MINUTES OF A PLANNING COtM1ISSION MEETING
A meeting of the Planning Commission
5:00 P. M., in the Board of Directors
Fayetteville, Arkansas.
was held on Monday, June 26, 1978, at
Room, City Administration Building,
MEMBERS PRESENT: Chairman Rita Davis, Newton Hailey, Peg Anderson, Ernest Jacks,
Beth Crocker, Morton Gitelman, Keith Newhouse, Bill Kisor.

Bobbie Jones, Angie Medlock, Larry Wood, David McWethy,
Larry Palmer, Wayne Jones, Jerry Fowler, Kenneth Garton,
Nancy Richards, and other unidentified persons.
—Chairman Rita Davis called the meeting to order.
Peg Anderson said on Page 2 it should read that the honey-
suckle is grown over the "doorways" rather than the front
door. With this correction, the minutes of the June 12,
1978 Planning Commission were approved as mailed.
MINUTES
The first item for consideration was the approval TERMINAL BUILDING
of the large scale development plan for a new terminal Drake Field Airport
building to be located south of the existing terminal
facilities at Drake Field Airport. This is a conditional
use which requires Planning Commission approval.
Larry Palmer and Ken Jones were present to represent the request.
Ernest Jacks noted that the Subdivision Committee had looked at the large scale
development plan and did not like the drives and the parallel short-term parking
as shown on the plat. He said they would be willing to have a special meeting
at a later date to discuss this with the Airport Manager.
Mr. Jacks made a motion to approve the conditional use. Bill Kisor seconded the
motion, which passed 8-0.
The second item for discussion was a
proposal by General Growth Management Corporation
to relocate a road in the Northwest Arkansas Plaza,
so it will be south of Sambo's and north of Nelson
Funeral Home. If this is to be a public street, it
approval.
Jerry Fowler and Larry Gage were present to represent.
Mr. Jacks said the Subdivision Committee 'recommends that the Planning Commission
approve the road as shown. He noted that there is a question about why they don't
go ahead and develop Stearns Road at this time but General Growth feels they won't
have time to get that approved through the City by the time (September) they are
committed to have a road in for Penneys.
Ernest Jacks made a motion to approve the road as shown. Newton Hailey seconded
the motion.
Morton Gitelman asked if they have solved the problem of the private existing
road stubbed out by Sambos. Bobbie Jones said she didn't think this was ever
dedicated. Mr. Fowler said they would be willing to abandon this as a City
street if it was ever dedicated.
Mr. Fowler noted that they are proposing 60 feet right of way for the new
street, and are proposing that no parking be allowed on the street. Peg Anderson
said she did not want parking on the street, but felt that General Growth could
not decide if they want parking or not if this is a City street.

Ernest Jacks amended his motion to 1) approve the location of the street as
shown with 60 feet right-of-way and no parking on the street; and 2) sidewalks
be built before the road is dedicated. Mr. Fowler said they will have side-
walks in before they dedicate the street.
Mr. Hailey questioned if there will be any houses along this road and Mr.
Fowler said "no". Mr. Hailey questioned if the City will maintain streets in
a commercial subdivision. Mr. Jacks said they would. Bobbie Jones noted that
General Growth still owns property to the west of this which is zoned R-0 and R-1.
Mr. Hailey seconded Mr. Jacks' motion to approve. The motion passed 8-0.
Beth Crocker asked if there will ever be a red light TRAFFIC PROBLEM
installed at the entrance to the mall. Mr. Fowler At Mall Entrance
said they have been talking with the Highway
Commission about this. He said General Growth has notified the State Highway.
Department that they feel the area --Shepard Lane, Zion Road, and Stearns Road
meet the criteria for traffic signals. He said they had asked that the Highway
Commission provide some type of traffic improvement. He said the Highway Depart-
ment has taken studies of the area and General Growth anticipates some type of
answer from them within a few months. Mr. Fowler noted that they do need support
from local offices. Peg Anderson suggested that the Planning Commission make a
recommendation to the Board of Directors that they express their concern about
this situation to the state senator, the District Highway Commissioner, and
the State Highway Commissioner. Rita Davis said she felt there should be an
overpass rather than a red light.
Next was the public hearing on Rezoning Petition
R78-17, Kenneth Garton to rezone property located
on the Northeast corner of Happy Hollow Road and
REZONING PETITION R78-17

District to C-1, Neighborhood Commercial District.
Kenneth Garton was present to represent the petition.
Planning Comsultant Larry Wood said he would not change his recommendation. He
said he still feels either the Church needs to own the tracts which Mr. Garton owns,
or Mr. Garton needs to own some of the Church property. He said he feels 125 feet
of commercial is inadequate in depth to permit the type of commercial needed at
that intersection.
Mr. Garton said he would not plan very heavy commercial at the intersection since
the Church is next door. He said there may be a beauty shop or some office space.
Mr. Garton said he did not feel the Church would sell the property where the
rental house is because they may need that for access to Happy Hollow Road at
a later date.
Larry Wood stated that they usually want 200-250 feet in depth for commercial
property.
Bobbie Jones noted that the corner would require a 50 foot setback from each
street and a 10 foot setback from the residential to the north. Also, if the
building height exceeds 10 feet, the setback from the north would be the same
as the height of the building.. Larry Wood pointed out that there is also a
20 foot rear setback.
Peg Anderson said she doesn't see any other options.
Peg Anderson made a motion to approve rezoning Tracts A and B to C-1. Ernest
Jacks seconded the motion.
No one was present in opposition.
The motion passed 7-1 with Anderson, Jacks, Davis, Gitelman, Crocker, Kisor,
and Newhouse voting "Aye". and Hailey voting "Nay".
Bobbie Jones noted this will go to the Board of Directors on July 5.

The fourth item for consideration was a conditional use NANCY RICHARDS
request for a duplex to be located at 1652 Markham Road, Duplex Conditional Use
submitted by Nancy Richards, property zoned R-1, Low 1652 Markham Road
Density Residential District.
Nancy Richards was present to represent. She said she wants to put an apartment in
her house. She said she would be.putting.a.door-:where.there.is.now a window, installing
a small'utility kitchen, and extending the porch.
Mr. and Mrs. Roger Widder, 1660 Markham Road, were present. They said they understand
why Mrs. Richards want to convert the house into a duplex and do not object, but
are concerned that she may some day sell the property and did not want the conditional
use to run with the land. They asked if the Planning Commission could impose a
stipulation that another owner would require Planning Commission approval
to continue the duplex use.
Boboie Jones noted that Mrs. Stubblefield had submitted a Bill of Assurance with
her duplex conditional use and Mrs. Richards could do the same thing.
Ernest Jacks made a motion to approve the conditional use with the provision that
Mrs. Richards provide a Bill of Assurance that the conditional use run only with the
current ownership. Peg Anderson seconded the motion, which passed 8-0.
Bobbie Jones told the Commission she had received LAMAR PETTUS
a request for a wood shop.in the building owned Mill St.
by Lamar Pettus at 231 Mill Street. The Planning
Commission had approved a change in non -conforming use to allow uses allowed in the
C-1 District in this building. Bobbie Jones noted thata wood shop is not allowed
in the C-1 District unless they consider it as an artist's studio. She said the
person she had been talking to indicated he would be making bowls, platters, etc.
and may make cabinets later on. She asked the Commission if they felt she should
consider this an artist's studio in this case. The unanimous consent of the Commission
was that she should consider this an artist's studio and allow this use in the
building.
