A meeting of the Planning Commission was held at 5:00 P.M. on
Monday, January 9, 1984 in Room 107 of the Continuing Education
Center, Fayetteville, Arkansas.

Chairman Newton Hailey called the meeting to order.
The first item of business on the Agenda MINUTES
was the approval of the minutes of the Planning Commission meeting
o f December 12, 1983. With no corrections or additions, the
Minutes were approved as mailed.
The second item of business was a REZONING PETITION R83-24
public hearing on Rezoning STERLING P. AND KAY Z. ANDERS
Petition R83-24, Sterling P. Anders 614-642 W. Sycamore
and Kay Z. Anders, to rezone property located at 614-642 W.
Sycamore from I-1, Heavy Commercial and Light Industrial
District to C-2 Thoroughfare Commercial District.
Chairman Hailey asked Bobbie Jones, Planning Administrator, to read
the reasons for requesting the change in zoning. Jones advised
that according to Mr. Ander's file, this rezoning was for the
purpose of accommodating a Hot -Wheels Store, selling neighborhood
sundries and food supplies. She advised that according to the file,
Mr. Anders felt the rezoning would not conflict with surrounding
land uses due to the fact that the property to the north is
the Skate Place which more properly would belong in a C-2 zone.
Other property in this area also more properly would fit in'a
C-2 zone. The property to the west is now being developed
into a coin operated laundry and restaurant business.
Chairman Hailey then requested Larry Wood, Planning Consultant's,
✓ eport. Wood advised that C-2 is not recommended for the following
✓ easons:
1. In 1972 (R72-40) a recommendation was made to the
Planning Commission and City Board that consideration
be given to establishing a light industrial area
from Township Road to North Street between Gregg
Avenue and Skull Creek. The intent was to provide

a centralized location for smaller light industrial
firms and related service businesses which do not
necessarily want to locate in the industrial areas
in the southern part of Fayetteville. The area recom-
mended was already anchored on the north at Township
Road and the south at North Street with industrial
uses. It was not the intent of the recommendation to
open this area to the heavier traffic generating
uses contained in the C-2 District.
2. The area being considered does not have direct access
to arterial streets and all traffic entering or
leaving must pass through existing residential areas.

3. The future street plan for this area does not contem-
plate improvements that would support a shift to
heavy traffic generating uses.
Establishing a C-2 District at this location is contrary
to the policies and standards for commercial location -
adoption in the General Plan.
Chairman Hailey opened the Public Hearing at which time Mr. Anders
advised that Mr. John Maguire wished to use the southwest corner of the
building under construction to open a "Hot-Wheels"".convenience_
grocery store with gasoline sales. Anders stated that Maguire felt that
d ue to the apartments in the vicinity, a "Hot Wheels Store" would be
of value. Anders stated that most of the traffic which travels in
the vicinity would travel down Sycamore anyway, that the "Hot -Wheels"
store would not generate any additional traffic. The Public Hearing
was closed with no one speaking in opposition to the rezoning.
Barbara Crook questioned confirmation that this use was available in
Use Unit 14 & 15 in a C-2 District, but not available in I-1 District.
Jones advised that Use Unit 16 is also allowed in C-2 but
Use Units 14, 15 & 16 were not allowed in I-1. Use Unit 15 allows
Grocery Store and Service Station. Ernie Jacks stated that it was
h is feeling that we keep saying that we wish to leave a mechanism to
allow for the small corner grocery store, however, there is already
one in this vicinity, and there seems to be a great move to
commercialize Sycamore. Jacks said he did not favor commercial-
izing Sycamore. Chairman Hailey requested to know how far it was
between the corner store on Leverett and Poplar and the one on North
Street. Wood advised that it was approximately 1/2 to 3/4 mile.
Melanie Stockdell advised that she agreed with Jacks not only in the
position he has taken on this matter, but also states she disagrees
with this rezoning due to the fact that there is no direct access.
Commissioner Stockdell made a motion to deny MOTION
approval of the rezoning petition. Motion was seconded by Morton
Gitelman. Motion passed 7-2 with Stanley Green and Fred Hanna voting
"nay".

The third item on the agenda was REZONING PETITION R83-25
a public hearing on rezoning STERLING P. ANDERS
petition R83-25, Sterling P. Anders, SE CORNER NORTH & GARLAND
to rezone Property described as Lots 5, 6, 7, and 1, Block 4,
Rose Hill Addition, from, R-3, High Density Residential, to C-1,
Neighborhood Commercial. The property is located on the SE corner
of North Street and Garland Avenue.
Chairman Newton Hailey requested Bobbie Jones to read the reason
for request of rezoning. Jones advised that according to Mr. Ander's
file, this rezoning was to accommodate two or three small retail
shops such as laundry pickup station, flower shop, ice cream or
yougart shop, automatic bank teller, coin operated laundry, small
clothing shop, sporting goods shop, donut shop, barber shop,
photo or photo copying, etc. She advised that Mr. Anders did not
feel that this zoning would conflict with the surrounding land uses
because the property to the north across North Street is zoned
commercial. The property to the northwest is zoned commercial
and used by Mcllroy Bank. The property to the east is zoned
R-3 and by zoning this property C-1, it makes a very logical buffer
to a busy intersection and high traffic area.
Chairman Hailey then asked for Mr. Larry Wood's report which was
as follows:
C-1 District is recommended for the following reasons:
1. The property is located at the intersection of two
arterial streets which is the location standard
suggested in the General Plan;
2. Two corners of the intersection contain commercial
development; and
3. The public facilities and services are available to
serve the property.
The public hearing was opened and Mr. Anders stated that he totally
agreed with Mr. Wood's report.- Anders stated he did not have plans
for this property at the present time, but did want to improve the
property at some point in time. Barbara Crook stated that we
needed to be sure that this zoning did not spread to the south and
east. Bobbie Jones advised that Mr. Anders would not be able to place
a clothing shop in this zoning district as this would require a C-2
zoning district. There being no opposition to the rezoning petition,
the public hearing was closed.
Ernie Jacks made a motion to approve
the rezoning of this property to C-1. MOTION
Motion was seconded by Melanie Stockdell. Morton Gitelman then
asked about the development to the south, and stated he would be
concerned if development were to move south and would oppose
development along Garland. Barbara Crook stated that she would

have to`vote against this rezoning as long as Lot 1, Block 4 was
included in the rezoning. Motion passed 8-1 with Barbara Crook
voting "nay".
The fourth item on the agenda was the REZONING PETITION R83-26
Rezoning Petition R83-26, Robert Nickle 1710 N. Leverett
and Charles Nickle for property ROBERT NICKLE & CHARLES NICKLE
located at 1710 North Leverett, Part of Lot 7, Block 10, Parker's
P lat of Valley View Acres, from R-2, Medium Density Residential,
to C-1, Neighborhood Commercial.
Chairman Hailey asked Bobbie Jones to relay the reasons for the
rezoning request. She stated that the owners desire to put in a
n eighborhood "take-out only" restaurant utilizing the present
structure after extensive renovation. There are no plans for
on-site food consumption due to limited space and lot size.
At present, the property exists as a single family residence which
it was before zoning took effect in the area. The R-2 zoning is of
no use as the lot is too small for any multi -family purpose.
Since the extension of Sycamore Street, the traffic count has increased
d ramatically, making residential use of the property much less desirable.
She stated that the petitioners did not feel that this would conflict
w ith the surrounding land uses as to the north and east sides, there is
currently an R-3 zone and to the south side, there is R-2 zoning
which is a non -conforming use (zoned R-2) which would not be
affected by C-1. Directly west (zoned R-1) is the back half
of lot with a high privacy fence; the dwelling is facing Kelly
S treet and is slightly north of the subject property.
The public hearing was opened and Mr. Nickle asked to give some
background on this property. He stated that in 1975, this property
was vacant and had been for a couple of years. This had a very small
single family dwelling located on the property. Mr. Nickle stated
that they fixed the house up to some degree and rented it out. Then,
an improvement district was formed and Sycamore was improved. Mr.
Nickle stated that he rendered his portion of property as was needed
for the said improvement, but since this occurred, the traffic on
Sycamore has increased drastically. Mr. Nickle stated that this house
was present on the property when the General Plan was adopted and is
Just too small for a single family dwelling. Mr. Nickle stated that
he would also be willing to accept some other form of zoning which
would enable him to make use of his property. Richard Mayes stated
that he was not really opposed to this take-out service, however, he
stated he would be against anything that would increase the.traffic
in the^area. He stated that traffic moves at a high rate
o f speed in that area, and there are many accidents. Nickle advised

that he did agree with the traffic problem, however, he expected that
h is take-out service would more serve the neighborhood people, possibly
on their way home, etc., and would not increase the traffic at all.
He stated he did not expect someone would come across town to come to
h is take-out service. The public hearing was closed.
Melanie Stockdell asked if there were any traffic counts in the area
in question. Mr. Larry Wood stated that he thought there was a
a study available. Sue Madison asked if there were any plans for
Sycamore (between Leverett & Garland) to be brought up to its standards
as a collector. Wood answered that this is in the very distant future.
S tanley Green requested to know if there was anything that could be
done with the property. Larry Wood advised that this could be
multi -family of some kind, i.e., duplex. Sue Madison stated she did
not see where this would help Mr. Nickle's problem of the traffic
situation since this would be adding another family. Mr. Nickle
stated it was not economically feasible for him to consider this route.
Ernie Jacks stated that it was his feeling that wherever you have
a take-out service, you have a tendency at some future time to
• have sit-ins. Jacks said the City had had'requests in the past to
commercially zone Leverett Avenue. Jacks said he was not in
favor of stripping it commercial.

Ernie Jacks made a motion to deny the
rezoning petition. Motion seconded MOTION
by Morton Gitelman. Gitelman reminded the Commission of a lawsuit
which ensued over the SE corner of North and Leverett in which
the City was upheld in its decision against rezoning.commercial.
Barbara Crook asked if there was a possibility of Mr. Nickle using
this property for commercial offices. Motion passed 7:=2.with Hailey and
Hanna voting "nay".
The fifth item on the agenda was CONDITIONAL USE
Conditional Use Request sub- FAYETTEVILLE COUNTRY CLUB
mitted by Northwest Engineers for -3335'Country Club Drive
Fayetteville's Country Club to
build an addition to an equipment storage building for golf
cart storage at 3335 Country Club Drive. Property zoned R-1
Low Density Residential District,
Chairman Hailey asked Bobbie Jones to advise what the Fayetteville
Country Club was requesting. Jones advised that the Country Club
was requesting to build a 201x 30' addition for golf cart storage.
This is just an additional structure to an existing building in the
northwest corner of their property. Harry Gray requested to know
if there was any way that they could avoid having to come through
the Planning Commission for such additions as this, as they were
planning -to expand the Country Club in the future. Chairman Hailey

advised that the Update Committee was in the process of trying to
get some means by which this could be accomplished, possibly by some
administrative means through the Planning Office.
Ernie Jacks made a motion to approve MOTION
the Conditional Use for the Fayetteville Country Club. Motion
was seconded by Morton Gitelman. Motion passed 9-0.
The sixth item on the agenda CONDITIONAL USE
was a Conditional Use Request 411 Patricia Lane
submitted by Tim J. Ernst, to operate Tim J. Ernst
a part-time portrait studio in his home at 411 Patricia Lane.
Property zoned R-1, Low Density Residential.
Chairman Hailey asked Bobbie Jones to explain what was being
requested in this Conditional Use. Jones advised that Mr. Ernst
was requesting a Home Occupation as a part-time portrait studio.
She advised that according to Article 7, Section 10, Home
Occupations are regulated as follows:
The home occupation cannot occupy more than 300 sq. ft. or 30%
of gross floor area of one floor, whichever is greater.
(a) No exterior alterations of the structure may be made
which are of a nonresidential nature.
(b) No advertising (signs), display, storage or other external
evidence of business shall be permitted, except that
for each dwelling unit with a permitted home occupation,
one unanimated, nonilluminated home occupation sign
which identifies the home occupation shall be permitted,
if such sign is erected flat against a wall or door or
is displayed in a window, and does not exceed three
(3) square feet in area; provided no such sign shall
be permitted in an R-1 district.
(c) No person may be employed other than a member of the
immediate family residing on the premises.
(d) No mechanical equipment may be used which creates a
disturbance such as noise, dust, odor or electrical disturbance.
(e) No parking spaces other than normal residential parking
spaces shall be permitted.
(f) In the R-1 District, Planning Commission approval is required.
No conditional use permit for a home occupation in an
R-1 district shall be issued for a period exceeding one
year, but such a permit may be for a period shorter than
one year. Upon expiration of a conditional use permit, the
planning administrator shall have the authority to renew
a conditional use permit for the same period as originally
authorized, if the planning administrator has received no
complaints or opposition from residents of the neighborhood

in which the home occupation is located. The planning
administrator may refer any proposed renewal of a conditional
use permit to the planning commission for final decision.
No home occupation in the R-1 zoning district shall be open to
the public earlier than 7:30 a.m. or later than 5:30 p.m.
without planning commission approval.
No home occupation shall be allowed in an R-1 district if
the Planning Commission determines that the home occupation
would generate such excessive traffic as would adversely affect
the safety, peace,.tranquility or welfare of the neighborhood..
Jones stated that Mr. Ernst had satisfied the requirement of
notification to the neighborhood by publishing a notice
in the newspaper.. She advised that Ernst had to meet one of
the three following requirements, i.e., (1) written:notice to
all owners entitled to notice; (2) publication in the newspaper
within the city; or (3) by obtaining the signature of each owner
entitled to notice on a notice containing the information
required by this paragraph; provided the signature of no more
than one owner in each dwelling unit shall be required. The Planning
Office also posted a sign on the property.
Ernst requested
to give a history of himself. He stated that he had worked as a
full-time photographer and writer for nine (9) years. He stated
that he had his own standard 9-5 shop, but sold this due to the
fact that he wanted to get away from the everyday 9-5 situation.
He stated that he is out of town a lot and restricts his business
to individuals and couples. He stated he would have no walk-ins
and all of his contacts would be by telephone first. Mr. Ernst
then presented several slides which showed the different views
of his home from several of his neighbors homes, the purpose being
to show how secluded his home really was. Chairman Hailey asked
if there were any objections to this conditional use. Ernie
Jacks advised that Mr. McFerran had called him and voiced objection
to this conditional use in that it would set a precedent, as well
as the fact that Ernst has beenin business already for sometime,
and this is all after -the -fact.
David Williams made a motion to MOTION
approve the conditional use. Motion seconded by Morton Gitelman.
Sue Madison questioned whether or not this dwelling would be in-
spected by fire inspectors due to the fact that strangers would
be entering his home for business purposes. Jones stated there
were some uses which were routinely inspected, i.e., child care
facilities, any place there would be the assembly of people. However,
Jones advised she did not think this was a use which would be
routinely inspected. Motion passed 9-0.

The seventh item on the agenda CONDITIONAL USE
was a Conditional Use Amendment for SUMMERHILL RACQUET CLUB
Summerhill Racquet Club, a private 1399 Masonic Drive
club, located at 1399 Masonic Drive, for an addition of 1400 square
feet for general purpose room for exercise, meeting, etc.
Property zoned R-1, Low Density Residential District.
Chairman Hailey asked Bobbie Jones to advise the purpose of this
request. Jones advised that she thought that Mr. Bill Meadows
would better be able to describe his plans.
Mr. Meadows advised that The Fayetteville Racquet Club was
planning to place an exercise room over the top of the racquet
ball courts.
Ernie Jacks made a motion'for approval MOTION
of the Conditional Use Amendment request.
Motion was seconded by Melanie Stockdell. Motion passed 9-0.
The eighth item on the agenda was REZONING PETITION R83-22
the referral from the Board of B. W. GRAUE
Directors on December 20, 1983 to the 4041 Wedington Drive
Planning Commission on Rezoning
Petition R83-22, B. W. Graue, located at 4041 W. Wedington. Mr.
Graue's petition to rezone from A-1, Agricultural District,/ to
R-0, Residential Office District,•was denied by the Plannirig
•Commission on December 12, 1983. Mr. Graue subsequently '
appealed the Planning Commission's decision to the Board of.
Directors. On December 20, 1983, the Board voted to refer
the petition to the Planning Commission for consideration
of R-2 zoning. Mr. Graue's reason stated on his petition
for the rezoning request was "to have a Share -A -Home for
elderly people". "Boarding Houses and Rooming Houses" are
listed in Use Unit 10 which is permitted in the R-3 and C-3
Zoning Districts as a use by right and in the R-0 and C-4 Zoning
Districts as a Conditional Use. Use Unit 10 is not allowed in
the R-2 Zoning District and the Use Units allowed in the R-2 Zoning
District do not contain "Rooming House or Boarding House".
Due to the fact that this house was in existence before the zoning
was changed, Bobbie Jones advised that she could handle this
matter administratively if the Graue's would obtain a notarized
statement to the effect that this was being used as a Share -A -
Home when annexed and up to May 15 (6 months prior to the date
the petition was filed).
David Williams made a motion to table MOTION
this issue until such time as the Graue's
could obtain the information which they needed. Motion was seconded
by Ernie Jacks. Motion passed 9-0.

The ninth item on the agenda LARGE SCALE DEVELOPMENT
was the Large Scale Develop- LENWYN K. OR KATHY EDENS
ment for 646 West Sycamore 646 W. Sycamore
by Lenwyn K. or Kathy Edens, for a restaurant and laundry.
Property zoned as I-1, Heavy Commercial and Light Industrial.
Chairman Hailey asked Barbara Crook to advise of the
recommendations of the Subdivision Committee. At that time,
Crook presented the recommendations of the Subdivision Committee
and moved as follows: The Subdivision Committee recommended
approval of the Large Scale Development subject to Plat Review
Comments; additionally and specifically that the safety zone between
the west drive and the right-of-way of Chestnut Avenue be increased
so that it meets the City Requirements, because it is the feeling
o f the Subdivision Committee, that at some future date,
Chestnut Avenue should be developed and opened; that we
receive a Bill of Assurance from the owner for sidewalk to be located
along Sycamore Street with same being shown on the plat; that
we receive a Bill of Assurance for the owner's proportionate
share of the improvement of Chestnut Avenue; that we secure
a drainage easement off of the north property line, the
width of such drainage easement to be determined with the
City Engineer, purpose being that the ditch shall be maintained
so as not to impede run-off from lots to the east; and in lieu
o f bumper blocks, that curb be provided on the west and north
boundaries of the parking area in order to prevent vehicular
traffic trying to access Sycamore Street via the north approach.
An opening will be needed in this curb to allow surface water
to drain to the NW corner of the lot.
Chairman Hailey asked if these conditions were acceptable to
Mr. Edens. At that time, Mr. Edens advised that he was not
present for the Subdivision Committee meeting and he did have
a few questions. Edens questioned the requirement of the
Bill of Assurance for the sidewalk and stated that in Plat
Review, he thought this matter had been taken care of, and that
it was decided that a sidewalk only needed to be on the south
side of Sycamore. Jones advised that Sycamore is a collector
and requires that a sidewalk be placed on both sides of the
street. Edens then said this was acceptable to him. Edens
also questioned the curb which was to be provided on the west and
north boundaries of the parking area.
Barbara Crook then amended the motion to read that curb or bumper
blocks sufficient to stop traffic would be acceptable, with the
approval of the City Engineer. Motion was seconded by Melanie
Stockdell.

Crook advised that the drainage for Sycamore and Ash seems to
be to the ditch. Crook stated that the width of this ditch
needs to be checked out with the City Engineer as well. Edens
advised that whatever the City Engineer needed would be acceptable
with him. He stated he did not need this full acre for his
development, that it just happened to be an acre. Chairman Hailey
asked if there were any waivers requested. Jones advised there
were not. Edens advised he could move his driveway without any
problem, thus not needing the anticipated waiver of the driveway
safety zone. Motion passed 9-0.
The tenth item on the agenda ANALYSIS OF GENERAL PLAN
was analysis of General Plan 1970-1990
1970-1990 by U. of A. graduate BY U. OF A. GRADUATE STUDENTS
students of Community Planning Process 5123. This plan was
accepted as submitted by the Planning Commission. Ernie Jacks
stated that he did some investigations into this study and stated
that the results of the study were astounding to him. He
stated that he was surprised that many people were not aware
of or believe there even was -A General Plan.
The eleventh item on the agenda
was a Zoning Report by Charles
Reed on "Accessory Apartments in
Single Family Houses." This report
by the Planning Commission.

was accepted for reading
The twelfth item on the agenda STORM DRAINAGE STUDY
was the storm drainage study,
Project DS --8108. This was referred to the Planning Commission
by the Board of Directors Resolution No. 142-83.
Chairman Hailey suggested to accept the Storm Drainage Study
as submitted by the Board of Directors.
Paul Marinoni was present and questioned the effect of this
Storm Drainage Study on the approval of his Camelot Subdivision.
Jones advised that this subdivision had been approved
and recording of this subdivision was held off due to
economic circumstances at the time (1981). Now Mr. Marinoni
was questioning whether or not he would need to come back
through the Planning Commission for approval again in
light of the fact that it had already been approved.
Jones stated that she had addressed this question through
the City Attorney and he had advised that Mr. Marinoni would
have to come back through the Planning Commission. It was
suggested that Clayton Powell be contacted with regard to
the drainage and street plans for that area; that the
City Attorney further be consulted in this matter as well.

Barbara Crook made a motion to MOTION
table this matter for definite instructions
from the City Attorney and in the meantime, ask the City
Engineer to look at the drainage plans in view of the
drainage study. Motion was seconded by Ernie Jacks.
Motion passed 9-0.
The only item to be discussed as OTHER BUSINESS
other business was the matter of a
Nominating Committee for -new Planning Commission Officers.
Chairman Hailey appointed Morton Gitelman as Chairman
of the Nominating Committee with Melanie Stockdell and Ernie
Jacks assisting Gitelman on this committee. Hailey asked
this committee to have their nominations ready for the meeting
of February 13, 1984 with elected officers. positions to
be effective immediately. Further committees will be
appointed by the incoming Chairman. Chairman Hailey did
announce that Barbara Crook had accepted to -Chair the
Subdivision Committee.
