I* Members Present: Roy Clinton, Albert 'Witte, L. M. McGoodwin, Byron Boyd, Ernest Jacks, Helen Edmiston, Members Absent: Al Donaubauer, Dr. James Mashburn, Dr. 'Walter Brown. Others Present: Gene Thrasher, Ervan'limberly, Larry Wood, lesley Hot;te, Harold Lieberenz, ?arion Orton, Jerry Fan Hoose, dells Bone, James Dickscn, Attorney, Paul hattke, Mrs. Donald McGinnis, Chairman Roy Clinton called the meeting to order. He departed from the order of the published Agenda. The first matter considered was a proposed Leverette Carden mobil Home LE"THETTE Park located :forth of Poplar Street and Nest of Chestnut Avenue submitted CAR::,; h:OBIL by Gene Thrasher. ?`r. Thrasher was present to answer questions. _rnest H011. PARK Jacks gave a report from the Subdivision Committee which recommended Poplar & that specifications for water, sewer, and drainage will have to be designed. Chestnut After discussion, Ernest Jacks moved that the Commission approve the plan as drawn with the prevision that details for utilities systems be worked cut with the City Engineer. Helen Edmiston seconded. It was approved unanimously. The next matter before the Commission was a public hearing cn the proposal to amend the zoning ordinance to include "home furniture HOME store" in C-1, Neighborhood Commercial Districts. A memo from Larry CC=1 Wood was read urging the Commission to consider certain implications in the proposal. Roy Clinton supported the proposed amendment or, the basis that home furnishings is a low traffic contributor. Ernest Jacks said the points expressed by Mr. ?Wood were well taken; however, C-2, C-1, and 0-3 zoning splits some fine hairs and the proposed use is an unoffensive one. Marion Crton pointed out that many furniture stores have outside displays. Both Mr. Licberenz and Er. Jacks said the present ordinance regulates this. Mr. Lieberenz's office has been working to get the pre-existing ones to comply. The public hearing was closed. FURNITURE IN I The next matter considered was the proposed Preliminary Subdivision Plat of Johnson Road Addition located East of Johnson Road and North of JOHNSON ROAD ADD. Highway 71 By -Pass. Jerry Iran Hoose, Engirner, and 'Wells Bone with Preliminary Plat Kelley Prcthers were present. Mr. Liebererz introduced the plat for discussion. *r. Wer.00d::i.n asked if it is necessary for the water lines to the fire hydrants to be 8 -inch lines with high pressz=e water service. He asked that the Rating and Inspection Bureau be questioned on this. Paul ?attke said they do not say they must be 8 -inch, bot they do say that they will assess penalty points is they are less tan 8 -inch. In 10 10 8-19-71 =2 - the past they have never gilen the City any credits for high pressure lines, Mr. Lieberenz pointed out that the lots around the cul-de-sacs have less than 70 ft. frontage. He suggested the Commission could waiver this. Jerry `:'an .loose said Page 92 of the Zoning Ordinance had a definition of lot width n:iich would handle this problem so long as the width at the building line is 70 ft., which he said it is. Mr. Lieberenz agreed to study this later. Ernest Jacks moved to approve the Preliminary Plat of Johnson Road Addition with the provision that the questions that have come up be resolved. Helen Edmiston seconded. It was approved unanimously. The next matter before the Commission was a discussion with representatives of Humble Oil Company relative to a proposed service station on the Barnes property at the Southeast corner of the intersection of HUMBLE OIL COcPANY Highway 62 Jest and Highway 71 By -Pass, James Dickson, Attorney, Highway 62 West and Ervan Wimberly with McClelland Engineers were present. Nr. Dickson summed up Humble Oil's position by saying they wanted to construct a' service station on the property without dedicating and improving the required service road along the By -Pass. Harold Lieberenz cited the three requirements which must be satisfied: (1) Subdivision of the property in order to transfer ownership of a portion; (2) 50 ft, service road; (3) Large scale development plan. Mr. W irrberly and Dr. Dickson stated Highway 62 has a median island which extends to the East across the front of the proposed service station and across the front of the existing Gulf service station. An access road coming in. along the By - Pass could feed traffic only to the East. tr. Wimberly said if the service road were to be brought in farther East such as on Hollywood the traffic could then go East, or West, or get back on the By -Pass to go North. He said Baldwin Piano and Mr. Adams were the only other two property owners between P,ighway 62 and 18th Street. Mr. Dickson. said the Gulf deed was not recorded until April, 1970, and they were not faced with these problems; therefore, he did not feel Humble Oil should be either. There was a discussion concerning the problems of traffic traveling North to get to the Gulf station and traffic stopping at the proposed Humble station going North on the By -Pass without first traveling East, turning around, and coming back on the North side of the median. Mr. Howe suggested the service road might be brought to the South and East of the Humble station to avoid the nobler„ of the median and to also satisfy the access road requirement. Nr. Dickson said he represented only Humble Oil; he could not speak for the Barnes' regarding their opinions on subdivision and the service road. Nothing was resolved. The next matter considered by the Commission was a discussion on two factors of the zoning ordinance: (a) Use Unit 8, the only unit listing single family dwellings, is not currently permitted in R -O. Roy Clinton said he felt this was an oversight. MY. Jacks did not feel this was an oversight, but acknowledged the hardship imposed on a large number of USE UNIT 8 in single family dwellings in the R-0 Districts. For this reason he was R-0 DISTRICTS also in favor of amending the ordinance on this. (b) Uinrehouses not currently permitted in C-2. MTr. Lieberenz said this could be handled WAREHOUSES IN by one of two ways: either (1) add warehouses to a use,unit already C-2 DISTRICTS permitted in C-2, or (2) add warehouses on review and a-&Froval of Planning Commission only. Larry Wood said he had mixed emotions, could work or it could be a hazard. Some warehouses are quiet, some are not. L. M. McGoodwin moved that the Planning Commission hold a public hearing on (a) permitting Use Unit 8 in R -C Districts, and (b) permitting 1• ie I0 8-19-71 -3- warehouses in C-2 Districts. Ernest Jacks seconded. The motion_ was approved unanimously. RESCLUTION PC 39-71 Next the Commission held a discussion with Paul Mattke, City Engineer. Pr, icGoodwin said that when the recent Red Arrow rezoning request was before the Board of Directors someone had asked about the se.gr r ?acilities. He then began to wonder about any policies the City might have regarding subdivision of lard where sewer service is not available. Mr. Mattke DISCUSSION WITH said that in a very few years he will have to require no more septic PAUL `•ATTKE, C.E. tanks in the City. F?e does not ncir have established areas for this. He is trying to approach this on new subdivisions, by eliminating any new subdivisions on septic systems. High density- developments have to have sewer service. In the case of Red Arrow, a written agreement had been worked out for the developer to bear the cost of constructing the sewer, Mr. Mattke recommended that if a subdivision cannot be corrected to a public sewer, the time frame of it be reconsidered. Larry Wood recommended the City Planning Commission and the Board of Directors work together to establish a utility extension policy, The next matter discussed was the proposed Preliminary Plat of Brookside East Subdivision submitted by Kelley Brothers, Jerry Van Hoose and Wells Bone were present. There was considerable discussion. Comments were: when the developer bought this land, they acquired the right-of-way to Highway 265 which is shm m to protect their property. An outlet to the North is needed; ?-"s. hlcGoodwin thought the alignment of the Azalea street would be the best route. He stated if the right-of-way for BKOKZIDE EAST Township to the East could be obtained, he felt he could assist the Preliminary P1 City in obtaining the right-cf-way to the blest for Township. The desirability of making Azalea a 60 ft. street was discussed, but it was felt the terrain and lay out required it to remain a residential street. Ernest Jacks suggested the cul-de-sacs be pulled back so they would intersect with Township only on the rdest and East of the subdivision. L. M. McGcodwin moved the preliminary plat of Brookside East Subdivision be approved subject to the cul-de-sacs being pulled back as suggested, and that right-of-way to the North across the developers property from Azalea be guaranteed. Byron Boyd seconded. It was approved unanimously. The Commission unanimously voted to schedule the September 7, 1971, meeting for 3:00 P.M. so that the Commission could be through with its business TI? FOR SEPT. and clear the room for the Board of Directors to meet at 7:30 P.M. MEETING RESET Mrs. Donald McGinnis said she lives in the area recommended to the Board of Directors to be rezoned from C-3, Central Commercial, to R-0, Residential - Office District, and that they have a petition signed by 100% of the R-0 DISTRICT owners in the area against the rezoning. L. 2•:. McGoodwin coved to approve the proposed ordinance to amend the zoning ordinance to add "home furniture store" in C-1, Neighborhood Commercial District as written. Byron Boyd seconded.
