HomeMy WebLinkAbout1988-01-11 MinutesMINUTES OF A MEETING OF THE FAYETTEVILLE PLANNING COMMISSION A meeting of the Fayetteville Planning Commission was held on Monday, January 11, 1988 in the Board of Directors Room of the City Administration Building, 113 West Mountain Street, Fayetteville, Arkansas. MEMBERS PRESENT: MEMBERS ABSENT: Ernie Jacks, Stan Green, Fred Hanna, Sue Madison, B.J. Dow, Butch Robertson and Gerald Seiff Frank Farrish and Julie Nash OTHERS PRESENT: Mr. Jim Herrin, Sandra Carlisle, Larry Wood and Tessi Franzmeier WAIVER OF THE SUBDIVISION REGULATIONS - LOT SPLIT MR. JIM HERRRIN - ROCKWOOD TRAIL AND N. JACKSON DRIVE The first item on the agenda was consideration of a waiver of the subdivision regulations (lot split) submitted by Mr. Jim Herrin. Property located North of Rockwood Trail and East of North Jackson Drive and zoned R-1, Low Density Residential District. Chairman Jacks asked Mr. Herrin if he had anything to add to his application for lot split and Mr. Herrin replied "no". Commissioner Madison asked what the little dotted line reflected on the zoning map that had been included in the agenda. Madison said she was worried that the property in question would cut off the back property without access. Jacks thought that dotted line was a street that had never been constructed. Madison asked if the street was deeded City access and Carlisle replied she had not researched that street and could not say for sure. Madison felt some assurances would be needed for public access to the back piece of property before the Commission voted to split the property in question. Jacks felt the lot split would not change the situation that existed now. Madison asked if the split was coming off the back portion of the property and Mr. Herrin replied "no" it was being split from the front two pieces. MOTION Commissioner Madison moved to approve the lot split as requested, seconded by Commissioner Hanna. The motion to approve passed 7-0-0. Chairman Jacks deferred item two until the arrival of Larry Wood. • Planning Commission January 11, 1988 Page 2 OTHER BUSINESS Carlisle advised the meeting scheduled for January 19, 1988 at 9:00 a.m. had been cancelled by the Mayor. Carlisle advised the Board of Directors had scheduled seven meetings for the month of January and would not meet once more. Carlisle said, however Mr. Raby was still arriving on January the 19th at 10:00 a.m. and would leave Tuesday the 20th at 5:30 p.m. Carlisle advised January 20th would be a good time for the Planning Commission to meet with the Planners on the Elderly Housing item. A meeting was then set for January 20, 1988 at 9:00 a.m., attending the meeting would be Fred Hanna, Sue Madison and Gerald Seiff. Hanna asked Carlisle to notify Don Mills, Chairman of the Board of Adjustment to attend the meeting as well. Carlisle advised any of the Planning Commissioners who wished to attend, come to her office at 9:00 a.m. and she would advise them where the meeting was going to be held. Chairman Jacks appointed a Nominations Committee for the selection of a Chairman, Vice Chairman and Secretary. Jacks advised Butch Robertson would Chair the Nomination Committee and that B.J. Dow and Julie Nash would serve on that Committee. Madison asked if it would be appropriate to wait until the Board had made their decision on the new nominations for the Planning Commission. Jacks advised the By -Laws stated the nominations had to be made by the first regular • meeting in February. • Chairman Jacks felt the By -Laws needed to be changed and added that the Planning Commission use to have one regular meeting a month and now they have two. Carlisle asked if a motion would be made to amend the By -Laws. NOTION Chairman Jacks moved to amend the By -Laws by changing the word "regular" to the word "first", seconded by Robertson. The motion to amend the By -Laws was approved 7-0-0. Chairman Jacks advised the last item under Other Business was a discussion from the Elderly Housing Committee. Fred Hanna advised the items that he had handed out prior to the meeting were relavent to future planning for caring for elderly people in Fayetteville. (1) Individual Care for Relatives (a) Work administratively toward making remodeling easier (b) Mother -in -Law houses on the same lot (c) Mobile Homes • • Planning Commission January 11, 1988 Page 3 (2) Institutional Care (a) Nursing Homes (b) Hospital Additions Commissioner Hanna advised the code book did not address nursing homes perse, but listed convelesent homes. Hanna felt it should be spelled out in the ordinances what use unit nursing homes would fall under and what zones they would be permitted in by right. (3) Intermediate Care in Homes (a) Residential Care (b) Boarding home for the elderly (4) Day Care of the Elderly Chairman Jacks asked if there was a zone for boarding houses and Carlisle replied "yes". Jacks then said Hanna was suggesting that the Boarding home for elderly should be treated differently. Hanna said personally he felt a definition should be added to the use units so people who came in would know if they could do this or not. Commissioner Madison felt the boarding home classification was sufficient and did not see why the City needed a special category or another piece of paraphernalia to be dealt with, just because of someones age. Commissioner Hanna felt the older people deserved better consideration other than sticking them in the R-3 zone which allowed boarding homes. He said most of the elderly do not drive, they do not have children or pets and the normal things that add to conjestion and felt they would be more acceptable in an R-2 zone. He also said it could be made a conditional use in other zones. Commissioner Madison said some time ago Sandra Carlisle had given the Planning Commission a copy of the 1987 facts for the Arkansas Legislature, whereby homes for developmentally disabled adults would be allowed in any and all zones by right. Carlisle advised that developmentally disabled was not necessarily classified as "elderly". Commissioner Hanna advised of ordinances that addressed day care situations, but there was nothing to address the elderly. Robertson felt a conditional use would be the way to approach problems on an individual basis. Commissioner Dow said it made sense to have a conditional use in any zone because it would be less intrusive than day care for example, which was allowed by conditional use in any zone. • • Planning Commission January 11, 1988 Page 4 Commissioner Hanna advised it was getting to be more common for churches to set aside 3 or 4 days a week for the care of the elderly such as the Fayetteville Sang Senior Center. He said in Little Rock they have day care centers for the elderly. Commissioner Madison asked how would someone define "elderly". Hanna advised the committee had discussed that and he personally felt it had to be somewhere between 60-65 years of age. Carlisle advised that the qualifying age for Community Development was 60 years of age. Commissioner Dow thought a use by right in the R-3 for elderly boarding homes would work and then may be a conditional use in R-1 and R-2. Commissioner Dow asked what was Butterfield Trail Village considered and Carlisle replied multi -family. Jacks advised the zoning was R-2 and that people owned their own individual units. Commissioner Madison asked if Fayetteville had any boarding houses and Carlisle replied "not her knowledge". Jacks said fraternity houses were considered boarding houses. Chairman Jacks requested a joint meeting with the Planners and the Planning Commission before they really get going on the General Plan. He felt a special meeting would be beneficial rather than a regular Planning Commission meeting. MINUTES The minutes of the December 14, 1987 meeting were approved as mailed. Commissioner Seiff questioned the minutes concerning the Board of Directors meeting held on Tuesday, the 5th of January. He asked what the decision was by the Board of Directors for the appeal of the Planning Commissions decision on a rezoning petition submitted by Mr. Pinnell. Sandra Carlisle noted that item had been tabled at that Board of Directors meeting and would be heard again on the 19th of January. Madison advised that Larry Wood had reversed his decision on the recommendation because Mr. Pinnell agreed to do sewer and water lines. Larry Wood advised that Mr. Pinnell had called him and said he would probably end up owning all of the lots west Oak Street and that he had options on the house and would also take an option on the vacant land. Wood said Mr. Pinnell intended to extend the water line from Highway 62 up to Oak and Rutledge Lane and install a fire hydrant at that location and also he would access to Velda Court. Larry Wood said if Mr. Pinnell did all those things he would recommend R-2 zoning. Larry Wood said he advised Mr. Pinnell to request that the Board of Directors send the petition back to the Planning Commission for further discussion. Larry Wood said Tuesday night the Board of Directors decided to table the item instead. Larry Wood said he had since sent a memo to the Board of Directors saying "yes he would reluctantly recommend R-2, if Mr. Pinnell would offer a Bill of Assurance specifying those items Mr. Pinnell indicated". • • • Planning Commission January 11, 1988 Page 5 DISCUSSION OF USES IN I-1 ZONES, CONCERNING CHEMICALS Larry Wood said a gentleman called him who operated a business on West Avenue in an I-1 district. His business was basically a service business to the poultry processors (Campbell Soup being one of them). Wood said apparently Cambpell Soup used some kind of a chemical for water purification process and when needed the gentlmans service would order it and deliver it to Campbell Soup. Wood said when the Fire Department inspected the gentlemans business he was told that he would either have to get rid of the chemical or apply for an I-2 zoning because he was not zoned property for hazardous chemicals. Wood said he told the gentleman that he would take this to the Planning Commission for a discussion because he felt this was more far reaching than just his problem and he could see a mass change from I-1 to I-2 for all the people who had hazardous chemicals on their property. Wood said he had hoped someone from the Fire Department would be present at this meeting so specific details could be given on what types of hazardous chemicals were classified "hazardous chemicals". Wood said in his business which was classified to be in an office district, normally had 4 -gallons of ammonia on the shelf all the time for blueprint process, and ammonia was classified as a hazardous chemical. Chairman Jacks noted that hazardous chemicals where classified in use unit 23 which was heavy industrial "only". Carlisle advised of a new State Law that sited if hazardous materials were stored the fire department must have a list of all chemicals they had and that list must be locked in a box with the fire department retaining a key to the box. Jacks said every paint store would have all sorts of paint thinners. Hanna asked if bulk petroleum plants were permitted in I-1 and Wood replied "yes". Hanna then said how much more flammable could petroleum get. Wood noted that was for underground only as he understood, but it was permitted in an I-1 zone. Commissioner Green asked if someone was relying on the zoning ordinance to say that those things were not allowed in I-2 or was it coming from the fire code or fire department. Carlisle replied that the problem was coming from the zoning ordinance. Green then said the zoning ordinance would apply to a manufacturer of those chemicals and not necessarily someone that just happen to have "detergent" in their home or garage. Chairman Jacks noted that warehousing was permitted in an I-1 zone and Madison said the City did not restrict what the warehouses could restrict in the warehouse zone. Seiff then added unless there was a fire code that the Planning Commission was unaware of. Hanna felt there could be mayor problems with existing businesses in the I-1 zones if they started requiring I-2 zones for chemicals. Madison noted there was nothing in the zoning ordinance that addressed anything about hazardous chemicals. Hanna felt if repackaging or manufacturing was occuring then he could see a problem, but grocery stores that carried already packaged poison and dangerous chemicals would be different. • • Planning Commission January 11, 1988 Page 6 Larry Wood felt someone from the fire department needed to attend a Planning Commission meeting so they could address what or what was not permitted in I-1 or I-2 zones as far as chemicals and fire codes. Commissioner Robertson felt something like this could get out of hand in a hurry and possibly alert EPA and OSHA. Larry Wood said hazardous chemicals were listed on an EPA list and those chemicals are to be reported to the fire department. He said there was a HAZMAT team being formed in Washington and Benton County. Wood said the team was specialized in fighting hazardous chemical and material fires. Madison felt a certain quantity would have to be met before someone would have to report it to the fire department. NOTION Commissioner Robertson moved to table this item until the next regular Planning Commission meeting so that a representative from the Fire Department could attend, seconded by Seiff. The motion to table passed 7-0-0.
