MINUTES OF A MEETING OF THE
FAYEITEVILLE PLANNING COMMISSION
A meeting of. the Fayetteville Planning Commission vas held on Monday, March 28,
1988 in the Board of Directors Room of the City Administration Building, 113 West
Mountain Street, Fayetteville, Arkansas.

APPROVAL OF LARGE SCALE DEVELOPMENT PLAN -
EAST OF HIGHWAY 112, N OF 71 - LEO RECKATHORN
The first item on the agenda was consideration of a Large Scale Development Plan
submitted by Leo Heckathorn to construct truckstop, furniture store, motel and 2
restaurants on Highway 112 and 71 Bypass. Property is zoned C-2, Thoroughfare
Commercial District.
Commissioner Robertson stated that this Large Scale Development was presented
before the Subdivision Committee on Wednesday, March 23, 1988. The Subdivision
Committee consisted of Julie Nash (who is ill tonight), Ernie Jacks (who is not
here), and myself and Don Bunn. The only thing that c:as brought up was some
concern over the drainage problem. Plat Review comments all have been met.
Commissioner Robertson stated that the motion was made to approve it subject to a
drainage report on Highway 112 and make sure the lift there is capable of
handling the sewer and water. Also, Don Bunn requested copies of approval of the
accesses at the intersection of Trucker's Drive and Highway 112.
Commissioner Robertson asked Mr. Heckathorn if those items had been worked out.
Mr. Heckathorn replied that as far as the calculations on the water and sewer,
the engineers are discussing it right now and will be bringing the information
in.

Commissioner Robertson asked Mr. Wimberly about the drainage report and the
capability of handling the water and sewer problems. Mr. Wimberly stated that he
had been working with Don Bunn on that. There is a drainage problem and they
will work it out with Mr. Bunn. It can be solved with the layout they have using
on site detention. Mr. Wimberly said at this point, we cannot come up with a
final answer until we work with the Highway Department on those culverts under
112. We like to ask you to approve it contingent on working that out with Mr.
Bunn and the Highway Department.
Commissioner Robertson asked Mr. Wimberly about the sewer pump. Mr. Wimberly
answered that the sewer pump wasn't a problem. Robertson asked about the radius
on Trucker's Drive. Mr. Heckathorn answered that the Highway Department had told
him that 30' was all they could allow unless they go before the Traffic Division.
That's where it is now and they said that he could have even 60' if he wanted to.
However, they couldn't allow that much unless he got approval by the Traffic
Division of the Highway Department. As yet, nothing had been received back from
them.
Commissioner Robertson asked if the entrance on Highway 71 had gone from 15' to
30'. Mr. Heckathorn answered, No, it's the easement. He stated that they had a
25' easement in there and the Plat Review asked for a 30' easement and we gave it
to them upto the point of the existing easement, then they agreed that they would
go with a 25' easement from that point because it did interfere with our driveway
across there.
Commissioner Dow asked if the State Highway has a statue that says that they have
to approve the drainage plans or is that just something you are going to be
checking with them on. Mr. Heckathorn answered that he didn't think they had
anything set on it. He stated that they did have a man come up and they went
over the property but as yet he had nothing officially from the main office.
Commissioner Springborn stated that he wanted to clarify Mr. Heckathorn's
position on the turning radius. He asked if they show 40' and they would
automatically get 30' from the Highway Commission. Mr. Heckathorn answered that
in the beginning the Highway Department automatically gave them 30' without going
before the Traffic Division. He further stated that since he felt that 30'
wasn't enough and since Perry Franklin had questions about this on the Plat
Review he wanted at least 40' and would rather have 50'.
_Commissioner Springborn clarified by asking Mr. Heckathorn if he wanted to go
further than 40'. Mr. Heckathorn answered, Yes, that he does not want to block
any traffic.

truckstop. He stated that if it is going to be open all night long

Mrs. Bill Forbess, a member of the audience, stated that she felt they needed
approval from the Highway Department on exactly what they are going to allow him
to do before they go any farther. Commissioner Robertson answered, Yes, they
would have to have approval. Mrs. Forbess asked if this would be the only
meeting they would have on this issue. Robertson answered, Yes. Commissioner
Dow answered that usually what they do is make their motion subject to approval.
What they want and how they want it to be will be stated and then nothing can
happen until it is actually approved by the Highway Department.
Mary Bassett, a member of the audience, who is with a Real Estate Company that
has this property listed said she would like to represent the owner of the
property, Mary Calabria. Ms. Bassett stated that she had spoke with Mary
Calabria on numerous occasions concerning the sell of this property and she is in
full approval of the project.
Commissioner Dow stated that it sounds like a reasonable plan, but she wants to
be sure that the drainage is done correctly. She said that it should be subject
to approval by the City Engineer. She further stated that the drainage is a real
problem. Commissioner Springborn clarified again that Mr. Heckathorn wanted to
go beyond 40' to ease the access to the property.
MOTION
Commissioner Hanna moved to approve the Large Scale Development Plan as submitted
subject to: 1) the drainage plan being approved by Don Bunn when it's finalized;
2) the easements and the ingress & egress be approved; and 3) the other Plat
Review comments.
Commissioner Dow asked if he would like to include a recommendation that the
Highway Department consider a wider cut. Commissioner Hanna, Yes. Commissioner
Seiff seconded the motion. The motion to approve the Large Scale Development
Plan passed 6-0-0.

APPROVAL 0 A PRELIMINARY PLAT - GLENWOOD ADDITION

The second item of consideration was a preliminary plat of the Glenwood Addition
submitted by Mike O'Neal for Dr. Glen Hardy for property located W of Crossover
Road and S of Country Way. This property is zoned A-1, Agricultural. The
applicant is bringing a request for rezoning to the next meeting for R-1, Low
Density Residential.
Mr. Bunn stated that the drainage problem was brought up and discussed at the
Subdivision Committee Meeting. The drainage goes to the North and right now goes
across the church property and goes across a residential lot. He stated that he
had not had a chance to review the drainage plan with the engineers except
briefly right before this meeting.
Mr. Bunn stated that the problems can be solved Some of the drainage along
Highway 265 on the north side of the church will flow back to the East and then
cross some lots and most of the drainage from this subdivision will be carried to
Highway 265. Because of the nature of the development, it might increase the
amount of water that finally gets back to the East and goes across the lots.
Mr. Bunn further stated that correction of this would be to construct a berm
parallel to Highway 265 that would prevent this condition from occurring. Then
the only water that would be draining across is on the property that lies north
of this proposed street. It could be worked out that way to where there won't be
any additional water that gets back across those lots to the North. It would be
cutting down the amount of water getting there quite a bit and it will alleviate
some of the problem. The conditions that exist now will not be hurt.
Mr. Bunn stated that they would have to get a variance for the length of the
dead-end street. The limit is 500'. There were comments concerning the median
at intersection. Mr. Bunn further stated that they would need to talk to the
Traffic Superintendent about some of the problems they've had with medians of
this type and see if some of those problems might be alleviated in this case.
Commissioner Robertson stated that the waiver on the length of the cul-de-sac
wasn't going to be that great. Mr. O'Neal stated that from the right-of-way of
Highway 265 to the center of the cul-de-sac is 590' so there is 90' difference.
Commissioner Dow stated that from looking atthe site, it backs up into back-
yards so you couldn't access from another street. Mr. Bunn answered that there
would be no chance to access another street.
Commissioner Dow asked Don Bunn is he was comfortable with that drainage plan.
Mr. Bunn answered that they hadn't gone into discussing it in any detail, but he
feels that what they are proposing will certainly not make the conditions any
worst to the North than they are now and it would alleviate it to the extend that
about 60% of the area that now drains across there will be taken to Highway 265.

Commissioner Springborn asked about the preferred method of handling the little
island at the access. Mr. O'Neal answered that he had talked with Perry
Franklin, Traffic Superintendent, about that and he suggested that they take 8'
off the exit and put it on the entrance and make it wider so that people coming
into the Subdivision wouldn't be as likely to hit the island.
Commissioner Robertson asked if they would move that back in the development 8'.
Mr. O'Neal answered, No, they had a 20' street width originally in the entrance
into the Subdivision and then a 20' exit coming out. They changed the exit to
12' and the entrance to 28' wide. Mr. O'Neal further stated that people turning
left off of Highway 265 would have a wider area and they could cut the corner a
little closer without hitting the island.
Commissioner Springborn asked what the little symbol on the island was. Mr.
O'Neal answered that it was a street light. Commissioner Springborn asked if
that was a good place for a street light if there is some risk of going in too
wide under slippery circumstances. He said that he thought it would be safer on
either side of the street. Mr. O'Neal stated that they could move it where they
wanted to. The island is about 40' deep and the street light could be moved back
into the island further back from the highway.
Commissioner Hanna asked if this was a preliminary plat and if they would have it
back as Large Scale Development. Commissioner Robertson answered, Yes.
Commissioner Robertson asked if anyone had comments for or against this proposal.
Gilbert Hoellerich, a member of the audience, of 2617 Country Way stated that he
was concerned about the drainage. He said he recognized that the top half would
be siphoned off to Highway 265 and he was concerned about if the size of the
sewer would take care of that. He furthered stated that the lower half would
still be coming out into his property and he was concerned about replacing soft
soil and trees with rooftops and removal of the trees. Because of this, what
would the ratio be between what he now gets and what he will get. Mr. Bunn
stated that in his discussion with the engineers, they didn't get into detail
about quantities of flow, but there are a certain number of acres that are going
to be taken to Highway 265 and not ever flow back to the North or to the East.
Mr. O'Neal stated that currently about 10 or 10 1/2 acres involved and that 6 of
that will be intercepted by the street and adverted out to Highway 265. The
problem right now is the side ditch that is currently on Highway 265 is not
working so there's additional water going down the property line. What we
propose to do is to build a berm along that ditch on Highway 265 to prevent any
of it from going towards the property line.

Mr. Hoellerich stated that he was also concerned about the traffic problem on
Highway 265 being compounded by the addition of another subdivision along that
Highway. He was concerned about whether his water pressure will drop with the
addition of other houses in the area and whether there would be room in the
schools for the additional school aged children. If not are the contractors
going to be asked to contribute to expanding schools.
Commissioner Robertson stated that it would be difficult to forecast what the
school aged children situation would be. Commissioner Hanna stated that there
are sixteen lots in the subdivision so it could add on the average of 1.5
children, but some of these could be people that moved from one space in
Fayetteville to another. The tax base will be increased by sixteen residences
when that is finished and a good portion of the revenue for the school system
comes off the millage and property taxes paid. Theoretically, their tax payments
are supposed to help alleviate school problems. The children are bused to
another part of town if they get too many in a given area.
Commissioner Seiff stated that one of the reasons that we do have a legal limit
on the length of that dead-end street or cul-de-sac is for consideration of
traffic. In this particular case, I don't have too much concern because of the
small addition from the alloted 500'. It's legal as far as traffic goes; if it
were to appear to be a terrific hardship of some kind, then I would be against
it. That cul-de-sac is not really overbearing in traffic.
Commissioner Hanna asked Mr. Bunn if there was any reason why this subdivision
should decrease water pressure in Mr. Hoellerich's subdivision (directly north).
Mr. Bunn stated that it could reduce it oy some incremental amount and he plans
to look at it. If it appears that there will be a significant reduction in the
water pressure, an additional tie and perhaps loop addition of be required.
Commissioner Hanna asked if this would be addressed in the Plat Review. Mr. Bunn
answered, Yes, on the final plat and also we will address it in the review of the
detailed plan discussion particularly for the water system. Commissioner Hanna
said to Mr. Hoellerich that it would be back before the Planning Commission when
it comes through Plat Review where all the utility companies and City Engineer
sit down with the developer and show him what he needs to do. Then it goes to
the Subdivision Committee Meeting and then it comes back before the Planning
Commission for final approval when all of these things have been worked out. At
that time a more definite answer can be given to your questions.
Commissioner Seiff stated that the Preliminary does have the preliminary
indication of where the water is coming from. The main water line comes in from
the Northwest between Mr. Duffield and Mr. Brashears' property.

MOTION
Commissioner Hanna moved to approve the preliminary plat with comments that have
been made here today to be addressed by the developer when they come before Plat
Review, seconded by Klingaman. The motion to approve the preliminary plat passed
6-0-0.
LARGE SCALE DEVELOPMENT PLAN - PARK INN
BILL CLODYELTER - SHILOH DRIVE
The third item of consideration was Large Scale Development Plan submitted by
Kenneth Cockram for Bill Clodfelter to construct 2 additional phases (58 rooms)
to the Park Inn. The property is zoned C-2, Thoroughfare Commercial.
Mr. Bunn stated that there are 2 separate units to be built on the west side of
the existing Park Inn Development. The Plat Review comments were mainly of the
nature of all the utilities and how they will serve the additional units. The
power company had comments about there capacity to serve the additional units and
that has been worked out. The other utility companies did not have a problem
with serving those additional units. The units do meet the setback requirements
and they have added enough parking spaces to meet the required number of parking
spaces. Two additional fire hydrants were requested by the fire chief and they
agreed to put those in. Mr. Bunn stated that basically, all the requirements had
been met.
Commissioner Robertson asked Mr. Cockram if he had any comments. Mr. Cockram
answered, No.
Commissioner Dow asked if the windows on the new units were going to be facing to
the front. Mr. Cockram answered, Yes, only to the front and that there is a
blank wall on the West side. Commissioner Klingaman asked if these new units
would have individual doors or would there be a hallway. Mr. Cockram
answered,Yes,
individual doors.
MOTION
Commissioner Seiff moved to approve the Large Scale Development Plan as
submitted subject to the Plat Review comments, seconded by Hanna. Commissioner
Klingaman asked if all the new parking is in front of the building to the North.
Mr Cockram answered that the parking along the West property line is new and they
have the additional parking to the North which they have there now but it isn't
being utilized. The motion to approve the Large Scale Dev;._opment Plan passed 6-
0-0.

WAIVER OF THE SUBDIVISION REGULATIONS (LOT SPLIT)
VOLA CAMILLE FLORA - NE CORNER OF LAKE SEQUOYAH DRIVE
& HUNTSVILLE ROAD
The fourth item of consideration was a request for
Regulations (Lot Split) for Vola Camille Flora for
corner of Lake Sequoyah Drive and Huntsville Road.

The property is zoned R-1,
Mrs. Flora stated that this property was a big lot on the corner and her husband
is no longer able to take care of that much property and that they need the money
that would be acquired from the sell of the lot being split off. Commissioner
Hanna asked if the lot they were splitting off was the portion to the rear down
Lake Sequoyah Drive. Mrs. Flora answered, Yes. Commissioner Hanna asked how
large the lot would be that was being split off. Mrs. Flora answered that it
would be 70' by 135'. Commissioner Klingaman asked about the offset that is
shown on the map. He said it looked like a straight shot off of Highway 16, but
the offset isn't there. Commissioner Klingaman further stated that the street is
60' wide to the rear and only 50' at the entrance of Highway 16. Mr. Bunn stated
that the easement may jog like that, but the street maybe positioned so that it
is straight.
Commissioner Dow asked what was on the lot to the East of this property. Mrs.
Flora answered that there was a home there. Commissioner Seiff asked if Mrs.
Flora was planning to retain 'che piece toward Highway 16 and split off and sell
the other piece. Mrs. Flora answered, Yes.
MOTION
Commissioner Hanna moved to grant the Lot Split as requested, seconded by
Commissioner Seiff. The motion to grant the lot split passed 6-0-0.
OTHER BUSINESS
Commissioner Robertson stated that Commissioner Seiff had informed him that they
had been delinquent in their participation at the Board of Adjustment. The
Planning Commission hasn't had anyone appointed to go there for 3 months or more.
Commissioner Robertson appointed Commissioner Hanna to participate at the Board
of Adjustment beginning at the first meeting in April.

Commissioner Robertson asked if the Planning Commission members had all received
a copy of the draft of the ordinance to amend the City Regulations for notice and
approval of Large Scale Developments that Mr. McCord had drawn up. The members
stated that this had been received. He further stated that they would hold this
subject for discussion at the next meeting.

Seiff moved to accept the minutes of the March 14, 1988, meeting were as mailed,
seconded. The motion was unanimous.
There being no further business, the meeting adjourned at about 5:45 p.m.
