HomeMy WebLinkAbout1980-01-31 MinutesMINUTES OF A PLAT REVIEW COMMITTEE MEETING A meeting of the Fayetteville Plat Review Committee was held on Thursday, January 31, 1980, at 9:00 A.M. in the Board of Directors Room, City Administration Building, Fayetteville, Arkansas. CITY REPRESENTATIVES PRESENT: Don Osburn, Clayton Powell, Wally Brt, Bill Boudrey, Bobbie Jones, and Michelle Hale. UTILITY REPRESENTATIVES PRESENT: Floyd Hornaday, John Parker, Dick Shaw, L. 0. Ferguson, and Kenneth Wagner. OTHERS PRESENT: Gordon Houston. The first item for discussion was HOUSTON PLACE the preliminary plat of a planned unit Porter Rd. development Houston Place located on Preliminary Plat Porter Road Present to represent was Gordon Houston. Mrs. Jones explained this was a PUD and she read the street requirements from the new PUD Ordinance. Mrs. Jones stated plans for the storm drainage system would have to be submitted to Clayton Powell, Street Superintendent, for approval. 1. Clayton Powell (Street Superintendent): Stated his concern for the 14 ft. street width. He said it is the intent of the ordinances that these be built under the supervision of a professional engineer, and he felt the engineer should attend all meetings. Mr. Powell stated he will need the engineering plans and profiles. on the private street and drainage. He said he will need 10 ft. additional right- of-way for the Master Street Plan where Porter Road abuts the proposed subdivis- ion because Porter Road is proposed for a collector street. Porter Road is an existing gravel street and is proposed for improvement under Community Development. If it is not to be improved under Community Devel- opment, the Planning Commission may require this developer to pave, curb, and gutter under off-site improvements. Perhaps a contract or bond should be required so that if it is not done by Community Development within S years, this developer would have to do it at that time. Mr. Powell suggested a Bill of Assurance that the street will be brought up to City standards within a certain period of time. . Mr. Powell asked Mr. Houston what the remainder of Lot 9 would be. Mr. Houston said it would be a vacant lot. Mr. Powell said to designate it as open space on this plat. Mr. Powell said he would have to have the certification from the consulting engineer that it was built within the minimum standards of a private street in a PUD. Mr. Powell stated if sidewalks are required they will have to designate on the plat what side of the street they will be on. He added one will have to go all around the loop and out to Porter Road. Mr. Powell stated it seemed to him the new PUD Ordinance left a lot of open area. He said the Planning Commission should go back and clear up the jogging tract ---what type of improvements will have to be made on it. Mrs. Jones said the Ordinance puts the planning of green space or open space on the developer. Mrs. Jones stated the Ordinance did call for the establishing of a Property Owners Association but the developer would be responsible for main- tenance until assumed by the City or POA. Mr. Powell asked Mrs. Jones about the lot widths. Mrs. Jones said in a PUD there is no longer any minimum lot width. She said Mr. Houston was talking • Plat Review Committee Meeting January 31, 1980 Page 2 about 27 duplexes and they must be setback 50 ft. from the exterior of the PUD. Mr. Powell said allowing 2 units on 60 ft. lots bothers him to no end. He recom- mended to the Planning Commission that this be scheduled for a public hearing since there has been so much opposition to apartments in this area. 2. Bill Boudrey (Fire Department): Stated from the 12 inch line on Porter Road, he wants a 6 inch line in there with fire hydrants on it. He wants fire plugs at 1000 ft. intervals. There should be one where the street makes a "Y" and down on the other end between Lots 12 P, 13. Mr. Houston said he had been talking about putting 2 fire hydrants in. Mr. Boudrey said where a water line dead ends it should be an 8 inch line. Mr. Boudrey added he didn't like the narrow street. 3. Don Osburn (Water Meter Superintendent): Asked Mr. Houston if they were going to meter each unit individually. Mr. Houston said yes there would be one meter for each living unit. Mr. Houston stated he was going by what was in the regulations. Mr. Osburn asked if each duplex would be constructed on 2 lots. Mr. Houston said it would be one duplex, or 2 units, per lot. Mr. Osburn asked Mrs. Jones if Mr. Houston was required to put a street marker up. Mrs. Jones said Mr. Houston was required to. She said it must read "Private Road" with the street name under it. Mr. Osburn said it should be permanent and show the street name. Mr. Osburn said when the duplexes are finished they will need house numbers on them, but if water is needed before they are finished, building permit site cards are required to be posted. He said house numbers are required to be at least 4 inches tall, either plastic or metal, fastened to the wall with nails or screws, and visible from the street. 4. Floyd Hornaday & John Parker (SWEPCO): Mr. Hornaday stated he had underground service around there and it can be provided. He requested a 40 ft. easement around the perimeter of the subdivision, cross the 24 ft. drive to the North property line, and out to Porter Road along the North side of the property. Mr. Hornaday said the easements will have to be cleared and the grade established. At the South end the bushes will have to be cleared off the ease- ments before the utilities will be installed. Mr. Houston said the brush at the South end is on the fence row. Mr. Hornaday stated on Lots 1-19 he could provide service in that area. Lots 23-27 there is not enough room to get down to 26 $ 27 without going between lots or buildings. He said they could put a transformer on Lot 23. Mr. Houston said Lot 23 was in the Flood Plain and probably 4 of the lots would be eliminated. He stated the easements would have to be executed by separate instrument and should be shown as a "utility easement". Mr. Hornaday asked about the street lights. Mrs. Jones said street lights were required every 300 ft. and the developer will have to pay 'Co install them as well as pay the monthly bills on them . Mr. Hornaday added he will need a 5 ft. easement along the lot line for the street lights. Mr. Hornaday also asked that the easement continue up the West and North sides of Lot 19. 5. Kenneth Wagner (Arkansas Western Gas): Stated in order to get down to Lots 23-27 on the West side of Lot 1 a 25 ft. utility easement will be needed. He said there • • Plat Review Committee Meeting January 31, 1980 Page 3 wasn't enough room on the East or West side of Lots 23-27 for all utilities, it shows only 10 ft. outside the street between the lots. Mr. Shaw agreed with Mr. Wagner. Mr. Wagner asked which lot they could use. Mr. Houston said he would elimin- ate Lot 7 to give an easement into the interior. Mr. Houston said he could give them 25 ft. off either the East or West side of Lots 23-27. Mr. Wagner said he wanted a 25 ft. easement either: (1) down the West side of Lot 1 and on down the West side of Lots 23-27; or (2) from the East boundary of the Subdivision, through Lot 7, then along the East side of Lots 23-27. Mr. Wagner stated in a development like this it will be the developer's responsibility to put the gas line in on contract with the gas company. He said it could be worked out at a later date. 6. Wally Brt (Sanitation Superintendent): Stated the 14 ft. street won't be wide enough for the Sanitation Department.trucks. He said it would need to be at least 20 ft. wide. Mr. Brt said the packer truck (residential) is 13 ft. wide with the flaps down. He said if it was necessary he would go before the Planning Commission and Board of Directors to explain this when this plan comes up. Mr. Houston asked if they could use a dumpster. Mr. Brt said yes, if it was placed at the entrance where there is a 24 ft. width street. Mr. Brt said if there are 54 duplexes they will need seven 6 cu. yd. containers. If there are 44 units they will need three 6 cu. yd. containers. Mr. Brt will have to have a turn around West of Lot 1 which would have to be 30 ft. x 30 ft. either asphalt or concrete. Mr. Houston said it will probably be concrete. The turn around needs to be approximately 50 ft. back from the containers because the truck'is 39 ft. long. Mr. Brt said the tender (dumpster) truck weight 18 tons empty and 36 tons loaded so he would need a good base under the street. Mr. Brt said if they don't use a dumpster he will need at least a 20 ft. wide street. He pointed out the cans will be a lot messier. Mr. Brt stated it needed to be in the covenants if he is to go in there. Mrs. Jones stated the PUD regulations say that City traffic laws could be enforced in a private drive. She said the City Attorney told her they could be enforced and the Municipal Judge said it could be if it is written in the Ordin- ance. 7. Dick -Shaw (S. W. Bell): Stated the easements asked for are fine. Mr. Shaw re- minded Mr. Houston that the easements need to be cleared. He said they need to get utilities in the center units before any concrete is poured. Mr. Shaw added he would like to see this plat again with the revisions before it goes to the Planning Commission. Mrs. Jones stataithe consulting engineers should give the utility companies copies of the revisions and ask for additional comments any time a proposed plat is changed. The easements asked for, designated as utility easements, should be shown on the revised plat. 8. L. 0. Ferguson (Warner Cable): Stated the easements asked for were satisfactory. He said the cable needed to be in before they pour any concrete. Mrs. Jones said a building can't be placed on an easement unless the ease- ment belongs to one utility company alone, and that utility company grants per- mission. Mrs. Jones pointed out the consulting engineer should be working with the utility companies. Mr. Shaw stated these will have to be utility easements, and not drainage easements because if there is drainage in them the utilities will have to get out. 9. Don Bunn (City Engineer): Not present. He submitted his comments to the Planning Office and they follow in memo form. • • • Plat Review Committee Meeting January 31, 1980 Page 4 10. Bobbie Jones (Planning Administrator): Mrs. Jones comments are as follows: 1. Identify the Flood Plain area and tell what the frequency of it is. 2. The nature of the surrounding development must be shown. 3. The nature of the proposed development (duplexes) and estimate of number of units for sale or lease must be shown. 4. The identification and size of all open space. List acreage of the lots; open space, streets, etc, 5. Need proof a POA is being organized. 6. On a private street the signs are to be put up and maintained by the developer, not the City. 7. At least 30% will have to be open space and no more than 50% of open space counted can be in the Flood Plain area. 8. Two parking spaces per unit is required. 9. The engineer should collaborate all changes made in the plat with the utility companies. 10. Sidewalks on one side of the street and street lights every 300 ft. need to be shown. If they are requested to be waived, that request needs to be in writing. 11. The fire hydrants will need to be shown. 12. The following things need to be added into the covenants: a. The City will require the POA to maintain the open space. b. Maintenance of private streets shall be the responsibility of the devel- oper or of a neighborhood Property Owner's Association (POA) and shall not be the responsibility of the City, The method for maintenance and a maintenance fund shall be established by the PUD covenants. The coven- ants shall expressly provide that the City of Fayetteville is a third party beneficiary to the covenants and shall have the right to enforce the street maintenance requirements of the covenants irrespective of the vote of the other parties to the covenants. The covenants shall provide that in the event the private streets are not maintained as required by the covenants, the City shall have the right (but shall not be required) to maintain Said streets and to charge the cost thereof to the property owners within the PUD on a pro rata basis according to assessed valuation for ad valorem tax purposes and shall have a lien on the real property within the PUD for such cost. The protective covenants shall grant the City of Fayetteville the right to use all private streets for purposes of providing fire and police protection, sanitation service and any other of the municipal functions. The protective covenants shall not be amended and shall not terminate without approval of the Fayetteville Board of Directors. c. All traffic laws prescribed by Fayetteville Codd of Ordinances, Chapter 19 (Traffic) shall apply to traffic on private street within a PUD. d. Maintenance of Private Open Space --The maintenance of all private open space shall be the responsibility of the developer or of a POA and the method for maintenance and a maintenance fund shall be established in in the PUD covenants. The covenants shall expressly provide that the City of Fayetteville, is a third -party beneficiary to the covenants and that the City shall have the right to enforce the requirements for open space irrespective of the vote of the other parties to the covenants. All private open space shall be maintained in an appropriate manner. Appropriate manner means a manner which does not violate City of Fayette- ville Ordinances or constitute a hazard to the safety, health or general welfare of the PUD residents or general public. Mrs. Jones told Mr. Houston the next Planning Commission meeting is February 11. Loop should be finished out with a 6 -inch and a fire hydrant set adjacent to lot 11. 3. Apparently sewer may be extended from the existing sewer on north side of the property. 4. Easements for new water and sewer lines should be indicated on Plat. 5. Sewer taps which cross paved streets to be installed by the owner at the time the -sewer is installed.
