PLANNING COMMISSION
A regular meeting of the Planning Commission was held on February 10, 1997 at 5:30 p.m. in
Room 219 of the City Administration Building, 113 W. Mountain Street, Fayetteville, Arkansas.
MEMBERS PRESENT:
Phyllis Johnson, Jerry Allred, John Harbison,
Conrad Odom, Gary Tucker, Lorel Hoffman, Bob
Reynolds, and John Forney.
STAFF PRESENT: Alett Little, Jim Beavers, Rich Lane, Dawn
Warrick, and Heather Woodruff.
Mark Sugg was in attendance as an applicant and did not sit as a member of the board.
APPROVAL OF THE MINUTES
The minutes were approved as distributed.
NEW BUSINESS

CU97-1.00: CONDITIONAL USE FOR A TANDEM LOT.

MARK SUGG- S. OF 7TH STREET AND W. OF WOOD STREET.
The first item on the agenda was submitted by Mark Sugg for property located south of 7th Street
and west of Wood Street. The property is zoned R-2 (Medium Density Residential) and contains
1.55 acres. The request was for a conditional use to allow a tandem lot.
The staff recommended approval subject to the following conditions:
1. Applicant shall agree to comply with the requirements of the zoning code section 160.091 for
the tandem lot (paving a minimum of 25 feet of the access drive, providing trash receptacles at
the public street ... ).
2. A private water easement will be required and the meter located at 7th Street. A private sewer
easement will also be required for the sewer service line. These easements may be combined
with the access easement.
3. A $300.00 park's fee.
Ms. Johnson asked the applicant if he agreed to the conditions of approval
Mr. Sugg stated he would agree to the conditions.

Ms Little stated Mr. Sugg was requesting a tandem lot on which to build a single-family home.
She added by definition only one single-family home could ever be built on a tandem lot.
Ms. Johnson commented the only usual thing about the lot would be the lack of street frontage,
although the single-family structure would be situated on a 1 55 acre tract.
Ms. Little explained there would be a 20' setback on all sides of the lot (on a normal residential
lot the side set backs were smaller).
Ms. Hoffman asked if Mr. Sugg would ever be allowed another lot split.
Ms. Little stated by definition there could only be one tandem lot behind a standard lot of record.
PUBLIC
Ms. Betty Smith, 777 Wood Avenue, asked if Mr. Sugg was required to zone the area to
residential.
Ms. Johnson explained the area was already zoned residential and under the present zoning a
duplex could be built on the site. Mr. Sugg was not going to build a duplex; he was going to
build one single-family residence.
Ms Smith replied it had been her understanding Mr. Sugg was building a duplex.
Ms. Johnson stated Mr. Sugg was building a duplex on the property in front of the proposed
tandem lot. He was allowed to build a duplex by right on the lot, without coming before the
Planning Commission.
Ms. Smith asked if he would need easements from any of the other owners.
Ms. Johnson stated there were three 25' easements located on Mr. Sugg's property to serve as
both utility easements and access.
Mr. Reynolds asked if the Planning Commission could require a bill of assurance stating Mr.
Sugg would only build one single-family residence and he would not pursue another lot split.
Ms. Little stated the code only allowed one single-family home on a tandem lot; however the
Planning Commission could require a bill of assurance since it was clearly stated in the
regulations.
Mr. Reynolds thought Mr. Sugg might want to include the bill of assurance to reassure his

neighbors.
Mr. Sugg was not willing to agree to a bill of assurance, stating he might acquire another access
or sell some of the land to a neighbor.
MOTION
Mr. Odom moved to approve the item subject to the staff comments.
Mr. Forney seconded the motion.
The motion carred by a vote of 8-0-0 with Mr. Sugg not voting.
The meeting adjourned at 5:45 p.m.
