Room, City Administration Building, Fayetteville? Arkansas, UTILITY REPRESENTATIVES PRESENT; Kenneth. Wagner, Clyde Terry; Roy Hawkins, James Crownover, CITY REPRESENTATIVES PRESENT: Clayton Powell, Bobbie Jones, Janet Bowen. DEVELOPERS and/or ENGINEERS PRESENT: Randall Barnes, John Cobb, Mel Milholland. The first item for discussion was the revised plat of the proposed Northwest Acres Subdivision located West of Ruple Lane outside the City limits but inside the Planning Ar John Cobb and Mel Milholland, along with Randall Barnes, were Comments were as follows: NORTHWEST ACRES 'Revised Preliminary Plat ea. present to represent. 1. James Crownover (Ozarks Electric): The easements are satisfactory except for one or two places. Continue the easement from Block D to Block J, by having a 25 foot easement between Lots 8 and .9, Block D and Lots 2 and 3, Block.. J. Where these easements cross the streets (like ontheWest end of Franciscan Trail) we would like to connect those two easements there. You show them up to the road easement but I think they should go all the way across. We need a 25 foot easement up the West side of Lot 1, Block A and along the East side of Lot 6, Block B because most of us (utilities) will want to loop so you will get continuity of service so if we have problems, most of it would be looped where we could feed the other way. (Note: Sewer will be in the street.) 2. Roy Hawkins (Southwestern Bell Telephone): Other than that, it looks real good. 3. Kenneth Wagner (Arkansas Western Gas): This looks good. 4. Clyde Terry (Warner Cable): Leave all the easements 25 feet as shown. Bobbie Jones.said a letter she had from County Judge Vol Lester says it will conform to the official County highway plan according to road widths and setback lines, and feels that it should be the decision of the Planning Commission concerning the lot widths. 5. Clayton Powell (Street Superintendent): I would like to compliment the developer on his desire to do something that would be an asset to the City and County. I have talked with the consulting engineer about street specifications and design. I can't add anything constructive at this time until.I see engineering plans and profiles. You should get a temporary construction easement from the adjoining property owners so you can build the streets right up to the property line. 6. Wally Brt (Sanitation Superintendent): Not present at meeting but telephoned the following comments; This is outside the City limits and we will not serve it. When it comes into the City we will serve it, 71. Larry Wood (Planning Consultant): .Not present at meeting but telephoned the following comments: Suggest that, in addition to the note, it would be more plain to the person buying the lots to put arrows- on each.sidetof the lot and put 'limit of no access" on the lost on Highway 16,' Plat Review March. 18, 1976 8, Bobbie Jones (Planning Adminis.tratorl:. In answer to Bobbie Jones' question; Mr, Barnes said they would build the, sidewalks: on one side, (Sidewalks are required on both.sides,o£ collectors: under City specifications..nside.the City), As Street Super- intendent Clayton Powell pointed out; there was recently a rebuttal from the County on Wooded Hollow Estates which_ established a precedent where the City does not have any control over anything outside the City limits-, Planning Administrator Bobbie Jones said there would be a discussion on the apparent conflicts between the City and County regulations in the Planning Area at the March 29th Planning Commission meeting. Bobbie Jones: You have the street widths shown on your typical street drawing, but I think it would be well to show on the ends of these the width of the street right-of-way. You do not have any setbacks shown. Street lights are not required. The side yard setback (where no zoning applies) should be 10 feet and rear yard 20 feet, so this would apply. You may want to add those just as notes. Inside the City on a corner=lot, there are two fronts and two sides but they cannot build over anceasement. I feel the Planning Commission should make the decision on the setbacks on corner lots. You might propose this the way you want to and you could draw up a typical corner lot to show how this would work out for you. On those corner lots where you have a 25 foot easement at the back and a 12' foot easement along the side, if you had to setback the 25 feet from each street right-of-way, it would not give you much room to build on. You could point this out to the Planning Commission, I wouldn't recommend anything less than the full setback on the lots along Highway 16. The 25 foot easement located outside the 40 foot roadway dedication for Highway 16 (shown on Page 2 of the plans submitted) should all be shown on this one page. Also show the driveway of the existing house (Lot 4, Block K) on the revision. If.this comes into the City and there was a house on the lot 10 feet from the side property line, along a street, it would be non -conforming. This means if they wanted to make an addition, they would have to go before the Board of Adjustment for a variance. This would come into the City as A-1 (Agricultural District) which requires a 35 foot minimum front yard setback and if the plat were approved with 25 foot front setbacks, it would still have to be rezoned since the A=1 Zone calls for a 35 foot setback In answer to Mr. Milholland's question, Bobbie Jones said once they got the approval of the preliminary plat, it authorized them to design their street, water and sewer lines, plans and specifications, and you have to have a soil analysis, etc. Those then have to be submitted to Street Superintendent Clayton Powell, City Engineer Paul Mattke, and the State Board of Health for approval. Once those are approved, you may either (1) start to install those improvements, but not sell any lots. If you wish to sell lots before all the improvements are installed you cannot sell any until the final plat has been approved and then filed. If the improvements are not completed, you can either post a cash bond, a performance bond, or a contract, giving the City a lien on the lost until the improvements are in. Once the improvements are in and accepted, they can be released from the bond or contract. We cannot issue any permits until the final plat is filed. Concerning the existing house located on Lot 4, Block K (which is a part of the Subdivision), Bobbie Jones said if it was sold as is except for the restriction of access to Highway 16, the owner of Lot 5 could give them a right of access across that property, This would be_between the property owners. I;f he sells Lot 5, Block K and he decides to do that, he would need to get the right of access in writing from the purchaser of that lot. Mr, Milholland pointed out that when the subdivision went in; access to Lot 4 could be off of Carriage Way and Bobbie Jones said this would be preferable, Mr, Barnes said this was his own house, he did not plant sell this lot; and if need be, the utilities could dig up the existing- driveway, Mr, Barnessaid his private gas and water yard lines cut through the middle of Lot 5, Block K. Mrs. Jones pointed out that if he did decide,to sell that lot, he would need to protect himself by getting this in writing. She said there was no easement covering that and if it ever came into the City, they could issuea building permit on top of the gas and Ia--J • 1 Plat Review March.18, 1976 -3- water line and.if this were cut in half and there was notan easement covering it, he would have to run a new line, Mr, Barnes indicated that he would like to propose duplexes on Block G, Bobbie Jones; You could showit that way on the proposed plat, She said then, when it came into the'City as -A.1, it could be rezoned and then most of your lots (maybe all of them) would meet the minimum requirement of 12,000 square feet in area Then you could appeal to the Planning Commission for duplexes, Mr. Barnes asked Planning Administrator Bobbie Jones if he could go ahead and hire people to start on this. She replied that she did not know of anything that would give them a problem on the plat except perhaps for the lot sizes and setbacks. Street Superintendent Clayton Powell felt there was nothing from his standpoint that would hold up approval. However, both Bobbie Jones and Clayton Powell told Mr. Barnes that approval of this was up to the Planning Commission. Mr Barnes then brought out that there would be a definite problem on building area on the corner lots if.hersetback'.25 feet from each street. He said the houses would be at the back of the lot and that they would have to be small rectangular houses. John Cobb sais the County had indicated that they would leave it up to the City to waive the 125 foot width on lots. Bobbie Jones: The 25 foot setback satisfies the requirements inside the City, so I have no objections. Street Superintendent Clayton Powell said a 50 foot right-of-way in the subdivision (with the exception of Franciscan Trail and Carriage Way, which will serve as collectors requiring 60 feet) would meet the City street standards. Bobbie Jones and Clayton Powell both stressed that a letter should be obtained from the County stating that they went along with these waivers of street widths and setbacks. Bobbie Jones: I need a revised drawing, preferably a black line pring (1 copy) showing all the revisions by Tuesday, (March 23) in order to get it to the Planning Commission by March 29th. 9. Paul Mattke (City Engineer): Not present at meeting but commented later: that basically his comments were the same as at the last Plat Review Committee meeting concerning this plat, and to be sure to remember that the Board of Directors has to give specific approval on the sewer. USED CAR LOT The last item for consideration was a used car lot located on Highway 71 North Highway 71 North between the Sonic Drive -In and Rita's Hair Design on property owned by C. T. Pearson, Jr. No one was present to represent. Comments were as follows: 1. Floyd Hornaday (SWEPCO); Not present but telephoned following comment: We already have service to this, 2, Larry Wood.(Planning Consultant): Not present at meeting but telephoned the following comment; Since this is- only a boundary line drawing, revise it to show the area paved, driveway point.of ingress and egress and any buildings or other improvements on the property, The utility.companies represented.at the meeting agreed with. Mr, Wood's comments, Theydid.state,that aelephone,:;T: A; ;and;electricis;:in front somewhere along Highway 71, Also, there is a gas line which. probably runs behind Rita's Hair Design approximately back about 200 feet.
