A meeting of the Fayetteville Planning Commission was held at 5:00 P. M.,
Monday, September 13, 1976, in the Board of Directors Room, City Administration
Building, Fayetteville, Arkansas.
MEMBERS PRESENT: Ernest Jacks (Acting as Chairman, in the absence of John
Power), Keith Newhouse, Donald Nickell, Rita Davis, Bill
Kisor, Peg Anderson, John Maguire (arrived late --S:15 P.M.).

Vice -Chairman Ernest Jacks called the meeting to order.
The minutes of the August 23, 1976 Planning Commission
Meeting were approved as mailed.
MINUTES
Vice -Chairman Jacks opened the public hearing on Rezoning REZONING PETITION R76-29
Petition R76-29, H. H. Hudgens, to rezone property H. H. HUDGENS
located on the South side of Highway No. 62 West, between So. side of Hwy. 62 West
Smokehouse Trail and Hoot Owl Lane, from A-1, Agricultural
District to R-2, Medium Density Residential District.
Mr. H. H. Hudgens was present to represent this petition.
Vice -Chairman Jacks said that the Agenda contained a list of 5 signatures of the
"area" property owners, stating that they have no objections to this rezoning.
Mr. Jacks said that he personally received two (2) complaints regarding this.
Rita Davis said that she received one complaint on this.
Larry Wood said that Hwy. 62 Plan, an amendment to the General Plan, defines
this as Low Density Residential. There are spots where Medium Density Residential
has been shown as a buffer from commercial portions; however, this property does
not fall within any R-2; and he said that he would not recommend Medium Density
Residential for this area
Mr. Kisor wanted to know if he has all the adjacent property owners' signatures.
Mr. Hudgens said that he does.
Bobbie Jones said that he wants it rezoned to R-2 so that he can have 60 ft. lots.
Mr. Hudgens said that Mr. Lieberenz suggested that he ask for R-2.
Mr. Hudgens said that the reason he is asking for R-2, is that one of those lots
won't meet R-1 requirements. He said that he does not want a subdivision; he
wants to build one house, and the Inspection.Supt. feels that he should rezone
this to R-2. He said that Mr. Lieberenz said that it would have to be rezoned
before he can get a building permit for another house.
Peg Anderson said that with three (3) lots (each needing 2 acres), it could not
go in A-1, but it could be put in R-1 zoning.
Mr. Hudgens said that he has no immediate plans to put another house there.
Mr. Lieberenz said that Mr. Hudgens had come in and wanted to get a building
permit to build a storage building, which he wanted to convert to a residence
later.
Peg Anderson wanted to know if R-1 would allow Mr. Hudgens to do what he wanted to

do.
Mr. Lieberenz said that as long as he has frontage (for each lot) to meet R-1
regulations, this would be o.k.
Mr. Lieberenz said that it is all one piece of property.
Mr. Hudgens said that he has no objections to zoning this R-1.
Mr. Lieberenz said that the Planning Commission only need be concerned with the
proper zoning district --the Planning Office can handle the lot splits.
There was,no one to speak -in opposition -to.this-petition.:..
Peg Anderson moved that Petition R76-29 be amended to rezone the property from
A-1 to R-1, and to recommend to the Board of Directors that the amended petition
be approved.
Mr. Newhouse seconded the motion, which was approved unanimously by a vote of 7-0.
Vice -Chairman Jacks opened the public hearing on REZONING PETITION R76-30
Rezoning Petition R76-30, John Daniel and Nancy Ann JOHN DANIEL $ NANCY ANN ANDRE
Andre, to rezone property located West of Crossover West of Crossover Rd. (Hwy. 265)
Road (Highway 265), and South of Highway 45 East, from
R-1, Low Density Residential District, to C-1, Neighborhood Commercial, or C-2,
Thoroughfare Commercial District.
Attorney Lamar Pettus was present to represent this petition.
Mr. Larry Wood said that he cannot recommend this for approval, as there are no
plans for sewer.
Attorney Pettus said that he believes the sewer would come later. He said that
there are no immediate plans for commercial. He said that the property across the
street is zoned Commercial; let Dr. Andre worry about sewer problems.
Mr. Roy Clinton said that he would like to speak in opposition to this petition,
as well as to one for the adjoining property owners to be heard, by the Planning
Commission on October 11, 1976. He said that, first of all, 11 years ago, the
property to the East (owned by Clay $ Wanda Yoe) was zoned C-2. To this date,
there has been no commercial development, except for a dance studio this year.
He said that some additional consideration should be given to the General: Land
Use, as to whether they need that much C-2 zoning for the years to come. The
road (Hwy. 265) cannot stand 12 acres, let alone 5 acres, which would make 61
acres on the West side of the road. Commercial Zoning would appreciate (the
value) the land. It should never be rezoned to C-2. He said that the General
Land Use Plan should be given plenty of attention, and the depth is not necessary
on the West side.
Attorney Pettus said, that to his knowledge, there are no plans to put a commercial
building there.
Bobbie Jones wanted to mention that the sign, which must be posted on the property
15 days before the public hearing, was posted by the Inspection Superintendent, but
it is no longer up. She did not know what had happened to it.
Mr. Kisor said that he agrees that C-2 is going too far.
Mr. Kisor moved that the Planning Commission deny Rezoning Petition R76-30 for
C-2 zoning.
Mr. Nickell seconded the motion.
Mr. Maguire said that he lives out there --he cannot go against neighbors. He said
that there is a lot of commercial zoning there.
Mr. Clinton said that two wrongs do not make a right. He said that he doesn't
know where they_will have a "stopping point" for continued rezoning to commercial,
where it is not needed, at the present time.
Attorney Pettus said that Mr. Clinton cannot argue the domino effect.
Mr. Clinton said that he doesn't believe it is necessary.

Peg Anderson said that she cannot see the commercial aspect.
The motion to .deny the petition, seconded by Mr. Nickell, was approved by a vote
of 7-0.
Vice -Chairman Jacks opened discussion on the Conditional
Use Request, submitted by Helen T. Edmiston, to
remodel an existing single-family dwelling into a
duplex at 895 Cato Springs Road, in the R-1 Zoning
District.
Mrs. Edmiston was present represent this request.

Helen Edmiston said that these:: are -two (2),old .school'houses--about 1700 square
feet which have been put together to make one dwelling. They have had difficulty
keeping it rented, but thought if they spent a lot of money and made it into a
nice duplex that they could rent it better.
Peg Anderson said that it sounds like a good idea.
Mr. Nickell said that he has seen the property, and this is a good idea

Rita Davis seconded the motion, which was approved unanimously by a vote of 7-0.
Vice -Chairman Jacks opened discussion on the
approval of the Final Plat of Rolling Meadows,
Phase I, located North of Rolling Hills Drive and
West of Old Missouri Road; Developer Associates,
Developer.

Mr. Jacks said that the Subdivision Committee reviewed this and it looks o.k.,
except for two (2) contingencies: (1) Satisfying Ozarks Electric Company, with
regard to the width of the easements; and (2) They clarify the 30 ft. dedication
on Old Missouri Road.
Mr. Robinson asked for a third contingency --that they correct the name of the
developer --it should be Realty Development Co., Inc., instead of Developer
Associates.
Mr. Newhouse moved to approve this Final Plat of Rolling Meadows, Phase I,
contingent on the three items mentioned above.
Mr. Kisor seconded the motion.
Bobbie Jones said that this plat is intended to vacate dedications in the
Stubblefield Addition.
Mr. Robinson asked that they agree to vacate.the existing plat.
Mr. Jacks asked Mr. Kisor if that would be agreeable to him, for them to
vacate the original plat.
Mr. Kisor agreed to this.
The motion, seconded by Mr. Kisor, was approved unanimously by a vote of 7-0.
Approval of this Final Plat presumes the vacation of the previous platting of
streets and easements in the Stubblefield Addition.

of the Final Plat of Jerry D. Sweetser Subdivision, East of Winwood Estates
to be located East of Winwood Estates (on an Final Plat
Extension of Bois de Arc Lane); Jerry D. Sweetser, Developer.

Mr. Neal Albright and Mr. Jerry D. Sweetser were present to represent.
Mr. Jacks said that they looked at this at the Subdivision Committee meeting,
and everything looks o.k., except for three (3) contingencies: (1) They
need to satisfy Clayton Powell regarding four (4) comments he had on street
and drainage plans; (2) Protective covenants; and (3) Change 30 ft. street
easement to right-of-way dedication for streets and utilities.
Mr. Newhouse moved that they approve this, contingent on: (1) Satisfying
Clayton Powell with regard to his four reservations; (2) Furnish a copy of
the protective covenants; and (3) Changing a 30 ft. easement to a right-of-
way dedication.
Mr. Kisor seconded the motion, which was approved unanimously by a vote of 7-0.
Vice -Chairman Jacks opened discussion on the
approval of the Final Plat of Mildred Lee
Estates, a subdivision located outside
the City Limits on the South side of Highway 16
West; Bill and Mildred Graue, Lloyd and Virginia
Bayley, Grady C. and Wanda G. King, and
Lenwyn and Kathy Edens, owners and developers.

Mr. Bill Graue and Mr. Frank Blew were present to represent.
Mr. Jacks said that Mr. Graue has agreed to install a 6 -inch water line.
There is a problem with the easements that they need to work out with the
utility companies. The County approved the road layout.
General Kendall said that the curve of the roadbed, itself, is smoothed
out.
Mrs. Anderson asked if 18 duplexes are really planned for this.
Mr. Blew said that he thought that deal had "fell through," although, he had
run perc tests, and the land would take care of that many.
Mr. Kisor moved that they approve this, contingent on: (1) Installing a 6 -inch
water line.; (2) Easements being worked out with the utility companies; and (3)
Correcting any technicalities that Bobbie Jones may have.
Peg Anderson seconded the motion, which was approved unanimously by a vote of 7-0.
Vice -Chairman Jacks opened discussion on the
approval of the Final Plat of Old Wire Road North
Subdivision, located East of Old Wire Road and
South of the proposed Township Road Extension;

Vice -Chairman Jacks said that there is one minor thing --an extension of easements
to the street right-of-way is needed between Lots 7 and 8, Block 5.
Mr. Jacks said that there was discussion about Lot 5, Block 4 having no access
to Old Wire Road, only on Stewart Street. Mr. Blew said that on Stewart Street,
the access would be more hazardous. It was decided that there should not be
a note on the plat concerning access to Lot 5, Block 4.
Mr. Newhouse moved to approve this, contingent. on the easementline being
extended to the street right-of-way between Lots 7 and 8, Block 5.
Peg Anderson seconded the motion, which was approved unanimously by a vote of 7-0.

Vice -Chairman Jacks opened discussion on the HERBERT HATFIELD
request submitted by Herbert Hatfield for Amendment to Zoning Ordinance
the Planning Commission to consider initiating an
amendment to the Zoning Ordinance (Appendix A - Zoning, Article 7, Section 9
Gasoline Service Stations) to amend the Ordinance as applies to the setbacks
of service station pump islands and canopies in the C-.3 Zoning District.
Mr. Herbert Hatfield was present to represent this request.
Mr. Hatfield said that he feels it is not very practical for them to require
35 ft. setback from College Avenue (25 ft. zoning, plus 10 ft. Master Street
Plan).
Mr. Jacks said that he is opposed to amending the Ordinance to satisfy one
case, and he asked how Mr. Hatfield could appeal the Board of Adjustment's
denial.
Bobbie Jones said that Mr. Hatfield's recourse would be to a Court of Law.
Mr. Hatfield said that he suggests that the Ordinance be rewritten for the
downtown area.
Mr. Nickell said that it is not the Planning Commission's position to make this
change.
Bobbie Jones said that the Board of Adjustment felt that this was a hardship
in general, rather than being a particular hardship on Mr. Hatfield. They
felt it should be changed for other C-3 property if it was going to be
changed for Mr. Hatfield.
Mr. Maguire agreed with this.
Mr. Jacks said that he feels the Zoning Ordinance is properly written as it is.
Bobbie Jones said that he could go back to the Board of Adjustment; he might
have to file a new appeal, unless they unanimously agreed to rehear his
original appeal.
Mr. Jacks said that his feeling is to give it back to the Board of Adjustment.
Peg Anderson moved that the Ordinance not be changed (Article 7, Section 9), as
it applies to service stations.
Mr. Newhouse seconded the motion, which was approved unanimously by a vote of 7-0.
Bobbie Jones said that only the Board of Directors can waive the Major Street
Plan portion of the setback.
General Kendall said that it seems that the Planning Commission has not solved
anyone's problem.
Mr. Jacks said that he realizes that --they need to make adjustments in certain
cases. It should be handled by the Board of Adjustment.
Peg Anderson said that the other alternative would be to have the City Board
take it up.
Bobbie Jones pointed out that there was a letter written OTHER BUSINESS
to Chairman Power by Don Grimes, regarding fencing,
that Mr. Power wanted everyone to see. Ernest Jacks said that
he and Larry Wood would take this into consideration in the study they
are involved in, on parking and screening requirements.
There was no further business to be discussed. ***peg Anderson wanted it mentioned
that she asked about the studies on Township Road and in the downtown area (business),
and that she is interested in "home occupations." (9/27/76 Planning Comm. minutes).

WHEREAS, a public hearing was held by the Planning Commission, Monday,
September 13, 1976, fifteen (15) days after a sign was erected upon the
property and after a notice was published in the Northwest Arkansas Times,
a newspaper of general circulation; and
WHEREAS, after the public hearing the Planning Commission voted to
make a recommendation to the Board of Directors on Rezoning Petition
R76-29, H. H. Hudgens.
NOW, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION

Planning Commission voted to make a recommendation to the Board of Directors

RESOLUTION PC 62-76
WHEREAS, at its regular meeting on Monday, September 13, 1976, the
Planning Commission voted to make a recommendation to the Board of Directors
on the final subdivision plat dated , 19 , known as
Old Wire Road North Subdivision submitted by W. T. Stewart and Roselyn
Stewart and
WHEREAS, the Planning Commission recommended that because the necessary
improvements have not been installed in said subdivision that W. T. Stewart
and Roselyn Stewart enter into and furnish the City with the necessary
subdivision guarantee before the Board of Directors accepts this final
subdivision plat.
NOW, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION TO
THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVU,T,F, ARKANSAS:
SECTION 1. The necessary subdivision guarantee be executed with the
City prior to the Board of Directors accepting the final subdivision plat.
SECTION 2. That the City of Fayetteville, Arkansas accept the final
plat along with the land dedicated for streets and other public uses in the
Old Wire Road North Subdivision described as follows:

Part of the W of the fractional NWt of Section 2, and part of the
NEt of the NE,, Section 3, T -16-N, R -30-W, or more particularly described
as follows: Beginning at the NE corner of the We of the fractional
NWt of the above mentioned Section 2 and running S 00° 03' W, 645.78
feet, thence N 89° 10' W, 1556.34 feet, thence N 31° 06' 18" E, 174.42
feet, thence N 31° 31' 46" E, 564.22 feet, thence S 89° 39' 13" E
1171 76 feet to the point of beginning and containing 18.98 acres
more or less, all in Washington County, Arkansas.
SECTION 3. That the easement line be extended to the street right
of way between Lots 7 and 8, Block 5.
