HomeMy WebLinkAbout1978-01-09 MinutesMINUTES OF A PLANNING COMMISSION MEETING A meeting of the Fayetteville Planning Commission was held on Monday, January 9, 1978 at 5:00 P. M. in the Board of Directors Room, City Administration Building, Fayetteville, Arkansas. MEMBERS PRESENT: MEMBERS ABSENT: OTHERS PRESENT: Rita Davis, Ernest Jacks, Keith Newhouse, Bill Kisor, Newton Hailey, Elizabeth Crocker, Morton Gitelman. Chairman John Power, Peg Anderson. Bobbie Jones, Angie Medlock, David McWethy, Scott Van Laningham, Larry Wood, Peggy Bishop, Jim Vizzier, Steve Krysowaty, Mel Milholland, Rudy Moore, Jim Lindsey, Ken Jones, Bryce Davis, Neal Albright, Ellis Bogan, Ervan Wimberly, Katherine Stubblefield, D. In the absence of Chairman John Power, Vice -Chairman Rita Davis called the meeting to order. The minutes of the December 12, 1977 Planning Commission meeting were approved as mailed. The first item for consideration was the approval of the final plat of a Replat of Block 5, Lots 9-24, Bishop Addition, Unit 2, located west of Appleby Road and north of Bishop Drive; Wade Bishop, developer. Peggy Bishop was present to represent. Ernest Jacks made a motion to approve the final submitted. Keith Newhouse seconded the motion, which passed 7-0. MINUTES BISHOP ADDITION, UNIT 2 Final Plat Replat of Block 5 Lots 9-24 plat of the replat.of,Block 5 as The second item was the approval of the preliminary HUNTINGDON plat of Huntingdon, a Planned Unit Development, Preliminary Plat located at the northwest corner of Old Wire Road Planned Unit Development and Highway 265; Northwood Corporation, developer. Rudy Moore, Jim Vizzier, Steve Krysowaty and Mr. Pickell were present to represent. Ernest Jacks made a motion to approve the preliminary,plat contingent on 1) build.the future street stub shown on the plat to the west; 2) waive the street light spacing to a maximum of 420 feet;. 3) waive the sidewalk requirements on the private drives; 4) correct the dimensional errors; 5) obtain the signatures of the adjoining property owners; and 6) amend the number of total units to 346. Bill Kisor seconded the motion. David Knowles, 2448 Elaine said he is opposed to the Planned Unit Development. Wayne Jones, 2346 Elafne, was also present in opposition. He suggested that a street be built now out to Old Missouri Road. He explained that the developer is talking about taking traffic from 370 units out on Katherine. and Oak Bailey Road. He said this would be adding a considerable amount of traffic and an increased number of children walking to school along these roads. He was very concerned about the safety of the children walking along these roads with the increased amount of traffic. Planning Commission Meeting January 9, 1978 -2- Jim Vizzier said the developers have provided a stub to the west to their property line but the primary access at this time will be to Oak Bailey Drive. Dr. Richard Podemski, 2502 Elaine, said he objects to the increased density. He said this would be another 500-600 cars on Katherine and Oak Bailey Drive. Jim Vizzier said the maximum number of units would be 346 but they feel there would be considerably less actual units put on the property. He noted that there is open space which makes up for the added density. Keith Newhouse explained .thc' concept behind the Planned Unit Development. He also said. that it would be approximately 4-6 years before this project is completed. John Williams, 2445 Sweetbriar, said he is not opposed to this subdivision but feels there should be another access. Ray Shipman, 3325 Katherine, said he had seen a plat showing this vacant land when he bought his house but did not think access to it would come from Katherine and Oak BaileyiDrive. Bill Adair, 2432 Elaine, stated that he feels this is an immediate problem. He felt this would cause considerable danger to the children walking along these roads with the increased traffic. David Knowles stated that he felt the purpose of the Planning Commission is to prevent objectionable situations like this. Mrs. Katherine Stubblefield said she would be glad to give property for sidewalks if the property owners could come up with funds to build them. Michael Corso, 2437 Sharon, asked if the developer would have to purchase more land to come in from Highway 265. Jim Vizzier said he would not, but it would be quite expensive to build a bridge across the creek. The motion, made by Mr. Jacks and seconded by Bill Kisor toapprove the preliminary plat of the Planned Unit Development passed unanimously. The fourth item was the approval of the NORTHSIDE ACRES preliminary and final plat of Northside Acres Preliminary 4 Final Plat located east of Highway 265 and south of Zion Hwy. 265 4 Zion Rd. Road; Fred Zamberletti, developer. Jim Lindsey was present to -represent. Ernest Jacks recommended approval of the preliminary and final plat with..the following stipulations: 1) furnish a ,quYtclaim deed for any additional road dedication needed; and 2) pave the road in accordance with the arrangements made with Street Superintendent Clayton Powell (4" base and chip and seal) or other arrangements made with the City. Mr. Jacks also included approval of the tandem lot in his motion. Bill Kisor seconded the motion, which passed unanimously. Next was the approval of the preliminary plat of Winwood II, Phase II, located west of Winwood Drive; Mildred Winborn, developer. WINWOOD II, Phase II Preliminary Plat West of Winwood Drive Ken Jones was present to represent Mrs. Winborn. Ernest Jacks madea motion to approve the preliminary plat of Winwood II, Phase II with the stipulations that 1) the developer submit protective covenants; 2) obtain the signatures of the adjoining property owners; 3) provide the easements needed by the utility companies; and 4) waive the scale. Keith Newhouse seconded the motion, which passed unanimously. The next item was the approval of the final plat of Maple Terrace Subdivision located south Of Highway 16 West and west of Highway 71 Bypass; Bryce Davis, Developer Bryce Davis and Neal Albright were present to represent. MAPLE TERRACE Final Plat S. of Hwy. 16 West Planning Commission Meeting January 9, 1978 -3- Ernest Jacks recommended approval of the final plat with the contingencies that 1) the easement be changed to 20 feet between Lots 12 and 13, Block 1; 2) obtain - the signature from the owner of Maple Manor Apartments to the east; 3) submit either a bond or contract to the City; and 4) abandon:Jewell.Road east of Betty Jo Drive if the property to the east is not required to extend Jewell Road. Keith Newhouse seconded the motion, which passed 7-0. The seventh item for discussion was the SWEETBRIAR ADDITION approval of the preliminary plat. of the Replat of Block .. Replat of Block 3 3, Sweetbriar Addition located north of Sweetbriar 'Preliminary Plat Drive; Paradise Valley Development, Inc., developer. This is a Planned Unit Development Neal Albright was present to represent. Bobbie Jones said Mr. Albright needs to show the maximum density as 21 units; submit a copy of the protective covenants; show the easement on the north side as 25 feet; also, an easement between Lots 16 and 17 as 15 feet and a 10 foot easement across the south side of the west 150 feet. She explained that they would need a waiver from the Board of Adjustment on the overall acreage --they are proposing 3.01 acres and the Ordinance requires 5 acres for a Planned Unit Development. She also noted thatsome easements will heed to be relocated and any lines in the existing easements will need to be moved at the owner's expense. She said the Planning Commission will need to waive the safety zone between individual driveways. John Williams, 2445 Sweetbriar, said he is against the multi -family dwellings being built directly across the street from his property. Jim Lindsey pointed out that this property is zoned R-2 and in the R-2 zoning district, the developer could get as many as 24 units per acre. Tom Terry asked if there is any kind of guarantee as:to what type of units will be built there and Mr Jacks said the only guarantee would be in the protective covenants. Ernest Jacks made a motion to approve the preliminary plat contingent on 1) show the maximum density; 2) submit the protective covenants; 3) obtain a waiver for the overall acreage from the Board of Adjustment; 4) provide a concrete swale (8 ft.) between the public street and the private drive at the east end of the development; 5) the easements being shown as required by the various utility companies; 6) - revise the plan so the cars will not back into the street and 7) the Commission does not grant a waiver of the 25 foot safety zone between driveways. The tenth item for discussion was a DUPLEX CONDITIONAL USE duplex conditional use submitted by Katherine Stubblefield Katherine Stubblefield for property 3340 Old Missouri Road located at 3340 Old Missouri Road, property zoned R-1, low Density Residential District. Katherine Stubblefield was present to represent. She explained that she has had a stroke and does not want to live alone. Ray Shipman, 3325 Katherine, said he has no objection to the duplex conditional use but asked that a condition be attached to it that the conditonal use will be terminated with the passing of the title of the property. Mrs. Stubblefield indicated that she would be willing to agree to this condition. Bill Adair, 2432 Elaine, said he has no objection to the conditional use. Ernest Jacks made a motion to approve the duplex conditional use with the stipulation that Mrs. Stubblefield submit something in writing that the conditional use will be in effect only as long as she owns the property. Keith Newhouse seconded the motion, which passed unanimously. • Planning Commission Meeting January 9, 1978 -4- The Planning Commission next discussed the duplex DUPLEX CONDITIONAL USE conditional use request submitted by Clifford Clifford Clevenger Clevenger for property located on Holly Street and Holly F, Sang Sang Avenue for six duplexes, property zoned R-1, Low Density Residential. Neal Montgomery was present to represent Mr. Clevenger. Vice -Chairman Davis acknowledged a petition and letter in opposition which follow on pages ,'7-10 of these minutes. Mr. Montgomery explained that Mr. Clevenger plans to have the lots split so each lot will have over 100 feet frontage; except one which will only have 80 feet frontage. He said the duplexes would be in the $40,000-$50,000 price range. He stated that most of the houses in the area:,are in the $25,000-$30,000 price range. He said there are approximately 10 duplexes in the area and approximately "50% of the property in the neighborhood is rental. Attorney Marshall Carlisle was present representing some of the property owners in the neighborhood. He asked that the people in the audience present in opposition stand and approximately 20 people stood up. He felt the Commission should be duty- bound to deny the request with;so much opposition. He said the people who live in the neighborhood should :have a voice in the way the property is used. He stated that they want the area to remain as.single-family residential. Keith Newhouse made a motion to deny the request for six duplexes. Ernest Jacks seconded the motion, which passed 6-1, with Jacks, Kisor, Newhouse, Crocker, Davis, and Hailey voting "Aye" and Gitelman voting '!Nay". Mr. Gitelman stated that he felt the Commission should "rethink" the idea of duplexes in R-1. He said he favors duplexes mixed in with single-family residential. He also felt the main objection was to the idea of duplexes rather than the traffic or some of the other problems mentioned. Rita Davis said she does not agree that duplexes should be mixed in with single-family residences. The next item was the public hearing on REZONING PETITION R77-49 Rezoning Petition No. R77-49, City of City of Fayetteville Fayetteville, to rezone property located West of Green Acres Road north of Sycamore Street and west of Green Acres Road from R-0, Residential Office District to C-2, Thoroughfare Commercial District. Larry Wood suggested that the Planning Commission consider rezoning the west portion of these three lots to C-2, since the front of the property is -•'already C-2. He said the Land Use Plan does recommend service commercial and this is not inconsistent with what is in the area at this time. Bill Kisor made a motion to approve the rezoning. Keith Newhouse seconded the motion. Ernest Jacks stated that the people who own the property, rather than the City of Fayetteville, should have petitioned for the rezoning. Mr. Gitelman said he did not feel this would permit any more intense development of the property. He also said he did not see where they could put any more accesses into the property. The motion, made by Mr. Kisor, and seconded by Mr. Newhouse passed unanimously. The next item was the public hearing on REZONING PETITION R77-50 Rezoning Petition R77-50, Rodger Seratt, Rodger Seratt to rezone property located at 109 South. School 109 S. School Ave. Avenue from R-0, Residential Office District, to C-2, Thoroughfare Commercial District. Vice -Chairman Daiis acknowledged a phone call received by the Planning Office from Mr. Seratt, who asked that his petition be withdrawn. Ernest Jacks made a motion to accept the withdrawal of Rezoning Petition R77 -S0. Bill Kisor seconded the motion, which passed unanimously. • • • Planning Commission Meeting January 9, 1978 -5- The next item for discussion was the REZONING PETITION NO. R77-51 public hearing on Rezoning Petition No. Edward M. Osburn R77-51, Edward M. Osburn for property Happy Hollow Road located north of Fifth Avenue and West of Happy Hollow Road, to rezone from R-1, Low Density Residential District to A-1, Agricultural District. No one was present representing Mr. Osburn. Planning Consultant Larry Wood said he does not feel the A-1 zoning would be consistent with what will be there in the future. He said this area is just beginning to develop. He also said if the City felt mobile homes should be allowed to be placed in scattered areas of the City, they should develop some other way of allowing them. No one was present in opposition to the rezoning. Ernest Jacks made a motion to deny the rezoning. Mr. Hailey seconded the motion, which passed 7-0. The thirteenth item for consideration was the public hearing on Rezoning Petition No. R77-52, D. W. and Marian Morgan for property located north of Willoughby Road and west of City Lake Road REZONING PETITION NO. R77-52 D. W. Morgan North of Willoughby Road & West of City Lake Road from R-1, Low Density Residential District to A-1, Agricultural District. D. W. Morgan was present to represent. Larry Wood said he recommended that they consider rezoning this to A-1. He noted that this entire area is subject to flooding, according to the Flood Hazard Boundary Map sent out by the Corps of Engineers. Mr. Morgan explained that he wanted to build a hay barn. He said this is the only portion of his 80 acre farm which is not in the A-1 District. No one was present in opposition. Bill Kisor made a motion to approve the rezoning as requested. Keith Newhouse seconded the motion, which passed unanimously. Next was the public hearing on Rezoning Petition R77-53, James E:. Lindsey to rezone property located south of Zion Road and west of Highway 265: REZONING PETITION NO. R77-53 James E. Lindsey S. of 'Zion Rd. $ W. of Hwy. 265 Tract A - 12.4 acres from A-1, Agricultural District to C-1, Neighborhood Commercial District; Tract B - 19.30 acres from A-1, Agricultural District to R-0, Residential Office District; and Tract C - 12.5 acres from A-1, Agricultural District to R-2, Medium Density Residential District. Jim Lindsey was present to represent. Planning Consultant Larry Wood said this request is consistent with the Highway 265 Land Use Plan adopted by the Planning Commission which calls for this type of pattern at this intersection. He stated that there is no sewer in this area and recommended that they gain assurance from the property owner that no building permits will be issued until sewer is available Mr. Lindsey said he is working with the City Manager on a plan for extending sewer to serve this entire northeast area. He said he is authorized to offer the City $30,000 toward extending the sewer lines. He said he would be willing to submit a Bill of Assurance that only one building permit will be issued before sewer is available. He felt he should be allowed to get, other building permits but not occupy the buildings before sewer is available. No one was present in opposition. Planning Commission Meeting January 9, 1978 -6- Mr. Jacks asked if there is any assurance on extending Zion Road to the east and Mr. Lindsey said he would dedicate the needed right-of-way. Ernest Jacks made a motion to approve the rezoning with a Bill of Assurance that only one building permit will be issued before sewer becomes available. Keith Newhouse seconded the motion, which passed unanimously. Next for consideration was the public REZONING PETITION R77-54 hearing on Rezoning Petition No. R77-54 Sam Mathias for Sam Mathias for property located on Sycamore $ Garland the northeast corner of Sycamore and Garland Streets from R-1, Low Density Residential District to R-2, Medium Density Residential District. Sam Mathias, Tom Mathias, and Attorney Marshall Carlisle were present to represent. Larry Wood gave.the following reasons for recommending approval of the rezoning: 1) the property is large enough to allow the proposed development to be blended with adjacent single-family; 2) access is restricted to either an arterial or collector street; and 3) the zoning pattern is consistent with the development_trend in the area. Vice -Chairman Rita Davis acknowledged a letter in opposition from Mildred Brooks, 1015 Bel -Air Drive. Marshall Carlisle said the Mathias would be agreeable to trying to work out the problems noted by the opposition. Debra Whisenhunt, 1755 N. Garland, said she has spoken to many of the surrounding property owners and they are not in favor of the rezoning. She said they would like to know more about what they are going to put on the property. Marshall Carlisle pointed out:that there are several steps in the rezoning process. He said the Planning Commission would make a recommendation to the City Board of Directors.for a final decision. Then, the developer would have to submit a large scale development plan showing the location of buildings and layout of the property. Tom Mathias said Mathias Real Estate Partnership would retain ownership of the apartments. Debra Whisenhunt asked Larry Wood why he felt this area is not suitable for single- family and he said most people would not want to build a home facing a highway. Danny Wright, who owns property which backs up to this property said the area is large enough that it could be built up with single-family. Richard Crittenden, 1773 N. Oakland, said he had talked with other people on Garland who are opposed. He said an apartment complex would generate a lot of noise. Ralph Mayes; 1771 North Oakland said there are a great number of people in the area who are opposed to building apartments on the property. Mildred Brooks said she is opposed to the rezoning. . . — Rog.n Whisenhunt asked that they table this and give Mathias Real Estate Partnership and the people in the neighborhood a chance to discuss their plans. Commissioner Gitelman made a motion to approve the rezoning request. Bill Kisor seconded the motion, which failed to pass 2-5, with Kisor and Gitelman voting "Aye" and Hailey, Jacks, Newhouse, Crocker, and Davis voting "Aye". Vice -Chairman Rita Davis adjourned the meeting at 7:30 P. M. until 5:00 P. M., Tuesday, January 10, 1978. '• Planning Commission Meeting January 9, 1978 PETITION We, the undersigned residents of the City of Fayetteville, hereby respectfully oppose the request for a conditional use for the purpose of building duplexes on Lots 2, 3, 4, 5, 6, 7, 10 and 11 in the Harris Addition to the City of Fayetteville on Sang and Holly Streets.- As residents and property owners in this neighborhood, we respectfully urge the Planning Commission to retain R-1 zoning without variance because to allow the construction of duplexes or other multi -family dwellings would destroy the integrity of this area for single family dwelling. Turner Avenue and the immediate vicinity has developed over the past twenty years as a single family residential district, and it is the desire of the majority of the residents - most of whom own and occupy their home - that it be retained so permanently. Over -concentration of population in this area will result in a definite disbenefit to the several property owners who deliberately invested in residences in this section of The City represented to be in a single-family ne ighborhood.
