MINUTES OF A PLAT REVIEW COMMITTEE MEETING
•
The Fayetteville Plat Review Committee met at 3:30 P.M., Wednesday,
February 21, 1973, in the Directors Room, City Administration Building,
Fayetteville, Arkansas.
Present: Wallie Brt, Larry Wood, Clayton Powell, Charles McWhorter,
Harold Lieberenz, Leslie Hays, Ted Stahl.
Utility Representatives: Jim Miller, Herbert Holcomb, Clyde Terry,
Jack Whitting.
Developers & Engineers: Scott Sherrill and Ray Conners
The first matter discussed was the Large Scale Development Plan submitted
by the. Hardesty Company of Tulsa, Oklahoma. This development plan
involves a proposed 194 unit apartment complex called "Century 21" with
Scott Sherrill and Ray Conners present to represent the plan. Comments
and requirements were as follows:'

CENTURY 21 APTS.
1. Clayton Powell: Unable to tell from plot plan how far N. Garland Ave.
North on Garland Ave. this proposed project was from Ken- L.S.Development
Claire Apts. The Cityciniedkadditional street R.O.W. of
at least ten (10) feet in some sections of Garland Ave.
Property owner will need to obtain a curb or driveway
permit from the State Highway Dept.
He insisted that the City retain public dedications on
East side He is opposed to closing any public alleys or
dedications at this location that the City might need to
control surface drainage in this area.
Mr. Sherrill stated that petitions to close public dedi-
cations had already been submitted to the City Clerk. He
realizes that drainage is an acute problem here. Mr. Sherrill
requested that he::and Mr. Powell meet on the site and study
the situation.
2. Harold Lieberenz: Is the driveway off of Garland adjacent to
another driveway for the property to the South. Mr. Sherrill
stated that driveway on the south existed at the present. This
driveway is the driveway for existing lane or drive for church
and Thomas residence.
The building setbacks shown on south and east would( not be
adequate as shown if public dedications are not vacated.
3. Paul Mattke: He understood that property owners had
requested that the public dedications be closed and that
public easements would be retained when he sent letter stating
that the Water and Sewer Dept. had no objections to closing
public dedications.
There is pbulic sewer available near SW corner on Highway 112.
A City water main is located on the west edge. He also brought
out that in his opinion without having a topic map available
for review that the property lying to the North and east of this
proposed. project in the future would have to drain through this
property, and easements would be needed.
4. Jim Miller: The telephone will need five foot easements, but

would like to have fifteen (15) feet easements all the way
around the complex and where the company branches off to
each building.
5. Clyde Terry: There would be needed twentyKfoot)(20) utility
easements on the south side where Transvideo has an existing
television cable if other utility companies plan to run along the
south side also.,

6. Larry Wood: Asked where the University Experimental Farm
412 property lies in relation to this proposed "Century 21" project.
Sherrill stated that there was a strip of one hundred and four
feet north of the project to the U of A farm.
Is,;' It was brought out that Major Street Plan indicated a collector
iii, street (80 ft. R.O.W.) was planned through this north part of
this 104 ft. strip. Powell indicated that if this proposed
collector street is to be built, the drainage easement along
the east side will definitely be needed for drainage.

7. Charles McWhorter: Asked if there was a way to get a vehicle
such as a fire truck alongthe south side of the
project. When
Sherrill indicated that there was adequate room for this, McWhorter
stated that there will need to be No Parking with signs by fire
hydrants throughout the project.
8. Jack Whitting: Stated that "Century 21" wished to bring in the
in power to one point in one mechanical building and have one elec-
,ct tric meter at that point to serve all the buildings in the proposed
apartment complex. He stated that the electric company had not,
at this time, received a commission ruling yet on this request. He
stated that underground electrical service would be provided.
9. Wallace Brt: Stated that;the_type of garbage disposal was left
entirely up to the owner of "Century 21", however, he stated that
the City pays half of the cost of lodal containers, should they
decide to go with the lodal method.
Concrete pads with pipe railings around pads upon which the small
garbage cans would be placed should the owner decide to go to the
small garbage can method.
Powell questioned the width of the sidewalks planned for the project.
Mattke further stated that he needed more time to check out to see
how the serving of the adjacent undeveloped properties to the East
with water and sewer in the future would effect the city's need for
easements across this project.
The next matter for discussion was a Large Scale Development Plan submitted
by Ervin Wimberely of McClelland Engineering Firm. This development plan
involves a proposed 111 unit motel complex of four buidlings with swimming MOTEL "6"
pool, called Motel "6", with comments and requirements as follows: N.College

No one was present at this time to represent the developer of this
project; Ervin Wimberely arrived later in the meeting to discuss the
project with the committee.
1. Wallace Brt: Suggested that the developer should consider the lodal
method of garbage disposal. This method requires about 60 ft.
turning radius for the truck to maneuver, and he requests deletion
of, 2 "off street" parking, spaces adjacent to lodal location to -
provide ample room for maneuvering.
If developer plans small garbage can method, then he must provide
concrete pads enclosed with pipe railing for these garbage cans
to sit on.
2. Larry Wood: No comments.
3. Clayton Powell: Developers must obtain curb or driveway permit from
the Arkansas State Highway Department at Springdale. Surface
drainage seems to be controlled.
4. Jim Miller: No comments.
5. Clyde Terry: Questioned if there was a utility chaseway between the motel
units of the structure.
6. Herbert Holcomb: No problems - electrical facilities already in this
area.
7. Paul Mattke: Developer must stay twenty-five (25) feet or more away
from high pressure gas'line. Developers need to provide a 25 ft.
easement adjacent to and along the Highway 71 as well as a 25 ft.
North-South easement along the west edge of the project to provide
service for Building "D".
Need an agreement with developer that if future excavation is needed
for sewer repairs, that the developer will pay increase cost of
replacing the parking lot pavement surface.
City water main is located along Highway 71, however, he cautioned
that the City water main pressure was high and they would need to
install pressure regulators.
B. Charles McWhorter: No problems.
The third matter discussed was the Large Scale Development plan submitted
by Don Williams and Bill Bequette representing the Westark Real Estate WESTARK REAL
and Development'Company. This development plan involves twa buildings ESTATE & DEV.
to be built immediately for commercial use With future building proposed. Hwy.71 B-pase

No one was at the'teeting to represent the developers.

1. Larry Wood: Requested that he submit his comments first,
as they might affect comments and decisions of the other
committee members.
A discussion followed the comments of Larry Wood and.it was
decided to delay any further action on this request -at this
time.
The matter was tabled by the Plat Review Committee until such
time someone could meet with the committee.

The fourth matter discussed was the Large Scale Development of Elkhart
Products Corporation submitted by Jack Burge Construction Co. This
development plan involves a proposal to build a 40 ft. by 60 ft.
addition on the south end of their existing Industrial Building with a
larger expansion proposed in the future. ELKHART PRODUCTS CORP.

No one was present to discuss the project with the committee. L. S. Development
1. Wallace Brt: No comments.
2. Larry Wood: Questioned whether or not the existing R.O.W. width of
Highway 71 at this location meets with the City Major Street Plan.
3. Paul Mattke: Stated that the R.O.W. was not eighty (80) ft wide
as called for by the M.S.P. and additional R.O.W. should be obtained
at this time.
City Plumbing Code requires that an acceptable reduced pressure back
flow preventor be installed at the plant. Suggests that a larger size
be considered at this time to take care of future planned plant expan—
sion.
4. Clayton Powell: Stated the need for obtaining additional Highway R.O.W.
at this time. He pointed out that the city is a ward of the State, but
here the State of Arkansas prevails on the City to provide any R.O.W.
needed for any highway widening projects. The pond on the property should
not be filled as this drainage datch and system is a natural flow to take
care of natural drainage from adjacent properties.
Powell requested of Harold Lieberenz that everyone presenting a Large
Scale Development of any type submit a;topo) map with its proposal so
that the committee can more accurately study surface drainage problems.
5. Jim Miller: No Comments.
6. Clyde Terry: No Comments.
7. Herbert Holcomb: No comments.
8. Charles McWhorter: No comments.

9. Jack Whitting: No comments.
10. Harold Lieberenz: Stated that'he was disturbed about the
C'; building setbacks of the proposed additions from the South
property line. It is less than the sixty (60) ft. which
is required by the City Building Code.
The meeting was adjourned at 5:10 P.M.
