A meeting of the Fayetteville Planning Commission was held on Tuesday, January 10,
1978, at 5:OO P. M., in the Board of Directors Room, City Administration Building,
Fayetteville, Arkansas.
In the absence of Chairman John Power, Vice -Chairman Rita Davis called the adjourned
meeting of January 9, 1978 to order.
The first'item for discussion was the
preliminary_ plat of Smoke Rise Subdivision
located west of Highway 71 Bypass and
south of Highway 16 West; Demaree, McChristian,
and Demaree, developers.
Pat Demaree, Dewayne McChristian, and Don Mitchell were present to represent.
Mr. Jacks explained that this subdivision is located on the east side.of Maple
Terrace Subdivision. The Planning Commission had required the developer of
Maple Terrace to stub a street to the east which would cut through this property
approximately 219 feet north of the southproperty line.
Mr. Jacks said the Planning Commission needed to decide if they would require
this developer to extend this street (Jewell Road) from their west property line
to tie back to Frontage Road.
Mort Gitelman felt they should amendLthe Master Street Plan before requiring a
developer to build a through street on a subdivision to subdivision basis.
Larry Wood explained that the Master Street Plan only sets up collector and
arterial streets and this would be a localcstreet.
Bobbie Jones said the Planning Report on this rezoning petition did recommend a tie
through to the Frontage Road.
Ernest Jacks made a motion to approve the preliminary plat contingent on 1) the
developer tie into Jewell Road to the west and extend it through to the Frontage
Road; 2) require sidewalks on all lots facing the Frontage Road; 3) correct the
discrepancy in the legal description; 4) show the flood plain boundary on the map;
5) submit the protective covenants; and 6) the street light spacing be waived to a
maximum of 400 feet.
Keith Newhouse seconded the motion, which passed unanimously.
Pat Demaree felt they should not be required to extend the street. He questioned
what procedure they should use to appeal this decision of the Planning Commission.
Bobbie Jones felt they could appeal to the City Board of Directors.

Next was approval of the preliminary plat
of West Wind Subdivision, Phases 2 and 3,
located north of Township Road and north-
east of Jimmie Lane; J. B. Hays, Dr. Bob Brandon,
Jim Younkin, and Johnie Bassett, developers. This
Ervan Wimberly was present to represent.
Ernest Jacks made a motion to approve the preliminary plat of West Wind Subdivision,
Phases 2 and 3, with the following contingencies: 1) waive the maximum length of
a dead-end street to 2200 feet; 2) add the -easements required by the Plat Review
Committee; 3) have the protective covenants reflect that if West Wind Drive is ever
connected to Sheryl, it must be built to full current City standards, including
sidewalks; and 4) approval of the four tandem lots shown on the plat.
Bill Kisor seconded the motion.
Mr. Jacks said the Planning Commission may be concerned about waiving the maximum
length of the dead-end street: Mr. Jacks pointed out that these will be very large
lots and will not generate much traffic.
Mr. Gitelman ques .oned the. grade on the tandem lot drives and Ervan Wimberly said
it is almost entirely flat, but in one case the grade would be approximately 10%.
The motion made by Mr. Jacks, and seconded by Mr. Kisor passed unanimously.

Next was the public hearing on Rezoning
Petition No. R77 -5S, Bryan Walker for property
located west of South College Avenue and south of

Residential District to C-2, Thoroughfare Commercial District.
Bryan Walker was present to represent.
The Planning Commission discussed this rezoning petition together with the rezoning
petition submitted by Belinda Faubus. They had indicated at the public hearing
for Belinda Faubus that they would like to see a more detailed rezoning proposal
for the entire area
Larry Wood summarized his recommendation for not approving the two rezonings.
He said 1) the General Plan recommends industrial as the future land use for this
area; 2) planned industrial areas should not be picked apart by small parcels of
zoning which commit the area to non -industrial uses; and 3) the C-2 District will
establish a trend toward commercialization of this area. He also felt this would
tend to commit:Highway 16 to strip commercialization.
Mr. Walker said he has no immediate plans for his property but has asked for the
rezoning to help Mrs. Faubus get her property rezoned.
Mr. Jacks felt the creek is a natural barrier between the C-2 and the R-2,and the
land east of the creek should not be zoned commercial.
Bill Kisor made a motion to deny the request for rezoning. Mort Gitelman seconded
the motion, which passed 6-1, with Kisor, Hailey, Jacks, Gitelman, Newhouse, and
Crocker voting "Aye" and Davis voting "Nay".
Next was the rehearing on Rezoning

Dr. Hal Merriman was present representing Dr. Andre. He said Dr. Andre plans to convert
part of his home to a duplex and plans to live in one part.
Bobbie Jones stated that this property is between the church and the property recently
rezoned to C-1.
No one was present in opposition..
Ernest Jacks made a motion to approve the conditional use. Bill Kisor seconded the
motion, which passed unanimously.

by Fayetteville Public Schools for a "playground"
to be located on the southeast corner of the inter-
section of Eastwood and Mission Blvd., property

No one was present either in opposition or in favor of the petition.
Ernest Jacks made a motion to approve the conditional use with the stipulation that
there be no lighting on the playground. Newton Hailey seconded the motion, which
passed unanimously.

Planning Commission Meeting

The last item was a public hearing to consider an amendment R-0 ZONE
to Appendix A, Zoning - Article 5, Section 10, Fayetteville
Code of Ordinances to amend uses permitted and uses permitted on appeal to the
Planning Commission in the R-0 zone and for other purposes.
Mr. Jacks explained that the proposedamendment would leave single-family and two-
family as uses by right and would make multi -family allowed only on appeal to the
Planning Commission.
Larry Wood said there are a lot of single-family and two-family houses already existing
in the R-0 zone and if they deleted this use from the R-0, it would -make those houses
non -conforming. He said he did not feel high-density uses should be left in the
R-0 as a use by right, especially in the, outlying areas.
Ernest Jacks made a motion to recommend approval of the proposed amendment to the
Zoning Ordinance. Keith Newhouse seconded the motion, which passed unanimously.

WHEREAS, at its regular meeting on Monday, January 9, 1978, the

WHEREAS, at its regular meeting on Monday, January 9, 1978, the
Planning Commission voted to approve the final subdivision plat dated
December 5, 1977, known as Preliminary and Final Plat of Northside
Acres submitted by Fred and Valerie Zamberletti.
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE
CITY OF FAYETTEVILIE, ARKANSAS.
SECTION 1. That the developer furnish the City of Fayetteville a
quit claim deed for any additional road dedication necessary.

RESOLUTION PC 3-78
WHEREAS, at its regular meeting on Monday, January 9, 1978, the
Planning Commission voted to approve the final subdivison plat dated
October 26, 1977 and revised December 29, 1977, known as Maple Terrace
submitted by Bryce J. and Betty Jo Davis; and
WHEREAS, the Planning Commission recommended that because the
necessary improvements have not been installed in said subdivision that
Bryce J. and Betty Jo Davis enter into and furnish the City with the
necessary subdivision contract before the Board of Directors accepts
this final subdivision plat.
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE
CITY OF FAYETTEVILLE, ARKANSAS:
SECTION 1. The necessary subdivision contract be executed with the .

RESOLUTION PC 11-78
WHEREAS, a public hearing was held by the Fayetteville Planning
Commission, Tuesday, January 10, 1978, fifteen (15) days after a notice
was published in the Northwest Arkansas Times, a newspaper of general circulation;
and
WHEREAS, after the public hearing, the Planning Commission voted to make
a recommendation to the Board of Directors on a proposed ordinance to amend
Article 5, Section X, of Appendix A to the Fayetteville Code of Ordinances
(Zoning Ordinance 1747) to provide that multi -family dwellings are a
conditional use in the R-0 Zoning District; to amend the minimum setback require-
ments for R-0 property when contiguous to an R-1, R-2, or R-3 District, and
to amend the height regulations for buildings in an R-0 District adjacent
to an R-1, R-2, or R-3 District.
NOW, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COFMISSION TO THE
BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS.
SECTION 1. That the proposed ordinance, attached hereto and made a
part hereof, be adopted to amend Appendix A of the Fayetteville Code of
Ordinances for the purposes hereinabove stated.
