A meeting of the Fayetteville Plat Review
June 15, 1978, at 9:00 A. M., in the Board
Building, Fayetteville, Arkansas.

CITY REPRESENTATIVES PRESENT: Bobbie Jones, Angie Medlock, Don Bunn,
Larry Poage.

DEVELOPERS and/or ENGINEERS PRESENT: Neal Albright, Jim Hatfield.
The first item for consideration was the
large scale development of Jim Hatfield,
located at the southeast corner of Dickson
Street and College Avenue, Midtown Plaza.
Neal Albright and Jim Hatfield were present to represent.

1. David McWethy (Administrative Assistant): Said it appears a portion of the
existing building is on the street right of way. He said he feels they should
consider bringing that existing structure into compliance with the setback
requirement. He stated that the driveway near_the_inter4ection;of_,,
College-and-Dickson,:.whichhis-existing now; is a very dangerous problem and he
feels they should close it at this time. He noted that if there is ever any
widening done to that intersection the driveway will be in the right of way.
Neal Albright said they would try to work out something to modify that corner.
2. Larry Poage (Fire Department): Mr. Hatfield said they are considering building
the building to the east, and the one to the south and not starting construction
on the one on North College at this time. He said that may be built in a future
phase. Larry Poage asked that when they get ready to build the building on
College, they get back with him. He indicated that building may need to be
sprinkled.
3. Clayton Powell (Street Superintendent): Dickson Street is designated as a
collector's street requiring 60 feet right of way. At the present time, we
have 47.5 feet. This will require a dedication on Dickson Street of 6 ft.
3 inches.
On College Avenue, which is designated as an arterial street, we now have 60
feet right-ofeway and the requirement is 80 feet. This will require an
additional dedication of 10 feet.
Mr. Powell stated that any driveway access from College will have to be
approved by the State Highway Department district engineer in Fort Smith.
The City Engineer's office has the forms to provide you to request this
approval.
Mr. Powell said any existing driveway which does not meet the safety zone
of 50 feet from the intersection should be corrected at this time.
He also requested that they control the on-site drainage and not empty it onto
College Avenue.

4. Don Bunn (City Engineer). There is a 4" water line in Dickson Street, on the
north side. Mr. Bunn asked if they would have any fire protection and Mr.
Hatfield indicated they would use fire plugs.
Don Bunn said there is a sewer manhole southeast ofthis property which the
back building would need to tie onto. He said the other building may be
able to tie into a manhold on Dickson Street, but he would have to work with
them on this. He also asked that they master meter the water.
5. Floyd Hornaday (SWEPCO): Said they have service on the south side of the Church
property and said he thinks they can come up the alley to get service to the
building on the east and the one on the south. Mr. Hornaday asked if they
would want overhead or underground service and Mr. Hatfield said they are not
sure yet. Mr. Hornaday stated that if they want underground, the electric
company will ask that the developer• -furnish the trench and the cable,
and probably some conduit out to the existing overhead service. If they
decide to go overhead, the electric company will take service to the building.
Mr. Hornaday asked that they let him know how many different offices there will
be in each building so they can plan their service requirements. He asked that
they also let him know if they want individual metering.
6. Andy Calloway (Southwestern Bell): Said there is no way to bury direct to
the building on College. He suggested that they designate a 6 x 6 ft. or
8 x 8 ft. telephone terminal room in the building at the southeast corner
so they can stub a piece of conduit out to the other buildings from this
terminal room, and all buildings could be looped and tied together.
Mr. Calloway asked for a 4" conduit into the main building and 3" conduit
into the other buildings.
7. Clyde Terry (Warner Cable): Said he prefers to go overhead if SWEPCO has
a pole line. If they do go underground, he asked that they furnish a piece
of 2" PVC conduit into the building. Mr. Terry said he will need to feed
from Dickson Street. If they go underground, he said he would need to work
with the developer on where he would need conduit.
8. John Kehn (Arkansas Western Gas): Said they have a 6" gas line on the south
side of Dickson Street. He asked that the developer get with him when they
have more complete plans. He said they also have a gas line on the church
property but feels they will want to serve from Dickson Street.
Bobbie Jones (Planning Adminstrator): Said Dickson Street presently has
47.5 feet right of way and the requirement is 60 feet. She said this
developer would need to dedicate 6 ft. 3 inches on the north side of their
property for the widening of Dickson Street. On College Avenue, there is
presently 60 feet right of way and the requirement is 80 feet. The developer
will be required to give 10 feet right of way on Dickson Street. This may
.only be waived by the Board of Directors on a recommend by the City
Planning Commission. These dedications will need to be done by a separate
instrument. Mr. Albright said he feels the owner will want to grant the
additional right of way. He noted that the setbacks shown on the north
side of the property (Dickson Street) are shown from the new right of way;
however, the setback shown on College Avenue is from the old right of way.
Bobbie Jones said they will need to either increase the building setback
for the building shown on College or obtain a variance to permit it to be
43.83 feet from the street right of way. Neal Albright indicated they would
move the building back 10 feet. Bobbie Jones said they could reduce the
setback to 25 feet with vegetation 18" high at the time of planting and
covering 10% of the open area in the front yard.

Bobbie Jones said Mr. Albright would not need the certificate of ownership and
dedication shown on the plat or the certificate of accuracy shown.
Bobbie Jones said they would need a Board of Adjustment variance for the building
on the southeast corner. Part of the building is in the R-0 district which would
require a building setback.
Bobbie Jones said they need to show a 30 foot separation between driveways.
Also, in the Residential zones, or within 50 feet of a residential zone, the
parking area must be set back from the street right of way 25 feet or may be set
back 15 feet with landscaping. She noted that if they come back 15 feet, they will
lose 3 parking spaces, if they come back 25 feet, they will lose 6 spaces.
Bobbie Jones noted that the existing driveway on the northwest corner is dangerous.
She said one of the basis' by which the Planning Commission may disapprove a
large scale development plan is if "the proposed development would create or
compound a dangerous traffic condition." The ordinance says a "dangerous"
traffic condition is one in which the risk of accidents involving motor vehicles
is significant due to factors such as, but not limited to, high traffic volume,
topography, or the nature of the traffic pattern.
Excluding the existing building, you are 92 parking spaces short.
The Ordinance requires that you file an as -built plot plan after the buildings
are finished showing what is now on the plan, as well as individual utility
service lines.
Bobbie Jones said she felt they should have a view -obscuring fence down the east
and the south sides of the property.
Bobbie Jones noted that Donnie Osburn, Meter Reader Superintendent, will not
set a permanent meter until there are permanent numbers on the building which can
be read from the street.
Any signs will need to be cleared by the City Sign Inspector, John Dietzen.
Any portion of the building having to do with food handling will require approval
of those plans by the State Board of Health.
Any building which costs more than $50,000 will require an architect's stamp
of approval on each page of the plans, and a certificate. (A copy of the certificate
may be obtained from the Inspection Department).
Bobbie Jones asked that they notify the property owner to the south and the one to
the southeast. this may be done by certified letter, return receipt requested.
The Planning Commission has the authority to require upgrading of Dickson Street
to meet current City standards.
We will need a revision by Monday, June 19, noon, to go to the Planning Commission
on June 26.
The second item for discussion was NORTHWEST ARKANSAS MALL
the proposed relocation of a drive Relocation of Drive
in the Northwest Arkansas Plaza.
—No one was present to represent.
Bobbie Jones said they want to relocate the road so it will be south of Sambo's
and north of Nelson Funeral Home. She said they have set aside 60 feet for
right-of-way. She said she understood they want to build the street to City
standards and may want to dedicate it as a city street and name it Bassett Road
1. Clayton Powell (Street Superintendent): Said they have indicated 60 ft.:rxght-of-way
dedication. Hesaid he does not see any purpose in that since they are not aligning
with any street on the east side of Highway 71 (Shepard Lane).

He said there is a depth of 450 feet from the new proposed street to the proposed_Stearns
Road which would allow for a depth large enough for double lots.
He said the street stub to the rear of Sambo's should be abandoned as a City street
since it will only serve private businesses and private businesses should maintain
their own driveways. Bobbie Jones said she did not think it had been dedicated
as a city street.
2. Jimmy Crownover (Ozarks Electric): Said they do have a 3" underground line which
will have to be protected. He said he did not know the exact location of that line.
He stated that if that line would have to be moved, it would have to be moved at the
developer's expense.
3. Clyde Terry (Warner Cable): Said they also have a cable line in that area and if it
has to be relocated, it will be done at the expense of the developer.
4. Floyd Hornaday (SWEPCO): The far west side of the road is the only portion that is
in their service area and they do not have any lines in that area.
Andy Calloway (Southwestern Bell Telephone Co.): Said the telephone company would
require reimbursement for any relocation of telephone lines.
6. John Kehn (Arkansas Western Gas): Said they have a gas meter close to the proposed
construction. He said he had talked to a representative from General Growth who
indicated they could work around that meter. Mr. Kehn said they also have a trans-
mission line which the representative indicated they could work around.

Bobbie Jones noted that ifit is to a publicstreet,. it will have to be approved by the
Planning Commission.
