HomeMy WebLinkAbout1978-08-28 Minutes• MINUTES OF A PLANNING COMMISSION MEETING A meeting of the Planning Commission was held on Monday, August 28, 1978, at 5:00 P.M., in the Board of Directors Room, City Administration Building, Fayette- ville, Arkansas. MEMBERS PRESENT: Chairman Rita Davis, Morton Gitelman, Beth Crocker, Keith Newhouse, Ernest Jacks, Peg Anderson, Bill Kisor, Windell Cullers, Newton Hailey. MEMBERS ABSENT: OTHERS PRESENT: None. Angie Medlock, Bobbie Jones, David McWethy, Scott Van Laningham, Larry Wood, Richard Osborne, David Mark, Mary Gray Sinnott, Walter Robinson, Linda Callentine, Robert McKee, Linda Apperson. Truman Yancey, and other unidentified persons. Chairman Rita Davis called the meeting to order. The minutes of the August 14, 1978 Planning Commission MINUTES meeting were approved as mailed. The first item for discussion was an AMENDMENT TO amendment to the Final Subdivision Plat of Final Plat Bishop Addition, Unit 2, to change the BISHOP ADDITION, UNIT 2 location of street lights, submitted by • Wade Bishop. Mr. Jacks said the Subdivision Committee recommends and he made a motion to eliminate two street lights and respace those on Sunny Lane to not exceed 350 feet spacing between lights. Keith Newhouse seconded the motion, which passed 9-0. The second item was a public hearing on Rezoning REZONING PETITION R78-19 Petition R78-19, Leonard and Aileen Warford Leonard Warford to rezone property located south of 13th Street and South of 13th F, Happy Hollow east of Happy Hollow Road from I-2, General Industrial District to C-2, Thoroughfare Commercial District. Attorney Richard Osborne was present to represent Floyd. Mabry, who is buying the property. Planning Consultant Larry Wood said this property is adjoining to property which was rezoned recently for Mr. Warford. Mr. Wood said he would recommend the rezoning for the following reasons: 1) the property is adjoining the property which was '-`rezoned to C-2 several months ago and as noted under the land use, that property now contains an auto service shop, and 2) the C-2 district uses are not considered to be inconsistent or incompatible with uses that might be allowed in the I-2 District. Mr. Osborne said Floyd Mabry is wanting to build another building similar to the one which is on the adjoining property. No one was present in opposition. Bill Kisor made a motion to approve the rezoning as requested. Peg Anderson seconded the motion, which passed 9-0. Next was the public hearing on Rezoning REZONING PETITION R78-20 • Petition R78-20, David F. Mark and Nancy S. David F. Mark Partos to rezone property located at 43 South 43 South Gregg Gregg Avenue from I-1, Heavy Commercial and Light Industrial District to R-3, High Density Residential District. David Mark and Walter Robinson were present to represett the request. • 1 L - Planning Commission Meeting August 28, 1978 Planning Consultant Larry Wood noted that this is an approximately 1.8 acre piece of property located on the west side of Gregg Street, just south of Center Street. He said this area was included in the amended land use plan recently approved by the Planning Commission and Board of Directors. He said the requested R-3 District is approved because 1) it is consistent with the General Plan, and 2) apartment development is consistent with the changing nature of the surrounding area. Mary Gray Sinnott, 121 South Gregg, said she is opposed. She said she would like to see either R-2, or R-1 zoning. She felt with the higher density, it would create a more unsafe condition with traffic problems. She presented a petition in opposition to the rezoning to the chairman of the Planning Commission. Mr. Robinson pointed out that Hays, the abutting property owner, was present, and did not have any objections to the R-3 zoning. Linda Callentine, 121 S. Gregg, said she had talked to several neighbors on the street who were in objection. She said they were concerned about the speeding and the traffic problem.' Commissioner Anderson said she feels R-3 zoning is better than industrial. She said however, she feels some attention should be given to the intersection of Gregg and Center Street. Mr. Mark said the street itself is one you don't feel like speeding on. He said he feels the sharp turn cuts down the speed. Linda Callentine said she would rather see the property remain as Industrial than R-3. She said she doesn't see the potential for industrial growth in the area. Peg Anderson made a motion to approve the rezoning as requested. Morton Gitelman seconded the motion, which passed 9-0. Linda Callentine said the transient students are her main concern. Next was the public hearing on Rezoning Petition R78-21, Robert and Elizabeth McKee to rezone property located south of Lewis Road and west of City Lake Road from R-2, Medium Density Residnetial District. Mr. 4 Mrs. McKee were present to represent. Planning Consultant Larry Wood said Loris Stanton had this property rezoned several. years ago. He said the property owner now wants to change this back to A-1 so they can build a barn on their property. Mr. Wood said this change would be recommended for the following reasons. 1) the area surrounding the property under application is undeveloped and rural in nature, and 2) development of the property under the A-1 District would not preclude future redevelopment of a nature consistent with the General Plan recommendations. No one was present in opposition. Mr. McKee said he has spoken to his neighbors and they have not expressed opposition. Chairman Davis said she is concerned about the A-1 distirct, in that hog farms are allowed in the A-1 district. Mr. McKee said they are wanting a barn for their horses. Newton Hailey made a motion to approve the rezoning. Beth Crocker seconded the motion, which passed 9-0.. REZONING PETITION -R78-21 Robert McKee City Lake Road. District to A-1, Agricultural Next was a discussion on amending the Zoning DISCUSSION ON AMENDING Ordinance to allow Book Stores and Barber or Zoning Ordinance Beauty Shops in Use Unit 12, offices, studios, Use Unit 12 and related services, submitted by Planning Consultant Larry Wood. Use Unit 12 is permitted in the R-0, C-1, C-2, C-3, C-4, I-1, and I-2 zones. • • Planning Commission Meeting August 28, 1978 Planning Consultant Larry Wood said he had received a call concerning beauty shops in residential districts. He said he was told that state licenses for beauty shops are not being renewed in homes if the beauty shop has been shut down. He said it appeared to him that the Planning Commission would be looking at some requests for commercial zoning in 'residential areas to accommodate the beauty shops. He felt rather than going to a commercial zone, it would be more compatible to have beauty shops allowed in the R-0 District. Bobbie Jones said she had someone come in recently and she said the State didn't -tell her anything about this new requirement. Linda Apperson said the State Cosmetology Board will no longer allow a beauty shop to be opened in a home. She said they would require that it be completely detached from the house. Bobbie Jones noted that beauty shops are now allowed in Use Units 15, 16, and 17. Mr. Jacks questioned if they should consider adding Use Unit 15 to uses permissible on appeal to the Planning Commission in the R-0 zone. Ernest Jacks made a motion to advertise a public hearing to add Use Unit 15 as a use permissible on appeal to the Planning.Commission in the R-0 zone. Keith Newhouse seconded the motion, which passed 9-0. Bobbie Jones said the soonest she could get this back on the agenda for a public hearing would be September 25. Next was discussion on a letter from the Fayetteville/ RIGHT-OF-WAY Springdale Transportation Committee on a request to Requirement reduce the right-of-way requirement of Elaine ELAINE STREET Street on the Fayetteville Master Street Plan. Truman Yancey said he would like to postpone discussion on this until the next regularly scheduled Planning Commission meeting. Morton Gitelman made a motion to table this item indefinitely. Peg Anderson seconded the motion. Beth Crocker said she would like some type of complete map showing where all the streets are connected. Mr. Yancey said he would provide this map. The motion to table passed 9-0. Bobbie Jones noted that the City Board wanted the Planning Commission to look at the right-of-way required on some streets where there is 60 feet or 80 feet required and the streets themselves will not take up nearly that much right-of-way. Mr. Gitelman noted that street standards have been pretty much standardized on a more or less national basis. Chairman Davis asked for copies of a master street plan map for the commissioners. Larry Wood said he would make some copies of the master street plan for them. Ms. Davis asked that they have these at the next meeting. Mr. Spencer Johnson, Bible Missionary Church, was Extension of Time present to ask for an extension of the 7 day conditional for Tent Revival use request for a tent revival to be located on the Fifteenth Street north side of East Fifteenth Street, between Morningside Drive and Wood Avenue. The conditional use was approved at the last Planning Commission meeting for 7 days, and Mr. Johnson said they would like to hold the revival for 18 days, from August 31 to September 17. Bobbie Jones said she had received written approval from the adjoining property owner, as requested when the tent revival conditional use was approved Keith Newhouse made a motion to extend the permission to use the tent revival through September 17. Bill Kisor seconded the motion, which passed unanimously. Chairman Davis read a letter written by Mr. Gitelman, secretary of the Planning Commission, asking the County to consider some type of land use in the growth area.
