A regular meeting of the Fayetteville Planning Commission was held on April 10, 2000 at 5:30
p.m. in Room 219 of the City Administration Building, 113 W. Mountain, Fayetteville,

APPROVAL OF THE MINUTES
Estes:
The first order of business on the agenda is the approval of the minutes from the
March 27, 2000 meeting. Are there any additions or amendments to the minutes?
Hearing none and seeing none, the minutes of the March 27, 2000 meeting will be
approved as presented.

ELECTION OF PLANNING COMMISSION OFFICERS
2000 TERM
Estes: The first order of new business to come before the commission is the election of Planning
Commission officers for the 2000 term. The nominating committee has made its report
and the nominations from the committee are as follows:
Conrad Odom, Chairperson
Bob Estes, Vice Chairperson
Lee Ward, Secretary
We have each been presented with ballots in accordance with our bylaws, the voting will be by
secret ballot. Are there any additional nominations for the office of chair? Are there any
additional nominations for office of vice chair? Are there any additional nominations for the
office of secretary? Seeing none and having one nominee for each office, do I hear any motions?
MOTION
There was a motion to approve the persons nominated by the nominating committee and the
motion has been seconded.
ROLL CALL
Upon roll call, the motion passed with a unanimous vote.
The new slate of officers having been elected, and Mr. Odom having been elected the chair, I
pass the remainder of the meeting to Mr. Odom.

PP 00-2.00: Preliminary Plat
Quail Creek phase III, pp 250
This was submitted by Dave Jorgensen of Jorgensen & Associates on behalf of Sam Mathias and
& Bleaux Barnes for property located west of Quail Creek Drive. The property is zoned R-1.5,
Moderate Density Residential and contains approximately 6.65 acres with 13 single family lots
proposed.
Chris Beck was present on behalf of Jorgensen & Associates.
STAFF RECOMMENDATION
1. Staff's recommendation is for approval, subject to seven conditions.
COMMISSION DISCUSSION
Odom: Staff, do we have signed conditions of approval? Are there any further conditions
of approval? Let me tum the matter over to the applicant.
Conklin: We do not have signed conditions at this time. Staff has no new conditions to
add.
Brackett: Hi, my name is Chris Brackett, and I am with Jorgensen & Associates. We are
here to represent the owners today.
Odom: Chris, you have the seven conditions of approval that have been recommended by
the staff. Do you have any problems with those conditions of approval?
Brackett: We have no problems with the conditions.
Odom. Do you have any presentation that you would like to make?
Brackett: All it is, we are just finishing up Quail Creek, this is the last phase of Quail Creek.
It will connect on to Appleby Estates that was approved recently and I would be
happy to answer any questions that you might have.
Odom: Before we go to questions from the Planning Commission, I'll ask if there is any
member of the audience that would like to address us on this issue? Seeing none,
I will close the floor to public discussion and bring it back to the Planning
Commission for questions and comments.

CU 00-10.00:Conditional Use
Clark Davis, pp 366
This was submitted by Clark Davis for property located at 716 W. Sycamore #2. The property is
zoned C-2, Thoroughfare Commercial and contains approximately 1.16 acres. The request is to
expand the existing the conditional use for a dance hall into an adjoining tenant space.
STAFF RECOMMENDATION
Staff recommends approval of the conditions subject to four conditions of approval.
Odom. Staff, do we have signed conditions of approval?
Conklin: We do not have signed conditions of approval.
Odom: Do we have additional conditions of approval?
Conklin: We do not have additional conditions of approval.

Odom. Clark, you have the recommendations of this staff. Do you have any questions or
comments about those, or are you in agreement?
Davis: I agree, it's pretty simple. I just want to expand into the adjoining empty space.
Odom: You have no problems with the conditions of approval?

CU 00-11.00: Conditional Use
Stephan Deen, pp 445
This item was submitted to Timothy de Noble on behalf of Stephan Deen for property located at
lots 7 and 8 of Drakes replat of blocks 1 and 6 of Englewood Addition (NW corner of Park Ave.
and Maple St.). The property is zoned R-1, Low Density Residential and contains approximately
0.32 acres. The request is for a duplex in an R-1 district.
Staff Recommendation
Conklin: Staff recommends approval of the conditional use subject to four conditions.
Odom: Staff, do we have a signed condition of approval?
Conklin: Yes, the applicant has signed a condition of approval
Odom: Do we have any further conditions of approval?
Warrick: We have no further conditions of approval, but I do have two brief comments.
The first is on the large sheet of elevations and site plans that were received in
regard to this project. There was a labeling error and the elevation that is labeled
Maple Street elevation is actually Park elevation, and vice -versa. So Park is
actually Maple. The other comment is with regard to Condition 1: The second
sentence states that the duplex shall be constructed using materials and colors as
stated in the application. The colors were not specifically stated, so I suggest that
we eliminate those two words. Materials were stated.
Odom. I'm sorry, Dawn, I didn't follow you. "The duplex shall be constructed using..."
Scratch what?
Warrick. The words "and colors". Materials were stated, but the colors really were not
specified.
Odom: Is that it?
Warrick: That's it.
Odom: Thank you. I would ask the applicant to come forward at this time.
• de Noble: I'm Tim de Noble and I represent Stephan and Hope Deen in this matter.

Odom. Tim, do you have any presentation to make?
de Noble: 1 do, dust to clarify things, some of which you have in a packet that I have already
distributed and I wanted to show a few other items.
Odom:
The best thing would be to place the display on the top easel and turn it just a little
bit so that the camera can pick it up and those that can't see it can look up on the
television screen and view it.
de Noble: Okay, as I said, I'm Tim de Noble, architect, and I represent Stephan and Hope
Deen. Hope Deen is currently a resident of Blytheville, Arkansas. Her son,
Stanley Deen currently lives in the house to the immediate north on Park Ave.
Stephan, her son, and his brother„ wishes to build a house for his mother. Also to
have a unit for himself in the house. I referred to that as a unit merely because he
wishes to have a small kitchen for himself in his unit so that they can continue to
live in close proximity, but lead separate lives. Basically, he likes to cook with
garlic and she does not. So, the program for the house is basically a three
bedroom house, although it is split into two units and I consider it a duplex in
name only. As a resident of the neighborhood, I in fact live on Forest, and my
backyard abuts the property, more or less. I was first hired and contacted because
I was a resident and care about the neighborhood and have championed the
neighboorhood in a number of other causes. Stephan has been great to work with.
We have driven around to look at a number of properties and have attempted to
design a house that is appropriate for the neighborhood. The plan that I have up
there is just to show you the existing duplexes in the area and those are shown in
blue. The yellow are actually three or more units, just so that you realize that
although we tend to think of the Wilson Park area as rather homogenous in terms
of use, there are a number of duplexes that seem to blend in quite well. And
actually there are two directly adjoining. To clarify the plans, the Hope Deen
residence or the mother's residence is on the middle floor. Parking will be in a
garage that's on the lowest level and entered by an existing alleyway. There will
be a stair that I refer to as a segregated stair that will serve both the mother's unit
and the son's unit above. At a future point, the house may be converted into a
single family house, simply by removing a short length of wall at the end of the
entryway, the stair will be opened up to the entire house. The stair will then serve
as a common stair for a single family house. Again, we have selected the
materials primarily meant to be a wood sided with varying sizes of lap. Painted
wood siding to match the materials of many houses in the area and that is
reflected best in these elevations. Again, as Ms. Warrick pointed out, I mislabeled
the elevations, something that I constantly harp at my students not to do. This is

Deen.
Deen's residence is actually in the back or through the garage, which will hold
two cars, and therefore no one can ever see that it's a duplex in any way from the
front. The other elevations are also in keeping with the neighborhood. We have
broad overhangs, hopefully to reduce the energy use of the building and in a
rather myopic and self-centered way, I showed the perspective of the house more
or less from the way that I would see from my backyard so that I could prove to
myself that I actually want to live near it. I think I do. I have contacted the
neighbors, I believe on Wednesday, March 290, I sent out a copy of these plans to
all of the adjoining properties and a number of other properties. I was not
contacted by anybody with any opposition; in fact, a number of people in direct
contact with the property have said that they welcome the design and have no
opposition to it. Lynn Wade, who originally sold the property to the Deens, is in
favor of it as apparently is his nephew, Wade Coldwell, who lives directly to the
east. In working with the Deens over the past four or five months, I have to say
that I am really looking forward to having them as neighbors, as pro -active
members of the Wilson Park neighborhood. I look forward to their involvement
and I do want you to meet them. They have come from Blytheville and Indonesia
to tell you a little about themselves.
Hello, I am Stephan Deen. The youthful looking red headed lady in the back is
my mother, Hope Deen. This is an application for our home. This is not an
application for a rental property. This is not an application for a property that will
be quickly developed and resold. Mother and 1, and my brothers are native
Arkansans. I am a fifth generation Arkansan, from the eastern part of the state.
My brothers and I attended university here, received our degrees in Fayetteville
and I have lived overseas for twenty years. I've saved my money. I've designed
this house and garden in my mind for twenty years and now it is time to proceed
with it, with your approval. The reason why Mother and I are here, Mother is a
widow, a very youthful widow, and I am unmarried. We like to keep an eye on
each other at this stage of our lives, and we are very independent people. I cook
with garlic, Mother can't stand it. I am a night person. Mother wakes up early in
the morning, walks at 4:30. So, although we are very supportive of each other, we
are very separate people, with very separate lives. We would like to be able to
live very close to each other, so that if she needs me, she can ring a bell and I am
there in a minute or less. Yet, at the same time, we are not in the same house.
Very few people that I know, an adult son and his mother, can live under the same
roof, in the same house, and let there be peace in the land.
Odom. Something comes to mind, but that's about it.

do plan to make this our home. We do plan to make this our home for the
duration. And although I do have a business in Indonesia, I come back and forth
to Arkansas at least two times a year, and plan to be spending at least three trips of
six weeks to two months each in Arkansas, with Mother, enjoying quality time.
Basically, we are really looking forward to living in Fayetteville and to having
this home and making this our home. We are fanatics when it comes to
gardening. We love gardens. We have one of the prettiest in Blytheville, azaleas,
Magnolias, dogwoods. You name it, we've got it. And I have already ordered
from a nursery in Eastern Arkansas, plants that will be suitable for Fayetteville's
zone 6-B, $ 7,800.00 worth of mature plants in the form of southern Magnolias,
fringe trees, trees which were loved by Jefferson, and they are all over Monticello.
Dogwoods, deciduous azaleas, we'll turn the front yard into a sea of crocus. I
think it will be one of the prettiest gardens in Fayetteville. I think you will find
me in the time I am in Fayetteville, during daylight hours, out there tending the
yard. Mother doesn't plant much but she maintains with a vengeance anything
that I have planted through the years So, I do thank you for your consideration
and we would like to have your approval I assure you we will maintain this
property beautifully and lovingly. It will be our home for the duration. Thank
you.
Odom: Let me ask. Are you finished with the presentation? Okay, thank you, Tim.

Estes: I think the project presented would be a very nice addition to the neighborhood. It
certainly appears to reflect general compatibility with the adjacent and
surrounding properties. It is for those reasons that I would move for approval of
conditional use 00-11.00.
Hoffman: I'll second.

approval of CU 00-11.00. Any further discussion?
Marr: As an adjoining property owner, I'll abstain from this vote.
Bunch: In our packets, there is some mention of removing walnut trees.
Odom: Tim, could you come back up to the podium to answer the questions?
Bunch: There is a question of removing some of the mature trees, I think to embellish the
gardening efforts. Could you please expand on that a little bit?
de Noble: Yes. Actually, I can also refer to the plan. Obviously, the footprint of the house
and the overhangs will necessitate the removal of trees here in the center of the
property, which 1 don't know if that's shown up there, but, in this area, there is
also a walnut here that has a Targe number of, actually almost the whole top fringe
is dead now. I met with Kim Hesse out on site and talked to her about various
trees. There is a walnut tree right here that is limping along, about to fall right in
the middle of the driveway. That one will also be taken down. Then there are
two here, along this edge, which one of them has a number of large, excuse me,
dead material, and we are going to take out one and leave the largest, if possible.
We are going to have those planed on site and then stored, dried, and use the
wood in the upper level of the unit. So, we've done a lot of research and found
that there is only one thing that grows really well under walnut trees and that is
poison ivy and we do have one of the finest poison ivy vines in Fayetteville on the
site right now.
Odom. Didn't that trigger our poison ivy ordinance?
de Noble: Well, we are doing everything we can to preserve that vine. At least until we get
building so that people don't park on the site. So those are the trees that are
coming out. The larger hackberries and elms we are maintaining on the site.
Those are the other large mature trees.

The next item on tonight's agenda is the appointment of Subdivision and Land
Use Plan subcommittees. With regard to the Subdivision, I am going to be
appointing Bob Estes, Lorel Hoffman, and Lee Ward, and for our substitutes, I am
going to be number one, number two, Sharon Hoover, number three, Don Bunch,
number four, Don Marr, number five, Nancy Allen, and number six, Loren
Shackelford. For the Land Use subcommittee, I am appointing Loren
Shackelford, Don Bunch, and Don Marr, thus sparing myself, Nancy, and Sharon
of any harsh committments. Did you get that Tim? Staff, are there any further
items for tonight?
Conklin: We have no other business this evening, but we like to welcome Nancy Allen,
who replaced Phyllis Johnson. She has been appointed for a three year term.
Allen: I am glad to be here, looking forward to learning and working with all of you, and
hoping not to alienate a large segment of Fayetteville.

Odom: That's okay, I didn't give you permission to speak. You need to be sure and ask
