation Superintendent): Mr. Mitchell said he would want a container rather than use cans. He and Mr. Brt determined that the best location would be the existing 9 ft. by 17 ft. concrete slab behind the most southern existing building. Mr. Mitchell is to extend this slab another 12 ft. to the East to be used as a wheel pad for the truck. 4. Larry Poage (Fire Inspector): There is presently no diking around the bulk tanks. I would prefer that the blue print show the diking that is to be done. Mr. Jones said there was a special spill -prevention plan prepared on this property and a copy was on file in the Inspection Office. Mr. Mitchell said it will be incorporated in this proposal and they would meet all federal guidelines. Mr. Poage asked about the uses proposed for the new building. Mr. Mitchell said it would be storage, mainly for steel siding, windows, doors, and home improvements. There would be a limited amount of motor oil stored there also as he wanted to get it out of the wooden building. He said only his employees would be working out of that building, not the general public. Mr. Mitchell said he plans to use the northernmost existing building as offices. He said he had recently had the gasoline bulk tanks fiberglassed and they should last for another 40 years. Mr. Poage said he was concerned with bringing the general public into the high hazard situation of a bulk plant operation and that he has been trying to get bulk plants out into more open and less congested areas. Mr. Poage asked there not be any blockages within 10 feet of the exits of the new building. Mr. Mitchell said there would be several 15 ft. overhead doors as well as walk-in doors along the North side of the building. Mr. Mitchell said that 100% of his oil and gasoline deliveries are brought in on his own trucks and that he would never leave a truck parked outside his fence along the highway at night. Mr. Poage said he would want to make fire inspections for purposes of fire prevention later and also that he would require fire extinguishers at certain locations. Mr. Poage suggested the building have some type of skylights in it to not only help with the lighting, but also to make it easier in case they had to fight a fire. Mr. Mitchell said that 25% or less of the material stored in the building would be flammable. • • • Plat Review Committee April 3, 1980 - Page 6 5. Don Osborn (Water Meter Foreman): Asked if this building would have any water service into it. Mr. Mitchell said it would not as it was strictly for storage. He said he would add another rest room to the northernmost existing building. He said he did not plan to sprinkle the building. Mr. Osborn said he thought the water line on 19th Street would handle a sprinkler system if Mr. Mitchell should ever decide to add one. Mr. Osborn suggested that he use flush tank type toilets in the new rest room rather than flushometers, as he thought the water meter already installed would better handle flush tanks. 6. L. 0. Ferguson (Warner Cable): Mr. Mitchell advised that he thought he might want TV cable service to the northernmost existing building (where the offices will be). Mr. Ferguson said cable is available from either the West side of Highway 71 or the North side of 19th Street. 7. Kenneth Wagner (Arkansas Western Gas Company): The plan notes a 2 -inch gas line on the South side of 19th Street, a 6 -inch high-pressure and a 4 -inch plastic line on Highway 71 That 6 -inch high-pressure also runs up the North side of 19th Street. If this road is widened we will be required to move this line. We will work with you on that. Mr. Mitchell offiered to dedicate the 25 ft. setback along 19th Street as a utility easement also. Mr. Wagner said if this is done, and the gas line has to be moved, it must be placed on the extreme South side of the easement because their requirements are that there can be no buildings within 25 ft. of a high-pressure gas line. 8. Dick Shaw (Southwestern Bell Telephone Company): Requested the 25 ft. building setback be a building setback and utility easement recorded as a separate document. Whatever Mr. Mitchell wants in the way of service can be worked out. 9. John Parker (SWEPCO): The power pole in the Northwest corner of this property is going to have to be relocated. There is already a stake at the Northwest corner of the building where the service will come in to clear the Highway right-of-way. What will the load requirements be? Mr. Mitchell said he would have office machines in the existing building to the North and would only want lights in the proposed building. Mr. Mitchell asked about night (security) lights. He said there would be an area that could be subject to pilferage. Mr. Parker agreed to work with Mr. Mitchell on that as well as his other service. 10. Bobbie Jones (Planning Administrator): Mr. Mitchell advised Mrs. Jones that he would not need any additional sewer connections. The additional right-of-way for 19th Street will have to be dedicated before the permit can be issued. Will there be any outdoor storage yards' Mr. Mitchell indicated that only the existing bulk tanks and some truck trailers would be stored outside. Mrs. Jones said she thought it had been decided earlier that that type of storage would not have to be screened; but any other outdoor storage would have to be screened from view from the public streets by a view -obscuring fence, vegetation, or a combination of the two. Mrs. Jones asked the size of the existing buildings and the proposed use of each structure. Mr. Jones stated that the buildings are drawn to scale The northernmost building would be offices requiring one parking space for each 300 sq. ft. of floor space; the proposed building would be warehousing requiring one space for each 1,000 sq. ft. of floor space; the existing building to the South would be repair shop requiring one space for each 600 sq. ft. of floor space. Mr. Jones said they might have to add some more parking spaces. • • • L Plat Review Committee April 3, 1980 - Page 7 Mrs. Jones asked that they confirm whether the Arkansas Highway Department was going to build a sidewalk in connection with the widening. She said the off-site improvements ordinance does require a sidewalk along a State maintained highway. Wayne Jones said it is in the plans for a 4 ft. wide asphalt strip. Mrs. Jones reaffirmed that the Planning Commission can require some improvements to 19th Street, either immediate, or with an escrow deposit for delayed improvements. What about the billboard shown on the plan? Whose is it? What are the lease arrangements? Mr. Mitchell said he did not know as it was there when he bought the property, but he would like to get it off the property. Mrs. Jones advised him that the City is under an injunction not to enforce the zoning or sign ordinances against Donrey Outdoor Advertising. Mr. Lieberenz and Larry Poage have worked up some previous comments on this property that will be included as a part of the record of this meeting. Revisions are needed no later than April 7 for the April 14 meeting. The next item discussed was the Preliminary Plat of Houston Place to be located East of Porter Road and South of Deane Street. Neal Albright, Engineer, and Gordon Houston, Owner, were present to represent. Comments were as follows: HOUSTON PLACE Preliminary Plat Mr. Houston said that he had abandoned the idea of a planned unit development. He is going back to the approval the Planning Commission had originally given him for a duplex subdivision. He said he plans 12 duplexes. 1. Don Bunn (City Engineer): All water and sewer taps to the proposed streets are to be made by the developer's contractor at the developers expense Contact the City Engineer for metal specifications. No other comment. (These comments were submitted prior to the meeting). 2. Harold Lieberenz (Inspection Superintendent): Not present, but submitted the following comments prior to the meeting: "The property below 1248 elevation is in "Zone B" (500 year) glood zone. It is not located in the "Zone A" (100 year) flood zone." 3. Clayton Powell (Street Superintendent): Ascertained that this is proposed as a standard subdivision with public streets, etc. Mr. Powell asked where the proposed Houston Court would intersect with Porter Road. Mr. Albright said it would be about 10 feet to the North of the existing box culvert on Porter Road. Mr. Powell said he thought this plan was much better than the one Mr. Houston had recently proposed. Mr. Powell said the plans should contain a sidewalk all around the cul de sacs to the end of the radius at the corner point of both Lots 6 and 7. Mr. Powell advised Mr. Albright how he should handle the drainage in the cul de sacs since there will be an inside curb (donut) as well as an outside curb He said the straight portion of the street with the 31 ft. paving width should have a parabolic crown, then they should transition and measure the slope of 15 inch per foot from the inside of the culs to the outside of the culs all the way around. He said he did not want any swales and pointed out where they should use underdrains and drop inlets. He said he did not want any inlets without grates over them, but they could end an 11" by 13" pipe opening without a grate if it was not an inlet. He asked for floors and splash walls to prevent erosion and undercutting. Don't put storm drains in the middle of lots; try to put them on the lot lines. Plat Review Committee April 3, 1980 - Page 8 4. Wally Brt (Sanitation Superintendent): Discussed it with Mr. Albright and stated that they will construct the inside radius on the culs de sac with a 34 ft. radius instead of a 40 ft. radius. This would allow a 26 ft. wide driving surface around the donut. He said he still would not be responsible if the Sanitation trucks broke down the curbs. Mr. Powell advised Mr. Houston that the City does not have the funds and is not set up to maintain the medians inside the culs. He said this would have to be the responsibility of a property owner's association. He said it would be a shame for them to have to be asphalted in just because of the maintenance problem. 5. Larry Poage (Fire Inspector): No comments. 6. Don Osborn (Water Meter Foreman): Asked how structures would be oriented on the lots. Mr. Houston said they would probably all face either East or West and not to the other street. He said he would want separate meters for each dwelling unit. 7. L. 0. Ferguson (Warner Cable): The utility easement looks good. We have service along Porter Road. 8. Kenneth Wagner (Arkansas Western Gas Company): Stated he needed a way to get from the apartment units on the corner of Deane Street and Porter Road down to this development. Mr. Albright pointed out easements for this purpose. Any easements outside this development not already dedicated must be deeded by separate instrument. The gas line must be installed at the developer's expense subject to a refund under contract. Mr. Albright said he was trying to keep the storm drainage away from the other utilities. 9. Dick Shaw (Southwestern Bell Telephone Company): Asked if the storm drainage would be open or closed. It will be closed. Repeated that the external ease - must be dedicated as a separate instrument, and the telephone company must have that before they can do anything. Also, any brush or trees which must be cleared from the property in order to put in utilities must be done by the developer. 10. John Parker (SWEPCO): We have an existing underground primary loop to the apartments. We will tap into that and extend it around the perimeter of this subdivision. Before we will go in, the lots must have the final grade set and all the corner pins set, and any trees which must be removed will have to be removed. SWEPCO will reserve the right as to where to set the pedestals. I would like to move the street light shown in the radius of Lot 1 across the street between Lots 6 and 7 with a 10 ft. utility easement between Lots 6 and 7 for that light. It would be easier and cheaper to serve from that location. 11. Bobbie Jones (Planning Administrator): The Planning Commission granted a conditional use for a maximum of 12 duplexes on this property on May 25, 1979. On the preliminary plat show the proposed use as duplexes (12). Does each lot contain a minimum of 12,000 sq. ft.? Mr. Albright affirmed that they do. Does each lot have 80 ft. in width at the setback line? Mr. Albright affirmed this to be true also, based on a tangent. The lots on the cul de sacs will not have enough lot frontage to have 2 separate driveways for each duplex and meet the 25 ft. safety zone between driveways. The site plan for each lot must furnish 4 parking spaces without backing into the street (where there are more than 2 parking spaces). A • • Plat Review Committee April 3, 1980 - Page 9 I assume the intent of the sidewalks is that they will extend down one side of the street and all the way around the cul de sac, but the plat should make that clear. I need a copy of the transfer to the City of the property where Houston Court will come off Porter Road into the subdivision. It may be necessary to have the City Board take some action to accept it. If there will be no protective covenants, show "None" on the plat. Planning Commission could require some contribution toward Porter Road. I am not sure what the status of the improvement of Porter Road is; it has changed so many times. Mr. Powell said that Porter Road has been reduced to a pavement width of 24 ft. with open borrow ditches, with 6 inches of SB -2 base and 2 inches of asphalt cement. There is a probability that in that program there is more construction cost than money available so there may be some reduction in the project. Mr. Powell said he would rather see the entire section of Porter Road paved from Mt. Comfort Road to Wedington than have it done in segments. If they do run short of money they should cut some complete project. The bids have not been accepted yet, so they don't know how short the funds will be. Revisions are due by April 7 for the April 14 meeting. The last item discussed was the question of abandoning CHURCH AVENUE the unopened streetright-of-way for Church Avenue between ABANDONMENT South Street and Archibald Yell Boulevard. This matter South of South St. had been before the Board of Directors at their last meeting and had been postponed for review by the Plat Review Committee. A Mrs. Adams who owns property on the West side of the unopened right-of-way was present. Comments were as follows: 1. Clayton Powell (Street Superintendent): Stated he felt the normal procedure for closing of streets and alleys should be adhered to in all cases. He said he saw no need for this street right-of-way to stay open as a street, but he has had numerous problems with this location. The tenant has=asked,the City to. install storm drainage and curb and gutter on the South side of South Street. Mr. Powell said we need to have the access off South Street controlled rather than have a continuous driveway with parking everywhere. He said the City needs to retain a part of the present street right-of-way as a drainage easement. He said the drainage easement could be retained wheree.er it would be to the best advantage of the property owners and utility companies. He did recommend that if the right-of-way is abandoned, that one of the conditions be that a curb and gutter be placed along the South side of South Street and the driveway locations controlled. 2. L. 0. Ferguson (Warner Cable): Said all he thought they had in there was a "drop" to serve the house and they might be able to serve it from another direction. 3. Kenneth Wagner (Arkansas Western Gas Company): We have a 2 -inch gas line that feeds down the West side of Church Avenue across Archibald Yell. I don't know the exact location. We have a 14 -inch line that comes off that other line and crosses to the East and angles up behind the parts house on the corner of South and Archibald Yell. He requested the City retain a utility easement the same width as the street. 4. Dick Shaw (Southwestern Bell Telephone Company): Mr. Shaw said he would also like to get back to the normal process in which each utility company is contacted for concurrences before a street or alley is abandoned. He said there are some times when it is not necessary to retain utility easements, and this is one reason for checking with the utility companies. • • • Plat Review Committee April 3, 1980 - Page 10 He requested a letter of assurance from the adjoining property owners that the right-of-way would remain a utility (and drainage) easement, a legal description and the names of the persons seeking to have the right-of-way abandoned. He said he has no objection to the closing of this right-of-way so long as a utility easement for the full width of the right-of-way is retained. He has never had his Little Rock office refuse to approve the vacation of one that he has recommended for approval, but he still needs the above paper work submitted to him. Mr. Powell discussed with the utility representatives their respective locations in the present right-of-way and the best location for a storm drain. 5. John Parker (SWEPCO): We have an overhead pole line on the West side of the Street. We also need the easement retained. We do need to keep that line in there. We serve the billboards South of the big house from it. The anchors on that pole at Church and South cannot be eliminated. Vacating the street right-of-way is satisfactory if a utility easement is retained. The meeting adjourned at 11:15 A.M.
