HomeMy WebLinkAbout1976-12-30 Minutes• • • MINUTES OF A PLAT REVIEW COMMITTEE MEETING A meeting of the Fayetteville Plat Review Committee was December 30, 1976, in the Board of Directors Room, City Fayetteville, Arkansas. held at 9:00 A. M., Thursday, Administration Building, CITY REPRESENTATIVES PRESENT: Clayton Powell, Bobbie Jones, Angie Medlock. UTILITY REPRESENTATIVES PRESENT: Clyde Terry, Jimmy Crownover, Frank O'Donnell. DEVELOPERS and/or ENGINEERS PRESENT: T. Ewing Shelton, Beverly Tyler, Mahaffey (arrived 10:00 A. M.). The only item for discussion was the preliminary plat of a replat of part of Blocks 2 and 3, Shelton's Sub- division, North of Highway 45. The property is in the county. John E. T. EWING SHELTON Preliminary Plat Shelton's Subdivision Mr. T. Ewing Shelton and Mrs. Beverly Tyler were present to represent. Mr. John E. Mahaffey arrived 10:00 A. M. to represent. 1. Charlie McWhorter (Fire Chief): Not present. This property is outside the City. We will serve it on a call basis and there will be a fee charged. There are no fire hydrants. 2. Wally Brt (Sanitation Superintendent): Not present. Sanitation service is not provided outside the City. 3. Roy Hawkins (Southwestern Bell Telephone Company): Not present. We will need a 10 foot easement on the back (south) side of Lots 2 and 3, Block 2, bordering Lots 7 and 8, Block 2, and the 10 foot easement on the east or back side of Lots 3, 4, and 5, Block 2, needs to be extended all the way to the Highway 45 right-of-way. 4. Clayton Powell (Street Superintendent): Said this property is outside the City limits but within the City's planning jurisdiction. He mentioned that Kingston Drive does exceed the length for a City dead-end street but he doesn't know about the requirements of the County. 5. Bud Allen (County Planning Administrator): Not present. Said the County has a letter and certificate they will give to Mr. Shelton. Judge Lester will accept the dedication of the road on the plat but the county will not accept it for maintenance until its improvements have been approved by the County Road Superintendent. 6. Frank O'Donnell (Arkansas Western Gas): I think possibly the easiest way to serve Lots 2, 3, 4, and 5, Block 3 (original plat) would be the easement along the west side of Lots 6 and 7, Block 3 (Replat). We could lay along the perimeter to get to Lot 5. We could come up and lay on the back slope of the property line to serve Lots 2, 3, 4 and 5. Arkansas Western Gas has a line to the Southwest corner of Lot 2, Block 2. There is an easement up the west side of that lot; we could follow that easement to the south side of Kingston Drive, then follow the south and east side of Kingston Drive; to the common lot line between Lots 5 and 6. The gas lines and street crossings will need to be in before the street is paved. We may need a 10=foot easement to go across the southwest corner of Lot 2, Block 2, or we will need a letter from the owner of Lot 1, Block 2, Mr. Philip Tooley, which will let us use the utility easement across their property (that existing easement may be for overhead lines only). 243 • • SF Plat Review Committee Meeting )ccember 30, 1976 -2- 7. Jimmy Crownover (Ozarks Electric): Needs a 20 foot easement on the back (south) of Lots 2 and 3, Block 2; to get to 2, 3, 4, and 5. The 10 foot utility easement shown on the east side of Lots 3, 4, and 5, Block 2 won't be enough. We will need at least 20 feet; assuming the rest of the service will be overhead. I already have service at lots 1, 2, 6 and 7; I can use that for the take -off point. This would be the simplest way for us. The easement across Lot 8 is not wide enough for us to put in a line. If we decided to use Highway 45 as the take -off point, we would have -to get an easement from the people on the south side of Highway 45. Jimmy Crownover called at 11:00 A. M. and said he had been out on the site and electric service is already in the subdivision. He can serve but asked for. a 20 foot ease- ment down the east side of Lots 3, 4, 5, and down the east side of Lot 8 (not included in replat, but still owned by Mr. Shelton). He does not need the 20 foot easement along the south side of Lots 2 and 3, but the telephone company still needs 10 feet. 8. Clyde Terry (Warner Cable): At this time I do not have service for this but in the future I hope to. Our problem would be the same as Mr. Crownover's. If we did go straight down we would have to deal with the property owners to have a downer (guy wire) in his yard. What we would plan to do if we get out that far would be to follow Ozarks Electric Power lines. There would be extra cost to put in underground but we would rather go overhead. If a letter has to be written to get permission for Ozarks Electric to put a downer on any property, I would suggest Warner Cable be added in that letter. 9. Paul Mattke (City engineer): Suggested that Mr. Shelton replat this. Water is available from the county road to the west (Shelton). You will have to take a dead end stub up the new road (Kingston Drive) to serve these lots. Shelton said the City Engineer's office had told him they would accept a 2 -inch line. Bobbie Jones said it is her understanding that on water and sewer extensions you have to have approval from the State Board of Health. Also, we can't have fire hydrants outside the City. The nearest water line of any size is on Highway 45. The Board hasn't approved any and the lines there aren't large enough. Sewer is not available. Perculation tests need to be approved by the State Board of Health or the County Sanitarian. 10. Bobbie Jones. Said he needs to add a graphic scale; show the acreage included in the replat. Under the location add "Outside the City". Cable TV is Warner Cable. Check to see if the "County Planning Commission" should be the "County Planning Board". The Title Block should read: "Final plat of a replat of Lots 2, 3, 4, and 5, Block 2 and Lots 6, 7, 8, and 10, Block 3, Shelton Addition". The legal description should describe just the replat area (metes and bounds). The concrete monument at the subdivision corners should be a 4 inch by 4 inch by 30 inch, the iron pins should be inch by 30 inches. You will need a pin at all lot corners..and points of tangency and curvature and angles. Dimension the 50 feet right-of-way on Kingston Drive. On the outside boundries put the sums of lots with bearing calls. The Planning Office would like to have one black line print or borrow the original and blue line print to make copies from. We still need the signatures of the adjoining property owners. Mr. Shelton said he is interested in selling 75 feet off the North end of Lots 5 and 6 to the owners of Lots 9 and 11. Bobbie Jones told him she had talked with the City Attorney, Jim McCord, and County Planning Administrator Bud Allen and they both suggested we proceed with the plat as it is shown and then have Bobbie Jones, Planning Administrator, grant a waiver of subdivision require- ments or a lot split on Lots 5 and 6 to combine the North part with the lots to the north.
