A meeting of the Fayetteville Plat Review- Committee was held at 9:10 A. M.
Thursday, May 15, 1975, in the Board .of Directors Room, City Administration
Building, Fayetteville, Arkansas.
UTILITY REPRESENTATIVES PRESENT: Randy Schneider, Floyd Hornaday*, Jack Whitting,
Roy Hawkins, Clyde Terry.
CITY REPRESENTATIVES PRESENT: Bobbie Jones, Janet Bowen.
OTHERS PRESENT: Larry Gage.
REVISION OF EASEMENTS
The only item for discussion was the revision of Northwest Arkansas -Plaza
the easements at the Northwest Arkansas Plaza Mall. Larry Gage, Manager of the
Mall, was present to represent. Comments were as follows:
1. Roy Hawkins (Southwestern Bell Telephone): Our existing cable is now on
the North side of the first access road in the flower garden median; our cable
runs exactly 4 foot off the curb running straight up that section to this
easement on the East side of the building. We would like to have that entire
Np section of flower garden median shown North of the double drive as a utility
easement extending to the easement._ The easements asked for cover everything
except for the one easement. After looking over Mr. Whitting's plans,Mr. Hawkins
said he needed a 20 foot easement running on the North side of the North entrance
road to the Mall and follow it along the West line along the top of the bank
l)! just outside the curb and fence.

2. Jack Whitting (Ozarks Electric): Right after the Mall was completed, we
ran.a survey on where our lines were buried containing magnetic bearings
'1' also distances, and angles and we never did have any easements sent back to us.

They had this on file up in their office and we made a copy of it here and I
outlined where the cable runs in red. I would like to submit this to show where
we would like to have our easements. It would be better than trying to describe
verbally. Mr. Whitting said he would be glad to supply the Planning Office a copy
of this. Mr. Whitting said they would be coming from the West along the same
line and break Northward along the West line of the Shoneys' site.
Planning Administrator Bobbie Jones explained that she understood that Shoneys
was having to shift their building site because of a sewer problem.
Roy Hawkins (Southwestern Bell Telephone): We can leave this easement along
Shoneys! West line until after the Shoneys' property comes in.
3. Randy Schneider and Frank Hornaday (SWEPCO): We don't serve anything in
here yet. But all this to the West we will serve since it does fall.under our
territory. We need a IS foot easement along the West line (Call N 0 degrees.
36'00" W 626.13) to get in there from the Northwest corner of the extreme North
portion of the property to wherever the future retail building is.
They discussed who owned the rectangle of property to the West of this.
Planning Administrator Bobbie Jones said they did not own it at first but that
they could have purchased it since.
Mr. Hornaday: Since we do not have a layout on the building yet we can't
think about an easement through there (past the location of the future retail
building.)

Meeting.

4. Clyde Terry (Warner Cable): I believe they have covered what I need because
we are with. the telephone company going in. However, where the telephone left off
behind Sears we go all the ivay down to the GMAC offices. It would be under the
street (drives). I think we are within that 20 foot easement shown. We need
a 20 foot easement along the South property line, West property line; and short
North side of the property line (call N86 degrees 26' 00" E 208.7').
5. Bobbie Jones (Planning Administrator). You might want to consider the
possibility of making these blocks (Block 1,2, and 3) and then later on if any
additional easements were granted in this it would only have to be worded
Block 3 of the plat and only describe this and not have to worry with the
descriptions of the complete plot. That could put the original Mall construction
under one block and Sambo and property behind it another block; a replat of this would
only have to deal with one block. This could not be broken up into other tracts
without a public street.
The ordinance limits the size of plats to 18 x 23, or it has to be waived by the
Planning Commission. Before the mylars (either size) are made up I would like to
have that question posed to the Planning Commission to see if they will accept that
and I will also check with the courthouse to see if they can handle a plat this size.
This does not need to be any smaller printing on the certificates.
You need to either have 1" = 100' or 1"= 200'.
We received a metes and bounds description for the Frontage Road and I have
a little difficulty getting it to align with the earlier plans submitted on the
Frontage Road. What do they intend between the Frontage Road and the highway?
There will be a strip approximately 100 feet wide between the Frontage Road description
and the highway as they have it shown. It might be that the two rights-of-way have
joint boundaries or adjacent to each other: I don't think they can (or do plan to)
use it for building purposes. They will just be paying taxes on property that is
being unused.
Larry Gage: I don't know. You can contact Max Hall Engineering Services. in
Springdale since he has worked with the utility easements and the Frontage Road.
Roy Hawkins (Southwestern Bell Telephone) commented that the street right-of-way
stakes are within 2 foot of the road all the way through.
Bobbie Jones: I platted out the descriptions of the Frontage Road and in cases
they did not mesh. I sent them back to the City Attorney and asked him to request
a surveyor's or engineer's certification on them if they were correct and I have not
heard anymore from them.They have wanted to do the Frontage Road by deed rather
than putting it on the plat. Itwould give us a clearer picture if it was all on
there together.
Comments from the Street Department, Water F, Sewer Department, and Arkansas Western
Gas were not available at this time.
There was no further discussion.
The meeting was adjourned at 9:50 A.M.
