HomeMy WebLinkAbout1988-02-22 Minutes• • • MINUTES OF A MEETING OF THE FAYE'1TEVILLE PLANNING COMMISSION A meeting of the Fayetteville Planning Commission vas held on Monday, February 22, 1988 in the Board of Directors Room of the City Administration Building, 113 West Mountain Street, Fayetteville, Arkansas. MEMBERS PRESENT: Ernie Jacks, Butch Robertson, B.S. Dow, Fred Hanna, Julie Nash, J.E. Springborn, Gerald Klingaman and Gerald Seiff MEMBERS ABSENT. Frank Farrish OTHERS PRESENT: Harry Gray, Lyndell Duncan, Barbara White, Larry Wood, Don Bunn, Tessi Franzmeier, members of the press and others APPROVAL OF A PRELIMINARY PLAT - SUMMERHILL WEST CHARLES SLOAN - NORTH OF MASONIC & SOUTH OF MILLSAP The first item on the agenda was consideration of a preliminary plat for Summerhill West submitted by Charles Sloan and represented by Harry Gray of Northwest Engineers. Property located north of Masonic and south of Millsap, zoned R-1, Low Density Residential District, parcel contains 4.5 acres with 12 lots proposed. The request included a waiver of the street light spacing requirement from the required 300' to approximately 370'. Chairman Jacks noted this item was not heard by the Subdivision -Committee. Chairman Jacks asked Mr. Gray if all easements as requested by the utilities were indicated on the plat and Mr. Gray replied "yes". Jacks asked Don Bunn if some type of an arrangement had been made by the City to help with the construction of Masonic Drive. Don Bunn replied no arrangement had been made as yet, but the City had hoped to find some funding in the budget for the improvements. Jacks asked Mr. Gray if the developer was willing to improve his half of Masonic and Mr. Gray replied "yes". Mr. Gray noted that a change had been made in the plat to reflect a correction in the abstract. He advised the new plat would reflect 12 lots rather than 14 lots because of an error in the legal description. Mr. Gray presented a corrected copy of the plat to the Planning Commission for review. Seiff asked if any Bills of Assurances were out on Masonic Drive. Bunn and Franzmeier said they were not aware of any for Masonic. Seiff said he was concerned about the funding for the street and felt the City should give some type of assurance for the improvement. Bunn noted the developer was willing to pave his half plus the western part as well if the City could find the funds to improve the other half. Sieff then said that was the "big if". Mr. Gray noted the existing curb and gutter in front of the Masonic Lodge building was approximately 2-3 feet south of the curb just west of there. He said in other words the curb lines did not line up and to make the project work right the existing curb needed to be torn out in front of the Masonic Lodge. Commissioner Hanna asked if the Masonic Lodge was built before the City started requiring off-site improvements and Bunn said he assumed it was, but did not know for sure. Jacks felt the Masonic Lodge was constructed prior to the off-site improvement ordinance. Chairman Jacks if anyone in the audience would like to speak for or against the request. There being no opposition the public hearing was closed and discussion returned to the Planning Commission. Commissioner Dow asked if the sidewalk would be require& -on -the-north side of Masonic rather than the south side. Mr. Gary noted the plat reflected the sidewalk on the north side of Masonic Drive. MOTION Commissioner Robertson moved to approve the preliminary plat with the waiver of the street light requirement subject to: 1) plat review comments and; 2) an arrangement with the City on the improvements to Masonic, seconded by Commissioner Hanna. The motion to approve the preliminary plat passed 7-0-1, with Commissioner Seiff abstaining. WAIVER OF THE SUBDIVISION REGULATIONS (LOT SPLIT) C. ODELL TAYLOR - NORTH OF WYMAN RD. & EAST OF STONEBRIDGE The second item on the agenda was consideration of a waiver of the Subdivision Regulations (lot split) submitted by C. Odell Taylor and represented by Barbara White, Century 21. Property located north of Wyman Rd. and East of Stonebridge, zoned R-1, Low Density Residential District. Request is for the first split with total acreage of 1.5. Ms. White advised the total parcel was 14 acres and Mr. Taylor would like to split 1.5 acres and sell the remainder. She added the 1.5 acres contained a house, barn and the ROW into the property. Commissioner Dow said the road was unpaved and asked if a stipulation should made that the property owner not asked the City to improve Stonebridge. Ms. White • • • Planning Commission February 22, 1988 Page 3 said the property owners knew the road was dirt and had no intention of wanting it improved. MOTION Commissioner Hanna moved to grant the waiver of the subdivision regulations (lot split) as requested, seconded by Seiff. The motion to grant the lot split passed 8-0-0. LARGE SCALE DEVELOPMENT - CONDITIONAL USE (PLANT NURSERY) LYNDELL DUNCAN - 2620 N. GREGG The third item on the agenda was consideration of a Large Scale Development and Conditional use for a plant nursery. Submitted by Lyndell Duncan for property located at 2620 N. Gregg, zoned A-1, Agricultural. After discussion it was decided Mr. Duncan's application for a lot split was not necessary because he was leasing the land rather than purchasing the land. Mr. Duncan advised he intended to use the fenced 4 acre area for an office and plant nursery. Chairman Jacks advised the request for conditional use had to come from the property owner for the use of the 4 acre tract of land. Mr: Duncan advised Dr. Nettleship was aware of what was going on. Mr. Duncan also noted he had worked for Dr. Nettleship since he was in the sixth grade. Dow felt the motion should include the approval of Dr. Nettleship. MOTION Commissioner Hanna moved to grant the conditional use for a plant nursery with the provision Dr. Nettleship sign the request for conditional use, seconded by Nash. The motion to grant the conditional use passed 8-0-0. Chairman Jacks asked Mr. Duncan if he would like to say anything pertaining to his Large Scale Development. Mr. Duncan had no comment. Commissioner Hanna asked if the culverts were in place and Mr. Duncan replied "yes" and he had also obtained the curb cut permit from the Arkansas Highway Department. Commissioner Klingaman asked if sewer facilities were on site. Mr. Duncan advised all sewer lines were existing with the exeption of the line to the new building. Chairman Jacks advised a Bill of Assurance would be accepted for the sidewalk along Gregg to include the frontage of the 4 acre parcel. Jacks also advised the Bill of Assurance would have to be executed by Dr. Nettleship. Chairman Jacks asked if proof of notification had been submitted to the Planning • • • Planning Commission February 22, 1988 Page 4 Office and Franzmeier advised she recieved proof of notification. MOTION Commissioner Nash moved to approve the Large Scale Development subject to: 1) approval of Dr. Nettleship, seconded by Commissioner Hanna. The motion to approve passed 8-0-0. DISCUSSION OF PLACEMENT OF MOBILE HOMES WITHIN THE ZONING DISTRICTS Planning Consultant, Larry Wood noted a situation had come up concerning mobile homes. He said a lady called him wanting to know if she could place a mobile home in an R-2 zone and 3 acres of land. Wood advised that mobile home parks were allowed in an R-2 zone on appeal to the Planning Commission. Wood felt if two mobile homes were okey and one mobile home was not, then there was a problem with the ordinance. He asked the Planning Commission if they felt a change in the ordinance would be needed for mobile homes. Chairman Jacks said mobile the Planning Commission. be place on the property wanting to redefine the replied "yes". Jacks said in R-2 or R-3 with 3 acres home parks were permitted in R-2 and R-3 on appeal to Jacks also noted in A-1 a temporary mobile home could with 3 or more acres. Jacks asked Wood if he was mobile home park ordinance as one or more and Wood that would mean a single mobileLhome could be placed of land on appeal to the Planning Commission. Commissioner Hanna advised there was mobile home park ordinance with very strict requirements. Commissioner Klingaman noted, today that person may want a single mobile home on his 3 acres, but five years down the road they may decide to add more mobile homes. Hanna advised at that time they would be required to go through the Large Scale Development process which would include plat review, subdivision committee and Planning Commission approval. Commissioner Hanna advised the conditional use would be granted for one mobile home on 3 acres of land. If in time they wished to install more than one mobile home they would have to come back through the process. He said the conditional use did not give them permission for anything other than the one mobile home. Don Mills, Chairman of the Board of Adjustment asked if the wheels of a mobile home were taken off, set on a foundation and tied into the sewer and utilities would that be allowed in the R-2 and R-3 zones. Jacks replied that the zoning ordinance separated mobile and prefabricated construction as two separate entities, which could be found in the use units. He said the prefabricated construction met the Southern Building Code and mobile homes did not. Commissioner Nash advised the square footage requirement was less for a mobile home than for a mobile home park. She asked would that be decided time of a conditional use request. Larry Wood replied "yes" and more than single at the likely • Planning Commission February 22, 1988 Page 5 that figure would be based on the zoning requirement for that district. Commissioner Klingaman felt it was a little silly to define a mobile home park as one unit. He felt it could be addressed at another point in the code where a mobile home be allowed as a single family residence. It was decided to table this item until the next regular Planning Commission meeting for further research and discussion. MOTION Commissioner Seiff moved to table this item until the next regular Planning Commission meeting, seconded by Commissioner Klingaman. The motion to table passed 8-0-0. APPOINTMELTP OF THE SUBDIVISION COMMITTER Chairman Jacks advised of the appointments to the Subdivision Committee for 1988. Chairman B.J. Dow, Julie Nash and Butch Robertson. • MINUTES The minutes of the February 8, 1988 meeting were approveh &,marled. OTHER BUSINESS MOTION • Commissioner Robertson proposed a resolution to Sandra Carlisle for her help, guidance, consideration and expertise in the job she did as City Planning Director, and a resolution thanking Tessi Franzmeier for the job she had done in her capacity to the City Planning Office, seconded by Commissioner Hanna. The motion was unanimous There being no further business the meeting adjourned at about 6:15 p.m. /9
