PLAT REVIEW COMMITTEE MEETING
A meeting of the Fayetteville
May 26, 1977, in the Board of
Fayetteville, Arkansas.
CITY REPRESENTATIVES PRESENT:
Planning Commission was held at 9:00 A. M., Thursday,
Directors Room, City Administration Building,
Angie Medlock, Bobbie Jones, Wally Brt, Clayton Powell,
Scott Martin.
UTILITY REPRESENTATIVES PRESENT: Dick Shaw, John Kehn, Clyde Terry, Floyd Hornaday.
DEVELOPERS and/or ENGINEERS-tkESENT:
Leo Peel.
The first item for consideration was the preliminary
plat of Grandview Place located East of Highway 71,
between 26th Street and 24th Street; Leo Peel, Developer.
Leo Peel was present to represent.
1. Wally Brt (Sanitation Superintendent): Wally Brt questioned

Preliminary Plat
if there would be access from Highway 71 and Mr. Peel said he had been talking with
the State Highway Department in Little Rock and they have set up three access points
to come in from Highway 71. They are going to four -lane Highway 71 but they will
not need any additional right-of-way from Mr. Peel. He will also have access from
either end, 24th Street or 26th Street. Wally Brt said when he progresses with
the proposed developments to get back with him on the location of the Lo -dal
containers.
2. Scott Martin (Acting City Engineer): Said water is already available. There is a
sewer line through Lot 1 and part of Lot 3 but he was unsure of the exact location.
He said they do have an easement covering this and it should be shown on the plat.
He said sewer service to Lots 2, 4, 5, and 6 would be a problem and Mr. Peel might
want his engineer to be looking at this. Leo Peel questioned if they could run a
water line along the back of Lots 3, 4, 5, and 6 with the gas line and Scott Martin
said there is a water line on 24th Street, 26th Street, and Highway 61 and he would
rather serve from the front since water is already available.
3. John Kehn (Arkansas Western Gas Company): Said all of the businesses would be
served from the back. He said if the gas company is the only utility in the ease-
ment, 15 feet will be sufficient. This easement should run north and south along the
east side of Lots 3, 4, 5, and 6. Mr..Kehn questioned how high the retaining wall
would be between the C-2 and R-2 and Mr. Peel said it would be 411-5 feet high.
Mr. Kehn said if they would put a pipe through the wall the gas company could run
wire through the wall and not have to go under it. He said he would talk to Mr. Peel
later about a contract.
4. Dick Shaw (Southwestern Bell Telephone Company): The telephone company asked for a
25 -foot easement completely surrounding the property on all four sides. He said
this wouldn't affect Mr. Peel anywhere except on the east property line. Everywhere
else it will be in the building setback. Mr. Peel asked if he could split this
easement with the property to the east and Mr. Shaw said he could if they would give
the land for the easement but Mr. Peel would have to get them to give the easement.
Mr. Shaw mentioned that there may be an existing easement on Grandview which they
don't know about. Mr. Peel said he doubts if there is already an easement existing.
Dick Shaw asked that if there is to be blacktop close to the building, they call the
telephone company so they can get conduit in before the paving is done. He said
the telephone company does request the developer to pay for the conduit.
5. Floyd Hornaday (SWEPCO): Questioned if they are going to put in two sets of apartments
and Leo Peel said he is planning on two twelve -unit apartments. Floyd Hornaday
said he would go in the 25 foot easement surrounding the property with the telephone
company and Warner Cable.

6. Clyde Terry (Warner CAble): Said the 25 foot, perimeter easement is satisfactory
with him. Mr. Terry said Warner Cable will request the developer to furnish conduit
under blacktop or cement to get into the building.
7. Clayton Powell (Street Superintendent): Said 24th Street on the Plat Book reflects
we have 60 feet right-of-way. He said there has been some confusion regarding this
60 feet of right-of-way. The developer of Country Club Estates submitted a
dedication all the way from Highway 71 South to their subdivision. They could not
dedicate the additional street right-of-way for 24th Street west of their subdivision.
When Grandview Apartments were constructed they obtained a deed for 30 feet from the
centerline to the north property line and Clayton Powellasked that Mr. Peel also
give 30 feet from the centerline on this property.
26th Street has 35 feet of right-of-way. They will need 7.5 feet of right-of-way
on the north side of 24th Street. Bobbie Jones said he has a deed for 10 feet of
right-of-way on 24th Street but she did not know whether this was taken into
consideration on the plat book or on this plat.
Clayton Powell said Highway 71 is designated as a principal arterial. 80 feet of
right-of-way is required and he may or may not need additional right-of-way.
Clayton Powell said the commercial zones require a 5 foot sidewalk. In residential
areas, a 4 foot sidewalk is required. He mentioned that the City has just finished
an improvement district on 24th Street. He requested a 4 foot sidewalk on the south
side of 24th and the north side of 26th Street and a 5 foot sidewalk where they abut
Highway 71.
He said the box culvert drain running through the property was constructed without
any approval of engineering plans and was never designated as an easement or public
right-of-way, therefore, it will have to remain a private responsibility.
He asked that they control on-site drainage and divert it to their box culvert drain,
not let the drainage run onto 24th Street, 26th Street; or Highway 71
For driveways and curb cuts for access to Lots 3, 4, 5, and 6 will be from Highway 71
he will have to have a permit from the State Highway Department. For Lots 1, 2, 3
and 6, if he wants access to those from City streets, he will need permits from the
inspection department.
8. Harold Lieberenz (Inspection Superintendent): Bobbie Jones said Harold Lieberenz
said where they have flumed the drainage ditch, that is shown as being in the flood
plain area, 50 feet each side of the centerline of the ditch and approximately 250
feet from the highway. He said the floor elevation of the buildings will have to be
two feet above flood elevation.
9. Bobbie Jones (Planning Administrator): Said on the plat where it says "zoning" it
should say R-2, Lots 1 and 2; and C-2, Lots 3, 4, 5, and 6. There is an error in
the acreage. He needs to be on a 1 inch to 100 or 1 inch to 200 scale or get a
variance from the Planning Commission. He needs to put the date on the plat. They
will need proof that the owner of Grandview Apartments have seen the plat, either
their signature on the plat or a certified letter, return receipt requested. Dimen-
sion the full right-of-way for 26th Street and she will send him a copy of the street
deed from 1972. She said he needs to show on the plat where the sidewalks will be.
The street lights are required at intersections and 300 feet intervals along the
street. If there are any street lights existing, they need to be shown on the plat
and show the new ones. She questioned if he would have any protective covenants
or deed restrictions and if not the plat should say "none". There should be a signa-
ture block for the Planning Commission approval. Show the existing sewer easements
on Lots 1 and 3 and show the easements requested by the utility companies. The final
plat should have a concrete monument at each corner of the subdivison and iron pins
at each lot corner.

Bobbie Jones said a revision should be in by June 6 in order to go to the Planning
Commission on June 13.

No one was present for the large scale development plan of Calvary Baptist Church so it
was tabled until June 2.
