HomeMy WebLinkAbout1978-12-21 Minutes• • MINUTES OF A PLAT REVIEW COMMITTEE MEETING A meeting of the Fayetteville Plat Review Committee was held on Thursday, December 21, 1978, at 9:00 o'clock A.M. in the Board of Directors Room, City Administration Building, Fayetteville, Arkansas. CITY REPRESENTATIVES PRESENT: Bobbie Jones, Gail Biswell, Clayton Powell, Don Bunn, Wally Brt, and Larry Poage. UTILITY REPRESENTATIVES PRESENT: L. 0. Ferguson, Andy Calloway and Kenneth Wagner. OTHERS PRESENT: W. D. "Woody" May, Wade Bishop, Wayne Lane, and Neal Albright. The first item for discussion was the final plat of Phase I of Regency North Subdivision, located North of Appleby Road and West of Highway 71 North. Wade Bishop, owner/developer, and Wayne Lane, engineer, were present to represent. REGENCY NORTH PHASE I Final Plat N. of Appleby Rd. 1. Clayton Powell (Street Superintendent): The streets, plans, etc. for the entire subdivision were previously approved, but now they have filed their final plat showing several changes, i.e., mayor changes being that some of the street names have been changed. This is frowned upon. Also, the simi- larity of certain street names (Pharris Drive $ Pharris Circle) are frowned upon. At the west end of Village Drive a barricade will need to be erected, and the streets curbed and guttered. No provisions have been made for drain- age coming down a borrow ditch and such provisions should be made. However, the overall subdivision plans should take care of some of the drainage prob- lems with this phase. Certain easements designated both as utility and drainage easements are unacceptable. Easements should be designated one way or the other, but not in combination. 2. Wally Brt (Sanitation Superintendent): No comments. 3. L. 0. Ferguson (Warner Cable): No comments, other than, if the power companies can get in, so can we. 4. Larry Poage (Fire Inspector): Similarity of street names make problems in emergency situations. 5. Don Bunn (City Engineer): Do we have off-site sewer easements? Wade Bishop replied affirmatively that they have been recorded and that he would see that Mr. Bunn received copies. Mr. Bunn stated he would need a 20' easement for the 16" water line and would want that easement designated solely as a water line easement, not general utility easement. He also stated that the uses, purposes and maintenance of parcels A & B (medians on Wayne Drive) should be clarified and noted on the plat, although left designated as utility easements. • 6. Andy Calloway (S. W. Bell): Concerned about easements designated both as "utility and drainage". All easements needed'specifically for drainage should • • • Plat Review Committee Meeting December 21, 1978 Page 2 be noted as drainage easements, easements needed specifically for utilities should also be noted as such. We do not want to place telephone cables in the bottom of drainage easements. Easements on Lot 7, Block 2 should be shown as full 25' easements; easements on Lots 4-12, Block 6 (which tie-in and should be shown full width all around) should also be shown 25'. Also show full ease- ment designation on Lot 17, Block 11. The legend stating "utility F, drain- age easement unless noted" is of major concern. We prefer not to be in any area designated to drainage, and will want a separate easement. Wade Bishop stated that he felt the utility representatives were "over- reacting to the word drainage" and that there would be "very little drainage of surface water." He said he had already spent over $75,000.00 on water drain- age for the subdivision, but could understand their worries. Bobbie Jones stated that the easements needed specifically for drainage should be determined and noted as such. The easements needed specifically for utilities should be determined and noted as such. She recommended Clayton Powell to assist Mr. Bishop in determining the needs and Mr. Powell responded that Mr. Bishop was paying his engineer to make those determinations. 7. Kenneth Wagner (Arkansas Western Gas): Easements will be fine but also agree that utility easements should be separate from drainage easements. 8. Bobbie Jones (Planning Administrator): Several of these lots are smaller than the ones proposed on the preliminary plat. Amend the plat to show the maximum number of units now proposed. Note the zoning on the plat (Block 1, Lot 8 and part of Lot 7, Block 2 are R-0, remainder are R-2). Note which units are proposed for single-family, duplexes, etc. Add names and addresses of owner -developer and of engineer. Note easements that will be needed for future phases on the plat, but note that the easements will be given by special instrument as you cannot dedicate easements on a plat if it doesn't cover that specific area Note on plat the ownership of parcels A & B along Wayne Drive and the per- son responsible for maintenance thereof. Note approximate height of any pro- posed plants, as well as the purpose of the parcels (green space, subdivision identification sign, etc.), but leave designated as utility easement. (Talk to John Dietzen, Sign Inspector, about type of sign which will be allowed.) Protective Covenants must be submitted before the Planning Commission meet- ing. A contract will be needed for uncompleted improvements. Designate the 20' easement for the 16" water line as a "water line easement" solely, not a general utility easement. All other easements, whether utility or drainage, should be separately noted for its specific purpose, not in com- bination. Easements on Lot 7, Block 2 should be shown as 25'. Easements on Lots 4-12, Block 6 should also be shown as 25' as they tie-in and need to be shown fully all around. Show full easement designation on not 17, Block 11. Correct error in legal description (2nd and 3rd calls from end of description are in error). Plat Review Committee Meeting • December 21, 1978 Page 3 • • The next item for discussion was the final GRANDVIEW PLACE plat of Grandview Place, located on Highway 71 Final Plat South near the southern intersection of Highway Highway 71 South 71 and Highway 71 By -Pass. Neal Albright, engineering consultant, was present to represent. 1. Clayton Powell (Street Superintendent): Additional right-of-way will prob- ably be needed for proposed widening on Highway 71. Exact requirements should be ascertained and shown on plat. Mr. Albright noted that the developers have agreed to provide the neces- sary right-of-way for widening whenever the determination is made as to what amount of additional land will be needed. 2. Wally Brt (Sanitation Superintendent): Stated that if apartments were built on any of the lots that containers would be required. Mr. Albright responded that, although plans had been made for apartments in the R-2 zoned parcels, such plans have been deferred for the present. Mr. Albright noted that usage of the lots would depend upon the sale of the lots and how the buyers would want to use them. 3. L. 0. Ferguson (Warner Cable): No comments. We can go in wherever the power companies go. 4. Larry Poage (Fire Inspector): No comments. 5. Don Bunn (City Engineer): Water and sewer are available. The 50' utility easement and building setback line along 71 is really more than needed. Mr. Bunn and the other utility company representatives agreed that 35' would be sufficient along Highway 71, and that 25! would-be sufficient along 24th and 26th Streets. A 25' utility easement is platted for the eastern boundary line. 6. Kenneth Wagner (Arkansas Western Gas): Gas is available on the west side of Highway 71 and on the East side of the 15' utility easement running along the eastern boundary lines of lots 3, 4 and 5. We have a line running along the west side of Highway 71 that crosses it at the southern edge of 24th street and then runs along the south side of 24th Street. Before any heavy backhoeing, etc. is done in that area we would like to be notified. 7. Bobbie Jones (Planning Administrator): In summary, will need: 1. Developer(s) to sign the application and pay the fee. 2. Flood plain shown on the plat. 3. Existing right-of-way along 71 should be shown and any additional dedica- .tion needed should be shown.(for highway widening). 4. Dimension the existing right-of-way of the streets. 5. Another 5' will be needed for 24th Street (include this in the description and show as dedicated.) 6. Dimension sewer easements. 7. Dimension 25' utility easements for entire length of northern and southern boundaries. Re -dimension the 50' utility easement and building setback along Highway 71 from 50' to 35'. • • Plat Review Committee Meeting December 21, 1978 Page 4 8. Note on the plat that the parcel between lots 3 and 4 is "not part of this plat." 9. Planning Commission previously waved required scale to allow this 1" = 50' scale, I believe. Mr. W. D. "Woody" May, Director of Properties ARKANSAS BANDAG CORP. or Arkansas Bandag Corporation, a subsidiary of Hwy. 112 - Truckers Drive Arkansas Best Corporation, was present to discuss the matter of utility easements which had been requested by various utility companies on property which Arkansas Bandag Corporation owns on the west side of Highway 112 between Truckers Drive and the City Limits. Mr. May expressed his concern based on difficulties the company has had elsewhere with utility easements. He said that in some instances the companies owning the easements had prevented the company from using the easement for park- ing or anything else. Mr. Crownover, Mr. Wagner, Mr. Calloway and Mr. Bunn all assured him that if the easements needed were granted, the company would have the right to pave the easement and use it for parking. Mr. May also was concerned as to whether they would be permitted to reroute the existing drainage ditch which crosses through the middle of their property. He was informed that this might be in the flood plain, and if so, would require an engineer to design the re-channelization and submit the plans to Harold Lieberenz, Inspection Superintendent, for a special permit. Clayton Powell said he did not object to rerouting the drainage of the creekbed as long as the entry point and exit point of the creek from this property is not changed. After discussion as to the easements needed by the various utility companies, it was mutually agreed that a 25 ft. wide public utility easement would be granted paralleling the new West right-of-way line of Highway 112, that the easement would also include authorization for Warner Cable (TV Cable) to use the easement, and that the document would include a statement assuring Arkansas Bandag Corporation that the easement could be paved and used for parking. The meeting adjourned at 11:30 o'clock A.M.
