The Fayetteville Planning Commission met on Monday, July 9, 1979, at 5:00 P.M.
in the Directors Room, City Administration Building, Fayetteville, Arkansas.
PRESENT: Chairman Ernest Jacks, Mort Gitelman, Rita Davis, Keith Newhouse,
.t• Windell Cullers, and Newton Hailey.
:ABSENT: Peg Anderson, Bill Kisor, and Elizabeth Crocker.
OTHERS PRESENT: Planning Administrator Bobbie Jones, Angie Medlock, David
McWethy, Jim Lindsey, W. C. Huffman, Steve Rucker, and
other unidentified members of the audience and press.
CALL TO ORDER
Chairman Ernest Jacks called the meeting to order at 5:05 P.M.
MINUTES
Chairman Jacks asked if any corrections were needed for the June 25,
1979 Planning Commission minutes. Commissioner Davis stated that there were
"several comments which don't particularly make a lot of sense" and asked that
oh.tpage 5t "streets on both sides" be changed to reflect "houses on both
sides". There being no other corrections noted, the minutes were approved
as submitted.
R 79-20/ SALVATION ARMY
R 79-21/ CLARK McCLINTON
Chairman Jacks opened the public hearing to consider two rezoning
requests, one submitted by the Salvation Army to rezone property located
on the_Southeast corner of Block Avenue and Rock Street, and one submitted
by C1ark:McClinton to rezone property located on the southwest corner of
Rock Street and East Avenue. Both petitioners had requested the zoning be
changed from R-0, Residential Office District to C-3, Central Commercial
District.
Planning Consultant Larry Wood summarized his recommendation that
the rezonings be approved for the following reasons:
1. In 1978 the Commission had reviewed a restudy of the area
and in thatstudy the south side of Rock Street had been
recommended on the General Land Use Plan for commercial
activities;
2. The property has direct access to Rock Street;
3. The Square is undergoing a change in commercial activities and
expansion and this is a logical change as part of that process;
4. There have already been zoning and land use changes on the south
side of Rock.
Jim Lindsey was present in support of the Salvation Army rezoning
petition. He said they feel C-3 zoning would be the most appropriate
zoning for this particular piece of property. He explained that R=0
zoning would cause setback problems for the lot. Lindsey said he feels
the rezoning as requested, will enhance the value of;the neighborhood
and contended that they feel the request is justified.
Keith Newhouse moved that both rezoning requests be granted. Mort
Gitelman seconded the motion which passed unanimously.

CONDITIONAL USE REQUEST / CHURCHILL ENTERPRISES, INC.
A conditional use request had been submitted by Churchill Enterprises,
Inc., for a retail sales and service building material at 2709 Drake Street,
property zoned C-2, Thoroughfare Commercial District.
Mr. W. C. Huffman explained that the use will be for retail sales and
service.
There being no opposition expressed, Windell Cullers moved the conditional
use permit be granted. Newton Hailey seconded the motion, which passed unanimously.
CONDITIONAL USE REQUEST / ERNEST R. COLEMAN
A conditional use request had been submitted by Ernest R. Coleman
Company to use a model home for real estate sales, on property located
at 1608 Cortland, Rolling Meadows Subdivision, said property zoned R-1,
Low Density Residential.
Steve Rucker said Ernest R. Coleman Company would like to have a
furnished model home to use as a "show home" for the remaining lots in the
Rolling Meadows Subdivision.
Keith Newhosue moved to approve the conditional use as requested. Rita
Davis seconded the motion which passed unanimously.
PLANNING AREA LAND USE CONTROL
Commissioner Hailey told the Planning Commission that Larry Wood and
Bud Allen had hoped to tour the county to try to get first hand:information-
on problems which may be encountered, and after that they will report back
to the Commission. He said they hope to go before the Quorum Court to get
their opinion in August.
ORDINANCE AMENDMENTS RE: SUBDIVISION PLATS
The Commission discussed briefly changes to revise the procedure for
processingsubdivision plats. Mr Jacks explained the idea is to require
subdivisions to go through the concept phase; the preliminary plat phase;
and then the final plat phase.
Mr. Jacks said Bobbie Jones had suggested the ordinance outline in
the concept stage what will be required of the developer in the preliminary
and final plat stages.
Newton Hailey moved to send the committee report to the City Attorney
and ask that he draft an ordinance to come back before the Planning Commission
for further consideration. Keith Newhouse seconded the motion, which passed
unanimously.
PUD REGULATIONS
The Commission discussed a draft of proposed Planned Unit Development
Regulations.
Chairman Jacks said Peg Anderson had suggested that variance requests
for Planned Unit Developments should only be discussed at a public hearing.
He said as the ordinance is now set up, there would have to be a public hearing
for PUD's of less than 5 acres.only.
There was considerable discussion about the narrow street width minimum
and Windell Cullers stated that the developers would build the narrow streets,
which would not allow for parking, and the property owners would still park
on the streets. Commissioner Davis said she could not go along with a street
which allows no parking on either side of the street. Windell Cullers agreed
with Mrs. Davis.

Windell Cullers suggested they require a street with parking on one
side of the street, and the developer would have the opportunity to
request a variance from this requirement. He said he didn't feel a developer
would plan to build a street wider than what is required.
Mr. Jacks noted that if homes in the PUD are built quite a ways back
from the street, parking on the street may not be needed. He said they could
consider tying the street width in with the setbacks.
In response to Chairman Jacks, Planning Consultant Larry Wood indicated
thathe felt a street with one lane of parking would be fair, since there
is a variance procedure whereby a developer could request a smaller width,
if he did not feel an..lane of parking is needed.
Mr. Jacks asked. the Commission if they would want to provide ,ithat a
variance could only be requested at a public hearing. Mr. Gitelman said they
could consider requireing the developer to ask for the variance at the preliminary
plat level, so the adjoining property owners would be aware that a variance is
being sought in connection with the PUD.
Mr Jacks noted that Planning Administrator Bobbie Jones was concerned
that a property owner's association should not be allowed to disband without
approval of the City Board of Directors. Mr. Gitelman said that every PUD
may not create a property owner's association, if a developer retained owner-
ship of the entire PUD. He agreed that the City does need to be protected
from the property owner's association disbanding and the protective covenants
expiring. Mr. Gitelman suggested that perhaps the protective covenants could
be standardized.
Newton Hailey moved to forward to the'City Attorney the draft of proposed
Planned Unit Development Regulations to be drafted into ordinance form.
Windell Cullers seconded the motion, which passed unanimously.
The Commission indicated to Mrs. Jones that a public hearing should be
called when.the ordinance is received from the city attorney.
OFF-SITE IMPROVEMENTS
Keith Newhouse explained that al committee had been discussing a
proposed ordinance to require off-site improvements for subdivisions and large
scale developments. He said they had been concerned about the number of lot
split developers in the county.
Bobbie Jones said that the way the proposed ordinance is written, it would
require many more lot splits to come before the Planning Commission.
Mr. Gitelman said they could require every subdivision of land to be
a subdivision plat, thus it would be required to come through the City Planning
Office for approval.
Bobbie Jones asked about construction standards to be required for access
roads located on state highway right-of-way. She asked if the Commission would
want to require curb and gutter and sidewalks for developments abutting access
roads.
Mr. Gitelman said he doesn't see why they should require a subdivider to
install off-site improvements on state highway right-of-way access roads.
Following considerable discussion, Chairman Jacks asked the subdommittee
to meet with Bobbie Jones about her concerns about the frontage roads.
Mr. Gitelman asked that Mr. Grimes express his opinion concerning the
lot split problems.
Larry Wood recommended the following change "on the preliminary plat stage
the street superintendent and/or city engineer will determine the percentage
that the subdivision bears in figures" rather than that the Planning Commission
will determine the amount.
There being no further business, the meeting adjourned at 6:30 P.M.
