HomeMy WebLinkAbout1976-07-08 MinutesMINUTES OF A PLAT REVIEW COMMITTEE MEETING 0 The Fayetteville Plat Review Committee met at 9:00 A.M., Thursday, July 8, 1976, in the Directors Room, City Administration Building, Fayetteville, Arkansas. • CITY REPRESENTATIVES PRESENT: Paul Mattke, Clayton Powell, Wally Brt, Perry Franklin, Steve Brown, Bobbie Jones, Robin Northrop, David McWethy. UTILITY REPRESENTATIVES PRESENT: "Boone" Carlon, Frank O'Donnell, Harold Lee. DEVELOPERS AND/OR ENGINEERS PRESENT: Buddy Coleman, Pat Mickle, Gordon Houston, Jerry Sweetser, Neal Albright. The first item to be discussed was the proposed Large Scale Development Plan of Gordon Houston for a 27 - unit apartment complex, to be located on the corner of Deane Street and Porter Road. Gordon Houston was present to represent. Comments were as follows: GORDON HOUSTON Corner of Deane and Porter Large Scale Development 1. Clayton Powell (Street Superintendent): Both Deane Street and Porter Road are designated collector streets on the Major Street Plan; this submittal shows 60 feet of right-of-way on Deane Street. No additional dedication is required there. Porter Road has an existing right-of-way of 40 feet and being a collector, you would have to dedicate half the additional right-of-way, which would be an additional 10 ft. for Porter Road. Otherwise, there are no public dedications that concern the Street Department. Be sure not to empty drainage out of your driveways into Deane Street. Put in catch basins or scupper drains and channel it into the ditch alongside Deane Street. 2. Perry Franklin (Traffic Superintendent): I need some street names. If Mr. Houston would like street markers, I will put them on. 3. David McWethy (Administrative Assistant): He said he would rather not have street names (markers) since this will be a private drive. Also, when this was rezoned, there was talk about dedicating a radius at the intersection of Deane Street and Porter Road, to soften that curve. He said this is to be an actual dedication, and whatever rights-of-way are needed on the radius should, be dedicated before a building permit could be issued. Clayton Powell agreed to figure the exact amount of land needed for the radius and furnish this information to Mr. Houston. He.asked what.the acreage was. Bobbie Jones said that the acreage was 2.32. 4. Steve Brown (Community Appearance): asked what the buildings look like. Mr. Houston said they were all single -story buildings. Mr. Brown said that any and all kinds of plantings are encouraged and generally needed and offered to furnish a list of appropriate plantings for the area. He encouraged Mr. Houston to plant. Also, the Community Appearance is available for any consultation on plantings that you may need. 5. Frank O'Donnell $ Harold Lee (Arkansas Western Gas): We will run line adjacent to property line coming off Deane Street. Mr. Houston said he would go along with whatever layout is proposed. There are easements needed on the East side, (15 ft. wide) and running North-South between Phase 4 and 8, and between Phase 5 and 6 (10 ft. wide), and along the South side as far as Unit 8 (10 ft.). He asked Mr. Houston how wide the sewer easement was. Mr. Houston replied that it was 15 to 20 ft. wide. Mr. Houston said that sewer is already in. Plat Review July 8, 1976 -2- 6. "Boone" Carlon (Southwestern Bell): We need an easement along the East property line (15 ft. wide) and along the South property line, 10 ft. wide, all the way to -5 the East property line. He asked Mr. Houston if he had talked with the Power Company. Mr. Houston said that he thought his electrician had. Mr Carlon said the easements requested would be enough for gas and telephone if they can also use the sewer easement South of the property. 7. Charles McWhorter (Fire Chief): Not present, but called in the following comments: There is no fire plug on proposed property. He probably feels there should be one in there. 8. Bobbie Jones (Planning Administrator): The patios, as shown, cannot be covered or it would pose setback problems. She also asked if there would be a sign; if so, Mr. Houston would have to talk with Mr. Lieberenz or Freeman Wood --a permit would be needed. She also asked if there would be any privace fences around the patios; if so, you can have a 30 inch high one or they must meet the required setback from street right-of-way. Mr. Houston needs:todedicate 10 ft. additional right-of-way on Porter Road She said the maximum units that could be built on this property is S0. Mr. Houston said that 27 is the maximum he would put in. The setbacks are o.k. Mr. Lieberenz said he would accept the 2411 ft. on Phase 3 from the South property line; since this is a complex we will interpret the East and South to be side yards. She asked Wally Brt how much width would be needed to get in to empty the trash containers. Wally Brt said he would need at least 15 feet. She said that on the North side of Phase 8 you can only get 7 spaces, on the South side of Phase 6 you can only get 7 spaces, and on the East side of Phase 7 you can only get 8 spaces. That will reduce the number of parking spaces you can get on there to 52. You have 41 required; so you are o;k. The spaces are to be 10' by 20'. Easemehts.are to be 15 ft. down East side and 10 ft. along the South side. On Phases 1 through 5, the parking spaces are right size; but need to be changed from gravel to paved. Easements are needed between Phase 4 and 8, and Phase 5 and 6. She told Mr. Houston that he would need to get a permit from Mr. Mattke's office to get driveway in. She asked Mr. Houston if he could get this revised to change these parking spaces, allow 15 ft. for trash bins, and show easements. 9. Paul Mattke (City Engineer): Said that there is at least a 15 ft. wide easement for sewer. Gas is his only concern. Mr. Mattke said that they have to keep the 10 ft. separation between gas and sewer lines, but otherwise the telephone company could use the City's easement. Water service would come from a 4 inch line on Sycamore. Mr. Mattke recommends Mr. Houston to parallel i a 111 to 2 inch pressure regulator on the water line; also recommend that he have a plumber fit this with loop so you will get better flow level. Mr. Mattke doesn't look for sewer to serve Mr. Houston until late fall. 10. Wally Brt (Sanitation Superintendent): Has one question --Between Phase 1 and Phase 2, which way do you want me to come in? What is the approximate width? Mr. Houston said that the width was approximately 12 ft. between buildings. Mr. Brt said that he should save himself some money and not put uup gate! Don't close the front of the containers. He wants a letter from Mr. Houston permitting him to come into private property. In later discussion, Mr. Houston decided to relocate this container slightly to the West to avoid any danger of the Sanitation trucks hitting his roofs. 11. Floyd Hornaday (SWEPCO): Not present; will call in comments later. 12. Clyde Terry (Warner Cable): Not present. /(03 Plat Review July 8, 1976 The second item for discussion was the proposed Sweetser Subdivision, located East of Winwood Estates and on Bois de Arc Lane. SWEETSER ADDITION Preliminary Plat Mr. Neal Albright and Mr. Jerry Sweetser were present to represent. Comments were as follows: 1. Clayton Powell (Street Superintendent): Asked if this street shown is the same one they plan to have for an access to Brookside East. Mr. Sweetser said that it is. They want to run both streets down and dead end them; don't want to put cul de sacs in. Clayton Powell said that he would be satisfied if they enclose the end of Bois de Arc; allow the drainage to go out and erect a barricade so it will not become a "lover's lane." I would require a dedication of right-of-way for Township collector, Lot 4, Block 2. We do want 4 ft. sidewalks. Topos were submitted on the previous preliminary plat. 2. Perry Franklin (Traffic Superintendent): What is the name for the street which goes into Brookside East, to the North of this property? Mr. Sweetser said that the street is proposed as Primrose Lane, in Brookside East. Mr. Sweetser said that he would like to change the name of Bois de Arc, but realized he couldn't. 3.Wally Brt (Sanitation Superintendent): asked Mr. Sweetser how he was supposed to get into empty trash containers. It was discussed and decided this could be handled as proposed until Brookside East is developed. _J 4. Steve Brown (Community Appearance): No comments. 5. Paul Mattke (City Engineer): Said his comments were basically the same as before. Mr. Sweetser pointed out that the last time, Mr. Mattke had pointed out that he wanted right-of-way off a piece of property not included in the subdivision. Mr. Sweetser contended that this had nothing to do with this subdivision and he didn't want to give right-of-way. Mr. Sweetser said they (City) have the right to take the land, but he doesn't want to give it to them until they are ready to build the street. Mr. Mattke asked about water and sewer. Mr. Sweetser said they are going to tie sewer plan into Brookside. He wants "and are hereby approved" and "and good engineering practices" striken:out. 6. Frank O'Donnell g Harold Lee (Arkansas Western Gas): As I recall, we talked about a 25 ft. easement on the South side of Block 1, to get utilities all in there conveniently. We cannot get in 15 ft. easement. We also need 25 ft. easement up the East side of subdivision and across the North side of Lot 2, Block 2, to get to Lot 1, Block 2. 7. "Boone" Carlon (Southwestern Bell): agreed with Mr. O'Donnell. 8. Bobbie Jones (Planning Administrator): Said that !'Bois de Ark" should have a "c" instead of a "k" at the end of the word "Ark." I would put the name Bois de Arc into subdivision and show Primrose Lane. Block 1 is not to scale (redraw to scale). Also, show 25 ft. building setbacks from all street rights-of-way, including the 30 ft. dedication for Township, on Revised Preliminary Plat. Mr. Sweetser also said that they might change the size of Lots 1 and 2, Block 2; this will be determined by drainage. Mrs. Jones said that street lights should be at each street intersection and at 300 ft. intervals in between. You will need one at the end of Bois de Arc and down at the West end. Also show sidewalks down one side of the street. I need signatures of adjoining property owners of unsubdivided property. I need .final. plat -to show how covenants are shown. The -vicinity map should show network of Winwood streets in there. Plat Review July 8, 1976 Mr. Sweetser asked who in the City was responsible for keeping the park he dedicated East of Sweetbriar Subdivision, mowed. She told him to contact Mr. Jim Pense, Building F, Grounds Superintendent. The application and $10.00 plat fee have still not been submitted. 9. Floyd Hornaday (SWEPCO): Not present; will call in comments later. 10. Clyde Terry (Warner Cable): Not present. 11 Larry Wood. (Planning Consultant): Not present, but submitted following comments at a later time: Show the other Jerry Sweetser property as Block 3. Dedicate 30 ft. of right-of-way for Township across North side of Block 2 $ 3. The third item for discussion was the proposed Final Plat of SWEETBRIAR #2 Sweetbriar #2, submitted by Mr. Jerry Sweetser. Final Plat Mr. Jerry Sweetser and Mr. Neal Albright were present to represent. Comments were as follows: 1. Perry Franklin (Traffic Superintendent): No comments. 2. Frank 0 -Donnell and Harold Lee (Arkansas Western Gas): No comments. 3. Wally Brt (Sanitation Superintendent): No comments. 4. Steve Brown (Community Appearance): No comments. S. Clyde Terry (Warner Cable); Not present. 6. Floyd Hornaday (SWEPCO): Not present, will call in comments later. 7. Bobbie Jones (Planning Administrator): Said that they don't need a vicinity map and adjacenty property owners' signatures on final plat. Underline the title of each certificate. On the "Certificate of Ownership and Dedication" -- you will need this Certificate signed by both the president and the secretary of the corporation. In the "Resolution", add another set of blanks for the authorization for the secretary of the corporation to sign, also. Mr. Sweetser asked if the resolution was to be attached to this. -Mrs. Jones said yes. "Certificate of Accuracy" should be changed to read "Certificate of Survey and Accuracy." In the "Certificate of Approval of Streets, Drainage, and Utility Easements", locat- ed in the third line, you need a comma after streets. "Certificate of Approval of Building Setback Dimensions" --need to add 2 words -- ▪ "Subdivision Plat" and "Current Building Setback." You should have legend for your concrete monuments at each subdivision corner. They are required to be 4 inches square by 30 inches deep. Also, legend iron • pins, 1/2 in. by 30 in. at each lot corner or change of alignment. Legend .i should also include sidewalks, 4=ft. wide for sidewalk. Mr. Sweetser asked if the person who gets the building permit is to pay for sidewalk. Mrs. Jones said they are, unless he wishes to build them himself. I would like a legend covering street lights, setback lines, and utility easements. The sidewalks should continue all the way around the cul de sac and across curved portion of -Lot 9. I would continue it around intersection radius on Pine Avenue and Sharon.and move it off private property over to curb line. Add the word "Avenue" to Katherine and Pine. Put arrow to 36 inch water line. Put arrows to these building setback lines and Plat Review July 8, 1976 utility lines, as well. Dimension utility easements on North, West, P, East lines, also. The Planning Commission waived the street light spacing between the intersection of Pine and Sharon, and the cul de sac on the preliminary plat. You still need to submit your application and final plat fee of $23.00. On Lot 5 -- 25 ft. easement, does that mean it goes.to the lot line between Lots 9 and 10 and 4 and 5? Neal Albright said "yes" it does. No fences over 6 ft. high over 50 ft. water easement. We .want to restrict location of driveways on Lot 7, Block 9, and Lot 5, Block 10, (Paul Mattke commented on this earlier). Mr. Sweetser said that they don't have the right to prevent a driveway over that easement. Mr. Mattke said the City does have this right because it purchased the easement in "fee simple." After a discussion, it was agreed that a driveway could be put over the easement if the driveway were scored so it could be broken on or along each side of the easement. Mrs. Jones directed a question to Mr. Mattke--To help people locate this easement, should there be a dimension from property line to easement line, or should there be pins in there? Mr. Mattke suggested dimensions from easement to lot corners on Lots 7 6 8, Block 9, Lot 5, Block 10, Lot 1, Block 11. "To Witt" should be corrected to read "To Wit." Dimension length of lot line between Lot 5, Block 11 and Lot 10, Block 9. I need a revised copy of plat before Planning Commission meeting. 8. Paul Mattke (City Engineer): Change note --any driveway on Lot 7, Block 9 and Lot 5, Block 10, must be scored on easement right-of-way. Mr. Albright asked why they just couldn't add another sentence to their note, providing point on easement for off -pavement on 50 ft. water easement. Mr. Mattke stressed that they could not put up fence in excess of 6 ft. in height on this. He would make that for water line easement, rather than utilities' easements, in general. 9. Clayton Powell (Street Superintendent): Comments were the same as contained in his letter of May 28, 1976. He said that the streets are cut to rough grade, which is permissable for a building permit (once the final plat is filed). Mr. Sweetser said he would rather post a bond as to file a contract 10. "Boone".Carlon (Southwestern Bell): No comments. 11. Larry Wood (Planning Consultant): Not present. • • Plat Review July 8, 1976 The last item for discussion was a Revised Preliminary Plat for Proposed Rolling Meadows Addition, located North of Rolling Hills ROLLING MEADOWS ADDITION No. of Rolling Hills $ W. of Old Missouri Road Revised Preliminary Plat Drive, West of Old Missouri Road, East of Sheryl, and South of Harold. Mr. Pat Mickle and Mr. Buddy Coleman were present to represent this matter. Comments were as follows: 1. Wally Brt (Sanitation Superintendent): No comments. 2. Clayton Powell (Street Superintendent): Nothing much I can say until I see detailed plans and specifications. Mr. Powell presented them a set of standardized instructions to aid them in complying with requirements and inspections. A waiver of the length a dead-end street (maximum length) will be required. I have no objections to a waiver on the length of the cul de sac so long as the Planning Commission and Board of Directors are in agreement. I personally feel 1,000 ft. in length is acceptable on a cul de sac. There is already an existing street named Briarwood; I don't know if Briarcliff is similar enough to cause confusion. I cannot approve the drainage on this plat until I get the plans and specifications. They have left out some drop inlets at intersections; there may be other things as well. It is not possible to divert drainage on a 90 degree turn. The existing segment of Elizabeth Avenue (going North from Rolling Hills Drive) was not constructed to current street standards. I would like for them to break out back to the rear lot line of Lots 1 and 2, Block 1, Oaks Manor Subdivision in making the transition from its current width to the current required width of 31 ft. from back of curb to back of curb. 3. Frank O'Donnell Y, Harold Lee (Arkansas Western Gas): They are not yet sure whether they want to use gas or not. The utility easements all seem good for whatever we might work out. If it becomes necessary, we could work out additional easements for individual lots, or something like that, in the future. 4. "Boone" Carlon (Southwestern Bell Telephone): The easements are okay. Anything we put in will be underground unless we run into a conflict with drainage, but I don't anticipate any problem. 5. Jack Whitting (Ozarks Electric): Not present, but called in the following comment: Easements are sufficient for underground service, but they might have to be increased for overhead service. Mr. Carlon explained that sometimes additional space is needed to "anchor" or "guy" down on overhead line. 6. Steve Brown (Community Appearance): Not present. 7. David McWethy (Administrative Assistant): Not present. 8. Perry Franklin (Traffic Superintendent): Not present. 9. Paul Mattke (City Engineer): I would rather you move the location of the fire hydrant on Furman Street out of the cul de sac and to the intersection of Furman and Loxley. Check with the Fire Chief on whether he wants an additional fire hydrant on Briarcliff. The spacing is more than 500 ft. on the East, but less than 1,000 ft. Mr. Mickle asked what type of sewer pipe is permitted for use in the City. Mr. Mattke said the City allows the use of clay, true truss (example. Armco), and cast iron. • l(e7 Plat Review Committee July 8, 1976 The City has been experimenting with ASTM 30-33 and ASTM 30-34, but does not permit it to be installed within the City otherwise, yet. 10. Bobbie Jones (Planning Administrator): The Planning Commission wanted the connection of Elizabeth Avenue to Harold Street to be left on the Preliminary Plat. Mr. Mickle argued fairly strongly to have it deleted when he was before them previously; and the Commission told him to leave it on the Preliminary Plat, but that they would consider the issue again when he gets ready to develop the final phase and file a Final plat on that. That decision will have to rest with the Planning Commission. In the legal description, where it says, "Beginning on the West line. . " you should add "of Section 36". The lot sizes look okay. I have not had time to fully check this over, so I would like to reserve the right to add comments later regarding sidewalks and street light spacing. You will need a waiver from the Planning Commission on the length of cul de sacs. Mr. Coleman said they would like to construct duplexes on the lots facing Old Missouri Road. Bobbie Jones asked if they already own the property, or if they have an option to purchase. Mr. Coleman said that they have an option. She told him that he would have to appeal to the Planning Commission for a conditional use to build duplexes and he, as the developer, would have to send certified letters, return receipt requested, to Mr. Stubblefield (as owner of this property as well as the property to the North), Apple Tree Inn, Fayetteville School District, and the owners of Lots 7 and 8, Block 2, Oaks Manor Subdivision. For each duplex to be constructed, they would need a lot 80 ft. wide and containing 12,000 sq. ft. and provide 4 parking spaces. Where you have 3 or more parking spaces in a group, they cannot back out into a public street. I think the Commission's greatest concern on duplexes at this location is going to be the number of driveways opening onto Old Missouri Road. (Some people have gotten around the requirement that they construct a turn around area for the 4 parking spaces required for a duplex by putting in 2 separate driveways per duplex.)Driveways have to be 25 ft. apart, which has been administered to require driveways to be 121 ft. from side property lines. On minor streets they also have to be 40 ft. from the street intersection (intersection of right-of-way) and up to 60 ft. from intersections on major streets. Building setbacks are 8 ft. from side property lines to roof overhang,. but if you have a 10 ft. easement, you cannot extend the building or overhang over the easement. I would suggest that if you wish to request duplexes here, that you request .i: them on the lots collectively, but accept an individual lot by lot ruling if it seems unlikely that you can get approval on all the lots. I think you might have a problem on Lots 35 thru 40. You might be able to work out a common driveway between 2 lots so long as you have the 4 parking spaces required for each duplex. I did wonder why you did not try to develop this additional property as a Planned Unit Development. We normally charge only one preliminary plat fee and since you have already paid that with the original submittal, I will apply your last $10.00 check toward.the final plat fee for your first phase. You will still owe me $15.00 when you submit the final plat for phase one. Mr. Mickle and Mr. Coleman asked if it was possible to take this revised preliminary plat on to the Planning Commission in its existing form. Mrs. Jones felt this would be permissible, since the only major revision needed concerned the connection of Elizabeth to Harold Street. • • • • • • Plat Review Committee July 8, 1976 11. Floyd Hornaday (SWEPCO): (The electric service for this subdivision is split between both SWEPCO and Ozarks Electric). Not present; will call comments in later. 12. Clyde Terry (Warner Cable): Not present. 13. Charles McWhorter (Fire Chief): When contacted about requiring an additional fire hydrant on Briarcliff, Chief McWhorter said that he cannot require an additional hydrant. They have to carry enough fire hose on the trucks to reach each lot on Briarcliff from the hydrant on the intersection of Briarcliff and Loxley. The meeting was adjourned at 11:50 A.M.
