MINUTES OF A MEETING OF THE
FAYETTEVILLE PLANNING COMMISSION
A meeting of the Fayetteville Planning Commission was held on Monday, July 11,
1988 in the Board of Directors Room of the City Administration Building, 113 West
Mountain Street, Fayetteville, Arkansas.
MEMBERS PRESENT: J.E. Springborn, Jerry Allred, Ernie Jacks, Julie Nash,
Gerald Klingaman, Gerald Seiff and Fred Hanna
HEMMERS ABSENT: B.J. Dow and Butch Robertson
OTHERS PRESENT: John Merrell, Elaine Cattaneo, Ervan Wimberly, Mary Eobiella,
members of the press and others
APPROVAL OF FINAL PLAT OF GLENNWOOD ADDITION
DR. GLENN HARDY, W OF CROSSOVER RD (HWY 265), S OF COUNTRY WAY
The first item on the agenda was consideration of the final plat of Glennwood
Addition submitted by Dr. Glenn Hardy and represented by Ervan Wimberly.
Property located West of Crossover Road (Hwy 265) and South of Country Way and
zoned R-1, Low Density Residential with total acreage of 6.48 and 16 proposed
lots.

recommendations that came from the preliminary plat. Mr. Wimberly answered, yes.
He stated that they had a little trouble getting the drainage worked out. He
noted that they were trying to divert a lot of the drainage to the highway into a
cross drain but the Highway Department wouldn't let them do it. Therefore, they
are going to storm drain all the way down across the church property that lies
north of this property, across a lot in Cedarwood and tie into a storm drain
system in Cedarwood Addition. In order to do this, they had to get an easement
off the private lot owner plus the Freewill Baptist Church and they have both
agreed to it. He advised that Don Bunn has reviewed and approved the concept of
the design of the perimeters, pipe size, etc. for the drainage.

Chairman Jacks noted that Commissioner Springborn had suggested in earlier
comments that they widen the entrance. Commissioner Springborn stated that he
had raised the question about the spacing of the street light at the entrance
which was right in the middle of the island. Mr. Wimberly stated that they have
moved it from the front nose of the island to the back nose of the island.
Commissioner Nash asked if things had been worked out about the island that Perry
Franklin was concerned about earlier. Mr. Wimberly stated that Mr. Franklin had
accepted the island that they have proposed.
Chairman Jacks asked if the question about water pressure had been all
straightened out. Mr. Wimberly answered, yes, the water plans have been approved
by the State Board of Health The fire hydrant spacing has been approved by the
Fire Chief. All of the construction plans except this revision to the off-site
storm drainage has been approved by everybody.
Chairman Jacks stated that any motion would need to include waiving the length of
the cul-de-sac which is 590'. Mr. Wimberly stated that the length of the cul-de-
sac had been waived when the preliminary went through.
Chairman Jacks asked if anyone in the audience was here to speak for or against
or wanted to comment on this.
MOTION
Commissioner Seiff moved to approve this final plat allowing for the excessive
length of the cul-de-sac, seconded by Klingaman. The motion to approve passed 7-
0-0.
CONDITIONAL USE FOR A HOME OCCUPATION (KOBIE'S CAKES) IN AN R-1 ZONE
MARY KOBIBLLA - 725 SKELTON (IAT 8, BLACK 2 OF J.W. SKELTON SUBDIVISION)
The second item on the agenda was consideration of a conditional use for a Home
Occupation (Kobie's Cakes) in an R-1 zone. Property located at 725 Skelton (Lot
8, Block 2 of J.W. Skelton Subdivision).
Mary Kobiella stated that she has had a shop on Highway 71 in West Fork for
seventeen years. The people next door to that at Newlin Realty know the type of
business she has. She stated that it is mainly to order and she has very little
walk-in business and she feels that the same situation would prevail at the new
location. She noted that what she does is custom orders for such things as
wedding cakes, birthdays, party food and a limited amount of off -premise catering
which would simply be preparation there and going elsewhere.
Chairman Jacks asked how much traffic could they expect in this operation. Mrs.
Kobiella answered that it was minimal, maybe six cars a day. She advised that
she has a very small business and she just wants to continue as she has been if
possible.

Commissioner Klingaman asked if she is planning on doing anything with her
parking area Mrs. Kobiella answered that this was a question that she wanted to
settle. She stated that she has room to make a little extra space in the front
yard which might hold 3 or 4 cars. Otherwise, if she is not permitted to do
that, she will just use the existing driveway. However, she would like to be
able to widen it so the traffic could drive in instead of having to back in and
out, so there would be a turn -around.
Commissioner Klingaman asked if parking is allowed on the street there. Mrs.
Kobiella answered, no. He asked how many vehicles she has. Mrs. Kobiella
answered, only one and she uses it when she does her catering.
Mrs. Kobiella noted that in the bulletin that she received it lists Bernard J.
and Mary A. Kobiella as the petitioners. She stated that her husband isn't well
and if something were to happen, she would not want to lose her business. It has
always been in her name and not in his. She asked if there was any problem with
this submission as being in both there names. Chairman Jacks answered that he
didn't see a problem there. He stated that she could work that out with the
Planning Office if there is a problem there.
Commissioner Seiff stated that he had lived in West Fork and he would vouch for
very little traffic at Mrs. Kobiella's business.
Chairman Jacks asked if there was anyone in the audience that would like to
speak. Frank Sharp of Smokehouse Road stated that he had known Mrs. Kobiella for
most of the seventeen years and she does offer a very homey type kitchen and he
stated that he thinks that she would make a very good neighbor.
Carolyn Anderson stated that she lives on Skelton Street and she would like to
speak for this. She stated that she thought that if Mrs. Kobiella moved in with
this business she would upgrade this particular location.
Lois Smith Combs of 744 Skelton stated that she thought that this would be a
welcome asset to their neighborhood.
Commissioner Springborn asked if a conditional use is renewable annually. Elaine
Cattaneo, Planning Secretary, stated that in an R-1 zone the Home Occupation is
an annual renewal.
Commissioner Hanna stated that they had decided last time that a Home Occupation
was automatically renewed by the Planning Office yearly unless there were
complaints from the neighbors in which time it is supposed to be brought back
before the Planning Commission for review. Commissioner Springborn stated that
the reason for the question was because he had no concern based upon all the
comments made with the understanding that business isn't so good that it gets out
of hand and goes to the point that it could be a problem If it is renewable
annually, then that should take care of it.

MOTION
Commissioner Hanna moved to grant this conditional use, seconded by Seiff and
followed by a question from Mrs. Kobiella.
She stated that she would like to clarify the parking situation because she was
told that she was not supposed to provide any additional parking other than what
the house normally had. However, she would prefer if she is permitted to add
that extra space which would simply mean widening the existing driveway about 6
feet or so. Chairman Jacks stated that this is a detail matter and he felt that
they would be happy to have her do anything that the ordinance permits. She
stated that her question is if this would be prohibited by the ordinance.
Commissioner Seiff asked what -is to stop any home owner from putting concrete all
around their house. Chairman Jacks stated that he thought there was a maximum
width of a driveway. Mrs. Kobiella stated that since there was no parking
allowed on the street, she was happy that the available space was there. What
she wants to know is if she can put in the extra parking. Chairman Jacks stated
that she should check with the Planning Office and have them go back through the
ordinances and see what the problems are with that.
Commissioner Springborn stated that if it was not a permanent type widening of
the driveway, he would think that it would be preferred in the R-1 zone.
Mrs. Kobiella stated that she was only thinking of graveling it. Chairman Jacks
advised that this could be a problem because he thinks all the parking ordinances
talk about it being durable and dustless.
The motion to grant the conditional use passed 7-0-0.
