MINUTES OF A PLAT REVIEW COMMITTEE MEETING
The Fayetteville Plat Review Committee met at 9:00 A.M., Thursday,
October 14, 1976, in the Directors Room, City Administration Building,
Fayetteville, Arkansas.
CITY REPRESENTATIVES PRESENT: Clayton Powell, Wally Brt, Tom Halk, Paul Mattke,
Paul Logue, Mary Parnell, Bobbie Jones.
UTILITY REPRESENTATIVES PRESENT: Dick Shaw, Clyde Terry, James Crownover, Kenneth
Wagner, Harold Lee.
DEVELOPERS and/or ENGINEERS PRESENTS: Mike Watson, Larry

The first item to be discussed was the large scale
development plan submitted by Bill Whitfield to
construct a Burger King on property on the West side
of North College Avenue between SpeeDee Mart and Whit
Chevrolet's truck lot. (South of Township Road).
Mike Watson was present to represent the proposed plan. Comments

were as follows:
1. Wally Brt (Sanitation Superintendent): We have our problems all worked out.
They want to enclose the pad for the trash container on three sides. If
they make that 12 ft. by 15 ft. I should be able to make it fine.
2. Tom Halk (Community Appearance): No comments. Mr. Watson said they do plan
to use shrubbery along the street that will not be over 24" to 30" high.
3. Clyde Terry (Warner Cable): Do they plan to have TV Cable service? Mr. Watson
did not know. Mr. Terry said they do have a line at the West side of the
"surplus" property shown. We are in an easement on an overhead pole line.
I need to know if they will want cable, so I will know whether or not to run
an underground cable in with the power company. If they do want cable, the
contractor must install 2 -inch PVC conduit under the parking lot. Requested
a minimum easement of 20 or 25 ft. along the South side of the "surplus"
property to take care of future needs.
4. Dick Shaw (Southwestern Bell Telephone Co.): If he wants to go underground,
we will need him to install a 2 -inch plastic conduit under that parking lot.
What are his future plans for the "surplus" property? Mr. Watson did not know;
he assumed that Mr. Whitfield would want to park trucks on it, at least for a
while. Mr. Shaw asked for a 20 ft. (or 25 ft. if all utilities have to be in
the easement) easement along the South line of the "surplus" property. If they
think they might eventually put a "road" over the easement, Mr. Shaw thought
they should go on and install a 2 -inch PVC conduit all the way from the
extreme West property line.
5. Kenneth Wagner (Arkansas Western Gas Co.): No problems.
6. Floyd Hornaday (SWEPCO): Not present. No comments. Mr. Watson said he would
personally contact Mr. Hornaday.
7. Paul Logue (Assistant Fire Chief): No comments.
8. Larry Wood (Planning Consultant): No comments. Not present.
9. Perry Franklin (Traffic Superintendent): Not present.

10. Clayton Powell (Street Superintendent): This abuts Highway 71B,or North
College Avenue, and there are to be no public right-of-way dedications
since we already have adequate right-of-way.
He must have a driveway permit from the Arkansas Highway Department for the
driveways. Mr. Watson said that he has already applied for those. Evidently
you are tying to a drainage structure running off Highway 71B. That should
be shown on your application for a driveway permit. Mr. Watson said that
drainage structure crosses the subject property and was put in by and
belongs to the property owner. Mr Powell said that needs to be reflected
on his driveway permit, especially since that is a natural drainage channel
collecting water off Highway 71B. Wally Brt said he thought they had enlarged
that when they rebuilt Highway 71B.
Note #1 of General Construction Notes: The City's standards for concrete
sidewalks in public right-of-way require 4200 P.S.I. with a 28 day curing
cycle, or 51 bag mix which is equal.
Mr. Watson said that the South driveway will be widened to 18 ft. where it
enters the Highway.
11. Paul Mattke (City Engineer): What do they mean by a "soakage pit"? He and
Mr. Watson checked the full plans and decided it was just a standard detail
included in all plans but not planned for at this location.
The water line is under College Avenue. There will be an extra cost for
cutting College Avenue. It takes about 3 weeks to get a permit from the
A. H. D. to cut College; please give us at least a month before you actually
need water service in order to arrange it.
Also I notice the architect calls for a 11 -inch water meter. I would like to
have some peak flow calculations on that. I think you are oversized. I have
never seen a restaurant of this size with 111 -inch meter service. If they will
furnish us peak flow calculations, we can properly size the meter and save
some money, I think.
I notice they call for a sprinkler system on this. Our City is set up so that
we do provide unmetered fire protection water and your architect needs to
know this because it makes a difference in how you design the water piping.
system. Water on an unmetered system CANNOT be used for anything except for
fire protection. We have had some people who used it for their cleaning purposes.
This will not be permitted.
Storm drainage cannot be connected to sanitary sewer.
The sewer main runs across the back of the original tract (West side of
"surplus" property) in the area of that 30 ft. ingress and egress road.
They will need to arrange an easement across that property for their sanitary
sewer. I do not recommend putting it in a public utility easement, because
someone else might cut it and you would have to fix it yourself. Mr. Mattke
recommended a 10 ft. easement adjacent to the easement requested by the other
utilities.
We will tap the sewer main and then your plumber will be responsible for
taking it from there on to the site and into the building.
12. Bobbie Jones (Planning Administrator): Mr. Watson said that Johnie Bassett,
the adjoining property owner to the West, has seen this but has not signed it
yet. He also said that they do plan to construct this with a shake roof
but it will be whatever is required to meet the building code.
Bobbie Jones said she did not see any problems with the proposed plan.

The next item for discussion was the proposed large
scale development plan for Shoney's on property belonging
to General Growth Properties and lying North of the
Northwest Arkansas Plaza. Larry Gage, Manager of the
Mall was present to represent. Comments were as follows:

1. Kenneth Wagner (Arkansas Western Gas Co.): We have a gas line to the North of
Shoneys running down that little road.
2. James Crownover (Ozarks Electric Cooperative): We have no problems. We will
put an underground transformer on the Northwest corner of the lot.
3. Clyde Terry (Warner Cable): If I remember correctly they do not want TV cable
service. Larry Gage said that is correct. Mr. Terry suggested that if at a
later, date they think they might want TV Cable, it would be at the owner's or
operator's expense to run the cable in; therefore, they might want to go on and
place a 2 -inch PVC conduit under the parking lot at this time for future use.
It would be much cheaper than tearing up the parking lot later to do it.
4. Paul Mattke (City Engineer): I am concerned about the location of the water
service we brought in for this. I think the service is presently fixed for
that triangle between the proposed access road and the Mall parking lot. It
should be brought to the same side of the right-of-way for the access road as
the building location. I don't think we have tested, chlorinated, or run a
bacteria test on that main yet. I suggest you have the water meter on the
North side of the access road, if the access road is to be a public dedication,
and place it in an area where we can get to it and where it is well -drained,
perhaps in the Southeast corner where a sign location is shown.
The last time I talked to you, you were unsure whether you would go through
your parking lot or around behind the building to get to sewer. There should
be no problem with sewer, they are crossing their own land with the sewer line.
Mr. Gage said they had run their sewer for this building off the sewer line
located between the offset between Dillard's and Osco's on the East side of
the Mall. It has already been run out from under the pavement. The dedication
of the access road as a public right-of-way may affect sewer also. The City
maintains operation up to the manhole on sewer and then stops there. I don't
think they have enough grade to extend that sewer to be a public sewer out
to this property.
I would recommend that where the sewer crosses that street that they encase
it with 6 -inch steel pipe to try to protect it.
The plumbing inspector will have to inspect that sewer line.
Mr. Gage said that he had contacted Des Moines and the dedications which
Mr. Mattke had asked him about the day before would be taken care of by
October 26.
5. Dick Shaw (Southwestern Bell Telephone): Since this will be a blacktop
parking lot with parking spaces in it, I need a 2 -inch PVC conduit run from
the building to the South side of the access road. We will then bury from
there up the enbankment to our services.
If you don't put it in conduit now, and it goes bad, we either have to dig
the parking lot up at your expense or go in and set a pole.
6. Paul Logue (Assistant Fire Chief): Do you plan to have any fire hydrants on
the property? Mr. Gage said there would be one in the triangle South of the
access road from the lot.

7. Tom Halk (Community Appearance): No.comments.
8. Wally Brt (Sanitation Superintendent): You have not indicated the size of
the pad for the trash container, but it needs to be at least 12 ft. by 15 ft.
because you will need a 6 cubic yard container set there. Also, I don't want
any doors on the front of the enclosure. You may enclose 3 sides if you wish.
Cut back the curb on the Southeast corner of the trash pad location, so my
trucks won't be breaking it. They can't make that turn otherwise.
9. Clayton Powell (Street Superintendent): I have received the street plans and
profiles, but I have not had time to review them. It will be next Monday
or Tuesday before I will have written comments on the street plans. This was
all gone over a year ago on the initial application, so I don't anticipate
any problem.
10. Bobbie Jones (Planning Administrator): I need to check to see if this abuts
the R-0 zoned property. If it does you will need to pull the parking 5 ft.
from the West property line and screen it. I will let you know on that.
Mr. Lieberenz's comments are as follows:
The sign as shown is not permitted. There is a setback problem on it. What
will be the area (size) of the sign?
We need State Board of Health approval on the food handling and plumbing (2
separate clearances).
The grease trap design must have baffles in it.
Will this be a lot split? Do we need a waiver of the subdivision requirements?
Mr. Gage said that General Growth would retain ownership of the property;
Shoneys will have a 30 year lease.
We need a contract for the improvement of the access road.
What arrangements have been made for sewer? (See Mr. Mattke's comments). pp

The last item discussed was the large scale development
plan of James and H. L. Mathias to construct apartments on
property lying North of Fairlane Street and West of
Morningside Drive. Fifty dwelling units are proposed.

1. Clayton Powell (Street Superintendent); Your vicinity map shows Highway 16 East
to the North. Everyone makes this mistake; but that is Huntsville Road. The
State relinquished that part of Highway 16 East long before my arrival. Fifteenth
Street to the South or Highway 16 By-pass is now Highway 16 East.
On 80 ft. of the property shown he has shown a 10 ft. dedication for the widening
of the street right-of-way for Morningside Drive. Why is it not shown for all
the property. Mr. Mathias explained that all they own on Morningside is the
80 ft. section shown and the 30 ft. section to the North of that.
Mr. Powell said that 30 ft. shown can only be a private drive. If it was going
to be a City street, it would have to have 50 ft. of right-of-way, and have
31 ft. pavement from back of curb to back of curb, with curb, gutter and sidewalk.
Do you plan to do anything with that natural drainage ditch on the West side
of the property? Mr. Mathias said they plan to leave it open.
Mr. Powell noted they have a 40 ft. driveway shown off Fairlane Street, also.
If.they wish, they can put in curb and gutter across that 80 ft. on Morningside
Drive, but for that distance it is not really significant. Some of the people
South of there did pay for curb and gutter and drainage along Morningside.
That is not a requirement.

2. Wally Brt (Sanitation Superintendent): I will need a letter in writing from
you with permission for my trucks to travel this private drive. I would
suggest that you construct it in a manner in which my trucks won't fall
through it. If you use a regular bituminous seal, you will have to have a
very good base or my trucks will literally tear it to pieces. A standard
base should meet 90% proctor density and 10% plasticity index. Even if you
use concrete and don't have a suitable base under it, my trucks will crack it.
I would suggest going to trash containers rather than cans. You can get by
with either three 6 cu. yd. containers or four 4 cu. yd containers. With
more containers it would be situated where the tenants don't have to walk so
far; but the 4 cu. yd. containers don't have sliding side doors which the people
like.
Mr. Mathias said they planned to build these apartments in sections of
4 units at a time. Mr. Brt said that when they get ten or more apartments,
they will need a container. In view of the fact that this would be built in
stages, Mr. Brt suggested they plan to have four 4 cu. yd. containers. He
told Mr. Mathias that he could enclose them on three sides if he wishes, but
that when they are enclosed the people tend to just throw the trash inside the
enclosure. If it is not enclosed, they will put it inside the container.
Mr. Brt recommended relocating the container shown between the two buildings
on the 80 ft. strip to the North end of the building to the South of those
buildings.
To prolong the life of the containers, he recommended constructing pads to
set them on: either asphalt or concrete; 4 inches of reinforced concrete or
6 inches of unreinforced concrete. For a 4 cu. yd.container the pad should
be 10 ft. by 12 ft. For a 6 cu yd.container the pad should be 12 ft. by 15 ft.
3. Tom Halk (Community Appearance): What will be in the 6 ft. and 20 ft. spaces
between the buildings? Mr. Mathias said this will be grass.
4. Paul Logue (Assistant Fire Chief): The largest sized water main is on
Morningside Drive. The closest fire hydrant to this is at the corner of
Morningside Drive and Fairlane Street. You really need a fire hydrant
somewhere within this complex for the protection of your buildings. We
need at least 20 feet in order to drive between the buildings and parking
areas. It was mentioned that having a fire hydrant might reduce the cost
of insurance on the buildings. Mr. Mathias said he would prefer to have a
fire hydrant up near the buildings, if he puts one in. He agreed to check
into this further.
5. Paul Mattke (City Engineer): Left the meeting before this item came up,
but submitted these comments: Water and sewer are both available. We will
need an exact location map or legal description to work out the details of
the service.
6. Floyd Hornaday (SWEPCO): Not present and did not submit any comments.
7. Larry Wood (Planning Consultant): Not present but submitted the comment
that this plan is incomplete as a large scale development.
8. Perry Franklin (Traffic Superintendent): Not present and no comments submitted.

the North property line for a utility easement, also. Also, we need to use
the 20 ft. shown between those buildings as an easement to put utilities in.
If there is more than one utility in there, we need a minimum of 20 ft. behind
those other buildings.
Mr. Shaw said that in order to serve the buildings on the South and East, they
must either move the buildings 25 ft. from the property line or the developer
must install a 2 -inch PVC conduit looped from the East end of the building on
the East, to the West end of the building on the East, to the North end of
the building South of there and on down to the North end of the building on
the extreme South. The conduit should have a pull wire, and it should be
stubbed up on the center end of each building. The Telephone Company
WILL NOT put in overhead (pole line) service. The conduit can go in the same
ditch with other utility lines so long as we have 18 to 24" clearance between
the different utilities. **(See additional comment below).
10. Clyde Terry (Warner Cable): The reason for asking how far your North property
line is from Huntsville Road is that we need to get through down there with
an easement. We cannot get into an 8 ft. or 10 ft. easement. I need to
reserve my comments until I find out how the power company will serve. We
will use the same 25 ft. easements down the North and West sides as Mr. Shaw
asked for ----also the 20 ft. between buildings. We like 25 ft. because if the
cable goes bad and has to be replaced, we must have that much room to get in
there and redo it.
On the buildings on the East, if SWEPCO goes overhead we can go on their pole
line. If they do not go overhead, we will also need a 2 -inch PVC conduit with
a pull wire similar to what Mr. Shaw asked for. It can follow the same route
and will have to be put in by the builder.

Mr. Shaw (TELEPHONE COMPANY) told Mr. Mathias that they need to know 2 or 3
months before a building will be finished so they can order their cable. It
takes 2 or 3 months to get the cable in. Mr. Mathias said they hoped to get
the first units underway as soon as possible.
11. Kenneth Wagner (Arkansas Western Gas)• No problem. We will have to trace
the gas line out front.
12. Bobbie Jones (Planning Administrator). Your driveways should be 121 ft. from
your property line. You need to get a permit for each driveway. I need a
layout of your parking (with each space drawn on) and driveways. I also
need a revision containing the things asked for today. You need at least
75 parking spaces. Mr. Mathias said he would like to allow the parking
and driveway areas to compact before paving them. Mrs. Jones said she would
check into this and see what arrangements, if any, could be made toward this.
The parking areas must be either 5 ft. from other properties with a screening
fence or 20 ft. without a fence. I need the legal descriptions so I can check
to see if the property has been divided since 1970.
