MINUTES OF A PLAT REVIEW COMMITTEE MEETING
A meeting of the Plat
1978, at 9:00 A.M. in
ville, Arkansas.
CITY REPRESENTATIVES
Review Committee was held on Thursday, September 28,
the Board Room, City Administration Building, Fayette -
PRESENT: Bobbie Jones, Angie Medlock, Don Bunn, Clayton
Powell, Wally Brt, Larry Poage, Don Osburn.
UTILITY REPRESENTATIVES PRESENT: Kenneth Wagner, Floyd Hornaday, Dick Shaw.
DEVELOPERS and/or ENGINEERS PRESENT: Mel Milholland, W.D. Pickell, Robert Reagan.
The first item was the preliminary plat of Pinewood
Subdivision, located on the west side of Azalea
Terrace Drive, south of Old Wire Road.
Robert Reagan was present to represent.
1. Clayton Powell (Street Superintendent): Mr. Powell noted that this subdivision
is being built against an existing subdivision street and it will block any
extension of Yvonne. He said he doesn't see any public improvements needed
except sidewalks and street lights. He asked that sidewalks be graded to not
empty into the street. Mr. Reagan explained that if he installed sidewalks,
he would lose a lot of pine trees Mr. Powell said he could move the sidewalks
back to his property line to possibly avoid some of the trees.
Mr. Powell said they would need to get curb cuts and driveway permits.
2. Wally Brt (Sanitation Superintendent): No comments.
3. Larry Poage (Fire Department): No comments.
4. Don Osburn (Water Meter Foreman): No comments.
5. L. 0. Ferguson (Warner Cable): No comments.
6. Kenneth Wagner (Arkansas Western Gas): Said he has been working with the
developer of this subdivison. Gas is available. Mr. Wagner said there is
a 2" gas line on the east side of the road, and if there is any digging
there, be sure to notify the gas company.
7. Floyd Hornaday (SWEPCO): Said SWEPCO could furnish underground service
from the south or overhead service from the north from Old Wire Road.
Mr. Hornaday said they would need a 10 foot easement runing east/west
for any place street lights are required.
8. Dick Shaw (Southwestern Bell): Said they will have service in the proposed
25 foot utility easement. Mr. Shaw said he would need an access to get
across Azaela Terrace Road. He requested a 25 foot utility easement between
Lots 1 and 2, 121/2 feet on each side of the lot line.

Preliminary Plat
9. Bobbie Jones (Planning Adm)Preliminary plat is misspelled. Sidewalks are
required and street lights at a maximum 300 foot interval are required.
This may be waived by the Planning Commission,but if it is waived
completely, it may require Board of Directors approval. The Planning
Commission will have to waive the scale to permit 1" = 30'. No topography
is shown on the plat. Show the proposed use as single-family. The
legend should show the designation forthe iron pins and monuments.

Iron pins are required at each lot corener between lots and concrete monu-
ments at each subdivision corner.
Dimension the right of way for Azalea Terrace. Show existing easements
in Azalea Terrace Subdivision, including a 25 foot easement along the south
side of this property and a 15 foot easement between two lots in Azalea
Terrace. Show utilities existing in these easements.
Show the right of way where Yvonne would stub into the end of this property --
somewhere near the middle of Lot 4 and the lower part of Lot 3.
The Planning Office will need a revision by Monday, October 2, noon, to go
to the Planning Commission on October 9.
10. Don Bunn (City Engineer): Said he has approved water and sewer plans and
will need to talk to the developer about easements for service lines.
Suzanne Matthews whose property adjoing this said she is against the building
of 5 houses on. this small piece of property. Bobbie Jones said there are
specific reasons why the Planning Commission could refuse to approve a plat.
These reasons consist of the plat not being submitted in accordance with the
zoning and subdivision regulations. Ms. Matthews submitted a letter in opposition
to the proposed subdivision which follows on page 4. Mr. James Spellman was also
present in opposition.
The other item for consideration was the
proposed final plat of Huntingdon Subdivision,
located north of Old Wire Road and west of
Highway 265. Mr. Pickell was present to represent.
1. James Crownover (Ozarks Electric): Not present. Said he has given the
developer a layout but has not had time to check this layout against the
easements shown on the plat. Mel Milholland said they used this layout
for the utility easements. Mr. Crownover said he would not have any problems
in going ahead with the three structures the developers are proposing at this
time.
HUNTINGDON SUBDIVISION
Final Plat
2. Clayton Powell (Street Superintendent): Said the two private accesses shown
for the three lots may cause problems. Mr. Powell said the Property Owner's
Association will be responsible for maintenance of the medians on the
culs-de-sac and the poind. Mr. Powell said this should be reflected on
the plat and in the protective covenants. Mr. Powell said he has not
received any final street plans yet and the final plans are supposed to be
approved by the street superintendent before the final plat is approved by
the Planning Commission. Mr. Powell also noted that no construction should
be started until final street plans have been approved.
Mr. Pickell said maintenance of the medians is included in the covenants as
a responsibility of the Property Owner's Association.
3. Wally Brt (Sanitation Superintendent): Mr. Brt said the City will not
be responsible for breaking of the curgs on medians and green areas. Mr.
Brt said he would rather not go onto the private drives to pick up trash,
but will if the property owners submit a letter granting him permission to
travel on the private drives. Mr. Brt said he would prefer that they
construct a masonry garbage can holder at the street line.

4. Larry Poage (Fire Department): Asked what type of building they are proposing
and Mr. Pickell said it would be a 20 x 30 foot one -room structure with
restrooms and lockers underneath. Mr. Pickell said this would be a civic -type
building and the basement would be used as a locker room for those using
the common facilities. Larry Poage said they would require an exit to the
outside from the basement. Mr. Pickell said they have provided this.
5. Don Osburn (Meter Reader Foreman): Asked if the tennis courts and pool
would be on the same water meter and Mr.Pickell said "yes". Mr.Pickell
said there would be multi -family in the subdivision on those lots surrounding
the park area with a maximum of 4 units per lot. Don Osburn said the
developer would need to rename Langton Court since there is already a
Langston Place.
Mr. Osburn asked that they indicate house numbers on a post where the water
meters will be located for those lots which will be tandem lots.
6. L. 0. Ferguson (Warner Cable): Mr. Ferguson said they have started installing
pipe for cable and are going in the ditch with SWEPCO and Ozarks Electric.
7. Don Bunn (City Engineer): Mel Milholland said water and sewer are being
put in now. He said they are waiting on fire hydrants and if they come in
soon, they expect to be finished installing water and sewer lines in about
two months.
8. Kenneth Wagner (Arkansas Western Gas): Said they hope to start in this
subdivision as soon as their contractor gets free. He stated that until
there -is a street address or lot number issued, the gas company will probably
just put their line in and not leave any services. Mr. Wagner said they
should show the restrictive easement for the 10" high pressure gas line
on the east side. He asked that the developer contact the gas company
before any digging is started in that area because that line serves
Springdale and Rogers.
9. Floyd Hornaday (SWEPCO): Said the easements on the south and west side
look fine. Mr. Hornaday said SWEPCO cannot get started providing service
until they have lot numbers on the plat. Mr. Hornaday noted that SWEPCO
has some lots which are in conflict with Ozarks Electric and they will have
to apply to the Public Service Commission to obtain approval to serve those
lots on the west side which are not in their service area.
10. Dick Shaw (Southwestern Bell): Mr. Shaw said it benefits all utilities
if the engineer will submit the final plat as soon as possible.
He asked that they designate all utility easements as utility easements
and dimension the width of each. Show a 25 foot utility easement on the
green areas coming in on Oak Bailey and Warwick Drive which were shown on
the preliminary plat. Mr. Shaw said the telephone company will need a
25 foot easement running north/south between those lots added on the
private drives. Mr. Shaw said to make a notation on the plat that all
green areas will also be utility easements.
11. Bobbie Jones (Planning Administrator): Said Harold Street should be shown
as Errol Street. Identify each easement as utility easement or drainage
easement. Show the gas line as being a restrictive easement, if it is
restricted to Arkansas Western Gas. Show the 30 foot unnamed street right-of-
way on the southwest side. There is a conflict with two street names --Harold
and Langston. Show all certificates and information. Show all lot and block

numbers. The Planning Office will need a ::opy of die protective covenants.
Add notes on the plat to show acreages devoted to specific uses. Show over-
all proposed density in the entire subdivision.
Show which lots are proposed for anything other than single-family, and
maximum density per lot. Designate the flood plain area.
You will need to submit a final plat application and fee.
Bobbie Jones said she has not yet checked the file on this subdivision,
but felt there was a requirement by the Planning Commission that the
developer notify all adjoining property owners of the date of the meeting
of the Planning Commission to consider this final plat.
Mel Milholland asked if they could get a waiver on the size of the plat
and Bobbie Jones said the Planning Commission has not wiaved the plat size,
but the engineer could submit more than one sheet, if he wishes.
