HomeMy WebLinkAbout1972-02-15 Minutes0 i 1] MINUTES OF A PLANNING COMMISSION MEETING The Fayetteville Planning Commission met at 4:00 P.M., Tuesday, February 15, 1972, in the Directors Room, City Administration Building, Fayetteville, Arkansas. Members Present: Roy Clinton, C:A.Hughes, Helen Edmiston, Al Donaubauer, John Maguire, Albert Witte, Dr. Walter Brown. Members Absent: Donald Nickell, Ernest Jacks, Others Present: Glen Wing, Wes Howe, Larry Wood, Pete Young, Harold L.ieberenz. Chairman Clinton called the meeting to order. The first item on the agenda was Rezoning Petition R72-8, Sunrise Manor, Inc. Cy Carney & Lettie Carney, to rezone part of Rochier Heights Addition PETITION R72-8 from R-2, Medium Density Residential District, to R-2, High Density Sunrise Manor, Residential District, continued from February 1, 1972. Glen Wing, Attorney. 1001 Rochie. was present. The Commission reviewed a letter from Mr. Wing requesting the petition be amended to a lesser area to cover the proposed expansion of Sunrise Manor Nursing Home. Helen Edmiston moved that the Planning Commission approve the amended petition. Al Donaubauer seconded. The amended petition was approved unanimously. The next item on the agenda was a study of the area on Cato Springs Road STUDY FOR to set boundaries for a public hearing to initiate a petition for rezoning. REZONING Larry Wood reviewed the present use of the area and recommended R-2 for Cato Springs an area bounded on the North by the railroad tracks, on the West by Garland Road Area Avenue and a line extending South from Garland Avenue to the creek, on the 'South by the creek back up to Cato Springs Road and Cato Springs Road East to the West side of Lot 1, Block 6, Meadowlark Addition thence North to the railroad tracks. Mr. Wood felt the area has a chance to survive residentially if the density is increased, but did not feel R-1 would survive. The rezoning would be from R-1 and I-1 to R-2. Mr..Wood's recommendations were discussed. Albert Witte moved that the Planning Commission call a public hearing to consider rezoning the above described property as recommended. Al Donaubauer seconded the motion. It passed unanimously. Roy Clinton appointed John Maguire to serve on the Subdivision Committee with Ernest Jacks and Helen Edmiston, SUBD, COMMITTEE After a discussion with the other Commission members, Chairman Clinton set Wednesday, February 23, at 7:00 P.M. as the next meeting date for MEETING FOR the joint sign review. If Wednesday was not satisfactory with the Board SIGN STUDY of Directors and Board of Adjustment, Chairman Clinton suggested Thursday as an alternate date. He further requested that Ernest Jacks be contacted and that the Sign Committee meet before that date. The review of land use goals and development objectives adopted by the Planning Commission in connection with the Comprehensive Plan was postponed. The minutes of the February 1, 1972, Planning Commission meeting were approved as mailed: The meeting was adjourned at 4:50 P.M. RESOLUTION PC 72-5 WHEREAS, pursuant to the provisions of the Code of Ordinances of the City of Fayetteville, Arkansas, the City Planning Commission held a public hearing on the following rezoning Petition, Tuesday, February 1, 1972, fifteen (15) days after a sign was erected upon the property and after a notice was published in the Northwest Arkansas Times, a newspaper of general circulation; PETITION NO. R72-8: The petition of Sunrise Manor, Inc., Cy Carney, and Lettie Carney for property located South of Highway 62 between Razorback Road and Hill Avenue described as: Lots 4 through 12 of Block 4, and all of Blocks 51 6, 79 89 91 10, 11, and 12, Rochier Heights Addition to the City of Fayetteville, Arkansas; from R-2, Medium Density Residential District, to R-39 High Density Residential District. WHEREAS, following the public hearing, on Tuesday, February 15, 19729 the Planning Commission voted to make the following recommendation to the Board of Directors. NOW,THEREFORE,BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION TO THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS.. SECTION 1. That an ordinance be adopted for the purpose of rezoning the following tract of property from R-2, Medium Density Residential District • to R-3, High Density Residential District. A part of Blocks 5, 6, 7, and 6 in Rochier Heights Addition to the City of Fayetteville, Arkansas, and also a part of the NWy of the NWJ of Section 21, T -16-N, R -30-W of the 5th P.M., County of Washington, State of Arkansas, and being more particularly described as follows, to -wit: Beginning at the NE corner of Block 6, said point also being 562.62 feet East and 299.84 feet South of the NW corner of Section 21, and running thence S 89°59' W along the South side of Rochier Street, 429.36 feet; thence S 37043' W 64 feet to the P.C. of a 300 09' Curve to the Southeast; thence curving Southeasterly along said curve 267.64 feet to the P.T. of said Curve, this curve being on the outside ROA1 of the street hereinafter excepted from this conveyance; thence S 43000' E 103.45 feet; thence S 760211 E 262.05 feet to the West side of platted Waunetta Avenue, thence N 16055' E 453.67 feet to the point of beginning, less and except a strip of land 50 feet of uniform width off of the West end of above described lands for Street, running from the South line of Rochier Street to the West line of Paris Avenue as now located in said Rocbier Heights Addition to the City of Fayetteville, Arkansas, as more particularly described in the deed of said Street to the City of Fayetteville, Arkansas PASSED AND APPROVED this W 15 day of February, 1972. APPROVED: ROY CLINTON, CHAIRMAN RESOLUTION PC 72-6 BE IT RESOLVED, by the Planning Commission of the City of Fayetteville, that a public hearing be called for the purpose of considering the rezoning of property hereinafter described and to rezone from I-1, Heavy Commercial and Light Industrial District, and R-1, Low.Density Residential District, to R-2, Medium Density Residential District, and BE IT FURTHER RESOLVED, that the Planning Administrator is hereby authorized to advertise said public hearing for the earliest convenient meeting of the Planning Commission, LEGAL DESCRIPTION: Property located on the North and South sides of Cato Springs Road and East of Garland Avenue, described as: Part of the SJ of the SW4 of Section 21, T -16-N, R -30-w, and Part of the NJ of the *11 of Section 28, T -16-N, R-30-ef, more particularly described as follows: Beginning at a point on the South right-of-way line of the St. Louis & San Francisco Railroad where said right-of-way line intersects the East right-of-way line of South Garland Avenue, thence South along the East right -6f -way line of South Garland Avenue to Cato Springs Road and - continuing due South to the centerline of Cato Springs Branch (Creek), thence running North in a Easterly direction along the centerline of said Cato Springs Branch (Creek), to the South right-of-way line of Cato Springs Road, thence East along the South right-of-way line of said Cato Springs Road to the NW corner of Lot 1, 3lock 6, Meadowlark Addition, thence North to the South ROW line of the aforementioned St. Louis and San Francisco Railroad, thence Southwesterly along the South ROW line of said St. Louis & San Francisco Railroad to the point of beginning.
