HomeMy WebLinkAbout1971-09-21 MinutesMINUTES OF A PLANNING COMMISSION MEETING The Fayetteville Planning Commission met at 4:00 P.M., Tuesday, September 21, 1971, in the Directors Room, City Administration Building, Fayetteville, Arkansas. Members Present: Albert Witte, Al Donaubauer, Roy Clinton, Ernest Jacks, Helen Edmiston, Dr. Walter Brown, Members Absent: Dr. James Mashburn, Byron Boyd, L. M. McGoodwin. Others Present: Col. V. C. Denton, Kenneth Lance, Joe Cogdell. The Chairman, Roy Clinton, called the meeting to order. The first matter considered was the sketch for a proposed development outside the City of Fayetteville and within the Planning Area for HICKORY HOLLOW SUBD. the City of Fayetteville located North of Highway 45 East (SW� of Col. V. C. Denton NW�, Sec. 27, T -17-N, R -29-W) submitted by Col. V. C. Denton and Outside City tabled September 7, 1971. The name of the proposed development is Hickory Hollow Subdivision. Col. Denton said that since the meeting September 7 he had contacted Bill Parette, County Sanitarian, about the Planning Commission requirement for test to prove the property would support individual septic tanks in accordance with State Health Department regulations. Mr. Parette had told Col. Denton to have a registered engineer to do the tests and that if the engineer would certify that it met the State requirements it would be satisfactory with him. Dr. Brown arrived at 4:15 P.M. Al Donaubauer moved the plat be approved with the provision that the tests results be submitted to the Planning Office signed by a licensed engineer stating that each lot will support private water and sewer systems. Helen Edmiston seconded. Albert Witte asked what regulations the City has on development outside the City. Col. Denton said he would have plat covenants covering the location of houses on lots. Dr. Brown questioned why the City of Fayetteville cannot require the developers outside the City to build streets to City street standards, with curbs and gutters. Roy Clinton said he thought perhaps the City might be able to at least wield some power along this direction, but did not think it economically feasible for the developers. He thought this might cause the developers to endeavor to circumvent the regulations and thought this the best the City could get. Mr. Clinton further stated that he thought in the future the property owners would have to use an improvement district to put in good streets. He thought the primary concern of the City now was proper width of streets and outlets to adjacent properties to prevent landlocking. Dr. Brown said he was interested in finding out what other cities such as Little Rock are doing in these situations. 9-21-71 -2- The vote was taken on Mr. Donaubauer's motion and it was approved unanimously. The next matter on the agenda was a petition to close a portion of 4 Jon Street West of Elizabeth Avenue submitted by Ralph, Roland, and PETITION TO CLOSE Katherine Stubblefield. The existing dedicated street stub stops PORTION OF JON ST* at the rear of a lot with a house on it facing Sheryl Avenue, Ralph Stubblefield Mr. Lieberenz said he thought that personally the street dedications should not have been accepted without lots platted on them. Mr. Stubblefield now desires to plat lots either along Jon Street or down both sides of Elizabeth Avenue. There were no comments from the audience. All utility companies submitted letters of concurrence. Helen Edmiston moved the Planning Commission recommend approval of the closing of Jon Street West of Elizabeth Avenue. Ernest Jacks seconded. It was approved unanimously. The next matter on the agenda was a sketch for a proposed development on the East side of Cabinet Lane and abutting Highway 71 By -Pass, a controlled access highway, submitted by Ken Lance. Mr. Lance was KENNETH LANCE present. Mr. Lieberenz read from the minutes of the Plat Review Sketch of proposed Committee and said there are three questions: (1) Service road development on requirement, (2) Will the property support septic tank systems? Cabinet Lane (3) Would there be a requirement to subdivide? The Commission discussed the problems with Mr. Lieberenz and Mr. Lance. Also, Mr. Lance, said Paul Mattke had insisted on having an 8 -inch water main brought onto the property. The Commission agreed (1) there would be a requirement to subdivide unless the property could be used for one building only, (2) Cabinet Lane would have to have a 50 ft. ROW. (3) The 50 ft. service road would have to be provided. They did not wish to get involved in the question of septic tanks, as they felt this was adequately controlled through the issuance of building permits. Mr. Clinton did say he felt an office building might be a more logical use of the property. He did not assure Mr. Lance the property could be rezoned to R-0, but implied this might be a solution to the problems surrounding the use of this property. The next matter on the agenda was a review of a petition for rezoning filed by Joe B. Cogdell. The property covered in the JOE B. COGDELL petition was included in a larger tract petitioned for rezoning Petition for earlier in the year. The earlier petition was denied. A new Rezoning rezoning petition cannot be processed unless the Planning Commission feels there is reason for accepting the petition before 12 months from the date of denial of the earlier petition. The property in question was discussed: it is a cafe which was built prior to coming into the City. Mr. Cogdell proposes a stop and shop grocery using the existing building. Ernest Jacks moved the Commission hear the new petition. Helen Edmiston seconded. It was approved unanimously. Mr. Witte said his favorable vote on the request was based primarily on the fact that the property is nonconforming. There followed a discussion concerning the desirability of joint meetings with the Planning Commission Subdivision Committee and the Plat Review DISCUSSION Committee. The Subdivision Committee preferred to continue on the on possible join present basis, as they felt the Plat Review spent a lot of time getting Meetings of things condensed down for them. Subd. Committee & Plat Review Comm. The minutes of Sept. 7, 1971, were approved as mAiled and the meeting was adjourned at 5:20 P.M. ,0 RESOLUTION PC 44-71 WHEREAS, the petition of Ralph E. Stubblefield, Roland P. Stubblefield, and Katherine Stubblefield for vacating a portion of Jon Street was pre- sented to the City Planning Commission for recommendation; and WHEREAS, at a meeting held September 7, 1971, the City Planning Commission voted to amke a recommendation to the City Board of Directors on vacating said portion of Jon Street. NOW, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION TO THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That after the public hearing an ordinance be adopted for the purpose of closing that portion of Jon Street herein described as follows: That portion of Jon Street 180 feet in length lying West of Elizabeth Avenue in Block 5 of Stubblefield Addition.
