HomeMy WebLinkAbout1979-09-13 MinutesMINUTES OF A PLAT REVIEW COMMITTEE FETING A meeting of the Plat Review Committee was held on Thursday, September 13, 1979, at 9:00 A.M. in the Board of Directors Room, City Administration Building, Fayetteville, Arkansas CITY REPRESENTATIVES PRESENT: Bobbie Jones, Michelle Hale, Clayton Powell, and Wally Brt. UTILITY REPRESENTATIVES PRESENT: Kenneth Wagner, Dick Shaw, Floyd Hornaday, John Parker, Jimmy Crownover, and L. 0. Ferguson COUNTY REPRESENTATIVES PRESENT: General Bruce Kendall. OTHERS PRESENT: Harry Gray. The first item for discussion was the CEDARWOOD ADDITION Final Plat for Cedarwood Addition located Final Plat on the West side of Crossover Road North of the township line. Present to represent was Mr. Harry Gray. 1. Harold Lieberenz (Inspection Superintendent): Not present, but submitted the fol- lowing comments: 1. The 100 -year flood plain will have to shown on the final plat. 2. Theymust construct a flood proof sewer where it will be in the 100 -year flood plain. 2. Larry Wood (Planning Consultant): Not present, but submitted the following comments: Mr. Wood requested that either Street "E" be extended to the East to stub into some property owned by Coach Eddie Sutton or that Street "G" be stubbed to the East to provide access to the property to the East other than from Crossover Road. He thought if one of the streets were stubbed they could get 2 additional lots. He said he had talked to Ervan Wimberly about this and Mr. Wimberly had thought Mr. House would not want to do it because of the delay it would cause. 3. Clayton Powell (Street Superintendent): Mrs. Jones asked him if the plansand pro- files for streets, curbs, gutters, and drainage had been submitted and approved. He said they had been submitted the week previous but he had not had time to check them so they have not yet been approved. He stated that where the drainage easements go between the lot lines, he could get by with a 16 foot wide easement for drainage alone, but he does not want storm drainage and utilities in the same easements. Separate easements should be shown for each where they will follow the same lot line. The Planning Commission did not require any improvements on Township Road except for the right-of-way.when the preliminary plat was approved. Mr. Powell said he was in the process of reviewing the plans for street construction and will furnish the Planning Office a copy of his letter when he completes his review. He added that there was to be no driveway access from Township Road or from Crossover Road and a note to that effect should be on the plat. He asked if the street names shown are the final names chosen. Mr. Gray said they are probably not. Mr. Powell stated that the street plans must be corrected to contain the corrected names of the streets 4. Mr. Gray said they were going to do it they are going to get the utilities in this Winter Mr. Gray said the first phase of construction will and 122. in phases; hopefully, and the streets next lie North of Lots 65, he added, Spring. 74, 77, 5. Jimmy Crownover (Ozarks Electric): Stated all of the utility easements looked good to him, except he will need a 15 ft. wide easement where street lights will be. He asked what the 50 ft. easement on the West side of Highway 265 is dedicated as. He was told it was a high pressure gas line easement. 6. Floyd Hornaday (SWEPCO): Stated that they will need a 25 ft. wide East-West ease- ment between Lots 69, 70, and 80 on the North and Lots 81 through 85 on the South. Anywhere that there will be sewer in the same easement they will need at least a 25 ft. wide easement behind the rear lot line. They also will need a 20 ft. ease- ment between Lots 90 and 91. He wants the easement widened to 20 ft.:: 1 between Lots 94 and 95; between Lots 99 and 100; . _. between Lots 104 and 105; between Lots 71 and 72; and, between Lots 71 and 72. Delete the 16 ft. easement between Lots 119 and 120 and put a 20 ft. easement between Lots 120 and 121. There is no easement shown on the West side of Lot 1. The ease- ment will need to be extended across the West side of Lot 1. The easement between Lots 40 and 43 on the East and Lots 41 and 42 on the West will also have drainage in there so it.:will need to be widened to 25 ft. going North and South. 7. Dick. Shaw (S. W. Bell): Stated the easements Mr. Hornaday asked for were fine. He added that he wants conduit for the street crossings installed as follows: 60 ft. of 2 inch P.V.C. across Street "A" between Lots 12 and 13 and Lots 24 and 25; between Lots 33 and 50 and Lots 32 and 51; across Street "B" between Lots 1 and 2 and Lots 41 and 42; across Street "C" between Lots 103 and 110 and Lots 104 and 109; 70 ft. of 3 inch P V C across Street "B" between Lots 120 and 121, and Lots 78 and 79; 70 ft. of 2 inch P.V.C. across Street "E" from the South side of Lot 92 to the South Side of Lot 93. They will use the new Federal Coloring Code for underground color distribution Mark each end of each piece of conduit, he added. Kenneth Wagner (Arkansas Western Gas): Stated that the easements on the West side of Lots 40 and 43 will need to be 25 ft. wide. All perimeter easements must be at least 25 ft. wide. On the West boundary along Lots 111 through 123 showsa 10 ft. easement. Mr. Gray explained that this was bordering Brookside East which has an easement along its East boundary. Mr. Wagner said not to reduce the easements shown, but to be sure the combined easement is at 'least 25 ft. wide. Mr. Gray added that they show only 20 ft. along the East side of Lots 86 through 92 because Mr. Sutton is going to give them an easement so they can keep a natural screen of trees in there. 9. L. 0.. Ferguson (Warner Cable): Stated that they need 2 inches of Schedule 40 conduit installed across the streets as follows: 60 ft. between Lots 12 and 13 and Lots 24 and 25; 60 ft East to West between Lots 33 and 50 and Lots 32 and 51; 60 ft. between Lots 103 and 110 and Lots Lots 104 and 109; 70 ft. between Lots 120 and 121 and Lots 78 and 79 and from the Southeast corner of Lot 93 to the Southwest corner of Lot 92. • Plat Review Committee Meeting September 13, 1979 Page 3 9. Bobbie Jones (Planning Administrator): Stated that they need to confirm to her that the Lots on the culs de sac have a 70 ft. width at the setback line. Azalea Terrace street stub needs to be shown on the plat where it touches the SW corner of the plat. The existing easements and their width in Brookside East need to be shown on the plat and labeled as "existing". Identify the 30 ft. as right-of-way dedicated for Township Road. Add a notation that Township Road is a proposed 60 ft. collector street. Show the utility easement to be from Mr. Sutton;show that it will be made by a separate instrument. Crossover Road right-of-way needs to be dimen-_ sioned,and identified as a principal arterialstreet requiring 80 ft. of right-of-way on the City's major street plan. Show the street lights and sidewalks location by legend; also, have a legend for the concrete monuments and pins. She added that they may need the corporate resolution on the Atlas Construction Company. Mr. Gray told her the way it was written, they may not need it. She told him he should double check with City Attorney, Jim McCord. Mrs. Jones asked if they were going to use a contract or a bond to insure completion of improvements to City standards. Mr. Gray told her it would be a contract. She said to get some reaction on the street stub that Mr. Wood asked for. Mrs. Jones said she will have to submit.Ithe street names to the Post Master. She asked Mr. Gray about the covenants and he told her he hasn't gotten them. This cannot go on to the Planning Commission until she is advised that the street, curb, gutter, drainage, water and sewer plans have been approved by the City Engineer and Street Superintendent. The last item for discussion was the preliminary plat for the Pond Addition located on Highway 16 West approximately 1 mile West of City Limits. There was no POND ADDITION Preliminary Plat one present to represent. 1. Jimmy Crownover (Ozarks Electric Cooperative): Requested an easement 15 ft. each side of the lot lines between Lots 6 and 7; between Lots 4 and 5; between Lots l- and 3; and between Lots 1 and 2. He also wants a 20 ft. easement across the North side of Lots 1, 2, and 3. He said the other utilities won't have any problem getting underground in the tranmission line easement of Ozarks Electric. Single phase line running North and South on the West side of Lots 6 and 7. Ozarks Electric will serve this Subdivision with overhead service. Show the private Ozarks Electric easement for the above single phase line (it should extend 15 ft. East of the line.) 2. Kenneth Wagner (Arkansas Western Gas): Stated the easements shown and asked for are sufficient. If the gas meter at the Southwest corner of the Church property and the private line up the East side of the County Road ever needs to be moved, it will be at the expense of the property owner on the line; the gas company would relocate the meter. If the line stays in there, he recommends that they get a private gas line easement from the meter to the house. 3. Dick Shaw (S. W. Bell): Requested a note on the plat that the property owner authorizes the other utilities land Warner Cable to construct and maintain underground utilities within Ozarks Electric's transmission line easement subject to the approval of each installation by Ozarks Electric. He stated that the easements shown and asked for will then be O.K. with the telephone company. He asked Bobbie Jones if the property owner made a statement on the Subdivsion Plat would it be sufficient. Mrs. Jones said it would be fine with her, but Mr. Shaw needed to check into the legality of it. 4. L. 0. Ferguson (Warner Cable): We have only a feeder line on the County Road; our trunk line is on Highway 16. Asked if the East property line met the Church property for the Freewill Baptist Church, or if there was a strip of land between them. There is an existing strip of land about 500 ft wide dividing the two. Plat Review Committee Meeting September 13, 1979 Page 4 5. General Bruce Kendall (County Representative): Stated that the addition was designed to take advantage of the State and County Roads because it had no interior roads. They have shown a 30 ft. easement on the County Road. For the State Hwy. there will be 5 lots to put in driveways. Mrs. Jones asked if the County Road had a name or a number. General Kendall said he didn't know if it had a name but he said it probably had a number. He said it was an existing dirt (not even gravel) road Mrs. Jones asked if the County was going to make any recommendations for the improvement of the road. General Kendall said the County cannot until they pass somekind of amendment to the Ordinance requiring off-site improvements. He asked Mr. Powell if he was satisified with the proposed draft.of the Ordinance for off- site improvements. He then added that this was no place for a subdivision. 6. Clayton Powell (Street Superintendent): Stated all lots abutting Hwy. 16 W. are required a driveway and curb cut permit from the State Hwy. Department District Engineer in Fort Smith. The subdivider cannot dedicate additional County road right-of-way from the Church property. We need an instrument from the Church dedicating this additional right-of-way, if its agreed with the subdivider to ded- icate it. The low-density of this subdivision does not warrant any additional off-site improvements. 7. Bobbie Jones (Planning Administrator): Comments as follows: 1. Please correct -(the error in the legal description. Is the point of beginning off? Before this can be put on the agenda for approval by the City Planning Commission, the Planning Office must have proof that the owners of adjacent property (including across the streets) have been advised of the subdivision. 2. Show the name of County Road Number of the road along the West property line. 3. A concrete monument will be required at the ?7ortheast and Southwest corners of Lot 1. 4. Add a graphic scale. 5. Dimension the highway and orad rights-of-way. 6. Doesn't the County require their plats to have a place for the individual utility companies to sign approving the easements. 7. Change the City Planning Commission approval certificate to read: CERTIFICATE OF APPROVAL FOR RECORDING: This plat was approved by the Fayetteville Planning Commission at a meeting held on DATED: (Secretary) 8. Submit 6 copies of the revised plat (containing all easements):'at least one week before Planning Commission meeting date Don Bunn -Plat Review 9-13-79 Pond Addition: 8 inch water line on North side of Hwy. 16 which will serve 5 proposed lots (Lots 1-5). Lots 6 F, 7 do not have water service available, run water line down North-South road on West side of Subdivision, it needs to be a 2 inch water line. Cedarwood Addition: No comments.
