Room, City Administration
Building,
Fayetteville, Arkansas.
Members Present: Al Donaubauer, Helen Edmiston, L. M. McGoodwin,
Dr. James Mashburn, Dr. Walter Brown.
Members Absent: Roy Clinton, Albert Witte, Byron Boyd, Ernest Jacks.
Others Present: Walter Niblock, Hugh Kincaid, Jr., David Faught,
Larry Wood, Russell Purdy, Dr. David Harner, Elvis
Heiney, Don Ward, Lester Atkison, Marion Orton, Peg
Anderson, Dale and Lois Slaughter, Bill Brown, Mrs. Imhoff,
C. T. Pearson, Jr., Harold Lieberenz, Mr. Kelly,
Marshall Carlisle, David Stevens, Ken Garton, Roger
Curtis, Mr. Hatfield.
Vice -Chairman Al Donaubauer called the meeting to order.
The first item of business was the rezoning petition of Dr. David Harner
to rezone from R-0, Residential Office District, to C-2, Thoroughfare
Commercial District, property on the west side of College Avenue and
north of Trenton Street. Dr. Harner was present to represent the
petition which had been tabled May 4, 1971. There was no opposition
present.
Dr. Walter Brown arrived at 4:25 P.M.
Larry Wood was asked to present the Staff Report. Mr. Wood felt the
petitions of Dr. Harner, James Holder and Tract No. 1 of the rezonings
initiated by the Planning Commission were so related they should be
covered together. He asked to defer the Staff Report on Dr. Harner's
petition until later.
Mr. Wood stated there were a number of persons present interested in

Tract 5 of the Planning Commission rezonings and asked that this be
considered next. The property on the South side of Meadow Street
between Locust Avenue and Church Avenue is proposed to be rezoned PLANNING COMMISSION
from R-0, Residential Office District, to C-3, Central Commercial Tract No. 5
District. Mr. Wood explained the property is now properly zoned. Meadow Street
The error to change zoning was made because of an error in a map.
He recommended the matter be struck from the agenda.. Helen Edmiston
moved to drop Tract 5 from the agenda and leave this property zoned
R -C, Residential Office, Dr. Mashburn seconded. The motion was
approved unanimously.
The next item of business was the rezoning petition of Red Arrow
Land Ccmpany, Inc, to rezone from R-1, Low Density Residential District,
to R-2, Medium Density Residential District, property west of Higharay RED
265, and tabled August 4, 1970. Walter Niblock, Attorney, represented Hi
the petition and stated they requested R-2, to get smaller lots. Helen
Edmiston moved the petition be reopened for discussion and hearing.
Dr. Mashburn seconded the motion, and the petition was reopened by
unanimous vote. Russell Purdy asked about sewer service.

Larry Wood presented a verbal Staff Report. He stated there should be
is some basis for changing from R-1 to R-2. The change would triple the
density level. There is no substantiating evidence for the change.
Al Donaubauer reviewed the minutes of the August 4, 1970, Planning
Commission meeting. L. M. McGoodwin moved to approve the rezoning
request. Helen Edmiston seconded. The motion was approved unanimously.
The next item of business was the rezoning petition of James F. &
Billye A. Fletcher to rezone from C-1, Neighborhood Commercial, to
C-2, Thoroughfare Commercial District, property located east of Stone
Bridge Road and on the south side of Highway 16 East, referred back
to the Planning Commission from the Board of Directors June 21, 1971.
The Commission unanimously agreed to hear from other interested
parties who had missed the earlier Planning Commission meeting.
Mr. Donaubauer noted that all mandantory notices of public hearing
had been met and that it is only a courtesy to adjacent property owners
that they are notified by mail. One adjoining property owner had not
received any notification by mail.

Highway 16 East
Elvie Heiney represented the Fletcher's. He stated an offer has been
made to purchase the property for a retail furniture store if the property
can be zoned for a furniture store. Larry Wood reviewed the Staff Report.
Don Ward and Lester Atkison objected to the change in zoning. Marion
Orton remarked this is a very pretty knoll, not too close to the Animal
Hospital and would be a pretty residential spot.
Dr. Brown moved the petition be denied. The motion died for lack of
a second. Dr. Mashburn moved the petition be approved; L. M. McGoodwin
seconded. The vote was taken; Mashburn, Edmiston, McGoodwin voted "Aye's
to approve the petition; Brown voted "Nay". The petition was approved.
The next item of business was the rezoning petition of James W. Holder
to rezone from R-0, Residential Office District, to C-2, Thoroughfare
Commercial District, property on the south side of Prospect Street
and on the west side of College Avenue. Mr. Holder was not present.
Dr: Harner spoke in his behalf. Dale Slaughter, who owns the property
south of Dr. Harner's, stated he would like to see his as well as theirs
zoned C-2.
Larry Wood presented the Staff Report for Dr. Harner's petition,
James Holder's petition, and Tract No. 1 of the Planning Commission's
petition. He favored leaving all the properties R-0 except the area
covered in Tract No. 1, which he recommended be zoned R-2, rather than
R-1, as advertised. He gave as reasons, traffic on Highway 71 increased
from approximately 16,000 vehicles daily in 1964 to approximately 28,000
vehicles daily at Dickson Street presently; there is an incline problem;
a blind curve; and the only access to the Holder property is off Prospect
Street, a residential street. Bill Brom asked what was recommended
for College and Dickson. It is recormended for C-2. Mrs. Imhoff, a
resident of the area expressed agreement with the report.

Dr. Brown moved to accept the Staff Report as stated covering the
iri petitions of Dr. David Harner, James Holder, and Tract No. 1 of the
4/ Planning Commission; i.e, to deny the petition of Dr. David Harner,
to deny the petition of James Holder, and to amend the petition of
the Planning Commission, Tract No. 1 to zone to R-2, Medium Density
Residential District. Helen Edmiston seconded, Edmiston, Brown,
and Donaubauer voted "Aye." Mashburn and McGoodwin voted "Nay."
The next item of business was the rezoning petition of Frank &
Maudie Kelly and Leonard & Frances Kelly to rezone from R-2,
Medium Density Residential District, to C-2, Thoroughfare Commercial
District, property on the northwest corner of Morningside Drive
and Highway 16 By -Pass. C. T. Pearson, Jr., Attorney, represented
the petition. Larry Wood presented the Staff Report. 1;r. Kelly
said they have not requested the rezoning on the south side of the
By -Pass because there is a dwelling there. Peg Anderson asked why
they had requested C-2 instead of C-1. Mr. Pearson said any zoning
which would permit a service station would be acceptable.
Dr. Brown moved the petition be denied. L. M. McGoodwin seconded
the motion. The vote was Brown, McGoodwin, Edmiston, Donaubauer
"Aye;" Mashburn, "Nay.',
The next item of business was the rezoning petition of Darrell
Stanberry to rezone from C-1, Neighborhood Commercial District,
and R-1, Low Density Residential District, to C-2, Thoroughfare
Commercial District, property on the south side of Highway 16
East, on the east side of Highway 16 By-pass, and on the west
side of Ray Avenue. Marshall Carlisle represented the owners
of East Gate Shopping Center and Darrell Stanberry and requested
the zoning change because there are some limitations in C-1 not
in C-2. Larry Wood presented the Staff Report. He recommended
the property owner provide curbs and specific access and egress
points onto Ray Avenue and screen along the East property line.
L._M. McGoodwin moved the petition be approved. Dr. Brown seconded.

David Stevens, Pastor of the Ridgeview Baptist Church, presented a
petition by the members of the Church asking that the rezoning be
denied and also a petition by area residents asking that the rezoning
be denied. He said a ligour store had been proposed and they oppose
this. Marshall Carlisle said there are no buildings existing on the
property which could have a liqour store under the ABC regulations,
Ken Garton and Roger Curtis opposed the rezoning,
The vote was taken and the Commission voted unanimously to approve
the petition to rezone.
Hearings on Tracts No. 2, 3, 4, and 6 initiated by the Planning Commission
were postponed until the next meeting, as Dr. Mashburn had to leave and
there was no longer a quorum present. Fr. Hatfield requested that not
only Tract No. 3 be rezoned, but that all the property he owns adjacent
to this tract.

The minutes of June 1, June 8, and June 15, 1971 Planning Commission
meetings were approved as mailed.
The meeting was adjourned at 6:00 P.M.
