MINUTES OF A PLAT REVIEW COMMITTEE MEETING
CITY REPRESENTATIVES PRESENT: Bobbie Jones, Angie Medlock, Wally Brt, Clayton
Powell, Don Bunn, Larry Poage, Larry Palmer.
UTILITY REPRESENTATIVES PRESENT: Floyd Hornaday, Kenneth Wagner, John Kehn,
Dick Shaw.
DEVELOPERS and/or ENGINEERS PRESENT: Wayne Jones, Lee Boss, Gary Ward.
The first item for discussion was the proposed
airport terminal to be located on Highway 71
South, south of the present terminal building.

AIRPORT TERMINAL
Highway 71 South
Engineers, were present
1. Clyde Terry (Warner Cable): Not present. Said they would have to serve from
the west side of the railroad tracks and said at this time he did not know
how they would get across the railroad tracks.:•and Highway 71. He said they
would try to extend service if the developer requests it. Mr. Terry said
they may ask the developer to participate in the cost of extending service
2. Clayton Powell (Street Superintendent): Stated that there is a drainage
problem in this area. He noted that the last rain we had washed away the
railroad and completely blocked the 36" pipe that underdrained Highway 71.
He said there is a discharge outlet on the east side of Hwy, ..71 skewing water where
the proposed parking and new building is shown. He said there will have to
be extensive drainage on the entire property to ever have any dryness in that
area. lie stated that any storm drainage work on Highway 71 will have to be
approved by the district engineer, Calvin Peevy, in Fort Smith.
3. Larry Poage (Fire Department): Asked if there will be any flammable liquids
stored in the building. Larry Palmer indicated that most flammable things will
be stored away from this building. He said there will be a place for bulk
storage at the southwest corner of the building.
Larry Poage asked if there will be a fence on the west side. Larry Palmer
said there will be a fence along the ramp, which will probably have a 12
foot gate.
4. Wally Brt (Sanitation Superintendent): Asked if they will need a container.
Larry Palmer said there will be a full -line restaurant which will need containers
and may need as many as three. They decided to set one container at the north-
west corner of the freight loading/unloading area, south of the security
lighting. Wally Brt asked that they put the container at a slight angle so the
trucks could get to it. Larry Palmer said he would have to get back with Mr.
Brt on the location of the container which will serve the restaurant.
5. Dick Shaw (Southwestern Bell): Asked where the mechanical room will be located.
He asked that all panels - coming into the mechanical room be 4 x 8 X 3/4"
plywood. He said the main feeder coming into the mechanical room needs to
come in from the north side of the driveway and be two 3" PVC conduits. He
said if they do not come in at an angle, and decide to go north, then west
to the fence line, the telephone company will need a pull hole.
6. Kenneth Wagner (Arkansas Western Gas): Said the gas company has a 3" gas
line close to the road. Mr. Wagner asked where they would want the gas
meters set and Mr. Palmer said he would prefer to have them set at the
property line.. Mr. Wagner recommended that the gas line under the pavement

• be cased. Mr. Wagner asked if the buildings would be on separate meters
and Larry Palmer felt the restaurant may be on a separate meter.

7. Floyd Hornaday (SWEPCO): Said underground service terminates now to the north
of this. He said they propose to go down the highway to where the fence is
now shown and would like to go underground from there into the transformer
location. He said there will be about a 500 foot pull so they will need a
pull hole about half way.Mr. Hornaday said they need one 4" PVC conduit but
strongly recommended that they place two 4" PVC conduits so if they have
trouble, they could correct it a lot quicker. He said if they want separate
meters for electrical service, one transformer could be used for all facilities
and then they will split it into separate meters. He said this would not be
a problem.
8. Bobbie Jones (Planning Administrator): Stated that the airport is a condi-
tional use and does require Planning Commission approval. Larry Palmer said
he would like to go to the Planning Commission on June 26. Bobbie Jones
stated that the parking requirements for the terminal are one for each 500
square feet of enclosed passenger terminal. She noted that they have shown
18,000 square feet of building, so the parking shown is adequate.
Bobbie Jones'said they will need to check with Harold Lieberenz on the flood
plain if they have not done so. She asked if they have been working with the
FAA for clearance. She stated that they will have to have State Board of
Health clearance for the restaurant for both plumbing and food handling.
She noted that on each page of the plans, there will need to be a statement
signed by an Arkansas registered engineer or architect, and stamped on each
page of the plans.
Bobbie Jones questioned the square footage of the restaurant and Larry
Palmer said it would be approximately 1500 square feet.
Bobbie Jones said that upon completion of the building, she will need
as -built plans showing the location of all utilities, including underground
conduit.
Also, before going to the Planning Commission, we will need names and addresses
of the adjoining property owners so they may be notified.
Bobbie Jones felt that part of the airport property is located outside the
City limits and asked that they check into this.
9. Don Bunn (City Engineer). Said there is a 12" water main on the east side
of Highway 71. Mr. Bunn asked if they have checked the grades for the sewer
and Mr. Jones said they can get into the lift station there. He stated that
was why they had to raise the elevation on the building. Mr. Jones noted that
there is also a 4" force main on the south side.
Don Bunn asked if they would want to make the sewer line a service line or
a sewer extension. He said it would have to be a 6" line. He noted that if they
want to make a sewer extension, they could put a manhole closer to the building
and dedicate it to the City and the City would maintain it.
The only other item for discussion was
a request submitted by Lee Boss to
close a utility easement located on

on North College Avenue.

Lee Boss explained that Midas Muffler (who is trying to buy the property)
has worked out an arrangement with Old South Donut Shop to share a parking
lot. He explained that their problem is that there is a utility easement
on the north side of the property which he gave to the City and which is
not being used by any of the utility companies at the present time. He said
the Ordinance requires that any building be built 20 feet from the center line
of a public easement which would make the building 25 feet from the property
line on the north side. He stated that they need the. additional footage
to have room to put the building on the property. He explained that the
easement was originally given for the gas company to extend their line, but
they decided to go down the east side of the property. Mr. Boss felt if
the easement is vacated, they could get within 10 feet of the private drive.
Bobbie Jones noted that she has a request from the Title Insurance company
asking that she sign a note sayingthat there are presently no easements
or rights-of-way on the property and there are none planned. She also
noted that the Street Superintendent and City Manager would like to see
the 40 foot private drive be changed to a city street and an additional
10 feet right of way dedicated.
1. Clayton Powell (Street Superintendent): Stated that at one time the
subdivider of property to the east requested that he be allowed to construct
a street to City' standards on the existing 40 foot strip. . The
Master Street Plan does not call for a collector street in this area but
for general traffic flow it is desirable to have this street connected from
College Avenue to the terminal point east. He stated that only the Planning
Commission and Board of Directors can say whether or not they don't want any
additional street right of way. If they do, we will need an additional five
feet right of way from this side of the street for the depth of this lot.
The abandonment of the easement will have no bearing on the street if the
easement is not needed by the utility companies. Mr. Powell questioned
if the owner would object to giving five feet right of way for a street.
Mr. Boss asked what the setback would be from the street if it was a
dedicated city street and Bobbie Jones explained that with landscaping 10%
of the open area and no parking between the building and the street the
building setback could be reduced from SO feet to 25 feet. Mr. Boss said
he had worked with Mr. Brophy on giving enough right of way for a street
a few years ago but Mr. Brophy's attorney recommended'.Uiat he not purchase
the additional right of way needed for the street because eventually the City
would either give him a waiver and let him build a 40 foot street or take
the needed right of way to make it a 50 foot street.
Clayton Powell also stated that there must be a 25 foot separation between
driveways and the driveway may be a maximum of 40 feet wide.
Clayton Powell stated that there is drainage coming.from the crest of the
mountain west into this property and there is an existing drainage ditch
running diagonally across this lot from the southeast corner to the.
northwest corner. If this is filled, that water will need to be re-routed so
the drainage won't damage adjoining property. He said for this developer to
tie onto the drainage structure on Highway 71 would require permission from
the State Highway Department engineer, Calvin Peevy. He stated that they
would not allow the drainage to be dumped onto the street. Mr. Boss said
they will show drainage plans when they apply for a building permit. He
said they plan to come east to west along Old South Donut with a concrete
swale down to the highway and put in another catch basin there and then
funnel the water north about 90 feet to the larger catch basin.
Clayton Powell stated that too often, the City officials and public utility repre-
sentatives are hass,ied.by:developers- when the street problem could have been
easily solved by the property owners at an earlier date.

3. Dick Shaw (Southwestern. Bell).:: Said he may need that easement to get into
some property in the back at a future date and said he could not release it..
4. Kenneth Wagner (Arkansas Western Gas): Said the gas company has been requested
to do a lot of work up on the hill and they may need to extend a gas line
through that easement at some time in the future or may need to relocate
some existing lines. He agreed that he would be reluctant to release the
easement at this time.
5. Floyd Hornaday (SWEPCO): Said they do have a guy in the 10' easement and they
will have to have enough easement to cover that. He stated that he does
concur with the telephone and gas companies that they may need to use that
easement in the future.
6. Don Bunn (City Engineer): Said they have a sewer line in the private drive
or the 10 foot easement. He stated that if they also need to put a water line
in, there: would not be enough room with only 40 feet right of way. Mr. Bunn
said if the private drive becomes a City street, they would not have a problem,
since on City streets, they like to stay in the street easement with water
and sewer lines, when possible. If the private drive stays private and they
need to run another line in there, the 10 foot easement would be helpful.
7. Larry Pogue (Fire Department): No comments.
8. Bobbie Jones (Planning Administrator): Said she had talked to the Inspection
Superintendent, Harold Lieberenz, and he had talked to City Manager Don Grimes
who feels a street could be very vital in that area. She said there is not
anything that the Planning Office can require since this is not shown on the
Master Street Plan, but the Planning Commission and Board of Directors may be
able to require something.
Bobbie Jones asked the size of the building and Mr. Boss said it would be 40 ft.
by 75 ft. (north/south). She said if the utility companies do not want to
vacate the easement, and it is not required to be built as a City street,
he could petition to the Board of Adjustment for a variance to permit him
to build the building next to the easement. If the drive is required to be
a City street, the building setback will increase to SO feet withparking or
25 feet with no parking between the building and the street and landscaping
occupying 10% of the open area.
