The Fayetteville Planning Commission met at 4:00 P.M., Tuesday, June 20, 1972,
in the Directors Room, City Administration Building, Fayetteville, Arkansas.
Members Present: Helen Edmiston, Al Hughes, Roy Clinton, John Maguire,
Albert Witte, Dr. Walter Brown.
Members Absent: Ernest Jacks, Al Donaubauer, Donald Nickell.
Others Present: Hugh R. Kincaid, Mike Watson, Sam Robinson, Jr.,
Larry Wood, Pete Young, Pat Tobin, George Holland,
Wells Bone, Harvey Smith, Donald Grimes,
Chairman Roy Clinton called the meeting to order.
The minutes of the May 23 and June 6, 1972 Planning Commission meetings
were approved as mailed.
The first matter considered was a large scale development plan for SAM ROBINSON, JR. ,
medically oriented office building submitted by Sam Robinson, Jr. and & KINCAID & CO.
Kincaid & Company for property on the East side of College Avenue L. S. Development
between Batter Street and North Street. Sam Robinson, Jr., Hugh K. North & College
Kincaid and Mike Watson were present to represent the proposed development.
John Maguire reported on the Subdivision Committee's review of the plan.
Mr. Kincaid explained a discrepancy on the West boundary line and presented
a revised drawing to correct the error. Mr. Maguire asked Mr. Kincaid
how the developer felt about dedicating aniadditional ll ft. for ROW for
College Avenue. He said it was quite a bit of land, but that was what
the Plat Review Committee felt they needed. Mr. Kincaid said that Clayton
Powell, Street Superintendent, had been willing to accept an easement for
5 ft. to widen Baxter Street if he could get right-of-way dedication for
the additional needed on College And North Street. Mr. Kincaid said that
the plan has one problem; the parking area is shown too close to Baxter
Street. A rezoning petition is on file to rezone the subject property
from R-1 and C-2 to R-0. He questioned the intent of the ordinance where
it requires screening of parking areas when they are across a street "less
than 160 ft. wide" from an R district. Yr. Maguire said that the telephone
company and Trans -Video need a 15 ft. easement down the East property line.
Mr. Kincaid said that he thought a waiver of the parking setback was a
matter for the Board of Adjustment but would be happy for the Planning
Commission to include it in its motion and check with the City Attorney
on whether the Commission had the authority to waive the parking setback.
Helen Edmiston moved that the Commission approve the plan. Al Hughes
seconded.
The Commission members discussed the meeting date for the month of July. RESCHEDULE
Roy Clinton said he would be unable to attend the meeting if held on MEETING FOR
July 11. Al Donaubauer has resigned. After some discussion the Commission -JULY 18
unanimously agreed to meet July 18 for public hearings on petitions, etc.
and not to have any other regular meetings in the month of July.
The next matter was a large scale development plan submitted for "Pat PAT TOBIN'S
Tobin's Golf King" at 50 West Township. Al Hughes expressed concern with GOLF KING

section of Township is pretty narrow and gets congested here. Mr. Tobin
agreed to move the drive entrance about 50 ft. to the West. Mr. Maguire
asked if the additional right-of-way for Township requested by the Plat
Review Committee was any problem. Mr. Tobin said it was not; there is
a phone cable there already.
Dr. Walter Brown said that Arlie Pennington had promised to give additional
right-of-way when the property was rezoned. He requested that Mr. Pennington
give the required right-of-way before dividing the property up and selling
it.
John Maguire moved that the Commission approve the plan subject to relocation
of the entrance and subject to the disposition of the right-of-way, either
under the old procedure or under the 20 ft. rule whichever is greater.
Helen Edmiston seconded. The motion passed unanimously.
The next matter considered was a request by Southwestern Bell Telephone Company
for approval of off-site, off-street parking for a proposed office S.W.BELL TELEPHONE
building. Mr. George Holland was present., He stated the proposed Off-site parking
building would be used to relocate the t®1'ephone business office.
He asked for permission to use the City parking lot across the street to
meet the parking requirements. After some discussion, AlMighes moved
to approve the request; Helen Edmiston seconded the motion; it was
approved unanimously.
The next item of business was a report on the Highway 71 By-pass Corridor
Study presented by Larry Wood at the request of the Planning Commission, HIGHWAY 71
It was noted that the study was requested by the Commission because of BY-PASS CORRIDOR
administrative problems with the ordinance requiring a parallel access STUDY
road along the By-pass because it does not designate where the access
road should be, where it should come into the By-pass, etc., and because
of repeated zoning requests for zoning changes. The General Plan is
not specific as to what the future zoning should be in some areas.
Mr. Wood had prepared a special lay out to illustrate his findings and
recommendations. He stated he assumed that the By-pass would continue
to be upgraded to 4 lanes divided with limited access facilities. Roy
Clinton asked if there is room on the present right-of-way for two
divided lanes plus two 2 -lane service roads. Mr. Wood said there might
be, but that he doubted that the Highway Department would ever allow
the service roads to be built on their right-of-way. Another assumption
of Mr. Wood was that as the By-pass is upgraded access to the By-pass
would be limited to major intersections. He expected Highway 112, Highway
16 and Highway 62 to have full access, but did not expect Johnson Road
and Highway 265 to have access. He recommended as a general principal
intersection ties starting with the most intensive zoning and working to
the least intensive through a series of office, multi -family, lower density
and finally single family and agricultural activities. Mr. Wood recommended
the property below Lake Fayetteville be for public uses. He recommended
the hill above the Elks Club remain either A-1 or R-1. The density will
probably have to be increased South and East of Nelson's Funeral Home;
He recommended as a prerequisite to zoning changes that improvement districts
be formed to cover the service road where bridges would be required.
High Density Residential zoning was recommended immediately South of
the I-1 zoning of Arkansas Western Gas with medium density below that
down to Krogers. About the only point to tie a service road at this time
is Millsap Road. That would be a bad intersection. Possible signalization
was discussed. He recommended C-1 on the Northeast corner of Johnson Road
and the By-pass with R-1 north of the south line of the proposed subdivision.
He recommended that the service road follow the south line of the subdivision.

On the South side of the By-pass, he thought it would be best to move the
service road to the East of Skull Creek and catch that when that property
divides and also utilize Appleby Road. Between Johnson Road and Highway
112, he stated he had recognized the C-2 and recommended dezoning the
I-1 to C-2 and cutting the C-2 back to match the I-1 dimension. He suggested
the service road flare out at this point. He had contacted the Arkansas
Highway Department and requested that they study the possibility of a
"Highway 71 North Expressway" with a tentative location for an intersection
with the By-pass; they said West of Highway 112 and East of Porter Road.
Ma. Wood recommended protecting the land area until the interchange can
be tied down.
He recommended that the C-2 across the By-pass from the fair grounds be
eliminated. He said the only place he could see where it would be
too difficult to get a service road was on the hillside next to the
Elks Club. Commercial was recommended on all four corners at the inter
section with Highway 16 West buffered by medium density residential. The
access road on the southwest side of the By-pass should be tied directly
to the access road on the north side. He recommended that the commercial
south of the R-2 on the West side of the By-pass be dezoned to residential,
with basically residential coming on down the By-pass. He recommended
using Old Farmington Road as the service road with a jog to the West to
a desirable development distance West of the IGA store then turn back
to Highway 62. Again, commercial was recommended at all four corners of
Highway 62. The Commission has already accepted Old Farmington Road as the
service road on the East side of the By-pass. The Highway Department said
they would not eliminate tying the service roads in at intersections,
but that they would discourage it. He was willing to go ahead and
recognize commercial establishments all the way out to the Ozark Smoke
House on Highway 62, but recommended that the City adopt either the
Highway Department access control or one of their own and start enforcing
it. This would serve the purpose of establishing spacing of driveways
and tying together adjoining parking lots. He recommended this not only
for Highway 62, but all the major highways in the City.
Mr. Wood did not foresee an interchange on Highway 16 By-pass and Highway
71 By-pass. He recommended the C-1 be cut back in size and the portion
East of the creek be dezoned to R-2. On the North side of Eighteenth
Street, he proposed the I-1 along the By-pass be changed to medium density
residential with high density East of the creek. Mr. Wood said his
report recognized the commercial pattern where the By-pass ties back to
Highway 71 with strict access control on both sides. He recommended the
service road tie back into the existing residential street on the South
and West.
Following the report, the Commission members discussed the recommendations
with Mr. Wood. Don Grimes, City Manager, said he thought the State Highway
Department has been very liberal in the issuance of curb cut permits. He
thought they have published standards, they just do not enforce them. He
said he understood that Mr. Wood was suggesting that the City request that
the State allow the City to enforce the State's regulations for them.
Mr. Wood and Mr. Grimes informed the Commission that sewer is proposed to
serve:+,Ithe area North and West of Highway 16 and the By-pass up to Mt.
Comfort Road and that construction will probably begin next February or March.
Mr. Witte said he wished to go slow on strip commercial on Highway 62 until
the Commission got something firm on the conditions discussed. Larry Wood
said his recommendation would be to get a committment on the improvement
district for the service road and bridges before doing anything in the area
where bridges would be required.

Harvey Smith said his property on the Northeast corner of Johnson Road
and Highway 71 By-pass has access to Johnson Road. He said that at the
time the Commission could get all other property owners together they
could attach an assessment on his property. He said he was willing
to give a committment for a service road on the East side of Skull Creek,
Roy Clinton stated that it might be best to leave this property I-1 and
rezone Kelley Brothers' portion at this time.
John Maguire moved that Rezoning Petition R72-19 be amended to rezone from
I-1, Heavy Commercial & Light Industrial District, to R-1, Low Density PETITION R72 -19i
Residential District, from the South side of the proposed Johnson Road PLANNING COMM.
Subdivision northward and leave the remainder I-1. Albert Witte seconded. Johnson Rd.
The motion passed unanimously.

The Commission unanimously agreed to hold a second or adjourned public ADJOURNED
hearing on the proposed sign regulations on June 27, 1972, in the Municipal HEARING
Court Room at 7:00 P.M.
Due to a conflict of schedules with some of the Commission members, the
next regular meeting of the Planning Commission at which rezonings and
the petition to remove duplexes from the R-1 district is to be heard
was rescheduled for July 18 instead of July 11,
Chairman Roy Clinton appointed Helen Edmiston to serve as Acting
Secretary of the Planning Commission during the temporary absence of
Ernest Jacks,

VWREAS, a public hearing was held by the Planning Commission,
Tuesday, June 20, 1972, fifteen (15) days after a sign was erected
upon the property and a notice was published in the Northwest Ark-
ansas Times, a newspaper of general circulation; and
WFEREAS, after the public hearing the Planning Commission voted
on June 20, 1972, to make a recommendation to the Board of Directors
on Petition R72-19, initiated by the Planning Commission to rezone
the following described property:
