.' The Fayetteville Planning Commission met at 3:00 P.M., Tuesday,
September 7, 1971, in the Directors Room, City Administration
Building, Fayetteville, Arkansas,
Members Present: Ray Clinton, Byron Boyd, Al Donaubauer, Helen
Edmiston, Dr. Walter Brown.

Chairman Roy Clinton called the meeting to order,
Mr. Clinton requested that before the Commission considered the
items on the agenda, consideration be given to a petition for closing
of an alley for the proposed new Federal Building. The alley is FRCPOSED FEDERAL
located in Block 29 of the Original Town Plat and runs East and .lest. BUILCLT;G - alley
Lynn ','lade, Attorney,was present and explained that the General Services closinP
Administration had just requested the alley be closed before deeding
the land to them. The formalities for the transfer of ownership are
scheduled for later this month. The closing of the alley, ti;•ith
retention of easements in some cases, has been approved by all utilities.

property owners in the area considered for rezoning objected. Bryce
Davis said the former motel has been changed tc officez. They planned
to construct apartments on the Gest portion of the pra_oerty. Apartments
cannot be constructed in C-2. Georgia i-ScCandless, 120 East Sycamore,
also owns 104, 116, and 124 East Sycamore, requested zoning not be changed.

Dr. Murray whose office, along with 4 other medical offices, is in
the area under censiderat`_on objected to changing this to C-2. He
requested everything North of the glass company be changed to R-0.
Item 1, C, on the Agenda, Planning Commission petition_ to rezone from
C-2, Thoroughfare Commercial District, to R -O, Residential Office
District, property located on the West side of Green Acres Road, from
Poplar Street on the North, South through 1915 Greer Acres Road, was
considered next. This public hearing had been postponed from August 3,
1971. Dr. Spencer Albright said he had understood his was supposed
to have been zoned erti%ely R.O. He requested this be done now. Also, PIANNING
he said Dr. Hays wanted his all zoned R-0. He felt the entire area CO*?FISSION
should all be R-0. Dr. Boyd llarris requested his property all be REZONING PETITION
zoned R-0, Mrs. C. E. _ci:inney requested her property be rezoned to Green Acres P.oa
R -O. Two Commission members, Dr. Brown and 111rs. Edmiston, stated & Poplar Street
they felt R -O was a better zoning for both tracts on Green Acres Road,
Mr. Clinton said the Cosmissicn is trying to square up property lines
and zoning lines. The owners could petition for change from C-2 to
R-0 on the South tract themselves.
The public hearing on the above three tracts was closed.
The rezoning petition of Dr. J. B. Hays to rezone from R-1, Low
Density Residential District, to R-3, 'nigh Density 'esidential District,
property located on the East side of North Gregg Avenue and lying DR. J. Be HAYS
between Ash Street and `iller Street was considered next. Larry ;1eod IT, Greeg betwee
presented the Staff Report. He saw a possibility of R-2, but felt R-3, teiller Ash
as requested, was too dense. John Box and Dr. clays represented the
petition. After a discussion, Dr. Hays stated he would accept R-2
zoning. Harold Lieberenz asked about a building on the East side
which apparently encroached on the property. Dr. Hays said a 15 to
20 ft. strip had been sold there.
The public hearing was closed as there were no further questions from
the audience or the Commission..
The rezonirg petition of Robert T. Stout to rezone from A-1, Agricultural
District, to C-2, Thoroughfare Commercial District, property located
on the East side of Highway 71 North and north and South of Shepherd ROBERT T. STOUT
Lane was considered next. Larry Wood presented the Staff Report. the No College
said he had made an error in locating the property and several points Shepherd Lane
in the Staff Report submitted did not apply. There is water on the
property, sewer is available, the property drains into Mud Creek, and
is separated by Shepherd Lane which is not a dedicated street. He
said the owners should strive to fulfill the service road requirements
for this section of Highway 71. Yr. Wood said he coed see either R-0,
C-1, or C-2 for this property. Truman Smith, Attorney,, and Dor, and
birs. Stout were present. The purpose of requiring a .service road
was explained to them. There were no questions or comments from the
audience.
The public hearing was closed.
• The next matter considered was the rezoning petition cf Robert Be
Westphal and Betsy J. Westphal to rezone from R-1, Lau,; Density

property located on. the .i_rth side of Plettleship Street and East
of Hartman Avenue. Larry 'Mood presented the Staff Report. Robert
Westphal was present. He stated he proposed to build a 10 -unit
apartment building, which would upgrade the area. Russell Purdy
asked whether the surrounding property owners had been notified.
Those immediately adjacent had. There were no other comments or
questions.
The public hearing was closed.
The next matter considered was a rezoning petition of James A.
Pennington to rezone from A-1, Agricultural District, to I-1, Heavy
Commercial and Light Industrial District, property located on the North
side of Township Road and Last of State Highway 180. Larry ?food JAM S A, PEI
presented the Staff Report. He further added that the City Engineer Te.mship Road
desires a drainage easement 25 ft. either side of the centerline of
the creek. Mr. Pennington was present to represent the petition.
There were no questions from the audience.
The public hearing was closed.
The next matter considered was the rezoning petition of Kerr Investment
Company to rezone from A-1, Agricultural District, to R-2, ?Medium
Density Residential District, property located South of Zion Road and
West of Cld ".issouri Road. Larry :food presented the Staff Report. K✓RR !:7hST"E1IT CO.
Robert Kilgore asked o:hether this zoning would permit a mobile home Old Nissc ri Rcad
park. He was told it would, but that mobile hems parks have to be
brought before the Planning Commission for approval. Mr. !rood said
that R-2 zoning would permit a maximum of 1200 units on this property.
Marshall Carlisle, Frank Kerr, and Ervan limberly were present on
behalf of the petition. A tentative lay out was shown on the plans
in the mill. It was noted it would be necessary to bring in a heavier
water line. The petitioner promised the development would be severed.
Mr. Kilgore, Harry I•IcPherson, and other area residents had some questions
and comments about the existing 1 -inch water line, no existing sewer
service, and the narrowness of Zion Rcad, Mr. McPherson requested a
meeting between Mr. 'err anthe neighborhood. Mr. .limberly said
they hoped to tie the streets and sewer service into the A. W. -Realty property.
The public hearing was closed.
Two new rezoning petitions initiated by the Planning Commission were
considered next. There were no questions from the audience or ccns:ents
from the Planning Commission on either. The proposals were to rezone
from A-1, Agricultural District, to R-1, Low Density ?esidential
District, property located on Sandra Street described as Lots 1 through
12 inclusive, Block 1, Stapletor.'s Subdivision No. 1; and to rezone
from A-1, Agricultural District, to R-1, Low Density Residential

The next matter considers,:, was a Large Scale Development Plan and
Conditional Use Request subr..itted by the Reorganized Church of Jesus
Christ of the Latter Day Saints for property on the 11lest side of REORGANIZED CHURCH
Old Wire Road and South of Grace Baptist Church, Ns, Liebererz OF ESUS CHRIST OF
reviewed the recorrendaticns of the Plat Review Committee including LATTER DAY SAIN
the request for an easement by the telephone company, Paul Kattke's Old Wire Road
recormendation for City sewer, and Paul Mattke and Larry Wood's L.S.Development &
suggestion for a provision to extend Hilldale Street in the future. Conditional Use
Mr. Oran 1•ihisler was present and said the local Church people have
approved dedicating for the street, He asked what the requirements
for improving would be. "r. Lieberenz said his understanding was
that if an easement for future street purposes was given, the Church
would not have to improve the street unless they wanted the street
improved. 'ohoever wanted the street improved would have to do it.
Mr. Johnson to the South had not been contacted about the street.
The next matter considered was a sketch for a ;proposed development
outside the City of Fayetteville and within the Planning Area for
the City of Fayetteville and located north of Highway 45 East (Si:,1„ CCL. V. C. DiNTO?•i
Sec. 27, T -17=N, R -3G -c!) subr..itted by Col. V. C. Denton. Col. Development cut -
Denton was present. Harold Liebererz reviewed the Plat Review side City inside
Committee's recommendations. Col. Denton said he had contacted the Planning Area
White River i;ater Lmprevement District for water service when they
get water cut there. He agreed to a proposed road leading to the
property North and East. Other points mentioned were: (1) Ingress
and egress into the property is only 20 fte as this is all that can
• be obtained at thi time. (2) Internal streets show_ are 50 ft. in
M,1; Subdivision Regulations specify 60 ft.;. Major Street Pian
specifies 50 ft. (3) Col. Denton does not desire to _ave the streets.
(4) Lots will have to have individual septic tanks. A discussion
followed concerning what control the City has over paving of streets
outside the City. Larry Wood felt it could be required. Al Denaubauer
felt the City could only request it. lis. :Mood suggested a written
agreement with the developer before the plat would be released.
The next matter considered was a proposed Flat to dedicate easements
inside Villa Kobile Ecme Park and also to dedicate street ROS! for VILLA MOBILE I OeE
Villa Boulevard. Mr. Liebererz explained the street has 50 ft. RO:; PARK - Plat to
and was built to City street specifications. The bad intersection dedicate easement
where it enters College Avenue was discussed. 2:r. Purdy* felt there
was only an assumption that Mr. Murphy would cooperate on extending
the street. "r Clinton said the Commission has some leverage, as
the expansion of bar. ;,_'urphy's mobile home park has not been approved.
The acceptance of the street :-could necessitate that the City waive
the setback requirements for mobile homes along this street, as set-
backs are greater along dedicated streets than they are along private
drives. It was suggested that this waiver be worded to apply only
so long as the property remained a mobile home park.
The next matter considered was a sketch for a proposed subdivision
outside the City of Fayetteville and within the Plan_ iz•4 Area for
the City of Fayetteville located hest of State Fiigh•ay 112 (Part of
NEy, SE -,i-„ Sec. 29, T -17-V, R-30-14) submitted by Gene Garrett.

Mr. Garrett was present. harold Lieberonz reviewed the Plat
Review Committee meeting. i'1. Garrett said he did not Alar to
pave the streets. He said he had talked to the property owners
to the South andlest about his plans. Larr,; Wood recctrmmended the
State Health Department approve percolation tests for each and
every lot and submit a letter of approval. This was discussed.
The Commission returned to action on the iters discussed previously.
Herbert Hatfield requested permission to comment on the proposed
rezoning for the property around the Library. i'.r. Clinton informed
him the public hearing was closed and no further information could
be accepted. He did acknowledge the letter submitted by Mr. Hatfield
earlier and mailed to each Commission member.
Dr. Walter Brown moved the proposal to rezone from R-2, Ledium Density
Residential District, to R -O, Residential Office District, property FLA4.7IN'G

Dr. :7alter Brown said he is opposed to an increase in C-2 and
moved to deny the Planning Cor=issionls proposal to rezone from R-1,
Low Density Residential District, and R -O, Residential Office District,
to C-2, Thoroughfare Cor.Wercial District, all that property not ;forth of Sycamore
currently zoned C-2, Thoroughfare Cerenercial District, which is West of Green Acre
located North of Sycamore Street and on the West side of Green
Acres Road through and including 1845 Green Acres Road. Al Donaubauer
seconded. The motion was approved unanimously and the petition was
denied.
Dr. Walter Brown moved the Planning Commission proposal to rezone
from C-2, Thoroughfare Commercial District, to R -O, Residential
Office District, property located on the 01'est side of Green Acres
Road, from Poplar Street on the ,forth, South through 1915 Green
Acres Road. Al Dcnaubauer seconded. It was approved unanimously.
Dr. ?:alter Bron moved to amend the rezoning petition of Dr. J. B. DR, J. B. HAYS
Hays to rezone from R-1 to R-3 and to approve the rezoning from R=1 North Greee
to R-2 property on the East side of North Gregg Avenue between
Miller and Ash Street. Byron Boyd seconded. It was approved unanimously.
Dr. Walter Brown moved to approve the rezoning petition of Robert T. ROBERT T. STOUT
Stout to rezone from A-1 to C-2 property located on the East side Hifhr 71 INJorth
of Highway 71 North and on both sides of Shepherd Lane. Helen
Edmiston seconded. It was approved unanimously.

WHEREAS, pursuant to the provisions of the Code of Ordinances of the
City of Fayetteville, Arkansas, the City Planning Commission held public hearings
on the following rezoning petitions, Tuesday, September 7, 1971, fifteen (15)
days after a sign was erected upon each tract of property and after a notice
was published in the Northwest Arkansas Times, a newspaper of general circulation;
and
WHEREAS, after the hearing the Planning Commission voted to make
recommendations to the Board of Directors on the following rezoning petitions.
