Subject: Agenda Packet for the April 9. 1990
City Planning Commission Meeting
Enclosed you will find one copy of the agenda packet for our April 9, 1990 meeting.
Several comments are in order on a few of the agenda items.
Item 2 is a request for a rehearing of a rezoning petition filed last year by Caroline
Parsons for property at the southwest corner of Wedington Drive and North Garland
Avenue. The attorney for Ms. Parsons will attempt to present evidence to the Commission
that circumstances have changed with the rezoning request. He will ask the Commission
to rehear the request prior to the expiration of the twelve month period in which
a rezoning cannot be reheard as provided by Article 12. Section 1 (h) of the Zoning
Ordinance. The staff feels that the decision on whether to rehear a rezoning case
is strictly in the province of the Commission and the staff will make no recommendation.
If the Commission denies the request the petitioner will have to wait until December
of this year to refile the request. If the Commission approves the request for a
rehearing we will schedule it for the next available Commission meeting and renotify
the neighboring property owners.
Item 12 involves a requested Conditional Use by Or. Floyd Harris to expand a nonconforming
use (i.e., the grass air strip associated with his proposed Mt. Comfort Air Park subdivision).
The staff has taken the position that even though the air strip is already in existence,
its nonconforming status will essentially be intensified if the subdivision plat is approved
and air traffic is increased. We are recommending that the Commission hold the
public hearing and consider the comments of the petitioner and the neighboring
property owners. We further recommend that no final decision be made on the Conditional
Use on April 9. The preliminary plat must still be acted on by the Commission and
our feeling is that action should be taken on the Conditional Use and the plat at
the same meeting since they are interrelated.
Item 13 is a Conditional Use request filed by Mr. Dale Benedict of Bio -Tech. Inc.
for wholesaling and warehousing of certain health products. This request involves
the property fronting on Shiloh Drive which was rezoned by the Board of Directors
last month. This is basically a "housekeeping" item and we recommend approval
particularly since the Board rezoned the land.
