HomeMy WebLinkAbout1986-12-08 Minutes• •4 MINUTES OF A MEETING OF THE FAYETTEVILLE PLANNING COMMISSION A meeting of the Fayetteville Planning Commission was held on Monday December 8, 1986 in the Board of Directors Room of the City Administa- tion Building, 113 West Mountain Street, Fayetteville, Arkansas. MEMBERS PRESENT: MEMBERS ABSENT: OTHERS PRESENT: Ernie Jacks, Stan Green, Fred Hanna, Butch Robertson, Frank Farrish, Gerald Seiff, B.J. Dow and Julie Nash Sue Madison E.H. Sonneman, Bob Crafton, Ronald Woodruff, Sandra Carlisle, Tessi Franzmeier, members of the press and others PUBLIC HEARING - REZONING R86-19 E.H. SONNEMAN - NORTH OF MT. COMFORT RD WEST OF DEANE SOLOMAN The first item on the agenda was consideration of rezoning petition R86-19 submitted by E.H. Sonneman, for property located north of Mt Comfort Road, on the west side of Deane Soloman Road. Request was to rezone 40 acres from A-1, Agricultural to R-1, Low Density Residential District. Planning Consultant Wood recommended rezoning to R-1 for the following reason: 1. R-1 District is recommended provided it is the intent of the developer to extend water and sewer facilities to the property and to provide fire plugs for fire protection. If these public facilities are not provided then the change to R-1 is considered premature. Mr. E.H. Sonneman said part of his plan was to extend water and sewer to the location in question. He said his intention was to subdivide at the south entrance of the Golf course. MOTION Nash moved to recommend approval of the rezoning from A-1 to R-1 with a Bill of Assurance that the water and sewer would be extended and that the fire plugs be added to the property, seconded by Hanna. The motion passed 8-0-0. Jacks advised the recommendation would then go on to the City Board on December 16, 1986. • • • Planning Commission December 8, 1986 Page 2 REPLAT OP FINAL SUBDIVISION PLAT - A.W. REALTY, BLOCKS 1 S 2 A.W. REALTY - EAST SIDE OF FRONT ST., SOUTH OF SAIN ST. The second item on the agenda was the consideration of a final plat of A.W. Realty Blocks 1 & 2 submitted by and represented by Bob Crafton of Crafton, Tull, Spann & Yoe located east of Front St., south of Sain St., containing and zoned C-2, Thoroughfare Commercial and I-1, Light Heavy Commercial. a replat of A.W. Realty for property 16.29 acres Industrial, Jacks advised this had been heard by the Subdivision Committee on December 4, 1986 and the only stipulation they had was that proof of notification of the adjoining property owners be submitted before approval of the final plat. Mr. Crafton stated he had submitted proof of notification to Planning Director, Sandra Carlisle. MOTION Dow moved to recommend approval of the final plat, seconded by Hanna. The motion passed 7-0-1 with Green abstaining. PUBLIC HEARING - REZONING R86-20 AIRWAYS FREIGHT CORP. - WEST OF THE 71 BYPASS SOUTH OF HWY 16 WEST The third item on the agenda was consideration of rezoning petition R86-20 submitted by Airways Freight Corporation for 9.26 acres located west of the 71 Bypass, on the south side of Highway 16 west. Request is to rezone from A-1, Agricultural to R-0, Residential Office. Planning Consultant Larry Wood's recommendation was: R-0 District is recommended for the north 500 or 600 feet of the property under application, with the remainder of the property staying A-1 District at this time. The request is consistent with the General Plan recommendations and the developing nature of the south side of Hwy 16 west. The City Board is currently discussing the formation of a sewer improvement district for Hwy 16 west. Some commitment to participate in the district should be provided by the applicant to the City. In answer to a question from Commissioner Seiff, Planning Consultant Wood stated the General Plan showed only the 500 or 600 feet of the property for R-0 District. Farrish said all the property was under one ownership and asked if it made any sense that the rest of it remain A-1 and was that the intended use for that property. Planning Commission December 8, 1986 Page 3 Wood said the plan called for R-1, Low Density for the remainder of that property. In answer to a question from Commissioner Farrish, Wood said at this time he was recommending the remainder of the property stay A-1 until a petition was filed for R-1. Ronald Woodruff, Attorney representing Airways Freight Corporation said this property was locally owned by the Caudle family and said the application was reasonably self-explanatory. He said the plan was to build a small office building on that particular site and there was no plan to develop the property any further other than to put their own corporate offices at that location. He said Mr. Caudle would join in the Sewer Improvement District. Commissioner Seiff asked the size of the proposed building and Mr. Dale Caudle said the building would be approximately 80' X 60'. Farrish asked how the petitioner felt about rezoning part of the property R-0 and the remainder A-1. Mr. Woodruff said he felt it should all be zoned the same and they had planned to set back off the highway and did not intend to farm on the remainder of the property. MOTION Farrish moved to recommend approval of this rezoning petition as presented by the petition for the 9.26 acres from A-1 to R-0 with the stipulation of a Bill of Assurance for the participation of the Sewer Improvement District, seconded by Seiff. The motion passed 8-0-0. Dow stated she would normally go along with the General Plan but with the property being R-0 she felt it would be a good buffer and felt it was a reasonable request. PHIL FREDRICKS - LANDSCAPING COMPANY - LSD EAST OF HWY 71 BYPASS ON THE SOUTH SIDE OF CATO SPRINGS ROAD. The fourth item on the agenda was the Large Scale Development Plan for a Landscaping Company submitted by Mr. Phil Fredricks for property located east of Hwy 71 Bypass on the south side of Cato Springs Road. Property is zoned I-1, Light Industrial, Heavy Commercial and contains 1.51 acres. Jacks advised this was heard and approved by the Subdivision Committee last Thursday subject to several contingencies; 1) ROW to be established in conformance with the State Highway; 2).proof of notification; 3) Bill of Assurance for a sidewalk along Cato Springs Road; 4) remove the word "retail" from the plat. Planning Commission December 8, 1986 Page 4 Carlisle advised that all of the above had been submitted to the Planning Office. SPOT NOT CAR -WASH - LSD SOUTH OF HWY 45 ON THE WEST SIDE OF HWY 265 - GMW PARTNERSHIP The fifth item on the agenda was the Large submitted by GMW Partnership for a Spot Not of Hwy 45 on the west side of Hwy 265. The Thoroughfare Commercial District. Scale Development plan Car -Wash located south property is zoned C-2, Jacks advised this was heard and approved by the Subdivision Committee last Thursday subject to; 1) Bill of Assurance for a sidewalk along the east side of Hwy 265; 2) proof of the permit from the State Highway Department on the Drives. MINUTES The minutes of the November 24, 1986 meeting were approved as distributed. There being no further business the meeting adjourned at 5:20 P.M.
